NEW YORK — Game 2 of the ALDS matchup between the New York Yankees and Cleveland Guardians has been postponed due to rain and moved to Friday, MLB announced. First pitch was originally scheduled for 7:37 p.m. ET Thursday night, though the forecast calls for rain most of the day Thursday and continuing into the early morning hours Friday. Instead, Game 2 will now be played Friday at 1:07 p.m. ET (still airing on TBS).
Here is Thursday’s weather forecast around Game 2’s original scheduled start time (via CBS News New York). The heaviest rain is expected to hit New York right around what would’ve been first pitch.

The Atlanta Braves and Philadelphia Phillies waited out a three-hour rain delay prior to playing Game 2 on Wednesday, though the Yankees and Guardians do not have a similar playable window coming their way Thursday, so the game was postponed.
Friday was originally an ALDS off-day, so rescheduling Game 2 was a piece of cake. However, the postponement does force the two teams to play Games 2-5 on four consecutive days (if Games 4 and 5 are necessary). Friday was the final scheduled off-day in the series. Here’s how the Game 2 postponement impact each team’s pitching plans.
The Yankees won Game 1 behind Gerrit Cole and Anthony Rizzo. They lead the best-of-five series 1-0. Game 2’s scheduled starters are All-Star lefty Nestor Cortes (12-4, 2.44 ERA) and 2020 AL Cy Young winner Shane Bieber (13-8, 2.88 ERA).

The other shoe has finally dropped in the mystery of just what the hell the UFC was thinking when they closed the doors of their Apex facility to media and the public for UFC Fight Night: Dern vs. Yan earlier this October.
The basic motivations behind the decision became clear on the night of the event itself, when—despite heavy denials in the days prior—Facebook CEO Mark Zuckerberg was spotted sitting cageside as one of a very select few people in attendance. Whether one of the world’s richest men had, in fact, rented out the whole event like a it was a laser-tag birthday party or the UFC had simply decided to gift him with sole occupancy was purely pedantic. Whatever the case, the Endeavor-owned fight promotion had given itself over to one high profile guest.
Now we know why.
The UFC announced on Thursday, October 13th, that they have officially partnered with Zuckerberg’s Meta company to deliver on-demand VR MMA events. In the near future fans will be able to access VR feeds of MMA cards on the Fight Pass platform (h/t MMA Fighting).
“We are excited to offer an unprecedented level of engagement for Fight Pass subscribers and MMA fans around the world by producing a live MMA event in virtual reality,” Crowley Sullivan, Fight Pass vice president and general manager is quoted as saying. “With Meta providing the VR platform and YBVR lending their production expertise, we’re confident this will be a great experience for fight fans.”
The first event to be hosted via this new platform will be LFA 144: Gafurov vs. Silva. Which can be accessed through the Meta Horizon Worlds app. That card takes place this Friday, October 14th, in Sioux Falls, SD. Fans who sign up for the virtual reality feed will apparently get access to a 180 degree panorama view of the fight fight card, and the ability to see and chat with other VR fans live. No word yet on what pricing will look like for future VR events.
The move has apparently been a long-term goal of Dana White’s. As far back as February, the UFC President was teasing his hopes for bringing the UFC to virtual reality sometime in the near future.
“We’re looking to do a fight in the Metaverse,” White enthused. “We’ve been working on it for a while. It’ll be a live fight, an actual fight that takes place inside the metaverse.”
“It’d be kids at home, you put on your (goggles) and you can (get) up and go walk around. We’re still working it out, but yeah, it’ll be soon. We’ll be doing a fight in the metaverse. It’ll be a real fight.”

Batman’s high-tech mirror demonstrates the show’s angle on the old “prep time” argument. The idea that Batman could defeat anyone with enough prep time remains true here, but instead of a cool, action-packed portrayal, it’s portrayed as silly, even somewhat slapdash, to get laughs.
8/10 Batman Carries A Key To Wayne Manor (Just In Case)
Once again, Batman‘s take on the idea of the always-prepared Batman is played for laughs, rather than showing a dangerous and shadowy vigilante. In the classic episode “Joker’s Provokers,” Joker ties Batman to a giant key duplicator, intending to kill him by running him through the machine.
However, Joker is foiled when Batman throws his spare key into the machine, buying him time to escape. Adam West’s Batman truly is prepared for everything, just like the comics’ Batman, but his preparations also include simply carrying a spare key in case he gets locked out of his mansion. In a series where the absurd is often presented as mundane, the mundane becomes absurd and increases the hilarity.
7/10 The Bat-Turn Lever Made For One Of The Shows Most Iconic Shots
What with Batman and Robin using an atomic-powered car with a rocket engine, a simple emergency break wouldn’t be enough to pull off high-speed turns. That’s where the Emergency-Bat-Turn-Lever comes into play. First, it releases parachutes to help slow the car before braking and allowing for a full 180-degree turn.
While it does, in a way, make sense that West’s sleek and powerful Batmobile would need a special way to turn, Batman ’66 gave it its own unique flavor. The over-the-top execution makes for a combination of a great action scene, and laugh-out-loud ridiculousness.
6/10 Batman Used Bat-Acillin For Headaches And Bullet Wounds
The modern Batman typically fixes his injuries on the fly with futuristic first-aid equipment or endures long enough to make it back to the Batcave, where Alfred can stitch him up. Adam West’s Batman, however, had a much better way to handle any combat injuries: Bat-Acillin
Bat-Acillin makes video game health packs blush, a simple lozenge that allows whoever takes it to instantly recover from any sickness or wound. In the Western-inspired episode “It’s How You Play The Game,” Robin is shot in the heel, and Batman gives him some Bat-Acillin. In the very next scene, Robin is up and about, jumping and clicking his heels as if it never happened. It’s absolutely ludicrous, but 100% fits in Batman‘s world.
5/10 The Bat-Ray Brought Any High-Speed Chase To A Close
Batman ’66 sure did love its car chases, and the Bat-Ray was Batman’s one-stop shop for ending them. Since Batman is strictly a non-lethal hero, he didn’t deploy any Mad Max or Fast and Furious tricks to get the upper hand. Batman used his Bat-Ray, a sort of ion/emp laser beam that disabled the villain’s vehicle.
How does this work without disabling the Batmobile, and why does it shoot out of the headlights of all things? In perfect Batman ’66 fashion, the series never bothers to explain how it works; it just shows off its flashy toy. The fact that its very first use results in an explosive crash really demonstrates the mix of silliness and awesome action that the series is famous for.
4/10 The Batmobile’s Anti-Theft Activator Is Goofy In All The Right Ways
Today, Batman uses everything from biometric scanners to an electric field to protect the Batmobile from theft, but that wasn’t so easy with an open-top Batmobile back in 1966. Instead, in the very first episode, when the Riddler tries to steal the Batmobile, Batman’s theft prevention methods are put on full display.
Robin disguises the anti-theft activator as the ignition, so when Riddler attempts to drive away with his prize, he instead sets off fireworks. Batman’s ingenious theft protection is to set off fireworks to allow anyone to track a stolen Batmobile. It’s ridiculous, but it’s funny in just the right way, and while it may be silly, it was effective, forcing Riddler to abandon his attempts.
3/10 Batman And Robin’s Bat-Shields Defy All Logic
Since Batman doesn’t use guns, he has to take steps to nullify the advantages guns give his opponents. Sometimes, he uses his Batarangs to knock them away, smoke bombs to block enemies’ sights, or (in the Arkham series) he disables them with advanced tech, but in Batman ’66, it got pretty silly, even by the silly standards of the show.
Batman and Robin used portable shields made of bulletproof glass that Batman kept in his utility belt. How, exactly, did Batman break the laws of physics, and not the glass, to store a collapsible shield in his belt? No idea, but watching it makes for a great comedic moment.
2/10 Batman And Robin’s Bat-Poles Were The First Sign Of The Silliness
In the pilot episode, before Batman and Robin even appeared in their costumes, one of the very first signs of the behavior of the Dynamic Duo was the Bat-Poles, and they made it crystal clear just how campy of a show the audience was in for.
The Bat-Poles are, inexplicably and hilariously, clearly labeled as the “Bat-Poles” that lead into the Batcave, and are also marked specifically for Bruce Wayne and Dick Grayson. So, if anyone (such as Aunt Harriet) happened to somehow accidentally open the secret entrance, there would be no possible deniability of its purpose, and that just makes it funnier. Batman and Robin always leave the poles already changed into their costumes, however that works.
1/10 Batman: The Movie’s Bat-Shark-Repellent Is Iconic
Batman: The Movie is nonsensical even by the standards of the show. But it is admirable that it manages to distill every aspect of the show into a film, utilizing famous villains from the original series like Joker, Penguin, Riddler, and Catwoman, and famously contains some memorable moments.
Really, what would any discussion of Adam West’s Batman be without Bat-Shark-Repellent? The gadget is the epitome of the show’s hilarious take on the over-prepared Batman, and the fact that the shark then falls back into the ocean and explodes is the perfect encapsulation of the series’ over-the-top comedy.

The years-anticipated Ethereum merge from proof of work to proof of stake finally happened on September 15, and it went off without a hitch. The Ethereum network now uses 99% less energy.
The merge went “what seems to be flawlessly,” Joe Lubin, CEO of crypto software giant ConsenSys and a co-founder of Ethereum, told Decrypt in an exclusive video interview last week. “I’ve asked around in a bunch of different contexts for any awareness of anything that broke, and I haven’t heard one thing.”
So, why is ETH down a brutal 22% in the month since the merge?
Lubin’s answer is that the price action immediately after the merge was a “possibly inevitable ‘sell the news’ kind of activity,” along with some Ethereum miners “unloading their ether inventory as they shut down their rigs.” As for why ETH has continued to drop since then, along with Bitcoin and the rest of the crypto market?
It’s the macroeconomy, stupid.
“The economy is broken, and it’s likely to remain broken for a while,” Lubin said. “So we remain the tail that is being wagged by a very sick dog: the global macro situation. But our ecosystem and our company are doing quite well, even with with reduced volumes, reduced intensity. I think we’re all enjoying just building.”
It’s the favored explanation from almost every founder in the crypto ecosystem right now, as crypto markets remain battered by the same economic headwinds in the U.S. (inflation, Fed interest rates) and globally (war in Ukraine, the hangover of COVID-19) that are weighing on stocks, bonds, and other more established investment vehicles.
Solana founder Anatoly Yakovenko points to the same factors—and sees at least another year of the bear market.
“Looking at macro stuff, my guess is there’s probably 12 to 18 months more of this brutal, Fed rates going up,” Yakovenko said on the latest episode of Decrypt‘s gm podcast. “But there is an end to it. And just like the last bear market, a lot of teams that built and focused on product-market fit, and really tried to build amazing products—a lot of those succeeded, I think, in a very dramatic way.”
FTX CEO Sam Bankman-Fried put it in similar terms, and maybe the most bluntly, speaking at Anthony Scaramucci’s SALT conference in New York last month: “Everything’s down this year, because dollars are up this year.”
Until money gets less expensive, crypto markets are expected to remain in the doldrums. But Lubin and other builders remain as optimistic as ever on the key parts of the crypto industry.
“I think NFTs still have a ton of legs, NFTs are going to undergo so much innovation,” he told Decrypt. “I imagine we’re post our irrational exuberance moments with respect to DeFi. I think it’ll continue to innovate and mature quite significantly, but I think the real building will be in the development of the Web3 economy.”

WASHINGTON, Oct 13 (Reuters) – The U.S. Justice Department on Thursday released a scathing new report that found that prosecutors and sheriffs in Orange County, California, had improperly used a jailhouse informant program in ways that routinely violated the constitutional rights of criminal defendants.
The 63-page report caps a nearly six-year civil rights investigation, known as a “pattern or practice” probe, by the Civil Rights Division into the Orange County District Attorney’s Office and the Orange County Sheriff’s Department.
The probe, which was started in December 2016, focused on local law enforcement’s use of a jailhouse informant program and whether those informants were used improperly to elicit incriminating statements from other criminal defendants.

The Justice Department’s report concludes that from 2007 through 2016, Orange County violated criminal defendants’ constitutional rights to be represented by counsel, as well as their 14th Amendment due process rights in which prosecutors are required to disclose to them any evidence that is exculpatory and could assist with their defense.
Although the investigation focused on prior misconduct, the report said that Orange County has yet to correct all of the problems.
“Restoring trust in Orange County law enforcement will require recognition and remediation of the harms caused by the law enforcement practices described in this report,” the report says.
It adds that although Orange County has taken some steps to better handle its informant program and provide better disclosures to defendants, “more work remains to be done.”
“It has been eight years since much of the misconduct came to light,” the department added, saying that the district attorney’s office “has still not taken adequate steps to ensure that prosecutors understand and carry out their constitutional disclosure obligations.”
Orange County Sheriff Don Barnes said he looked forward to the Department Of Justice reviewing his department’s current procedures.
“I am confident they will find our current practices have addressed many of their recommendations, and anticipate a prompt and complete resolution to this matter,” he said.
In a statement, Orange County District Attorney Todd Spitzer said his office has been willingly cooperating with the investigation, and he noted the county stopped using the jailhouse informant program in 2016.
“Throughout this multi-year investigation, I repeatedly asked the DOJ for input on the numerous reforms I have implemented, including the prohibition of utilizing a jail house informant without the express consent of the elected district attorney,” he said.
He added that he also conducted his own outside investigation, and fired a senior prosecutor for failing to disclose information to a defense attorney.
Pattern or practice civil rights probes typically take several years to complete.
While sometimes adverse findings in pattern or practice investigations can lead to litigation, the parties usually try to resolve the concerns first. A department spokesperson said the department is negotiating with Orange County to implement reforms.

He struck earlier this time, but Astros slugger Yordan Alvarez struck again. His two-run homer in the sixth inning squeaked out just enough to beat an excellent outing from Mariners starter Luis Castillo. The Astros now have a commanding 2-0 series lead as the series heads to Seattle.
The hero of Game 1, Alvarez came to the plate in the sixth with Houston trailing, 2-1, and rookie shortstop Jeremy Peña standing on first base. Castillo, working to win another key game for his new team after coming over at the trade deadline, pitched Alvarez carefully. It didn’t matter. His second 98 mph sinker off the plate left the park, as Alvarez flicked it into the Crawford Boxes in left field. SAN ANTONIO — From the start, Tuesday’s discussion the Classical Music Institute ’s request for $300,000 in funding from Bexar County Commissioners Court was ugly and divisive.
Critics of the proposal characterized CMI as something it isn’t and resorted to name-calling.

County Judge Nelson Wolff, Precinct 1 Commissioner Rebeca Clay-Flores, Precinct 2 Commissioner Justin Rodriguez and Precinct 3 Commissioner Marialyn Barnard saw through the malice and approved the funding.
It will allow CMI to serve as the orchestra for Ballet San Antonio and Opera San Antonio for the 2022-23 season. All three are resident companies at the Tobin Center for the Performing Arts.
In the public comment portion of the meeting, those who opposed the funding said it should go instead to the San Antonio Philharmonic, made up of musicians from the now-defunct San Antonio Symphony, which ceased operations in June after 83 years.

It received no funding request from the Philharmonic.
‘Us-vs.-Them’
The pain and anger felt by the former Symphony players and their supporters came through loud and clear.

That they are hurting, however, doesn’t give the Philharmonic the right to attempt to hurt another organization, especially one whose goals are to reach and teach low-income students and increase diversity among classical music performers and educators, as well as staff, audiences and donors.
Some of the critics came off as mean-spirited and elitist, saying CMI could never become “world-class,” a judgment that sells short the organization’s roster of talented performing artists and administrators.
Funding one arts organization doesn’t mean the county won’t fund another.
Several commissioners including Rodriguez lamented the “us-vs.-them” vitriol and the false choice opponents presented.
CMI isn’t out to hurt another arts organization. especially the Philharmonic. I’ve been writing about CMI for several years, and that’s not in its DNA.
CMI’s mission is different than that of the Symphony and the Philharmonic. CMI has always been smaller, younger and committed to cultivating new listeners and donors who’ve never given to arts organizations before.
There’s no need for competition between CMI and the Philharmonic, nor is CMI out to “bust” a union, as several speakers contended Tuesday.
‘Weekend warriors’
Most of the city’s arts organizations and institutions aren’t unionized, although the Symphony musicians were. Most workers in this city aren’t unionized. That doesn’t mean they’re anti-union. That doesn’t mean they’re not supportive of unions.
CMI isn’t a union house but it pays above union scale, its leaders said.
Its members aren’t “scabs,” either. CMI’s leaders and performers haven’t crossed a picket line in defiance of a labor strike.
In addition to performing with the opera and ballet companies, the county’s grant will help CMI make progress toward its goal of providing year-round music education in high-poverty schools, especially the Edgewood Independent School District on the city’s West Side, where the institute holds its summer camp.
As far as I heard during Tuesday’s meeting, no one from CMI attacked the Philharmonic.
CMI’s co-founder and artistic director, Paul Montalvo, listed CMI’s guiding principles — “music education, excellence in performance, innovation, collaboration, fiscal responsibility, sustainability, donor stewardship, diversity, education and performance as a service to our community.”
Montalvo, a retired San Antonio firefighter who studied composition at the University of Texas at San Antonio, said CMI has used the county’s proposed funding to leverage an additional $500,000 in private donations.
In contrast, Richard Oppenheim was cutting in his remarks about CMI. Oppenheim is president of Local 23 of the American Federation of Musicians, which represented the Symphony’s players.
He characterized the county’s grant to CMI as “chump change to a collection of weekend warriors.” He said CMI’s “imported mercenaries” won’t produce “a quality product” and will embarrass San Antonio.
“Don’t lavish Tiffany prices on QVC costume jewelry,” Oppenheim said to sustained applause.
That was the real embarrassment.

“I’m so sorry it’s come down to this,” Wolff said, reminding residents that the county gave millions to the symphony over the years.
Wolff said he’s excited the Philharmonic is “moving forward,” but added the county hasn’t received a funding request from the organization.
“I would hope the Philharmonic would ask us for financial help,” he said.
Clay-Flores, a classical music fan, said she reached out to the Philharmonic and wanted to know how the county could assist. She said she never heard back.
If supporters of the Philharmonic hoped to drive a wedge between commissioners court and a fellow arts organization, it didn’t succeed.
And the Philharmonic needs to succeed.

It feels like much of society is returning to normal after several challenging years of pandemic life, but the travel experience is markedly different. Sure, most countries have reopened their borders and the testing requirements are getting progressively more relaxed, but the actual act of booking your vacation is definitely not the same.

Here’s why I’m OK with using more credit card points than usual to fit a trip to Vietnam into my limited winter break.
The best value redemption is the one you actually book
With my fiancée set to wrap up a scuba dive master training program in Indonesia at the start of December, I couldn’t miss the opportunity to fly out and meet her in Southeast Asia. We settled on a two-week trip to Vietnam, a destination we’ve both been dreaming of ever since our trip in the fall of 2019 got canceled by a typhoon.
Our home airport of Miami doesn’t have any non-stop flights to Asia, so I knew I was looking at two stops minimum to get to Vietnam; three stops once we decided to start our trip around Da Nang as opposed to Hanoi or Ho Chi Minh city. But I’m not losing sleep over paying twice what I would’ve liked to for the routing we settled on.
Going straight from a cardiology exam to the airport is going to be stressful enough, and while I miss being on the road, I don’t necessarily miss 40-hour-long travel “days.” With less than two weeks on the ground after accounting for travel time, I wanted a lie-flat seat so I could arrive well-rested and enjoy this vacation as much as possible.
Unfortunately, I couldn’t find a single saver-level business class award seat on any airline despite hours of searching and getting very creative with the routing options I considered. I knew I was in trouble when I seriously considered paying 180,000 United miles for a one-way, three-stop Polaris business class routing. Here’s what I ended up booking instead:
Miami to Los Angeles in Jet Blue Mint for 72,000 JetBlue points (which I thankfully had lying around from my old Brex Card welcome bonus)

I credited this flight to my United account, meaning I’ll earn about 11,000 miles on this trip. The reason I chose to use my Capital One Venture Rewards Credit Card instead of a card with higher earnings on travel purchases, like my Chase Sapphire Reserve®, is that I was able to redeem my Capital One miles at a rate of 1 cent each to erase this travel purchase from my statement. I have 90 days from the date of the purchase to decide how many miles I’ll redeem versus how many I’ll save for future travel, but I should be able to wipe off at least $4,000 worth of this charge by redeeming 400,000 Capital One miles.
I’m beyond excited about this trip, but this is most certainly not an aspirational redemption. When you own one of the country’s largest fleets of private jets, shuttling well-heeled customers wherever they want to go, you can base your company just about anywhere.
Jim Segrave chose Kinston, the struggling Eastern North Carolina city racked by flooding and the decline of the state’s tobacco and textile industries.
This week, Segrave’s company, flyExclusive, celebrated the opening of its fourth hangar at the Global TransPark, the state-owned business park that surrounds Kinston’s airport. The company has become the largest employer in the TransPark, where about 500 of its nearly 800 employees work.
FlyExclusive expects to hire another 200 in the coming months and start work soon on a fifth hangar and a company headquarters building with a training center for its 350 pilots. The company’s revenue climbed 72% over the last year, Segrave told a gathering in the new hangar Wednesday, and is expected to double again in the coming year.
There are 1,929 private jet charter operators in the United States, Segrave told the crowd, which included hundreds of flyExclusive employees. Seven years ago, flyExclusive was the smallest; now it’s the second largest, he said.
“Can we grow stronger based here in Kinston?” he asked. “Absolutely. We have already proven that.”
Segrave, 51, didn’t come to Kinston by chance. He was born in the city and has roots that go back generations. His great uncle was C. Felix Harvey, who led a family enterprise that included insurance, banking and John Deere dealerships. Harvey helped start the Global TransPark Foundation, which promotes the park and its mission to bring companies to Eastern North Carolina.
Segrave had already founded and built a charter jet company, which he sold to Delta Air Lines in 2010. He took the proceeds from that sale to start flyExclusive in 2015. With its close ties to the TransPark, his family urged him to base his new company in Kinston.
The city, about 80 miles southeast of Raleigh, is an unlikely spot to build a national luxury brand. Kinston’s population has shrunk 23% since 1990, on declines in traditional manufacturing and repeated flooding by the Neuse River and its tributaries after hurricanes in 1996, 1999, 2016 and 2018.
The novelty of flyExclusive making a home in an underdog town came up repeatedly at Wednesday’s ribbon-cutting ceremony, including in videos produced by the company. Jim Perry, the Republican state senator who represents the area, said the company’s growth means much more than jobs.
“Today is about something bigger for Eastern North Carolina,” Perry told the crowd. “It’s about a fighting spirit, and it’s about hope. It gives us all hope in our community to see something like this, to see someone take these risks on our people, on our community, to see this type of growth and success.”
Global TransPark has plenty of space
FlyExclusive’s expansion is also encouraging for the TransPark. Created by the General Assembly in the early 1990s, the park was envisioned as a place where companies would set up manufacturing plants around a runway, shuttling components in and completed products out.
But it has struggled to attract tenants, and most of its 2,500 acres remain empty. The next largest employer is Spirit Aerosystems, which produces fuselage sections for Airbus passenger jets and ships them to France, through the port at Morehead City, for final assembly.
Mark Pope, the TransPark’s economic development director, said the park has been hurt by a lack of access to rail and an interstate highway. The N.C. Department of Transportation recently built a six-mile rail spur to connect the park to the Norfolk Southern system and plans to eventually convert U.S. 70 through Kinston into Interstate 42.
In the meantime, the TransPark has begun to draw flight schools and other aviation-related businesses that want to be close to its 11,500-foot runway, Pope said. That includes military contractors and programs, such as the Navy’s Fleet Readiness Center East, which opened a satellite helicopter maintenance and repair facility at the TransPark last year.
Pope acknowledges that attracting and keeping workers in Eastern North Carolina is challenging, as it is in many rural areas.
“Our saving grace is the military,” Pope said in an interview. “We’re surrounded by five military bases; 15,000 plus are coming out of the military every year. We don’t retain all of those. But if we have opportunities for jobs like this, it’s a whole lot easier to retain them, to keep them living here in Eastern North Carolina.”
‘We can control our destiny’
FlyExclusive intends to have more than 2,500 employees by the end of the decade, and Segrave says most of them will be in Kinston. The company opened a technology hub in Durham last year for computer programmers, to tap into the Triangle’s talent pool, but only about 15 people work there, he said.
Segrave says a large majority of the 250 technicians who work on planes in Kinston were recruited from outside the area and that “it’s not been terribly difficult” to persuade them to come. He credits a company culture that stresses humility and teamwork and the fact that outside investors aren’t making decisions or demanding short-term returns.
“It’s a big benefit that we can control our destiny,” said Segrave, who said his children own small pieces of LGM Enterprises, flyExclusive’s parent company, but that the vast majority is his. “We run it the way we want to run it. We’re not trying to crush our people and squeeze every drop out of a turnip that we can so we can make an extra dollar to meet some private equity’s return criteria and exit plan for three or four year from now.”
Segraves said he thought he would lose the business when COVID-19 brought the economy to a standstill in the spring of 2020. For several weeks, he had 50 Cessna Citation and Gulfstream jets parked at the TransPark instead of carrying paying customers.
Demand has rebounded strongly since then, Segrave says.
“The demand at the moment is nearly elastic,” he said in an interview. “There’s more than any of us can handle.”
About 600 people have joined flyExclusive’s Jet Club, which for a deposit of $75,000 to $250,000 and a $1,000 a month membership fee gives them access to the company’s fleet of jets. (Daily and hourly rates apply when they actually fly.) Occasional flyers can charter planes, while frequent flyers can become “fractional owners” of the company’s new Cessna Citation CJ3+ jets, buying shares in a plane.
After the initial shutdowns ended, the pandemic has been good for the private jet business. As airlines struggle with cancellations and labor shortages, people with the means are booking private jets.
Business travel, which accounted for up to 40% of trips before the pandemic, hasn’t come back, Segrave said. More than 90% of flyExlusive’s customers now are jetting off to vacation spots, second homes or to visit family.
Lingering health concerns about crowds and cramming into airports and planes has also helped, Segrave said.
“It drives business to us,” he said. “People who could have always otherwise afforded it would say, ‘I’ll just fly the airlines to save money.’ Now they’re saying, ‘I don’t want to risk my health.’ And the really nice thing about that is once you fly on these, it’s very difficult to go back.”

Chautauqua County District Attorney Jason Schmidt said Thursday Javier Cruz-Corraliza, 34, has been formally charged with the assault on the youths, ages 8 and 12, who were injured in the incident. Both suffered gunshot wounds, which occurred around 8:30 p.m. that evening along Route 60.
Witnesses, according to the Dunkirk Police Department, said a southbound vehicle on Route 60 was passed by another vehicle, at which point shots were fired. Afterward, occupants inside the vehicle struck by the gunfire sought safety and medical assistance at the Route 60 Red Apple Kwik Fill in Fredonia.
Both juveniles were transported to Brooks-TLC Hospital System in Dunkirk.
Cruz-Corraliza was arraigned Thursday on a four-count indictment in Chautauqua County Court by Judge David Foley who set bail at $25,000 cash or $50,000 property bond. He faces charges of first-degree assault, a felony, two counts of first-degree attempted assault and second-degree assault.
Cruz-Corraliza is represented by Nelson Torre, a Buffalo attorney, and is due back in court on Nov. 28 for a discovery conference. Schmidt offered his thanks to the Dunkirk Police Department for their thorough work on this case.

If your work deals with chemicals like ammonia, properly naming their storage is a must. You will need to be labeling some things at some point. That might be for storage purposes, or might simply be for organization. Whatever the reason, that’s nothing that a few well-placed, high-quality label makers can’t fix. The exception is if you need to label items on a larger scale.
In some situations, you might need more than a couple of label makers for miscellaneous tasks. Industrial label printers are ideal for printing labels quickly. You should carefully plan and budget how much equipment will be needed for the task in question.
Personalized Desk Trinkets
Everyone is going to decorate and use their desk or cubicle space differently. You may want to have a small, portable fan to keep you cool. You might want a quick and powerful charging station. Others may want to use cup holders that clip onto the edge of the desk or noise-canceling headphones so they can focus better on their work.
Regardless – you should try to find the items you need to make your work experience more enjoyable and relaxing. Efficiency comes from a happy employee who feels like they are thriving, so find ways for you to succeed. Tech companies will have different office equipment than an insurance firm – which in turn, will have different office gadgets from the sales department of a company. Find what works for you and your company culture. Once you do, you won’t be able to go back!

JPMorgan CEO Jamie Dimon surprised no one as he held the stage at an Institute for International Finance (IIF) event, again calling crypto tokens “decentralized Ponzis” even as he praised aspects of blockchain technology.
There’s plenty of illicit activity in crypto, said the man whose bank has been fined many billions of dollars for its own violations of statutes.
Blockchain, on other hand, at least has certain “real” aspects, Dimon allowed, noting JPMorgan’s Onyx platform for wholesale payments transactions.
For years Dimon has made no secret of his disdain for crypto, and just last month in congressional testimony again called tokens “decentralized Ponzis.”

NEW YORK, Oct 13 (Reuters) – A federal prosecutor on Thursday urged jurors to convict Nikola Corp (NKLA.O) founder Trevor Milton of fraud, calling him a “con man” who lied about the low-emission vehicle company to defraud ordinary investors.
The prosecution and defense delivered their closing arguments in Milton’s New York City trial, which began last month.
Assistant U.S. Attorney Jordan Estes said Milton deceived investors about the electric- and hydrogen-powered truck maker’s technology starting in November 2019. Milton left the company in September 2020 after a report by short seller Hindenburg Research called the company a “fraud.”

Defense attorney Marc Mukasey told the jury that prosecutors had twisted Milton’s statements about Nikola’s plans to shake up the automotive industry.
“It’s a distortion to say that Trevor Milton intended to commit fraud when the statements he made were about the Nikola business model,” Mukasey said.
Though Milton sometimes “fell into the wrong grammatical tense,” other executives did, too, Mukasey added.
Estes recapped evidence from the trial including testimony from individual retail investors who prosecutors have said Milton targeted in podcasts, interviews and social media.
“Trevor Milton is a con man,” Estes said. “His lies may have been on social media, but his was an old-fashioned fraud.”
Prosecutors during the trial said Milton made false statements about Nikola’s progress on developing its technology as the company joined the mounting number of tech and electric vehicle companies going public through special purpose acquisition vehicles, or SPACs.
They also said Milton’s improper statements included that Nikola built an electric- and hydrogen-powered “Badger” pickup from the “ground up,” developed batteries in-house that he knew it was purchasing elsewhere and had early success in creating a “Nikola One” semi-truck he knew did not work.
Milton was obsessed with the company’s stock price and made the statements to inflate it and his net worth, Estes told the jury.
Mukasey countered that Milton was open about his interest in the stock price with top Nikola executives and that they praised his statements in emails. It was only after the government started investigating that Nikola turned on its founder, Mukasey said.
“If you are being investigated by the government and you want them to go away, you say what the government wants,” Mukasey said.
Milton’s lawyers also have said Nikola’s filings with the U.S. Securities and Exchange Commission made clear it was an early-stage company and that investments in it were highly speculative.
The case is U.S. v. Milton, U.S. District Court, Southern District of New York, No. 1:21-cr-00478.

NASA has targeted Nov. 14 for a third attempt to launch its big, next-generation rocketship, the U.S. space agency said on Wednesday, after weeks of technical setbacks and foul weather delayed the uncrewed inaugural Artemis mission to the moon. Plans call for rolling the 32-story-tall Space Launch System (SLS) rocket and its Orion capsule back out to Launch Pad 39B at NASA’s Kennedy Space Center in Cape Canaveral, Florida, as early as Friday, Nov. 4 to renew final flight preparations.
Arizona cryonics facility preserves bodies to revive later
Time and death are “on pause” for some people in Scottsdale, Arizona. Inside tanks filled with liquid nitrogen are the bodies and heads of 199 humans who opted to be cryopreserved in hopes of being revived in the future when science has advanced beyond what it is capable of today. Many of the “patients,” as Alcor Life Extension Foundation calls them, were terminally ill with cancer, ALS or other diseases with no present-day cure.
Archaeologists unearth eight colonial-era mummies in Peru
Archaeologists in Peru have unearthed eight centuries-old mummies at a site in the country’s capital, an important find that experts say could point a colonial-era cemetery. Archaeologists on Tuesday were hard at work in Lima’s Park of Legends on the coast of central Peru, carefully cleaning the ancient preserved corpses found under the site, including the remains of children.
Asteroid’s path altered in NASA’s first test of planetary defense system
The spacecraft NASA deliberately crashed into an asteroid last month succeeded in nudging the rocky moonlet from its natural path into a faster orbit, marking the first time humanity has altered the motion of a celestial body, the U.S. space agency announced on Tuesday. The $330 million proof-of-concept mission, which was seven years in development, also represented the world’s first test of a planetary defense system designed to prevent a potential doomsday meteorite collision with Earth.

Billionaire Elon Musk’s SpaceX said on Wednesday that the world’s first space tourist Dennis Tito and his wife Akiko have signed up to fly around the moon on the space exploration firm’s Starship rocket. Engineer turned financial analyst Tito, 82, was the first private individual to pay for a trip to space on Russia’s Soyuz TM-32 mission in 2001, when he spent nearly eight days aboard the International Space Station.
‘Although not alive, I can still create art,’ robot Ai-Da tells UK lawmakers
A “robot artist” called Ai-Da told British lawmakers on Tuesday that although it was an artificial creation, it was still capable of producing art, as it spoke at a parliamentary inquiry into how new technologies will affect the creative industries. Described as “the world’s first ultra-realistic AI humanoid robot artist”, it appeared in one of parliament’s ornate wood-panelled rooms, wearing a short black-haired wig and denim dungarees.
Japan’s Epsilon rocket failed after launch – Kyodo
The Japanese space agency’s Epsilon rocket failed after it was launched on Wednesday, Kyodo News and other domestic media reported. Japan Aerospace Exploration Agency (JAXA) sent a destruction order signal to the rocket after detecting trouble, Kyodo said. Public broadcaster NHK said the signal was sent after JAXA determined that rocket was not able to fly safely.

San Antonio is big, very big
San Antonio has more than 1.4 million residents, making it the seventh most populous city in the U.S., though some demographers predict it will surpass Philadelphia in the coming years. Physically, the San Antonio metro area is massive, encompassing 498 square miles, according to 2020 U.S. Census data. (By comparison, New York City’s five boroughs combined encompass just 302 square miles.)
With nearly 500 square miles of space, it’s unsurprising that San Antonio offers a wide variety of housing, from inner city apartments to suburban neighborhoods to rural swaths of property. San Antonio is older than you think
San Antonio has been around for more than 300 years, making it older than Chicago, Los Angeles and Houston. Because of its stalwart status, San Antonio has played a pivotal role in Mexican, American and indigenous histories. Though perhaps most famous for the Battle of the Alamo, the San Antonio region was also the stage for the bloodiest squirmish ever fought on Texas soil, the Battle of Medina.
San Antonio’s centuries-long life has created a rich historical tapestry, beginning with the Missions, a UNESCO World Heritage Site composed of five sites across the city. That rich history has inspired the city’s unique architecture, which runs from Spanish Colonial to Victorian to Neoclassical in style.

San Antonio has many nicknames
All that history means a host of nicknames for San Antonio, beginning with the rather self explanatory Alamo City. Other names you might come across are Saytown (S.A. — get it?), Military City, the 2-1-0 and, our personal favorite, Ol’ San Antone.
As for other short lessons in other lingo, residents are called San Antonians, UTSA’s motto is “Birds up!” and the iconic barbecue restaurant is referred to simply as Bill Miller.

San Antonio is geographically and culturally South Texas
There is a lot of talk about San Antonio and Austin eventually merging to become a metroplex, similar to Dallas-Fort Worth. As a result, San Antonio often gets incorrectly identified as being in Central Texas (or South Central Texas, which doesn’t exist). Geographically and culturally, San Antonio is South Texas. The city was once part of Mexico, and ties to our southern neighbor are strong, from the annual Fiesta San Antonio and Dia de los Muertos celebrations to the cuisine to the architecture.

San Antonio is hot, y’all
San Antonio trends towards hot, dry weather, with temperatures averaging in the high 90s during the summer months and the 60s and 70s in the winter. That doesn’t mean San Antonio doesn’t get cold, however. Temperatures in the winter can drop below freezing (it’s a very big news story when it does), and San Antonio will see flurries and ice. In 2021, the entire region was part of Texas’ infamous winter freeze.
Of course the tradeoff for what can be brutal summers is the rest of the year when the weather is relatively mild. (For all those relocating from cooler climates, it’s not unusual to find San Antonians dining al fresco in February.)

The military is major in San Antonio
It doesn’t get the moniker Military City, USA, unless there are quite a few men and women in uniform marching around. Unlike smaller cities, because San Antonio is so sprawling, it’s easy to forget the city is home to multiple major military operations.
Joint Base San Antonio is actually comprised of four military bases — Fort Sam Houston, Camp Bullis, Randolph Air Force Base and Lackland Air Force Base — which together combine “11 geographically separated parcels of land consisting of 46,539 acres, and 35 million square feet in facilities that support over 266 mission partners,” according to the City of San Antonio. JBSA’s workforce is also more than 80,000 people, making it the largest employer in the city.

It’s H-E-B’s world in San Antonio. We’re just living in it
If you’re from Texas, H-E-B likely needs no introduction. The grocery chain has an almost fanatical following, and the cult of H-E-B only grew during the pandemic. Fewer Texans know that H-E-B is based in San Antonio and its headquarters are located on a picturesque campus just south of downtown. In terms of jobs, H-E-B is the second biggest employer in the Alamo City behind JBSA, and followed by insurance giant USAA in third.
A note, however: H-E-B’s hometown is actually Kerrville, and South Texans will balk if you confuse “hometown” with “headquarters.” (Whataburger is another example. Though the beloved fast food chain is based in San Antonio, its hometown is Corpus Christi, as South Texans are quick to remind you.)

San Antonio boasts culinary star power
Tex-Mex reigns in South Texas, and there is no shortage of opinions on where to find the best taco, but San Antonio is also one of the most exciting culinary cities in the South. Of course visitors may include stops by Mi Tierra Cafe y Panderia or La Fonda on Main, but residents take advantage of the burgeoning global food scene happening across the city. In 2022, San Antonio received seven James Beard Awards semi-finalist nominations and even scored one of Bon Appetit’s coveted Best New Restaurants for Reese Bros Barbecue.
If you’re still unpacking boxes, fuel up at Singh’s for quick and delicious Vietnamese fare or grab the kids and walk up the street to Cullum’s Attagirl for fried chicken and a local brew. Make it a date night at Scorpion or simply grab one of the best sandwiches in the city at Station Cafe.

San Antonio is a college town
With its burnt orange lewks and hook ‘em attitude, the University of Texas at Austin has a tendency to steal the collegiate spotlight in the Lone Star State, but San Antonio is home to its own member of the UT system — the University of Texas at San Antonio — and about a dozen more universities, private colleges and two-year colleges.
Topping the list is Trinity University, a prestigious private school that ranks among the top liberal arts schools in the country, according to the U.S. News & World Report. Also located in the city limits is University of the Incarnate Word, St. Mary’s University of San Antonio, Our Lady of the Lake University, Texas Lutheran University, Texas A&M – San Antonio and University of Texas Health Science Center.
Along with four-year programs, the city’s two-year schools are among the best in the nation — literally. In 2021, San Antonio College won the $1 million Aspen Prize, becoming the first community college in Texas to win the prestigious award. SAC is a member of the Alamo Colleges, an elite group of two-year programs that spans five different schools across the city, including St. Philip’s College, Palo Alto College, Northwest Vista College, and Northeast Lakeview College.

Housing prices are going up in San Antonio, but they’re still among the lowest in Texas’ major cities
Texas welcomed a boon in pandemic newcomers over the past two years, a trend that fueled a well publicized rise in home prices. Of Texas’ four biggest cities, Austin home prices saw the most dramatic rise followed by San Antonio. By the end of 2021, the average price of a single-family home in Bexar County had increased 15 percent from the year before while the median price rose 18.5 percent, according to the San Antonio Board of Realtors.
Those numbers are dramatic, but San Antonio home prices are now on par with Houston, and remain more affordable than Dallas and Austin. According to SABOR’s most recent numbers, released Sept. 19, home sales are down, a trend that echoes that of the rest of the state and country over consumers’ growing wariness over the Federal Reserve’s rate hikes. Price wise, home prices in San Antonio are continuing to rise, and the average is now $391,467, which still makes it among the most affordable big cities in the U.S. And because it’s continuing to attract new companies and new talent, property in San Antonio will ...

While my kids much prefer the brunch food and so on, my wife and I were able to find comfort at the exquisite lobby bar, which is complete with views of the golf course and glimpses of the Atlantic City lights. The fire pit outside offered a comforting spot to enjoy a beverage or two on late summer nights.
The service at all the restaurants and bars was phenomenal, but to be honest, the service in every corner of this resort is exceptional. From the lobby staff to the housekeeping, every member of the Seaview team worked to provide an experience to my family that was equally hospitable and unforgettable.
Another draw for the resort is that they are pet friendly. There is no worse feeling than having to leave your furry friend behind when going on a family vacation. After all, they’re a part of the family too. Luckily, at Seaview by Dolce, pets are more than welcome and rooms that accommodate guests looking to bring their companion are ample and available.
Additionally, the resort pays close attention to the needs of folks who may require ADA accessible amenities. Accessible rooms are offered, as well as a map of accessible attractions— which can be found here. Assuring no guest is alienated is just another reason why Seaview is top-of-the-line.

One of the best places to start when building a smart home ecosystem is smart light bulbs. Not only are they relatively affordable compared to other IoT gadgets, often costing between $10 and $50 a bulb, but they can also completely change the feel of your home. You can go from boring and analogue to colorful and automated within minutes, and there are endless possibilities when it comes to using smart light bulbs to create funky-colored light scenes, setting schedules and more.
But like the rest of the smart home space over the last few years, there are now more players in smart lighting than ever before. We tested out some of the most popular smart lights on the market and found that most of them are quite good, but there are differences in compatibility, color quality and mobile app usability that are worth considering before deciding which smart bulb system will be right for your home.

What to look for in smart light bulbs
Connectivity (to hub or not to hub)
One of the biggest appeals of smart lights is being able to control them from your phone. Most of them are able to do so by connecting to it via WiFi or Bluetooth, or via an external hub, which handles the connection for them. Bluetooth connectivity limits the range in which you’ll be able to control the light, so it’s only best for a limited number of bulbs and ones you don’t expect to control when you’re away.
WiFi smart lights are easy to set up and can be cheaper overall since they don’t require a hub to connect them. However, having something like a central Zigbee hub can make your whole system more reliable since its connection is separate from your home’s WiFi network. For that reason, hub-based bulbs tend to be more expandable, so we mainly recommend those if you want to eventually have dozens of smart lights around your home.
White or color?
Most smart bulbs you’ll find today are “white and color” bulbs, meaning they can glow in vibrant blues, pinks, greens and everything in between, as well as shine with different temperatures of white. But there are some white-only bulbs out there, and they are often a bit more affordable than their color counterparts. While we recommend springing for the white-and-color devices, if you’d prefer white only, make sure you’re getting a bulb that can span the temperature spectrum (typically from about 2000 to 5000 Kelvin), offering you various levels of warm and cool white light.
App features
One of the perks of smart lights is the amount of control you have over them thanks to their various app-connected capabilities. Most companion apps let you do things like set lighting schedules, group individual lights into room designations and create your own custom light “scenes” with different colors. But we have seen other features that aren’t as ubiquitous like vacation mode for automatically turning lights on and off to enhance your home security, and sync with media, which changes the colors of lights depending on the music you’re listening to or the game you’re currently live-streaming.
Smart home compatibility
If you use a virtual assistant like Amazon’s Alexa or the Google Assistant regularly, make sure the smart lights you get work with your favorite. All of the bulbs we tested supported both Amazon’s and Google’s virtual assistants, allowing you to use voice commands to turn lights on and off, dim them and more. The wildcard here is Siri and Apple’s HomeKit; while numerous smart bulbs have added HomeKit to their list of compatible connections, not all lights support Apple’s smart home framework.
Expandability
We alluded to this above, but you’ll want to consider how many smart lights you eventually want in your home. Some brands and systems are easier to expand than others, and we generally recommend going for hub-based bulbs if you plan on putting smart lights in every room in your home. If you’re only looking to deck out your home office or living room with some fancy lights, WiFi options should serve you well. Thankfully, these are some of the most affordable smart home devices you can get, so even if you don’t have a clear answer to this question now, you can reconsider your options down the line if you do decide to outfit your home with dozens of bulbs.

If you’ve done any research into smart lights, you’ve probably come across Philips Hue bulbs. The range is popular for a variety of reasons, and we agree they’re the best smart light bulbs you can get thanks to their wide compatibility, easy to use mobile app and their expandability. Particularly, if you know you want to outfit more than one room in your home with these IoT devices, Philips Hue is the way to go.
The first thing that’s important to know about Hue bulbs is that they are now Bluetooth enabled. That means you can buy a few to try out first, then easily expand your system with a hub when you want to add more lights to your home. Previously, the hub was required for any and all lights, but now it’s much easier to dip your toe into the range before fully taking the plunge.
Like all of the other smart lights we tested, you only need to screw in a Hue bulb, turn on your light, and follow the instructions in the Philips Hue mobile app to start using it. Even if you only have the lights in one room to start, we still recommend grouping them into their own “room” in the Hue app so you can easily control the entire space’s environment at once.
Hue’s White + Color bulbs provide a range of warm to cool whites and millions of colors to experiment with. Colors are rich and vibrant, and Philips’ pre-programmed scenes, such as Energize, Bright and Relax, let you quickly emulate your old “dumb” lights with different warmth levels of white light. You can pick from a number of color scenes in the app, too, but it’s also easy to create your own color temperature. So if you’ve always wanted to flood your office with a rainbow of colors while you’re live-streaming on Twitch, you can find the precise presets you want, save them and then turn them on with just a few taps in the app.
The Hue app is pretty easy to use, and the bulbs support voice commands from Amazon’s Alexa and the Google Assistant. That means you don’t even have to open the app to control your lights; you can simply say “Alexa, turn off the bedroom lights” and only the lights in that designated room will extinguish. You’ll be able to add up to 10 bulbs to your system using Bluetooth alone – at which point you’ll have to add a Philips Hue hub into the mix to support up to 50 lights. The hub also enables things like HomeKit connectivity, light schedules and automations, home and away modes and syncing with movies and music.
Arguably the most useful of those features is automations, which lets you set on/off schedules for your lights, including automatically turning the lights off when you leave the house. It’s understandable why Philips would make these few features exclusive to those with Hue hubs – adding a hub into the mix makes the system more reliable, allowing you to do more with increasing numbers of connected lights, plus it will encourage many to invest in a hub and more Hue bulbs over time. We like Hue’s hub not only for its reliability, but also because it allows finer and more flexible control over your devices. So if you’re on vacation and want to turn on your living room lights to see what’s going on, you can do that.
Expandability goes beyond the number of lights you have in your home: It also includes multiple smart bulbs you can install outside, too. The Hue range has a ton of indoor and outdoor bulbs to choose from, including recessed lights, outdoor pedestal and flood lights, light strips and more. It’s one of the few ranges available today that gives you a ton of options to make every bulb in and out of your home smart, which is important to consider if you know you want to go all in on the smart light front.
But that brings us to the biggest downside of Philips Hue, which is the price. Hue bulbs are on the expensive side, with a two-pack of White + Color Ambiance bulbs costing $80. If you’re looking for cheap bulbs to test out smart lighting, some of our other picks below, like the Kasa smart light bulb, will be better choices since most of them have lower prices per bulb. However, if smart lighting is something you want to invest in going forward, we recommend going with one of Philips’ Hue starter kits: the White + Color Ambiance starter kit, including three bulbs, a hub and a smart button, comes in at $180, which is cheaper than if you were to buy all of those components separately.

Overall, LIFX’s color smart lights are similar to Hue’s White + Ambiance bulbs in that they’re easy to set up, they offer striking, saturated colors and work with three major platforms: Alexa, Google Assistant and HomeKit. But the main difference is the LIFX bulbs are WiFi only, so you can’t connect them to a hub even if you wanted to, and some are slightly more expensive than Hue devices. The Color E26 bulb, which supports 1100 lumens, normally costs $50, but there’s an 800-lumen equivalent that’s a bit cheaper, coming in at $35 per bulb.

The crypto think tank Coin Center has sued US Treasury Secretary Janet Yellen over sanctions imposed on the coin mixer Tornado Cash, saying the service has legitimate use cases.
In the lawsuit, filed in Florida on Wednesday this week, Coin Center said Tornado Cash is “an open-source software tool that helps Americans maintain their privacy while using cryptocurrency.”
“The Administration’s use of the foreign-affairs power to punish domestic cryptocurrency users was unprecedented and unlawful,” the lawsuit added, referring to the sanctions imposed by the Office of Foreign Asset Control (OFAC).
Among those named as defendants in the suit were US Treasury Secretary Janet Yellen and OFAC Director Andrea Gacki. New York-based crypto investor David Hoffman and Florida-based software developer Patrick O’Sullivan were among the plaintiffs named in the suit.

According to the lawsuit, Hoffman has previously been “dusted,” meaning that someone has sent him a small amount of ETH through Tornado Cash after the service was sanctioned in an attempt to get him into legal trouble.
“[…] Ethereum users like Mr. Hoffman have no ability to reject incoming transfers. So the criminalization of Tornado Cash empowered someone else to implicate Mr. Hoffman and force reporting obligations on him by causing him to receive an asset from a sanctioned entity,” the lawsuit explained.
Both Coin Center and the broader crypto industry has on several occasions pointed out that OFAC does not normally sanction software, and that Tornado Cash is not operated by any central entity.
Tornado Cash is a coin mixing service on the Ethereum (ETH) network designed to improve the privacy of users and obfuscate who owns what on the network. Erosion Barrier Installations Corp. failed to train divers on emergency procedures
MARGATE, FL – Working at the bottom of a Margate canal on April 4, 2022, a young diver was removing sand with an industrial vacuum to restore an embankment project when sediment above collapsed onto him, leaving the 22-year-old worker trapped until he drowned.
A U.S. Department of Labor Occupational Safety and Health Administration investigation found the diver’s employer – Erosion Barrier Installations Corp. of Davie – did not follow required safety standards and issued citations related to the following violations:
Failing to train divers in dive-related physics and physiology.
Not training dive teams on equipment use, techniques and emergency procedures required to perform underwater tasks safely.
Not ensuring that all dive team members are CPR-trained.
Failing to require that an experienced dive team member supervise dredging operations in a canal with zero-visibility.
Failing to have an emergency aid list at the worksite.
Performing underwater dredging in a canal without a standby diver.
Not providing employees with harnesses capable of distributing the pull forces over divers’ bodies.
OSHA proposed $46,409 in penalties to address the two willful and 10 serious violations.
“Erosion Barrier Installations Corp. ignored safety standards, and a young worker has died. The company could have prevented this tragedy by ensuring dive team members had the experience and training needed before allowing them to do this dangerous work,” explained OSHA Area Office Director Condell Eastmond in Fort Lauderdale, Florida. “Commercial divers face a variety of hazards, and employers must not allow a dive to start until all workers’ safety is assured. The risks and the cost of failure are too great.”
OSHA also cited the company in April 2011 due to a fatal diving incident.
Operating throughout Florida and the Southeast, Erosion Barrier Installations Corp. provides shoreline and seawall restorations, erosion and retaining wall repair, dredging, culvert cleaning and pipe inspections. The company offers services to residential, commercial and local government customers.
The company has 15 business days from receipt of its citations and penalties to comply, request an informal conference with OSHA, or contest the findings before the independent Occupational Safety and Health Review Commission.

SAN ANTONIO — Visitors can now stand in the same spot where worshipers at one of the first Black churches in Texas gathered by San Pedro Creek.
Next to the color-illuminated water wall on the newly completed section of the San Pedro Creek Culture Park is the original 1870s St. James African Methodist Episcopal Church site. As the public begins visiting the creek during a weekend celebration Friday night and Saturday, historical texts will explain that the 100-member congregation made the site its first spiritual home in a small former soap factory in 1871.
“St. James, the first A.M.E. church in San Antonio where African Americans worshipped autonomously and without restrictions imposed by others, became a beacon” in what now is considered the western part of downtown, states text written by a local focus group that will be displayed at the site.

Today’s St. James congregation, which now gathers in a 1935 church on the near West Side, will stage a “praise fest” of music and dance from about 2 to 4 p.m. Saturday, the church pastor said. The February 2020 archaeological discovery of the church site and an extensive public involvement process to determine how to preserve it has been “eye-opening,” even while the church was closed during the pandemic, he said.
“For us to be part of this cultural park, it really says something about the makeup of San Antonio and its diversity,” said the Rev. Alvin Smith, the St. James pastor for seven years.
A downtown resident who watched a concert rehearsal this week reached out to the pastor afterward.

“He was just amazed. He had not met me but really complimented the work that was being done, and he asked for a business card because he wants to attend the church as well,” Smith said.
The Bexar County Historical Commission was briefed last week on permanent signage for the site on the creek’s east bank, just south of Houston Street. The commission also heard an update on a city initiative to guide preservation of buildings, sites, neighborhoods and customs tied to Black heritage in San Antonio.
Other U.S. cities such as Los Angeles, San Francisco and Philadelphia have taken similar steps to preserve Black, Latino and LGBTQ communities.
“It’s a more equitable form of preservation that we were striving for,” said Claudia Guerra, cultural historian in the city’s Office of Historic Preservation.
The rectangular church site and most of its low exterior walls have been structurally preserved. Visitors can walk on a durable, reinforced composite deck flooring where early St. James members gathered and workers labored to support the town’s budding industrial economy of the 1800s.
Signs in English and Spanish will explain the “multi-layered urban cultural site” was a “testament to the confluence of ethnic groups who have directly shaped the unique culture of San Antonio.” The mid-1800s Klemcke-Menger soap factory was “a keystone to modern health and hygiene,” while an 1875 St. James church cornerstone, placed when the church expanded, “remains a tangible landmark of the thriving Reconstruction-era African American community.”

The congregants, including some who’d been enslaved, had not had a permanent church home until they secured “the first physical meeting place for African Americans” and the AME Church in San Antonio.
Churches were a societal lifeline for freed Black Texans. St. James “stressed political participation, education, civil rights, public service and economic empowerment, with members having served as firefighters, freemasons, postal workers, and college founders,” signs will read.
The signs, now in production, also will include an 1874 article in the San Antonio Daily Express written by the St. James pastor, the Rev. W.R. Carson. In two years, he had performed 85 baptisms and 15 marriages in the church, which had grown to 203 members.
“I shall ever remember the kindness and hospitality that has been extended to me by the citizens of San Antonio, and wish them every blessing,” Carson wrote.
But the church also was at the center of struggles for equality. Black firefighting companies organized at St. James out of necessity.

“White firefighters would not come into our neighborhood. And so they started their own, right there in the church,” Smith said.
Learning those stories has inspired and sometimes challenged today’s St. James congregation, he said.
“Being a lover of history, all of that was really just overwhelming,” he said. “To see how it’s blossomed, and to see the start, looking at that cornerstone, and for the ancestors to know what it’s become today, is tremendous.”

The city’s recently announced three-year effort to identify, preserve and protect resources tied to local Black History is supported by grants from the National Park Service, Texas Historical Commission and nonprofit preservation groups. A key meeting is set for Feb. 4 at the Carver Library.
The state recently extended the city’s deadline to complete a cultural context statement by one year to September 2023. As funding allows, the city preservation office hopes to document the histories of other groups.
