The indexes were little changed following the release of the minutes from the Federal Reserve’s last interest rate policy meeting. The minutes show Fed officials stressed their commitment to taming “unacceptably high” inflation before announcing another hefty interest rate hike and signaling more large rate increases ahead. The S&P 500 rose 0.4% as of 2:29 p.m. Eastern. The index was roughly evenly split between gainers and losers. Different sectors have the market have been alternating between leading and lagging throughout the day. The Dow Jones Industrial Average rose 162 points, or 0.6%, to 29,404, and the Nasdaq rose 0.5%. Treasury yields, which have driven much of Wall Street’s recent trading, eased modestly. The yield on the 10-year Treasury, which affects mortgage rates, fell to 3.90% from 3.95% late Tuesday. It had been at 3.92% before the release of the Fed meeting minutes. The yield on the 2-year Treasury held steady at 4.31%. Banks and technology stocks made solid gains. Bank of America rose 1.4% and Intuit rose 2.6%. Consumer goods companies also rose broadly. PepsiCo rose 4.3% after raising its profit forecast for the year following encouraging quarterly financial results. Cruise line operators were among the biggest gainers in the S&P 500. Carnival rose 9.7%, Norwegian Cruise Line gained 10.2% and Royal Caribbean climbed 10.3%. Markets have been volatile all week as investors wait for the latest round of big company earnings reports and fresh reports on inflation and retail sales. The benchmark S&P 500 is coming off five straight losses and is close to its lowest point in nearly two years. A report from the government showed that inflation at the wholesale level eased last month, though it was a bit worse than economists expected. A more closely watched component of the inflation data matched economists’ forecasts. Inflation updates are being closely watched by investors who worry that stubbornly high prices on everything from food to clothing could lead to a recession. Those worries have been worsened by central banks around the world raising interest rates to make borrowing more expensive and slow economic growth. The Federal Reserve has been particularly aggressive, and its strategy carries the risk of stalling an already slowing economy and causing a recession. In the minutes from the central bank’s Sept. 20-21 meeting, Fed policymakers judged that a “softening of the labor market’’ — likely including higher unemployment — would be needed to curb the nation’s inflationary pressures. They noted that hiring remained “robust,” which itself fuels high inflation as wages rise sharply. A closely watched report on consumer prices is due Thursday and data on retail sales for September is due Friday. Both reports could help give Wall Street a clearer picture of where prices remain hottest and how consumers are reacting. The corporate earnings season begins in earnest this week. Domino’s Pizza and Walgreens will report their results on Thursday. Big banks, including Citigroup and JPMorgan Chase, will report results on Friday. The British pound weakened against the U.S. dollar after the governor of the Bank of England, Andrew Bailey, confirmed the bank will not extend beyond Friday an emergency debt-buying plan introduced last month to stabilize financial markets. Markets in Europe were mostly lower. The U.S. dollar has been gaining strength relative to other currencies amid increased recession fears. The Japanese yen declined to a 24-year low against the U.S. dollar to 146 yen-levels, raising expectations of an intervention to prop up the yen following one such move in September. The two year drop of 2.7 years is the largest decline in 100 years. Factors included in the decline range from COVID-19 to accidental deaths, drug overdoses and an unhealthy lifestyle. On the other hand, 97,000 Americans have achieved the distinction of being centenarians, a term denoting more than 100 years in age, the most of any nation on earth. Men should take note that 85 percent of centenarians are women. In a recent interview, a 105-year old farmer in Minnesota attributed his longevity to maintaining an active mind and body. As a healthcare professional, I am often asked for an opinion on healthy living. Although some may say genetics is the ultimate factor in our longevity, we can all slow potential medical problems by mere changes in lifestyle. So, if cardiovascular issues are common in your family tree, it should be a warning sign that exercise and healthy eating habits may reduce the chances of that occurring to you. Driving to work early each morning, it is encouraging to observe locals starting their day with a brisk walk. And, in my trips to a local gym it is apparent that more people are starting their day with a workout. There are days I almost want to say “power to you and keep it up.” Medical journals are unanimous in stating smart food choices, a good night’s sleep of seven to nine hours, avoidance of tobacco products and no more than a moderation consumption of alcohol are important factors in longevity. Many non-consumption factors that are often overlooked deal with the mind and include everything from adaptability to change, maintaining a sense of humor, determination, optimism, and maintaining social relationships. It is never too late to take control of your health; so, let’s all make the commitment to do so today and by next September we will be reaping the benefits of a healthier and happier life.

I got him excited about Celebrity IOU.” Barkley still had three years left on his current contract, but that didn’t stop WarnerMedia from making him a priority for an extension. Some are excited to see Barkley take on some new roles on television, while others aren’t so sure.  Barkley will be back on Inside The NBA, where he has worked for more than two decades, for the upcoming 2022-23 season. He was reportedly making $10 million per year for that assignment before this new contract, plus another $10 million in endorsements.

Part of the challenge may be the technology is rudimentary. But the Bensalem venue believes it would be generating more revenue if it weren’t for unregulated skill gaming machines operating throughout the commonwealth. “Pennsylvania Skill” machines are found in various businesses across the commonwealth. The richest casino in Pennsylvania, Parx Casino, contends in a lawsuit that the devices are illegal. (Image: Facebook) Georgia-based Pace-O-Matic (POM) and its Pennsylvania subsidiary, Miele Amusements, are the leading manufacturer and distributor of the controversial gaming terminals. “Pennsylvania Skill,” as the games are branded, look and operate closely to traditional slot machines found inside Pennsylvania’s legal casinos. Skill games have the same spinning reels and ringing sounds as slots, but they differ in that the player must identify a winning payline. A slot machine automatically pays out on a winning spin. Parx Casino, owned and operated by Greenwood Gaming and Entertainment, filed the lawsuit against POM in the Philadelphia Court of Common Pleas. The casino alleges that POM’s products are nothing more than cleverly designed slot machines, and as such, the games are operating outside of the state’s existing regulatory framework on gambling. Lanham Act Allegations Pennsylvania courts continue to mull a lawsuit regarding the legality of POM’s machines. POM argues that since there’s an element of skill involved, the terminals don’t constitute gambling apparatuses, and therefore fall outside the scope of the state’s Gaming Act. Parx attorneys contend that the machines are banned under state law because they are unregulated gambling devices. The casino also alleges unfair competition, tortious interference with a legal, regulated industry, and negligence per se. Parx cited the Lanham Act — also known as the federal Trademark Act of 1946 — in its lawsuit. The Lanham Act is a federal statute of US law that bars activities that infringe on trademarks, trademark dilution, and false advertising. The Pennsylvania Crimes Code makes it illegal to intentionally or knowingly make, assemble, set up, maintain, sell, lend, or lease ‘any slot machine’ except as permitted under the Gaming Act, the State Lottery Law, Bingo Law, or the Local Option Small Games of Chance Act,” attorneys representing Parx Casino alleged in the lawsuit. The lawsuit contends that the Gaming Act defines slot machines to include traditional slot machines along with “skill slot machines” and “hybrid slot machines.” The skill component of POM machines, Parx’s legal team maintains, doesn’t supersede the terminals’ element of chance in determining the outcome. “Pennsylvania Skill-branded slot machines are illegal gambling devices, and they are represented to be games of skill when they are not,” the lawsuit continued. “Consideration is required to play, the machines employ random number generators, there is a reward for successful play, and the results of play are not predominantly determined by skill.” The lawsuit concluded by alleging that skill games are “essentially the same” as licensed slot machines. Costly Decision POM maintains its terminals have been a lifeline for struggling small businesses amid the pandemic. Revenue from the games is split between the host establishment and the manufacturer and distributor. They’re not illegal,” said Michael Barley, chief public affairs officer for POM, last month. “Every dollar that’s made, over 92% of it is staying in the commonwealth, staying in small business.” The machines are not taxed nor regulated to assure players of fair play or a minimum payout, as are casino slots. The Pennsylvania Lottery believes skill games have hurt lottery sales by more than $650 million since 2017. Parx’s lawsuit is seeking financial damages from POM. “As a direct and proximate result of POM’s wrongful conduct, Parx Casino has suffered and will continue to suffer a great risk of financial losses, permanent irreparable harm, and other continuing harm,” the lawsuit ended.

The recipe to start on this path is pretty well documented, if surprisingly accessible. Sleep well. Get up and move. Drink water. Eat fruits and vegetables to get your essential vitamins and minerals. As if. “Grandma has been saying forever to eat our veggies and we still don’t eat our veggies,” said Floyd Chilton, Ph.D., director of the Center for Precision Nutrition and Wellness at the University of Arizona, at the annual Council for Responsible Nutrition (CRN) conference in Phoenix on Oct. 11. “We should have gotten to the point of exhaustion that we are not doing anything to modify that.” Only about one in four Americans consumes the daily recommendation of five to nine fruit and vegetable servings every day. Even that sounds like a bit of a reach—unless you start counting ketchup as a vegetable. The promise and potholes may come from the appeal of scientific investigation. While the mainstream, pharma-based American model may look at nutrition science as a “soft” science, there is no doubt that positive nutrition can both prevent diseases and improve overall vitality. “Essential health is where our dietary guidelines are. We’re not trying to prevent (nutrient deficiency diseases) scurvy and pellagra and beri beri,” said Emili Ho, Ph.D., director of the Linus Pauling Institute, at the CRN conference. “Optimal health is much more than about preventing deficiencies and disease. How do we think about optimal health?” Science can sell. It’s not the end-all and be-all, and sometimes the science gets misinterpreted in the popular press, and sometimes the message is enough to turn consumers all the way off. “The complaint I always hear is the nutritionist says one thing and then says another thing later,” said Barbara Shukitt-Hale, Ph.D., at the Neuroscience and Aging Laboratory at Tufts University. “We need to be consistent over time. Eggs are good for you; eggs are not good for you.” Shukitt-Hale has conducted reams of research, mostly on rats, investigating simple nutritional interventions on aging animals. “All our animal studies showed us that nutritional interventions can reverse deficits in learning and memory and declines in motor behaviors,” she said at CRN’s conference. “These are easily achievable quantities of berry fruits like blueberries and strawberries, which can improve some aspects of cognition in healthy older adults.” Shukitt-Hale said one-half cup to two cups a day of blueberries and strawberries have been shown to reverse some age-related deficits in cognition as well as preserve function among the healthy geriatric set. Sounds easy, right? And yet. “A lot of the time,” said Shukitt-Hale, “the message gets mixed up.” Who’s to bless and who’s to blame? How can the message of simple nutritional intake leading to better lives break through? “It’s like you put six keys in a lock and you have to turn them simultaneously for the lock to open,” said Stephen Lindemann, Ph.D., assistant professor in the department of food science and nutrition science at Purdue University. “So branding is extraordinarily complex.” Maybe a middle-aged shopper is thinking about forestalling chronic diseases, but a young professional is more interested in powering through the afternoon, and a mother just wants to make sure her toddler does not get sick. And certain diverse communities have different health concerns, be it outsized incidence of obesity or diabetes. Lindemann advocates research targeting these groups to make nutrition resonate with those communities. And then, Lindemann says, the onus is on brands to communicate that message. Another way might be to just go stealth with the message because otherwise it might not take. Too many Americans would rather experience the salty crunch of a chip than the crisp sweetness of an apple. And who knows what to do to get a vegetable to taste anything like a burger with bacon? “The approach,” said the University of Arizona’s Chilton, “is to treat everyone like toddlers and hide the veggies. We need to deliver the health benefits in a way that palatability is not impacted. It’s a challenge from a food science perspective, but we need to get vegetables in a product without them being expected and declined.” You have your marching orders.

The new virtual and mixed reality glasses are Meta’s most technologically advanced attempt to popularize the metaverse, a digital environment to which the company, founded by Mark Zuckerberg, has entrusted its future. The biggest novelty of the new glasses is that they work in mixed reality: that is to say, they are capable of integrating three-dimensional virtual objects (that which is seen in virtual reality) into the physical environment surrounding the user. This could be, for example, the avatar of a co-worker sitting across the desk. Or a massively large screen to work on, which could render physical work screens obsolete. It will cost €1,799.99 ($1,746), a considerable hike over the company’s previous model, the Quest 2, which retails at about €400 ($388). Zuckerberg showed off the Quest Pro’s capabilities at Meta Connect, the company’s annual event, while also making another important workplace announcement: Meta has partnered with Microsoft. Satya Nadella, Microsoft’s CEO, explained that the company’s work tools, such as Teams, can be used with the Quest Pro glasses, so the avatars of those who are connected remotely can appear next to the user while they type on their computer. The system will also allow people to share a virtual desk on which papers, documents or models are displayed and that is visible to all participants in the meeting. “We want to create the sense that everyone is present when you’re working with them, even if they’re not really there,” Zuckerberg said. The Quest Pro has a more advanced and compact design than the Quest 2. It also features new technologies, such as an eye-tracking system and another capable of extracting facial expressions so that a user’s avatar represents a more natural and reliable reproduction of the host. These sensors will be incorporated on top of those that Meta’s previous glasses already contain, in addition to all kinds of cameras, microphones and speakers to recreate a fictitious world in the eyes of the wearer. The goggles are also used in conjunction with Meta Quest Touch Pro controllers, a kind of game console controller that allows a user to touch objects in the metaverse. At last year’s Meta Connect conference, Zuckerberg doubled down on his commitment to the metaverse by officially announced that his flagship company, Facebook, would be renamed Meta. What Zuckerberg and his team demonstrated was a mix of test products and recreations of how they hope the metaverse will evolve. The idea is to develop an immersive virtual environment that can be accessed with virtual or mixed reality glasses. In this new world, which Zuckerberg sees as “the logical evolution of the internet,” we will interact with our friends, play video games, work, shop, watch television shows or learn. “Eventually, I’m confident that we will be seen as a metaverse company,” Zuckerberg said. Microsoft is not the only company that has agreed to a deal to join the metaverse. The consulting firm Accenture will work with Meta and Microsoft to design customized virtual workspaces for companies. Meanwhile, Zuckerberg also announced several partnerships in the entertainment industry, including with Universal and Dreamworks, to offer “new audiovisual experiences.” Mark Zuckerberg announced during last year’s Facebook Connect conference that the company’s name would be changed to Meta. In February of this year, Facebook, the jewel in the company’s crown, announced that for the first time since it was launched it is losing users instead of gaining them. Until then, it had been able to compensate for a lack of interest in the platform among young people via huge growth in other countries. Still, Facebook remains the largest social network in the world, with nearly two billion daily active users. In July, Meta posted its first annual revenue drop of 1% over the second quarter a year earlier to $28.8 billion. A few weeks ago, Zuckerberg warned that he was going to freeze hiring, something that has not happened since Facebook was launched in 2004. He also said that various parts of the company would have to be restructured and that in 2023 Meta would probably employ fewer people than it does now, as reported by Bloomberg. Zuckerberg’s company hopes that the metaverse will provide a gateway to Meta for younger users: some popular video games such as Fortnite or Roblox already contain some of the fundamental dynamics of the environment. Meta is also banking on the fact that navigating virtual reality is easier and more intuitive for the generations that have grown up in the digital age than for those who did not.

For nearly four decades Ed was our community’s Mr. Halloween –  the guy who put the haunt into the season by turning his garage into “Harding’s House Of Horrors,”  a haunted house that attracted children and adults from across the community who were looking for a good scare. Ed didn’t charge an admission to go through his haunt, but he did accept free-will offerings that were donated to a local cause or organization, usually the Glenwood Booster Club. During an interview I conducted with Ed about this time last year, he talked about the history of his haunted house and how much it had grown over a nearly 40-year period. “It started with a talking pumpkin,” he said. “We had a lot of fun with that. The trick-or-treaters were talking to it. So, the next year, I thought, ‘Well, I’ll do a little display instead of just a talking pumpkin.’” That “ little display” evolved and grew over the years and eventually became an all-out haunted house featuring not only the ghouls, ghosts, goblins and creepy characters you’d expect to encounter at a haunt, but also some high-tech gadgets and creatures Ed created and installed himself. Last year, he added an awesome smoke-blowing dinosaur dragon. Harding’s House of Horror’s was a traditional Halloween stop for many Glenwood children and families through the years. In addition to staging his haunted house, Ed also established a Halloween photo booth for youngsters who were trick or treating around Glenwood’s Town Square during Square Crow Days. Although there will be no haunted house in Ed’s garage this year, the photo booth tradition will live on at Square Crow Days and the entire event on Saturday, Oct. 22 (9 – 11 a.m.) is being dedicated in his honor. The photo booth will be outside City Hall. “This year, with the blessing of the family, we would like to dedicate the Square Crow Days in honor of Ed. It seems perfectly fitting,” Square Crow Days organizer Emily Prickett said in a recent post on the Friends of Ed Harding Facebook page. The promotional flyer for Square Crow Days says, “We are honored to dedicate this year’s Square Crow Days celebration to Mr. Ed Harding. He loved our community, photography and all things spooky. We always looked forward to him capturing the best moments from this event.” Indeed he did. In fact, Ed captured the best moments from every event he photographed – spooky, athletic or otherwise.

That’s partly because the “reliance of the running of a large portion of the blockchain on a single or small group of cloud service providers becomes a non-negligible risk to consider,” Shah wrote in a note to clients. For instance, 65% of ethereum’s (ETH-USD) nodes are hosted by a cloud provider, with Amazon Web Services accounting for half of them, the note said. And problems could emerge if service providers decide to censor certain participants or crypto products, or if there are lengthy server outages. “The crypto ecosystem has evolved over recent years with many applications, code, services and companies feeding into the underlying decentralized blockchains, which we would argue is causing parts of the broader crypto ecosystem to become less decentralised and more dependent on individual services,” Shah explained. As part of ether’s (ETH-USD) centralization issue, 60% of the blockchain’s validators are managed by just four companies, Shah pointed out. Note that since ether’s transition to Proof-of-Stake from Proof-of-Work in mid-September, transactions have been approved by validators, canceling out the need for miners as part of the software update. Another reason why the crypto world is becoming less decentralized is because the ecosystem has developed crypto-focused, regulation-friendly products that attract users, hence it’s “starting to look more like the centralised banking world,” the note said. TradFi is simultaneously rolling out crypto products to offer services such as custody for their clients. The Bank of New York Mellon (BK), for example, recently allowed some of its U.S.-based clients to hold and transfer bitcoin (BTC-USD) and ether (ETH-USD). The justices heard arguments in the Andy Warhol Foundation’s appeal of a lower court’s ruling that his 1984 paintings – based on a 1981 photo of Prince that celebrity photographer Lynn Goldsmith shot for Newsweek magazine in 1981 – were not protected by a copyright law doctrine called fair use. This doctrine permits unlicensed use of copyright-protected works under certain circumstances. The justices over nearly two hours pressed attorneys representing both sides and President Joe Biden’s administration, seeking clear answers to complex questions about when art can legally take from other works. A key factor courts consider in determining fair use is whether it has a “transformative” purpose such as parody, education or criticism. Some justices expressed skepticism of a lower court’s ruling that judges should not consider the meaning of an artistic work in determining fair use, but also wondered whether Warhol’s work was transformative. “The purpose of all copyright law is to foster creativity,” liberal Justice Elena Kagan said. “So why shouldn’t we ask,” Kagan added, if a work is really creative and “something new and entirely different?” Questions and answers during the arguments touched upon a wide range of artistic creations, from Leonardo da Vinci’s 16th century Mona Lisa painting, director Steven Spielberg’s 1975 film “Jaws,” the 1970s and 1980s TV shows “All in the Family” and “The Jeffersons” and even Syracuse University sports merchandise. The dispute over where to draw the line between inspiration and misuse has drawn broad interest for its implications for artists and the entertainment industry more broadly. Warhol, who died in 1987, was a central figure in the pop art movement that arose in the 1950s. He often created silkscreen print paintings and other works inspired by photos of famous subjects and commercial products – work that has considerable artistic and monetary value. For instance, Warhol’s 1964 silkscreen portrait of actress Marilyn Monroe was purchased for $195 million in May, setting a record for a work by an American artist sold at auction. Warhol made 14 silkscreen prints and two pencil illustrations inspired by Goldsmith’s photograph. Goldsmith, 74, has said she learned of Warhol’s unlicensed works only after Prince’s 2016 death. She countersued Warhol’s estate for copyright infringement in 2017 after it asked a Manhattan federal court to rule that his works did not violate her rights. A federal judge found Warhol’s works were protected by the fair use doctrine, having transformed the “vulnerable” musician depicted in Goldsmith’s work into an “iconic, larger-than-life figure.” In reversing that ruling last year, the Manhattan-based 2nd U.S. Circuit Court of Appeals said judges should not “assume the role of art critic and seek to ascertain the intent behind or meaning of the works” but instead should decide whether the new work has a “fundamentally different and new artistic purpose and character” that “stands apart from the ‘raw material’ used to create it.” The Supreme Court has not ruled on fair use in art since 1994, when it found that rap group 2 Live Crew’s parody of singer Roy Orbison’s “Oh, Pretty Woman” made fair use of the 1960s song. Biden’s administration has backed Goldsmith, as have trade groups for the recording industry, actors and publishers. Documentary filmmakers, fan fiction writers and the estates of other major figures in the pop art movement have come out in support of Warhol. A ruling is due by the end of June. First: ‘Responsible social media’ council looks to bridge divides on tech Public officials in Washington for years have sparred along partisan lines over whether social media platforms take down too much or too little hate speech and misinformation.  A council launching this week aims to sidestep those disputes by proposing reforms that tackle issues of bipartisan concern, including children’s safety and national security. The newly minted Council for Responsible Social Media, set up by the nonpartisan nonprofit Issue One, features a wide-ranging and influential lineup of former U.S. lawmakers and federal officials, advocates, scholars, industry leaders and whistleblowers.  They include former Democratic House majority leader Dick Gephardt, former defense secretary and White House chief of staff Leon Panetta, former Jan. 6 House select committee adviser and Republican congressman Denver Riggleman, former Google ethicist and Center for Humane Technology co-founder Tristan Harris and Facebook whistleblower Frances Haugen.  “This is not a think tank. This is an action tank,” Gephardt told The Technology 202. “We want to see results.”  The group is staking out three initial areas of focus: how social media platforms may adversely affect children’s mental health, how they can be weaponized by foreign adversaries to the detriment of U.S. national security and how they may exacerbate societal divisions.  “The core goal of the commission is to really show that there are bipartisan paths forward … that involve having companies have to actually talk about what is their role in society,” Haugen said in an interview. Haugen said the council can move the debate around social media accountability forward by focusing on areas of “common ground,” like concerns around algorithmic amplification, transparency and platform design choices.  Haugen said proposals the council might explore include giving users, particularly children, the option to “reset algorithms” so they do not keep wandering down the same risky “rabbit holes.” By focusing on systemic issues, she said, the group might be able to help build support for ideas that sidestep thorny speech debates. The council has received roughly $250,000 in funding collectively from the Omidyar Network, the Newton and Rochelle Becker Charitable Trust and the Wend Collective, according to Issue One spokesperson Cory Combs. Combs said the council has not received direct funding from any tech companies. Some of the members, including Gephardt and Panetta, have ties to firms that have represented industry giants.  The Omidyar Network, a philanthropic venture launched by eBay founder Pierre Omidyar, has pushed for greater regulation of the tech giants. The Newton and Rochelle Becker Charitable Trust is a foundation that describes itself as a “support organization” for Jewish communities. The Wend Collective is a philanthropic group launched by Walmart magnate James Walton. The council may also rally around legislation that already has bipartisan support, such as recent Senate bills on kids’ online safety and platform transparency, Haugen said. One of those proposals, the Kids Online Safety Act, would give parents greater control over their children’s online activity and require that platforms give kids the option to opt out of algorithmic recommendations and other potentially harmful features. The other, the Platform Accountability and Transparency Act, would force companies to turn over data about their services to researchers, or face fresh liability threats if they don’t. Both proposals have bipartisan support, and the children’s safety bill advanced out of committee in the Senate with broad backing. But neither has a counterpart in the House, and the latter hasn’t been formally introduced, signaling they may both still face a long path to passage.  The council is also poised to shine a brighter spotlight on how U.S. companies may be playing into the hands of foreign adversaries — scrutiny that has largely focused on TikTok, owned by Beijing-based tech giant ByteDance. The council includes a slew of national security heavyweights, including former defense secretary Chuck Hagel, former CIA director Porter Goss and former Cybersecurity and Infrastructure Security Agency director Chris Krebs. Haugen said one concept the group may explore is requiring “consistent reporting” by companies about how much they are investing to counter foreign influence operations.  The group is launching ahead of a summit in Washington on Thursday, where it plans to lay out a “plan of action for the months and years ahead,” according to a release. Uber, Lyft, DoorDash shares drop after Biden administration announces gig worker rule The new proposal would require gig firms to consider workers as employees when they’re “economically dependent” on the company, Rachel Lerman reports. The share prices of Uber, Lyft and DoorDash slid on the news. Uber said the Labor Department listened to drivers, and argued that drivers prefer the “flexibility” of being independent contractors. Lyft said it would return gig firms to similar rules from the Obama administration, which “did not result in reclassification of drivers.” The AFL-CIO and Gig Workers Rising praised the proposed rule, but some critics said it didn’t go far enough. Officials at federal regulators invested in tech stocks More than 1 in 5 top federal officials disclosed investments in firms that were lobbying their agencies, the Wall Street Journal’s Rebecca Ballhaus, Brody Mullins, Chad Day, John West, Joe Palazzolo and James V. Grimaldi report. “While the government was ramping up scrutiny of big technology companies, more than 1,800 federal officials reported owning or trading” stock in Amazon, Apple, Facebook or Google, they write. “More than five dozen officials at five agencies, including the Federal Trade Commission and the Justice Department, reported trading stock in companies shortly before their departments announced enforcement actions, such as charges and settlements, against those companies.” Some agencies waived rules when the investments caused a conflict. In most cases that the Wall Street Journal identified, ethics officials said employees complied with ethics rules, which have some exceptions allowing officials to hold stock in firms that conflict with their agencies’ work. Meta pitches the metaverse to corporate America with its new VR headset The company’s new $1,500 virtual-reality headset will be integrated with ubiquitous Microsoft products, but it’s not clear if that’ll be enough to sway firms to Meta over Apple and TikTok parent ByteDance, which offer or are expected to release their own technology, Naomi Nix reports. Meta has significantly invested in chief executive Mark Zuckerberg’s vision of the metaverse as a place where virtual-reality experiences transform people’s lives. “The biggest impediment to Meta’s plans doesn’t have an easy fix: The technology required to accomplish some of Meta’s biggest ambitions for its VR devices is, by its own admission, still years away,” Naomi writes. “Even if Meta manages to continue elbowing out its headset competitors, there is no guarantee that most people will want to don the headsets and spend their lives in a virtual world.” Avatars in the Meta metaverse will soon have legs. The conference started as an idea among young business professionals attending a social mixer during the State of theTribes Address earlier this year in Madison. With success at the mixer, a conversation continued among Rob Pero (Bad River Ojibwe), Collin Price (Ho-Chunk Nation), and Zoar Fulwilder (Salt River Pima) to create a Tribal business professional group to host similar events in the future. The trio founded IBG in July 2022 as a 501(c)(6) tax-exempt organization that works similarly to a chamber of commerce, with a focus on improving business conditions for Indigenous businesses in Wisconsin. “Politics and bureaucracy aside, we’re going to shift the paradigm of elevating Native talent through IBG,” Pero told Native News Online. The inaugural Indigenous Biz Con event is designed to be a much-needed catalyst for Indigenous people, but is also inclusive to non-Indigenous supporters. The funds raised from the conference will continue to help IBG promote Indigenous-owned businesses and for future events. Wisconsin has another business entity that has been a champion for Wisconsin’s American Indian owned businesses—the American Indian Chamber of Commerce of Wisconsin (AICCW). One of its founders and longtime president, Craig Anderson, passed away in December 2020 and AICCW has been reorganizing since. Anderson was recognized at the Indigenous Biz Con conference by several speakers who acknowledged his mentorship. A portion of the proceeds of the conference will be contributed to AICCW, according to the event’s organizers. The conference included panels discussing energy development in Indian Country, developing Tribal healthcare infrastructure, and financing and lending opportunities for small businesses in Indian Country.  Other topics of discussion included the diversification of Tribal economies, the emerging cannabis industry and Indigneous women in business. Sterlin Harjo, co-creator and showrunner of Hulu’s “Reservation Dogs” was scheduled as the conference’s keynote speaker, but canceled because he was diagnosed with Covid-19. Cue a new round of complaints about “money grubbing” and “nickel and diming.” “Every time this happens, fans go online to vow that they won’t return to Disney again,” Robert Niles, editor of Theme Park Insider, said in an email. “And maybe they don’t, but plenty of other visitors do keep coming to the parks, allowing Disney to keep bringing in more and more revenue. I expect this price increase to result in the same.” Disney’s parks in Florida and California rolled out new prices on Tuesday for the Genie Plus service, which allows guests toavoid lengthy waits. How much will the cost go up? That depends where you’re going, which day you’re visiting and — in California — when you buy the add-on. At Walt Disney World in Florida, the world’s busiest theme park complex, the price used to be $15 regardless of the day. For October, the cost will vary between $15 and $22, depending on how busy the four parks are on a particular day. After this month? No one is saying. Admission has been based on demand for several years, with the slowest days priced at $109 for a one-day, one-park ticket and busier dates climbing to $159; those prices did not change in Florida. That means a family buying tickets for a visit in the slow season in late August can expect to pay far less than someone visiting during the popular winter holidays. The company encourages guests to check the My Disney Experience app on the day of their visit, which is the only time Florida guests can purchase Genie Plus. That means park goers there won’t know how much they’ll need to spend until they’re on vacation — though steeper admission on busy days could be a hint that the service will also be on the pricier end. Disney charges for faster access to a handful of its most popular rides separately from Genie Plus; those “individual Lightning Lanes” were already priced variably. Deadline reported that the price range to skip the lines of some of those attractions would expand to include higher fees on busier days. That’s up from $20. The Los Angeles Times reported that the price will be $25 when purchased with a ticket or package in advance but variable when visitors buy it after entering the park. Disneyland also increased the price of admission on its busiest days to $179. The L.A. Times said the highest-priced ticket was previously $164; the paper reported that a two-day ticket that used to cost $255 is now $285. “I’m not surprised by these price increases,” Len Testa, president of the theme-park trip-planning site Touring Plans and co-author of the Unofficial Guides to Walt Disney World and Disneyland, said in an email. “Disney CEO Bob Chapek’s comments on the last earnings call and subsequent investor meetings were pretty clear: they’re going to increase prices until demand falls off.” Disney parks, experiences and products reported $7.4 billion in revenue for the quarter that ended July 2, a 70 percent improvement from the previous year. It was $7.2 billion in the first fiscal quarter, when Chapek said the company’s domestic parks and resorts “achieved all-time revenue and operating income records despite the omicron surge.” During an earnings call in August, Chapek said about half of the people who visit the parks “buy up” to the product. First up to disturb the market from its slumber is the US PPI data, a measure of inflation at the factory gate.  Any sign of cooling will be treated as confirmation of the need for the Fed to ease off on interest rate rises. Such an outcome would light a fire under stocks and crypto prices. Conversely, if producer price inflation continues to heat up, then expect risk assets to resume their sell-off.  PPI inflation comes in lower than August reading Well the data is in and Core PPI month-on-month rose at double the level expected, by 0.4% as opposed to the 0.2% forecast.  Meanwhile, year-on-year headline PPI was 8.5%, hotter than the 8.4% forecast, although that is down from 8.7% in the previous month (August) – and that last point seems, initially, to be the key takeaway for the market. As such, reaction so far is fairly positive – Bitcoin remains largely unchanged, but could move higher if equities can pick up some positive momentum.  BTCUSD 15 min candles, 12 October, Source: Messari The S&P 500 is up 0.2% to 3595, the Dow 61 points higher and the Nasdaq 0.38% the better at 10468.  Elsewhere, the UK 30-year government bond sell-off has picked up, with yields accelerating upwards 23 basis points to 5.00% (more on the UK financial crisis below) But the PPI data is the warm-up act for the main show, which is the US consumer price index (CPI) inflation data release on Thursday. FOMC minutes could stir up the crypto market However, even before those hotly anticipated numbers are released, market participants will be provided with plenty to ruminate over when the Federal Open Market Committee (FOMC) releases the minutes from its 21 September meeting at 18:00 UTC. The minutes will likely show that there is a firming consensus around the need for a 75 basis points rates hike in November.  Fed watchers will be looking for any changes of language that could be interpreted as either a hardening of hawkishness or a willingness to pivot away from such a trajectory, should incoming data indicate that inflation might be starting to weaken. An area of possible disagreement though, or at least a lack of alignment, will be over the terminal rate – in other words the rate which will mark the peak of the hike cycle. According to Refinitiv data, the consensus forecast for the terminal rate now stands at 4.45%, way-off the earlier projections made in August that targeted 3.7%. The date for the terminal rate is assumed to be the 22 March 2023.  Any hints at the terminal rate coming later than expected and at a higher level will prompt selling in both the stock and crypto markets. Some economists think the terminal rate will be nearer 5%. Either way, the FOMC minutes could throw some light on the thinking of its members.  Bitcoin is holding its value better than UK government inflation-linked bonds right now Perhaps the most striking observation to be made on market conditions in crypto over the past few weeks, has been the relatively stability, especially when appraised alongside that of other asset classes. Take UK government bonds for example, where the trauma in those markets continues, perhaps coming to ahead on Friday when the Bank of England says – although the signals are confusing the market – that it will end its bond purchase at the long end of the curve (30-year bond maturities). Take a look at this chart from a recent Financial Times story:  The chart shows the bitcoin price is down 67% since November 2021 but the UK inflation-linked maturing in 2073 is down nearly 80%.  That is an amazing juxtaposition. It underlines how a maturing bitcoin market actually competes well in the volatility stakes up against previously solid asset class instruments such as UK inflation-linked government bonds, or ‘linkers’ as they are known. Bitcoin volatility may spike soon, but overall volatility is on a declining trend Our second point to consider is the weakening volatility of the bitcoin price.  This of course matters because volatility is another way of expressing risk – and it is becoming less risky to hold bitcoin. We can see this in the descending peaks of the Bitcoin Volatility Index illustrated by the orange line on the chart below (the two down spikes are explained by missing data):  How will the FOMC minutes and inflation data play into the bitcoin’s ongoing bottom formation? And what we all want to know is how might the news from the economic statisticians and the Fed feed into the calculations as to whether the bitcoin price is near its bottom? On that, the bitcoin accumulation trend score might help to clarify matters. It is a relatively new (March 2022) Glassnode metric and here is a helpful definition: The Accumulation Trend Score is an indicator that reflects the relative size of entities that are actively accumulating coins on-chain in terms of their BTC holdings. The scale of the Accumulation Trend Score represents both the size of the entities balance (their participation score), and the amount of new coins they have acquired/sold over the last month (their balance change score). An Accumulation Trend Score of closer to 1 indicates that on aggregate, larger entities (or a big part of the network) are accumulating, and a value closer to 0 indicates they are distributing or not accumulating. This provides insight into the balance size of market participants, and their accumulation behavior over the last month. If you want to get a bit deeper into the metric, watch this video: What is notable about the chart is the possible repeat today in the bottom formation pattern seen at the end of 2018 and first quarter of 2019. Here’s the annotated Glassnode chart:  Glassnode highlights, among other things, how “the Accumulation Trend Score for whales holding 1k-10k BTC highlights aggressive accumulation since late September”: In our current market structure, and noting an approximate 10x in BTC prices, we can see very similar behavior occurring in large entities, however driven more so by the 100-1k BTC cohort during the August rally. In addition to the relative neutrality across small to medium-address cohorts, the Accumulation Trend Score for whales holding 1k-10k BTC highlights aggressive accumulation since late September. Whales owning 10K BTC are biased towards weak distribution over recent months. A closer look at the two periods is shown below: If the apparent fractal is the right interpretation, then whatever happens in terms of near-term volatility, bitcoin is in a good place.  Cost-averaging into the market under the $20k level could be a relatively good entry point, especially if you are buying the BTC/GBP pair. Portfolio diversification – go green And it you fancy fishing among some of the up and coming altcoins, a good diversifier if you already hold bitcoin might be a green eco-friendly crypto such as IMPT, which is currently on presale.  It is worth a mention because it is the only coin out there that is targeting shoppers by enabling them to offset their carbon footprint.  The presale allocation is selling at an impressive clip, with $3 million worth of tokens snapped up in a week, but do your own research.

Despite the mixed report from the Labor Department on Wednesday, inflation remains stubbornly high, likely compelling the Federal Reserve to raise interest rates by 75 basis points next month for the fourth time this year. “Inflation is all about pass-through costs at the lower level of production so this report counts as some relief for beleaguered consumers who face runaway inflation on the goods sitting on store shelves,” said Christopher Rupkey, chief economist at FWDBONDS in New York. Data for August was revised lower to show the PPI falling 0.2% instead of dipping 0.1% as previously reported. Economists polled by Reuters had forecast the PPI rising 0.2%. A 0.4% rise in the price of services accounted for two-thirds of the increase in the PPI in September. Services climbed 0.3% in August. More than a quarter of the rise in September was driven by a 6.4% surge in hotel and motel accommodation prices. There were also increases in the costs of food and alcohol retailing, portfolio management, machinery and vehicle wholesaling, oil and gas well drilling services as well as hospital inpatient care. But prices for long-distance motor carrying fell as did fuels and lubricants retailing and consumer loans. Goods prices increased 0.4% after declining 1.1% in August. A 1.2% jump in the price of food accounted for 60% of the increase in goods. Food prices were boosted by a 15.7% surge in the cost of fresh and dry vegetables. There were also increases in the prices for chicken eggs and pork. Energy prices rose 0.7%, driven by diesel fuel, residential natural gas and home heating oil. Excluding food and energy, goods prices were unchanged. This was the weakest reading for the so-called core goods since May 2020. U.S. stocks opened higher. The dollar rose against a basket of currencies. U.S. Treasury prices were mixed. SUPPLY CHAINS EASING In the 12 months through September, the PPI increased 8.5% after advancing 8.7% in August. The moderation in annual producer inflation is being driven by an easing in supply chain bottlenecks as well as a retreat in commodity prices from the highs seen in the spring. But oil and gasoline prices have likely bottomed following last week’s decision by the Organization of the Petroleum Exporting Countries and allies to cut crude production. Data on Thursday is likely to show consumer prices picking up in September, according to a Reuters survey of economists. Financial markets have almost priced-in a rate hike of three-quarters of a percentage point at the Fed’s Nov. 1-2 policy meeting, according to CME’s FedWatch Tool. The Fed has since March raised its policy rate from near zero to the current range of 3.00% to 3.25%. Excluding the volatile food, energy and trade services components, producer prices also rose 0.4% in September. The core PPI increased 0.2% in August.
