Bitcoin and ether prices flattened in Wednesday trading as investors weighed the latest jobs data suggesting the economy isn’t finished growing.
Bitcoin’s (BTC) price slumped a fraction of a percentage point on Wednesday but climbed back above the $20,000 level after slumping below earlier in the day. BTC had declined overnight and accelerated for several hours, with the sharpest decline occurring during the 13:00 UTC hour (9:00 a.m. ET), as U.S. traditional markets opened and ADP’s Employment report on job creation in the private sector arrived hotter than expected. BTC volume during the downturn exceeded its average volume during that time frame by 5 times.
Ether’s (ETH) price’s also declined, as the second-largest cryptocurrency by market capitalization fell 0.95%, erasing a portion of its gains from the prior two days. ETH’s biggest drop occurred during the 13:00 UTC (9:00 a.m. ET) timeframe. ETH prices are down 19% since the Merge, the Ethereum network’s conversion from a proof-of-work consensus mechanism to a proof-of-stake system on Sept. 15.
The CoinDesk Market Index (CMI), a broad-based market index that measures the performance of a basket of cryptocurrencies, recently declined by 0.32%.
U.S. Equities: Traditional stocks declined following strong labor data, as the Dow Jones Industrial Average (DJIA), tech-heavy Nasdaq composite and S&P 500 fell 0.14%, 0.25% and 0.20%, respectively.
OPEC (the Organization of Petroleum Exporting Countries) announced a 2 million barrel per day cut in oil production.
In the U.S., crude oil inventories dropped by 1.36 million barrels versus expectations for a 2.1 million barrel increase for the week ending Sept 30. Gasoline inventories fell by 4.7 million barrels, significantly more than the expected 1.3 million barrel decrease, and the largest decline in eight weeks.
Both developments will likely send energy prices higher, a challenging scenario given the U.S. central bank’s current priority to tame inflation.
Energy markets rose following the OPEC announcement and U.S. inventory data, as WTI and Brent European crude increased 1.8% and 2%, respectively. Natural gas prices increased 1.8%.
Metals: Gold prices declined 0.3%, while copper futures rose 1.6%
ADP Employment, which measures job creation among private U.S. businesses, grew by 208,000 in September, versus consensus estimates of 200,000, and a 12% increase over the 185,000 jobs created in August.
According to the report, annual pay increased 7.8% for workers who stayed at their jobs, while wages for job changers increased 15.7%.
The news, which showed a still-hot jobs market, indicated that the economy is not slowing as much as inflation hawks had hoped to see.

BTC continues to trade in a consolidated range
BTC prices spent much of Wednesday toggling above and below $20,000, as the largest cryptocurrency by market cap continues to trade in a tight range.
The Average True Range (ATR) for BTC has decreased 64% in 2022. ATR measures an asset’s daily range of movement. The contraction of ATR for bitcoin signals prices have gotten less volatile.
In lieu of a tangible catalyst, BTC continues to fluctuate as the narrative around economic growth changes. Tuesday’s Market Wrap highlighted increased optimism for a Federal Reserve pivot to lower interest rates, which seemingly pushed risk assets (both traditional and digital) higher.
Today’s better-than-expected ADP jobs data is having the opposite effect, giving the Fed additional cover to follow through on its intentions to push interest rates aggressively higher. The CME FedWatch tool continues to project another hefty 0.75-percentage-point (75-basis-point) rate hike in November.
For BTC investors looking for bullish signs, on-chain analytics offer potential clues for bitcoin price expansion when volatility begins to increase.
The net position change for stablecoins (denoted in green in the chart below) on cryptocurrency exchanges has begun to increase again, and has been net positive in each of the most recent 24 days.
Often an increase in the balance of stablecoins implies additional buying pressure for an asset, whereas the increased supply of cryptocurrencies (i.e. BTC and ETH), implies increased selling pressure.
For BTC investors leaning bearishly, the current bitcoin price appears to be near its production cost.
Glassnode’s Difficulty Regression Model estimates the “cost of production” for BTC miners, and currently it puts that at approximately $18,081, or 11% below bitcoin’s current price. A reduction in BTC’s price below this figure is likely to add stress to bitcoin miners, which could have a downward impact on prices as well.
Viewing that in conjunction with technical data, however, implies that while nearing the cost of production, buying support exists at levels above $18,000.
Volume Profile Visual Range (VPVR), a tool that illustrates trading volume by price level, indicates that historically BTC investors have been willing to add to long positions in a range between $19,000 and $20,000.

WASHINGTON, Oct 5 (Reuters) – A federal appeals court ruled on Wednesday that a program that has protected hundreds of thousands of young immigrants from deportation was unlawful, but said current enrollees could renew their status and sent the case back to a lower court to consider a new Biden administration regulation.
A panel of three judges from the conservative-leaning 5th U.S. Circuit Court of Appeals affirmed a lower court’s ruling against the program, called Deferred Action for Childhood Arrivals (DACA), but remanded the case in light of a new regulation issued in August.
The decision is a mixed one for U.S. President Joe Biden, a Democrat, who said he wants a permanent pathway to citizenship for DACA recipients – often known as “Dreamers.”

The court allowed for the current 594,000 DACA enrollees to maintain their status, but continues to block new applications.
In remanding the case, the appeals court said it did not have enough information to rule on the new regulation, which is set to take effect on Oct. 31, but that the case should be resolved as quickly as possible.
The 46-page opinion signaled the judges were skeptical of DACA’s legality.
“The legal questions that DACA presents are serious, both to the parties and to the public,” they wrote. “In our view, the defendants have not shown that there is a likelihood that they will succeed on the merits.”
Former President Barack Obama, a Democrat, whom Biden served under as vice president, created DACA in 2012 after efforts by U.S. Congress to grant citizenship to immigrants brought to the country as children failed.
Texas and a coalition of states with Republican attorneys general in 2018 sued to end DACA, arguing it was illegally implemented. In July 2021, U.S. District Court Judge Andrew Hanen in Texas sided with states. read more

1. The Google Pixel 7 is upon us

2. Google settles U.S. ‘location data’ case
Staying in Google town and two years ago, the Arizona Attorney General sued Google for allegedly tricking people into giving up their location data, even after they tried to turn off the company’s location data settings. Google agreed to pay $US85 million (a little under $120 million) to settle the lawsuit this week and fix an incorrect description of what its Location History setting actually does. If it sounds familiar, that’s because there was a similar case in Australia. In August, Google agreed to pay $60 million in penalties to settle claims that it misled some users about personal location data collected through Android devices for two years.
3. Overwatch 2 launch not going as planned
One of the biggest games of the year is off to a rocky start, with Overwatch 2 plagued by problems, including a distributed denial of service (DDoS) attack that impacted launch day play. Blizzard president Mike Ybarra announced on Twitter yesterday that the Overwatch 2 servers were undergoing a “mass” DDoS attack. Things haven’t gotten much better, with a second DDoS attack and servers still not exactly stable.

4. Prison security firm next data breach casualty
The Guardian is reporting that current and former employees of a security firm that provides services for prisons across Australia (including previously the federal government’s offshore detention centre on Manus Island) have had their personal information stolen. The firm, G4S, said it had been the subject of “a cyber incident” that gave an unauthorised third party, “or malware program”, access to its systems. The breached data includes tax file numbers, bank account information and medical checks.
5. Capital One hacker gets merely 5 years
Still on data breaches and if you cast your mind back to 2019 when U.S. bank Capital One had 100 million credit card users’ accounts hacked, you’d remember it was one of the largest breaches for its time. Well, today, ex-Amazon software engineer Paige Thompson, the woman who cost the company at least $US270 million (around $380 million in Aussie terms), was sentenced to time served and just five years’ probation in a Washington court.

SAN ANTONIO – Despite being sworn in, former Bexar County Precinct 2 captain Marc D. Garcia left court Wednesday without taking the witness stand against his former boss, Michelle Barrientes Vela.
The temporary delay came less than a day after sources said Garcia agreed to testify about his tenure under Barrientes Vela in exchange for prosecutors dismissing all criminal charges against him.
Prosecutors revealed in court Wednesday morning that they had learned about new evidence in the criminal case against Barrientes Vela during “late night” discussions Tuesday with Garcia and his criminal defense attorney.
KSAT Investigates spotted Garcia walking into the Bexar County Justice Center around 4:40 p.m. Tuesday. He appeared to still be inside the building as of 6:15 p.m. Tuesday.
But plans to have him testify against his former boss were halted Wednesday after conflict of interest concerns surfaced.
Garcia’s attorney, Mark Anthony Sanchez, represented both Garcia and Barrientes Vela in multiple civil claims filed against the former Precinct 2 leaders by other members of the agency.
The county settled the various lawsuits for $467,000, nearly half of which went to Deputy Leonicio Moreno.
Judge Velia Meza had revealed just before court adjourned for lunch Wednesday that Garcia would likely need to find a new attorney and could even potentially be disqualified from testifying. Prosecutors informed the court of their intention to file a motion to have his attorney withdrawn after the hearing resumed Wednesday afternoon.

Wednesday’s testimony focused on the chaotic manner in which Barrientes Vela ran her agency from the time she took office in January 2017 to her stepping down in October 2019.
Steve Moninger, an attorney for the Texas Department of Public Safety, testified about state laws pertaining to off-duty deputies working security.
Prosecutors have previously accused Barrientes Vela of violating the state’s Private Security Act related to her scheduling of deputies at Rodriguez Park and other events, including a church festival.
Defense attorney Jason Goss denied that Barrientes Vela violated the Private Security Act, comparing her security set-up to the house not taking a cut after a game of poker is played.
Renee Garza, court manager for Bexar County Precinct 2, made a revelation on the witness stand that had not been previously known publicly.
Garza testified that defendants with warrants out of Precinct 2 were being forced by deputies to pay money before making appearances in the justice of the peace court, a clear violation of court procedures. She testified that fines and fees in many of the 93 cases identified later had to be waived.
Precinct 2 Judge Roberto Vazquez, who shared a Northwest Side county building with Barrientes Vela, said he was forced to go to the then-district attorney in 2017 in order to get Barrientes Vela to stop the practice.
“They are directed to arrest that individual and bring them before myself or the local magistrate,” Vazquez testified.
Vazquez engaged in a combative back-and-forth with Goss, at one point telling the attorney how to properly object in court, before Meza told them to move on.
Vazquez repeatedly issued biting criticism of Barrientes Vela, recalling one meeting in which he sought to discuss with her the code of criminal procedure. Vazquez testified that during the meeting Barrientes Vela pushed a copy of the statutes away and let him know, “that she knew the code of criminal procedure better than any lawyer or judge, so I didn’t have to worry about it.”
Vazquez testified about a separate incident in which Barrientes Vela, unhappy with how 2018 budget sessions had played out, had the metal detector removed from the entrance to the Precinct 2 building, leaving it without security for 24-36 hours. Vazquez pointed out that the metal detector did not even belong to the constable’s office and was actually owned by the court.
On cross-examination, Goss said that Vazquez’s dislike of Barrientes Vela had caused him to act unprofessionally.
Current Pct. 2 Constable Leticia Vazquez, who took over for Barrientes Vela in October 2019, testified Wednesday afternoon that she inherited a mess.
The agency’s credit cards were frozen. Shelves of envelopes were found that needed to be mailed out but had not because the agency’s stamp machine was inoperable due to an outstanding balance.
Pct. 2′s property room was also in “disarray,” Constable Vazquez testified.
Barrientes Vela’s nearly two-week long trial concluded last month with a jury convicting her of altering security payment logs for Rodriguez Park and knowingly turning over false records to law enforcement after receiving grand jury subpoenas in the summer of 2019.
Barrientes Vela still faces three counts of official oppression related to her treatment of Moreno and a second Precinct 2 Deputy Christopher De la Cerda.
Prosecutors have indicated that they will dismiss those charges at the conclusion of her sentencing hearing for felony tampering.
Like Moreno, De La Cerda was given a six-figure settlement from the county last year.
Garcia was scheduled to go to trial for felony perjury in late November, and like Barrientes Vela, also faces multiple counts of official oppression.
The prosecution’s move to withdraw its criminal case against Garcia in exchange for his testimony likely indicates that the state is pushing for Barrientes Vela to serve jail time.
Garcia was ordered to appear before Meza when the sentencing hearing resumes at 1 p.m. Thursday.
Barrientes Vela faces between two years probation and ten years in prison.
She has asked to be sentenced by Meza.

It has established a Professional Women’s Group to support participants looking to advance their careers and gain leadership skills. And, in response to the needs of local women during COVID, it has established a digital literacy coaching program that has provided over 400 hours of one-on-one learning.
Overseeing this advancement is Jess Roncarati-Howe, who has been promoted to director of programs and operations. Having been hired in January of 2020 as a part-time program coordinator, Roncarati-Howe quickly advanced, expanding programming, fostering community relationships and responding to the needs of local women seeking gainful employment during and post-pandemic.
Volunteer Engagement Manager Diane Jacobs oversees over 100 active volunteers. In a tweet over the weekend, Arizona Cardinals defensive end J.J. Watt revealed he’d been treated for atrial fibrillation or A-fib.
“If you have atrial fibrillation, take it serious,” said Dr. Christopher DeSimone, a cardiac electrophysiologist at Mayo Clinic.
DeSimone says a-fib is an irregular heart rhythm and because it can lead to blood clots in the heart that can travel to the brain, those who have it are at increased risk for stroke.
“Instead of having a coordinated contraction where the heart’s filling and contracting, filling and contracting, it’s almost chaotic. So it’s jiggling like you have a bag of worms,”
DeSimone said warning signs often include a rapid heartbeat, chest pain, dizziness, fatigue, lightheadedness, reduced ability to exercise, shortness of breath and weakness.

NASHVILLE – The Tennessee Department of Commerce & Insurance’s (“TDCI”) Division of Securities is joining the North American Securities Administrators Association (“NASAA”) to share an Informed Investor Advisory cautioning investors to protect themselves from investment scams and frauds offered in the unregulated metaverse, the online virtual “world” that provides users with immersive experiences through virtual or augmented reality technologies.
The metaverse may offer numerous potential investment opportunities, including virtual real estate, nonfungible tokens (“NFT”) and other businesses. But the advisory warns that the lack of regulation in the metaverse, combined with the ability to operate from anywhere in the world, make it easy for fraudsters to hide their financial schemes. In addition, security lapses on some developing platforms and the ability to build fake metaverse experiences can lead to hacks, fraud, or the theft of users’ funds.
“All investments come with some risk, and no one can be guaranteed against loss when it comes to an investment,” said TDCI Commissioner Carter Lawrence. “While the metaverse promises the benefits of new technology, scammers will use it to dress up the same old financial scams and prey on investors in the metaverse. Tennesseans need to be wary of any investment that is promising unrealistic returns with minimal risk.”
The advisory explains the risk of metaverse-focused investment scams and frauds, and how investors can protect themselves if they are considering investing in this emerging realm.
TDCI and NASAA are providing the following tips to help investors identify common telltale signs of possible investment fraud in the metaverse:
Understand the risks and make sure you are comfortable with them, including the possibility that you might lose your entire investment.
Verify that the person or entity offering the investment is registered with one or more securities regulators. Visit TDCI’s Securities division online here.
Avoid discussing investments or sharing personal or account information with avatars, or digital representations of users that can take on any appearance or personal attribute. Fraudsters may try to leverage shared interests, ideas, and goals to build trust and convince investors to invest in phony investment schemes.
Steer clear of metaverse crypto or NFT investment offers and avoid investment advice in the metaverse.
Be wary of misinformation including fake news and online celebrity gossip as scammers write fake online articles and social media posts that create buzz by falsely stating a celebrity or public figure is involved in technology investment.

PowerTrade, a crypto exchange focused on derivatives, is rolling out a request-for-quote (RFQ) model for the options market, which it says will cater to institutional investors by mirroring a widely used practice in traditional finance.
The exchange, which is available as a mobile and web-based application, is the latest to launch an RFQ model. Institutional players tend to prefer to trade options as multi-leg RFQs as they allow investors to buy and sell assets in bulk. Generally speaking, an RFQ is when an investor asks brokers or market makers to bid on a trade.
Other exchanges such as Paradigm and Dfyn have launched RFQs in the past. Deribit, the world’s largest bitcoin and ether options exchange, offers a similar option called “COMBOS”.
The RFQ workflow goes as follows:
Client A sends an RFQ, which is then visible to all market makers, including any other client who wants to show a quote.
PowerTrade’s options market maker sends a two-way quote (bid/offer) back to client A.
Client A or any other client who is logged into the exchange can trade on the quote, and the trade settles on the platform.
Proponents say that RFQs allow users to gain access to better prices, particularly for medium- and high-volume trades.
“Our goal with RFQ is to drive the adoption of the crypto options markets by supporting smaller institutional traders with no minimum order sizes,” said Bernd Sischka, head of institutional sales at PowerTrade, in an interview with CoinDesk. “We are tackling key problems in the crypto derivatives industry that are impeding rapid adoption of these products amongst the traditional finance clients.”
PowerTrade says its investors include Pantera Capital, Ledger Prime and QCP Capital.

Oct 5 (Reuters) – In a February meeting with mining executives, President Joe Biden laid out an aggressive goal for the United States to produce more of its own minerals for the electric vehicle revolution in ways that respected the environment.
A “big part” of those efforts, the president said, was a plan by Warren Buffett’s Berkshire Hathaway Inc to filter lithium from superhot geothermal brines swirling beneath California’s Salton Sea, something that had never been done before.
The project aimed to help usher in a new way of producing lithium – a key constituent of EV batteries – in the United States while avoiding the controversies that come with building mines that are often unpopular with local communities.

The U.S. Department of Energy had chosen Berkshire the day Biden was inaugurated in January 2021 for a $14.9 million grant to study how Salton Sea-region lithium could be used to make lithium hydroxide, a specialized type of the metal that produces more efficient and longer-lasting EV batteries.
“We’re going to set America up to lead the world by building a clean energy economy and a clean energy future,” Biden said at the February event, which was billed as a critical minerals roundtable.
Alicia Knapp, chief executive of Berkshire’s BHE Renewables division, told Biden that Berkshire was “working to secure the most abundant source of lithium in the United States using the world’s most environmentally friendly technology.”
Two weeks later, though, the Energy Department rescinded the grant, according to emails and documents obtained by Reuters, after Berkshire requested what the Energy Department called a “material change” to its lithium project. The withdrawal of the grant has not been previously reported.
While the sum of money was relatively small for the mining world and the Salton Sea grant was for a pilot project, the tale of Berkshire’s tangle with Washington shows how Biden’s plan to shift the economy away from fossil fuels faces some significant technical and business challenges.
Thirteen months of negotiations between the company and the government, which Reuters is reporting for the first time, stalled as Berkshire sought control over patents, changes to technology, and whether it could one day sell the lithium business, even after the government helped build it, the emails and documents show.
Asked about the grant withdrawal, a Biden administration official said there are “inherent risks” in funding research and development projects, and noted that several companies including Berkshire are still working on U.S. lithium projects.
The Energy Department’s March 9, 2022, letter telling Berkshire it was rescinding the grant said the move was “the result of a mutual decision” and would not bar Berkshire from applying for future federal funding.
Berkshire, however, is facing problems extracting lithium from Salton Sea geothermal brines, according to three sources with direct knowledge of the operation who declined to be identified so as not to jeopardize future relationships with the company.
In a statement to Reuters, Berkshire said it had planned to develop “a first-of-its-kind demonstration plant to produce lithium hydroxide” but “subsequently decided to use a commercially proven process” to produce lithium carbonate instead.
“This change in technology increases the likelihood of success and accelerates the speed to market,” Berkshire spokesperson Dan Winters said. The company declined to comment for other parts of this story.
‘NASTY, HOT SOUP’
Berkshire operates multiple power plants near the Salton Sea, roughly 160 miles (258 km) southeast of Los Angeles, where it flashes steam off brines brought from deep underground at temperatures around 700°F (371°C) to spin turbines that produce electricity.
In theory, Berkshire’s plan made sense. Technology for an extra processing step could be connected to one of the existing plants to extract lithium before the brine is reinjected underground. That would avoid the need for open-pit mines or large evaporation ponds, the two most-common but environmentally challenging ways to extract lithium.
From the start, Berkshire’s challenge was twofold. First, it needed to separate lithium from that hot brine using a commercially unproven class of technology known as Direct Lithium Extraction, or DLE. Then it aimed to develop new technology to process that lithium into lithium hydroxide.
For the first challenge, the California Energy Commission gave Berkshire a $6 million grant in May 2020. As part of its agreement with the state, Berkshire said it would use DLE technology from another company, AquaMin Lithium and Water Recovery Inc.
But corroded equipment and clogged pipes from the superhot brine are plaguing the extraction operation, according to the three sources with direct knowledge. “I think Berkshire has an unsolvable problem,” said one source, who described the facility struggling to get even the most basic processing equipment to work due to the extreme heat of the geothermal brines.
AquaMin, a division of privately held Conductive Energy Inc, did not respond to requests for comment. The California Energy Commission (CEC) said its funding for Berkshire was not affected by the loss of the Energy Department grant.
The region’s brine teems with lithium, calcium, sodium and other minerals that are very complex to separate, said Corby Anderson, who teaches metallurgy at the Colorado School of Mines.
“It’s just a nasty, hot soup that’s sometimes acidic,” said Anderson, who is not involved in Berkshire’s project.
The U.S. Department of Energy grant was focused on the second challenge, turning the extracted lithium into lithium hydroxide.
BMW (BMWG.DE) and some other automakers prefer hydroxide over carbonate because it allows batteries to hold more power.
“Batteries should last longer and therefore be more sustainable” with hydroxide, Eric Smith, Berkshire’s vice president of lithium development, said during a July 2021 presentation to Salton Sea-region officials.
But making hydroxide requires extra processing involving crystallizers and other specialized equipment. If and when Berkshire is able to extract the lithium from the Salton Sea brine, making carbonate would be less complicated and expensive than making hydroxide.
The day after Biden touted Berkshire’s project, the company privately asked the Energy Department to change the grant’s scope and let it make carbonate instead of hydroxide, according to the emails obtained by Reuters through a public records request.
The Energy Department declined, saying that would be a “substantial departure” from the original proposal and would be unfair to others who applied for the grant.
Within weeks the grant was rescinded.
Emails show the Energy Department had warned Berkshire in December 2021 – two months before Biden’s minerals roundtable – that talks on grant terms had reached an “impasse.”
While the White House was aware negotiations were ongoing when it hosted Berkshire, it did not know about the impasse warning, according to the administration official.
“We remain optimistic and hopeful that (Berkshire’s) technology pans out and think there’s great opportunity if and when it does,” the official said.
Berkshire’s website now says it aims to open a lithium carbonate pilot plant next spring.
Berkshire’s decision not to make hydroxide from the Salton Sea – and to forego the federal funding for that – indicates it likely faced far more complex technical challenges than it expected, four analysts told Reuters.
“It’s an indication to me that they have some real challenges standing in their path to commercial lithium production,” said Chris Berry, an independent lithium industry consultant who is not involved in Berkshire’s project
Privately held Controlled Thermal Resources Ltd and EnergySource Minerals LLC are also trying to extract lithium from Salton Sea brines with different DLE technology for eventual use in EV batteries, but neither are at commercial production.
“The magic here is elusive,” said Anderson, the Colorado professor. “It’s not as easy as people portray it to be.”

A Latino civil rights group on Wednesday said it is doubling its reward offer for information that leads to finding or prosecuting a woman who authorities said lured migrants from San Antonio to Martha’s Vineyard under false pretenses.
The League of United Latin American Citizens, or LULAC, announced that information that leads to locating, arresting and prosecuting Perla Haydee Huerta will be rewarded with $10,000. Huerta, 43, is sought in connection to what LULAC president Domingo Garcia said was an orchestrated scheme to use the migrants from Venezuela as political pawns.
About 50 migrants were flown to Martha’s Vineyard last month on a flight that originated from San Antonio and was paid for with Florida state funds on the orders of Florida Gov. Ron DeSantis, NPR reported last week.
“It’s time that Perla Huerta goes before a grand jury and answers who hired her, who paid her and what was the purpose of her mission in this scheme? Why did Gov. DeSantis decide to engage in tribal political politics literally, a month before his election,” Garcia said during a livestreamed press conference from Washington, D.C.
“Venezuelan refugees deserve respect, deserve dignity and they deserve Christian charity, they don’t deserve to be used as political props,” he added.
Garcia said the group will also file a complaint with the U.S. Department of Justice urging the agency to open an investigation and convene a grand jury to investigate the issue.

“These refugees were transferred across state lines from Texas to Florida and eventually to Massachusetts,” Garcia said. “We believe multiple federal crimes could have been involved in that [transport], and we’re asking the attorney general to look into that matter.
Some of the migrants have also filed a lawsuit against DeSantis, Florida Secretary of Transportation Jared W. Perdue and five unnamed persons as defendants. One of the unnamed persons in that lawsuit is also identified as “Perla” and allegedly approached a defendant identified as Yanet Doe.
Doe and her family crossed the border in July at Piedras Negras, Coahuila, which is across the border from Eagle Pass, Texas. The family surrendered to federal officials after entering and received notices to appear before an immigration judge next month, according to the complaint.
“Perla … was asking people outside the shelter if they needed help” and were told “if the family got on the flight she arranged, then [Yanet Doe] would be provided with permanent housing, work, educational resources for her son, and help changing her address for immigration proceedings,” the lawsuit states.
The Bexar County Sheriff’s Department announced last month it opened a criminal investigation into the matter to see if any crimes were committed in the scheme. Citing a source with knowledge of that investigation, the New York Times reported earlier this week that a woman named Perla Huerta was being looked into. The woman is a former counterintelligence official and a combat veteran who served in the U.S. Army, the publication reported.
Garcia said that when he met with some of the migrants sent to Martha’s Vineyard last month, he was also told about a woman named Perla who approached the migrants in San Antonio.
“The question is: Where is Perla Huerta? We want to find out, and so does a grand jury in Bexar County, and so do investigators, we believe, with the Department of Justice,” he said.

Mitchell Pally, the CEO of the Long Island Builders Institute, has been appointed to the boards of the Town of Brookhaven Industrial Development Agency and the town’s Local Development Corporation.
Pally, who’s led LIBI since Dec. 2010, will be retiring as the organization’s CEO at the end of the year. He previously served as a member of the IDA for 15 years, leaving the agency’s board in 2008.
“It is an honor to be selected by our town board to once again assist in the continuing development and improvement of my local community,” Pally said in a written statement.
Pally has also served as the Suffolk County representative to the board of the Metropolitan Transportation Authority, leaving in 2019 after 14 years. Prior to joining LIBI, Pally was the partner in charge of government relations for the Weber Law Group, and before that was vice president for governmental affairs at the Long Island Association.
“It’s a privilege to welcome Mitch Pally back to our board,” Fred Braun, chairman of both Brookhaven economic development agencies, said in the statement. “We will benefit from his years of experience as our economic development efforts move forward.”

The World Health Organization (WHO) issued an alert Wednesday over four cough and cold syrups made by Maiden Pharmaceuticals in India, warning they could be linked to the deaths of 66 children in The Gambia.
The UN health agency also cautioned that the contaminated medications may have been distributed outside of the West African country, with global exposure “possible.”
WHO chief Tedros Adhanom Ghebreyesus told reporters that the four cold and cough syrups in question “have been potentially linked with acute kidney injuries and 66 deaths among children.”
“The loss of these young lives is beyond heartbreaking for their families.”
Tedros said that WHO was also “conducting further investigation with the company and regulatory authorities in India.”
According to the medical product alert issued by WHO Wednesday, the four products are Promethazine Oral Solution, Kofexmalin Baby Cough Syrup, Makoff Baby Cough Syrup and Magrip N Cold Syrup.
“To date, the stated manufacturer has not provided guarantees to WHO on the safety and quality of these products,” the alert said, adding that laboratory analysis of samples of the products “confirms that they contain unacceptable amounts of diethylene glycol and ethylene glycol as contaminants.”
Those substances are toxic to humans and can be fatal, it said, adding that the toxic effect “can include abdominal pain, vomiting, diarrhoea, inability to pass urine, headache, altered mental state and acute kidney injury which may lead to death.”
The Gambia’s health ministry asked hospitals last month to stop using a syrup paracetamol, pending the outcome of an investigation, after at least 28 children died of kidney failure.
WHO said that information received from India’s Central Drugs Standard Control Organisation indicated that the manufacturer had only supplied the contaminated medications to The Gambia.
“However, the supply of these products through informal or unregulated markets to other countries in Africa, cannot be ruled out,” the UN agency said in an email.
“In addition, the manufacturer may have used the same contaminated material in other products and distributed them locally or exported,” it warned.
“Global exposure is therefore possible.”
Tedros urged caution, calling on all countries to work to “detect and remove these products from circulation to prevent further harm to patients.”
The Gambian health ministry’s advice on syrup paracetamol was issued on September 9, a month after investigators reported the death of at least 28 children aged five months to four years from acute renal failure.
The investigation had been opened on July 19. No details were given as to when the children died.

Hoping to capitalize on the rebounding crypto markets, San Francisco-based crypto index fund provider Bitwise has rolled out BWEB, a new Web3 exchange-traded fund (ETF).
ETFs are financial instruments that trade on an exchange like stock, but track a specific market or asset, such as bitcoin (BTC).
“Today, many experts believe we’re on the cusp of a major evolution in the core architecture of the internet,” Matt Hougan, Bitwise’s Chief Investment Officer, said in a statement. “With the Bitwise Web3 ETF, we’re excited to give investors the opportunity to capture one of the fastest-emerging themes in technology through a diverse mix of companies that we believe will lead the charge.”
“More than 85% of the index is comprised of ‘pure-play’ companies directly linked to Web3 themes and business activities,” the statement said.
A factsheet presenting the product states that, as of October 4, the ETF’s top ten holdings included crypto exchange Coinbase, online gaming platform Roblox, data center specialist Equinix, game developer Unity Software, Facebook’s parent company Meta Platforms, social media platform Twitter, online retail specialist Shopify, networking and cyber-security business Cloudflare, game developer Electronic Arts, and game publisher Take-Two Interactive.
With more than $1.3 billion in assets under management, the San Francisco-based firm says it is one of the largest crypto asset managers in the market.
BWEB trades on the NYSE Arca, a U.S. securities exchange on which exchange-traded products (ETPs) and equities are listed. The Bank of New York Mellon is the ETF’s custodian and administrator, according to data from Bitwise.

A nightclub bouncer was convicted in September by a local court for attacking a U.S. Marine in 2021 in Darwin, Australia.
Hayden Robert Bruce Summers, 34, was found guilty on Sept. 2 by a Northern Territory Supreme Court jury for “unlawfully causing serious harm,” according to a Tweet from the court.
After only four hours, the Australian jury unanimously found the bouncer to be guilty. His sentencing hearing was scheduled for Tuesday, Xavier La Canna, a spokesman for the court, confirmed in an email to Marine Corps Times.
Summers will serve behind bars for three months, according to an Australia’s ABC news, before spending nine months in home detention. The nightclub bouncer received a partially suspended prison sentence of three years and six months for his actions.

The incident between Summers and the Marine, who the Australian outlet ABC identified as Glen Thomason, occurred outside Darwin’s Monsoons nightclub in the early hours of April 11, 2021.
Closed-circuit TV footage that captured a video of the altercation was shared with Marine Corps Times from the court.
It shows the Marine, who reportedly had been ejected from the bar, swinging an arm toward Summers before the bouncer then struck him in the head, causing him to fall to the ground.
The U.S. Marine’s injuries led to a “significant amount of time” in a hospital and in rehabilitation after having part of his skull removed, the Australia broadcaster reported.
Summers, who according to the broadcaster had worked 15 years in the industry and was the head of security at the nightclub, pleaded not guilty.
During the trial, according to ABC, witnesses testified that during the interaction between the two men Thomason was heard saying “I could kill you, I’m a Marine,” or similar words to that effect.
His team argued, however, that the bouncer’s actions were unreasonable and that he failed to pursue other ways to de-escalate the situation.
At Summers’ sentencing hearing, the court justice reportedly said, “You appear genuinely shocked and sorry about the level of injury. Although the slap was intentional, the type of injury was not.”
Exactly what Thomason’s duties were in Australia remain unclear at this time.
A Marine rotational force in Darwin participates each year in six months of training missions, with this year’s rotation including 2,200 Marines, according to Stars & Stripes, who also reported that Thomason was not a member of this year’s rotation.
Unfortunately, this incident is not the only recent altercation at a bar in which a Marine or Marine veteran has been injured.
On Aug. 16, 2021, while out for a friend’s birthday at Gallery Art Bar in Oakland, California, Marine veteran Mahmoud Berte allegedly was shot 10 times, according to KTVU FOX 2.
Four shots struck him in his right leg, three in his stomach and another three in his left leg, which reportedly needed to be amputated, he said.
“I’m a human being. I served this country. I deserve justice,” Berte said to the local outlet.
He has filed a lawsuit against the bar for allegedly not having safety measures in place. A GoFundMe page to help cover Berte’s expenses has raised just over $14,000 as of Tuesday morning.
A spokesperson from Marine Rotational Force–Darwin was not immediately available for comment.

Since 1990, Mental Illness Awareness Week (MIAW) takes place the first full week of October to bring attention to the mental health conditions experienced by one in four Americans. Mental Health America has resources specifically dedicated to MIAW, including tips on navigating the unique life challenges that those living with mental illness encounter. Those interested can learn more at mhanational.org/miaw.
Behavioral health, as acknowledged via one of the five pillars of the Healthy Boiler Program, plays a key role in overall employee well-being. Regardless of how someone refers to it – behavioral health, mental health, emotional well-being, etc. – one thing is certain, it matters.
Purdue understands that raising awareness about mental health needs and ensuring that resources are readily available is an everyday necessity.
“Human Resources is continuing its long-term initiative to help ensure the Purdue community can learn about the variety of accessible resources, tools and more so that employees have the help, support and information they need,” says Candace Shaffer, senior director of benefits in Human Resources. “We remain focused on bringing mental health assets to the forefront while at the same time enhancing or pursuing new tools, programs, training opportunities and more to share with the Purdue community.”
Human Resources has created a hub, which is featured on the Human Resources website, for these types of mental health resources. Via the Mental Health Resources webpage, employees will find a list of available resources, such as:
