Met de uitspraak van de EK over de #noodwet is in zekere zin sprake van toetsing vooraf. NSC en @PieterOmtzigt pleiten voor dergelijke 'ex ante'-toetsing van wetgeving en zullen nu dus heel blij zijn dat bij voorbaat is vastgesteld dat de weg van het noodrecht onbegaanbaar is.

Hoe dan ook, de uitspraak van de Eerste Kamer is een enorme opsteker voor de ministerraad. Die kan voorstellen voor een noodprocedure toch al niet accepteren als ze niet deugdelijk onderbouwd zijn. En nu weet hij ook dat ze verder kansloos zijn.
