It was part of Binational Health Week, which for the past 22 years has bridged the gap between local health providers and the immigrant community. “Basically, what we do here is take their blood pressure, offer different tests so if they have any problems, they can be referred to low-cost clinics or hospitals or we can help them navigate the insurance system,” said Consul General Mauricio Ibarra Ponce de Leon. Twenty-one El Paso hospitals, nonprofits and insurance companies are partnering with the consulate to promote healthy living. The El Paso Food Bank donated 200 boxes with food staples that were distributed to participants in a Tuesday health fair in the consulate’s parking lot. Ibarra said talks about cancer, high blood pressure, mental health and others would take place throughout the month in Spanish online and in-person at the consulate. The U.S. Census July 2021 population estimate shows that nearly one in four El Paso County residents were foreign-born, and that 69.8 percent speak a language other than English at home. Those numbers make the consulate a key player in community health education. “We need to raise awareness of the importance of having good physical and mental health and that everybody knows they can reach out to a health provider regardless if they have insurance or not,” Ibarra said. All of Mexico’s 50 consulates in the United States are observing Binational Health Week, though some may have it on a different date. Maria Estrada (Border Report photo) Maria Estrada, a Mexican national who says she has lived in El Paso for many years, was among the first in line at the screening tents. “I’m here for the tests, medical insurance information, everything they have here,” she said. Others came for the flu and COVID-19 shots and the free foodstuffs. “This is the first time I come to these fairs. I came here for the flu vaccine. I have all the COVID vaccines and all,” said Ana Lilia Perez.

The government wants to do it itself. In an answering brief filed with the US District Court of Appeals, DC Circuit, government lawyers essentially told the Seminole Tribe’s legal team and court, “we got this,” asserting that it alone could handle the slow-moving process. Government lawyers put forth that the Seminole Tribe, although it has attempted to become an intervening party and filed an amicus brief supporting the DOI appeal, is not an “indispensable party” in the litigation. The Seminoles offered legal sports betting in Florida last November through their Hard Rock Digital app, but a lawsuit brought by a group of pari-mutuels led to the shutdown. Feds Seek to Go it Alone in District Appeals Court In its answering brief, the government used two routes to cleave the Seminoles from the appeal process. First, lawyers cited the Administrative Procedure Act, which asserts that the government is generally the only indispensable party in such cases. Secondly, it invoked Rule 19a of the Federal Rules of Civil Procedure, claiming that the appeals process can “accord complete relief” in the mutual interests of the Seminole Tribe and government without tribal legal teams involved. Said government lawyers’ brief: “While the federal government and the Tribe both seek reversal, the Tribe’s preferred path is in tension with circuit precedent and, if adopted, could functionally nullify the APA’s waiver of federal sovereign immunity in the wide swath of cases where federal agency action benefits a tribe or state that cannot be joined to litigation without consent. Thus, while this Court should reverse for the reasons stated in the government’s appeal, the district court’s denial of the Tribe’s motion should not be disturbed.” The filing of further paperwork is scheduled through November, meaning any decision could carry well into 2023. Legal and gambling observers inside and out of one of the top remaining parcels of sports betting real estate in the United States are beginning to agree that sports betting in Florida is unlikely before 2025. The Department of the Interior allowed the compact to pass into law by letting a 45-day assessment period lapse. DOI eventually issued a set of opinions on the compact, looking unfavorably on the marketing agreements the Seminoles were required to offer the state’s pari-mutuel outlets, but saying that Native American gambling operations shouldn’t be constrained by an Indian Gaming Regulatory Act that pre-dated the opportunities provided by mobile and Internet technology. The case has become a national curiosity because of its potential to influence the future of tribal gaming. Government Filing Another Step in Lengthy Process Unless the Appeals Court reverses course on a compact Judge Dabney L Friedrich invalidated as a “legal fiction,” the state and Gov. Ron DeSantis would be sent back to the proverbial drawing board. The Seminole Tribe would seemingly be inspired by recouping the right to offer craps and roulette — which were also a part of the 2021 compact — and retail sports betting. The state would seemingly be motivated by the $2.5 billion in revenue share payments through the first five years of the deal that the invalidation has cost Florida. Legalizing sports betting off tribal lands, and most importantly via mobile, would become an issue for state legislators again and certainly cue a massive lobbying and advertising effort from sportsbook operators hoping to launch in a state of nearly 22 million. The disparate makeup of the Florida electorate and marshaled anti-gambling groups and laws — and DeSantis’ expected run for the Republican nomination for president — would not suggest a fleet or friction-free process.

Qualcomm: Battle Of The Metaverse Chipmakers – Seeking Alpha https://clarkcountynewsnow.com/nvidia-vs-qualcomm-battle-of-the-metaverse-chipmakers-seeking-alpha/ photoman Thesis The metaverse, according to McKinsey is estimated to claim a market size of $5 trillion by 2030, and semiconductors are poised to play a key role in building the necessary infrastructure — be it for data communication, graphics or computation. In my opinion, there are two major semiconductor companies that lead innovation in this field: Qualcomm (NASDAQ:QCOM) and Nvidia (NASDAQ:NVDA). Both NVDA and QCOM shares are down significantly YTD, almost 60% for NVDA versus about 40% for QCOM. Thus, it might be tempting to start considering buying the dip. But which one of the metaverse chipmakers should you pick? Seeking Alpha In this article I will discuss whether an investment in Nvidia or Qualcomm is preferable, comparing the two firms with regards to (1) products and technology, (2) growth, (3) profitability and (4) valuation. 1. Technology & Products Both Nvidia and Qualcomm have strong exposure to secular trends in connection to the next-generation internet, or in other words, the metaverse. But their associated technology differs somewhat. Nvidia To simplify, Nvidia is well positioned to grow alongside the metaverse-related gaming industry, or better the experience industry, by providing solutions for AI cloud-computing and 3D visualization technology. Notable highlights of Nvidia’s product portfolio include (not exhaustive): GeForce GPUs to power a cutting-edge gaming experience; GeForce NOW to support computing-power intensive game streaming services and related infrastructure; and GPU software to support cloud-based visual and virtual computing. Moreover, one of NVIDIA’s most interesting ‘metaverse products’ is the company’s ‘Omniverse’ software, which is a cloud-based development framework for the creation of 3D immersive and virtual worlds. The ‘Omniverse’ platform allows for real-time photorealistic visualizations and incorporates AI for supporting lifelike simulations. Nvidia Qualcomm Qualcomm, on the other hand, is focused on supporting the necessary infrastructure for wireless low latency data communication — which will be absolutely key for the metaverse experience. Notably, Qualcomm’s Snapdragon chipset currently powers most, if not all, AR/VR devices, including Meta’s (META) Oculus Quest and Lenovo’s Mirage Solo. In September 2022, the company has announced a strategic partnership with Meta Platforms to customize chipsets for VR/AR technologies. Mark Zuckerberg commented: We’re working with Qualcomm Technologies on customized virtual reality chipsets — powered by Snapdragon XR platforms and technology — for our future roadmap of Quest products Moreover, QUALCOMM has launched a $100 million investment fund dedicated to XR technologies, which aims to: … accelerate the Metaverse content ecosystem and the next generation of spatial computing … … for developer ecosystem funding in XR experiences such as gaming, health and wellness, media, entertainment, education, and enterprise. Finally, Qualcomm also enjoys exposure to 5G, artificial intelligence, automotive, consumer, enterprise, cloud, and IoT — technologies that are likely going to have an indirect connection to the metaverse infrastructure and experience. 2. Growth As a function of the product portfolio, it is arguably enormously difficult to derive a conclusion which company has a stronger growth outlook. And accordingly, readers should acknowledge this section with a healthy dose of skepticism and independent thinking. Personally, I believe Qualcomm is in a better position to experience a near-term growth acceleration on the backdrop of the 5G rollout and higher VR technology adoption. Nvidia’s technology and value proposition, on the other hand, builds on the precondition that the infrastructure for 5G and low latency data communication has been broadly accepted. Accordingly, I believe that Nvidia’s growth might be a little bit more deferred and speculative. Looking at the past 5 years, Qualcomm and Nvidia have grown at a similar rate. Nvidia has grown at an annual compounded growth rate of 25%, while Qualcomm has expanded revenues at a 22.5% CAGR. According to analyst consensus estimates, which project revenues until 2025, expect that both companies will grow at an estimated 20% – 25% (Source Bloomberg). This expectation could be reasonable, in my opinion, if risk-taking (innovation and technology R&D) is accepted by the economy with a similar enthusiasm as it has been in the past decade, on the backdrop of low interest rates and strong valuation multiples for growth assets. But with rising real yields and falling asset prices, growth in the technology sector will likely be somewhat lower. So, in my opinion, investors are well advised to estimate a topline expansion for Nvidia and Qualcomm somewhere between 15% – 20%. 3. Profitability Nvidia and Qualcomm are both highly profitable and claim margins that rival the profitability of the leading FAANG tech companies. But in context of a head-to-head relative comparison between Nvidia and Qualcomm, I am struggling to derive an insightful takeaway. This comparison is perfectly balanced, in my opinion. For the trailing twelve months, Nvidia has managed to claim a gross profit margin of 60%, which is 20% higher than what is the median for the technology sector. Qualcomm’s gross margin was 58% respectively, which is about 16% above the sector median. However, operating income margin (EBIT, TTM reference) is 35.8% for Qualcomm and thus higher than the respective 31.5% for Nvidia. There is also no clear takeaway which company operates more capital efficient. It is true that Qualcomm enjoys a return on total assets (TTM reference) of about 27.4%, as compared to 17.8% for Nvidia. But Nvidia generates $344,460 of net income per employee versus $285,800 for Qualcomm. Nvidia Seeking Alpha Qualcomm Seeking Alpha 4. Valuation Given that both Qualcomm and Nvidia post competitive size, growth and profitability, an investor would expect that the two companies trade at a similar valuation. But this is very far from the reality. Nvidia trades much more expensive. According to data compiled by Seeking Alpha, Qualcomm is valued at a one-year forward P/E of x9, while Nvidia’s one-year forward P/E is x36. Consequently, the P/E multiple implies a 40% sector valuation discount for Qualcomm, versus a 114% respective premium for Nvidia. The argument of a valuation dispersion can be made for all relevant multiples, including P/S and P/B. Enclosed is some more data. Nvidia Seeking Alpha Qualcomm Seeking Alpha Conclusion To sum up the situation, as I see it, both Nvidia and Qualcomm are very competitive with regards to their technology, growth outlook, and profitability. But Qualcomm is clearly trading cheap, while Nvidia is not. Moreover, the valuation dispersion is highly significant, as investors should consider that the attractiveness of every investment opportunity must be a function of the price. On the daily timeframe, Cardano has closed a strong green candle, indicating a strong possibility of a bullish reversal. However, a hybrid of mixed fundamentals is limiting ADA’s upside. Nevertheless, its market capitalization of nearly $14.8 billion places it in the top 10 cryptocurrencies. Claims have been made that Cardano’s architecture makes it more efficient at running smart contracts than Ethereum. After all, ADA network creator Charles Hoskinson helped build the infrastructure for the cryptocurrency generally regarded as the “king of all altcoins.”  Hoskinson ensured that his improvements to Cardano’s smart contract performance would be as effective as possible. However, it appears that this progress will not be enough to spur the growth of the digital currency, as its price remains relatively low. After the fork, people still felt optimistic since the network kept working normally. Now that everything seems to be running smoothly with Vasil, Cardano’s creator Charles Hoskinson said on October 3 that the next phase, the age of Voltaire, was on the horizon. According to a tweet by Hoskinson, the new age is designed for network builders and users. He claims Cardano’s goal is to create decentralized governance that will show the rest of the industry how to do it properly. Cardano Price Prediction – Is ADA Preparing for a 100% Move? With such strong fundamentals, demand for Cardano is increasing, and the ADA/USD price is likely to rise. The ADA/USD has shaped a descending triangle pattern, with support extending near $0.4181. Because descending triangles are more likely to break on the lower side, the $0.4181 level should be monitored closely.  A break below this level may result in downward pressure, causing the ADA price to fall to an immediate support level of $0.3678. If the ADA/USD coin remains above $0.4180, the triple bottom support level may rise further towards $0.4850. A downward trendline at $0.4850 on the daily timeframe may obstruct Cardano’s upward movement. On the other hand, increased demand for Cardano could break through this level and extend the uptrend until $0.5275 or $0.5835.  Leading technical indicators such as the RSI and MACD remain below 50 and 0, indicating a bearish trend in Cardano, respectively. In contrast, the 50-day moving average will likely keep the ADA price below $0.4660. As a result, Cardano will face significant difficulties in reaching $1.  The ADA/USD pair has the potential to move 40% above $0.4180 if it breaks through the $0.4660 level. On the other hand, a breakout of $0.5275 and $0.5835 may increase the chances of a 100% move above. Trump filed an emergency request asking the justices to block part of a lower court’s ruling that prevented an independent arbiter requested by Trump, known as a special master, from vetting more than 100 documents marked as classified that were among 11,000 records seized by FBI agents at the Mar-a-Lago estate in Palm Beach on Aug. 8. read more The Atlanta-based 11th U.S. Circuit Court of Appeals on Sept. 21 repudiated a decision by U.S. District Judge Aileen Cannon, who had temporarily barred the department from examining the seized classified documents until the special master had weeded out any that could be deemed privileged and withheld from investigators. Trump’s lawyers in Tuesday’s filing said Dearie should have access to “determine whether documents bearing classification markings are in fact classified, and regardless of classification, whether those records are personal records or presidential records.” The Justice Department has “attempted to criminalize a document management dispute and now vehemently objects to a transparent process that provides much-needed oversight,” Trump’s lawyers added. The court-approved Mar-a-Lago search was conducted as part of a federal investigation into whether Trump illegally retained documents from the White House when he left office in January 2021 after his failed 2020 re-election bid and whether Trump tried to obstruct the probe. The investigation seeks to determine who accessed classified materials, whether they were compromised and if any remain unaccounted for. At issue in the 11th Circuit ruling were documents bearing classified markings of confidential, secret or top secret. Cannon, presiding over Trump’s lawsuit seeking to restrict Justice Department access to the seized documents, barred review of all of the materials and named Dearie to review the records, impeding the investigation. On Sept. 15, Cannon, who was appointed to the bench by Trump, rejected the Justice Department’s request that she partially lift her order on the classified materials as it impeded the government’s effort to mitigate potential national security risks from their possible unauthorized disclosure. The three-judge 11th Circuit panel included two judges appointed by Trump and one by former President Barack Obama. Noting that classified records belong to the U.S. government, the 11th Circuit doubted Trump has any “individual interest” in them and that he “has not even attempted to show that he has a need to know the information contained in the classified documents.” The 11th Circuit also rejected any suggestion that Trump had declassified the documents – as the former president has claimed – saying there was “no evidence” of such action and that the argument was a “red herring because declassifying an official document would not change its content or render it personal.” In Tuesday’s filing, Trump’s attorneys said he had “broad authority governing classification of, and access to, classified documents.” In an interview on Fox News last month, Trump again asserted without evidence that he declassified the documents and claimed he had the power to do it “even by thinking about it.” The three statutes underpinning the search warrant used by the FBI at Mar-a-Lago make it a crime to mishandle government records, regardless of their classification status. Cannon had tasked Dearie to review all of the seized materials, including classified ones, to identify anything subject to attorney-client confidentiality or executive privilege – a legal doctrine that shields some White House communications from disclosure. The document investigation is one of several legal woes Trump is facing as he considers whether to run again for president in 2024. New York state’s attorney general last month filed a lawsuit accusing Trump and three of his adult children of fraud and misrepresentation in preparing financial statements from the family real estate company. NFL.com Ranking: 10 Previous: 3 Analysis: The Dolphins lost for the first time this season against the Bengals on Thursday Night Football, but the story after the game surrounded Tua Tagovailoa, and the head and neck injuries that sent him to a Cincinnati-area medical center after a second-quarter sack. Tua was quickly released from the hospital and flew back to Miami with the team, but questions linger about whether the QB should have been on the field at all after his head was slammed to the turf in the Week 3 win over the Bills. The NFL Players Association terminated the unaffiliated neurotrauma consultant involved in Tagovailoa’s concussion check, and changes to the league’s concussion protocol are being implemented. On Monday, Dolphins coach Mike McDaniel ruled Tua out of Sunday’s game against the Jets. Expect Miami to handle this situation with extreme caution moving forward. The Ringer Ranking: 7 Previous: 6 Analysis: The biggest story line coming out of the Dolphins’ 27-15 loss to the Bengals is just how poorly the NFL and the team handled Tua Tagovailoa’s Week 3 injury against the Bills and the subsequent concussion Tagovailoa suffered four days later, Thursday night in Cincinnati. Head coach Mike McDaniel announced Monday that Tagovailoa will miss the team’s Week 5 matchup against the Jets. Teddy Bridgewater will get the start against New York. McDaniel’s offense is explosive and creative enough to survive Bridgewater being a step back in timing and accuracy from Tua, but Tagovailoa will need to be the healthy starting quarterback for Miami if its deep postseason aspirations will ring true. It will be interesting to watch the betting line on this game throughout the week, as last week’s line shifted from Bengals -1 to Bengals -3.5 even before Tagovailoa’s injury. The Dolphins opened as 3.5-point favorites on the road against the Jets. The Sporting News Ranking: 5 Previous: 1 Analysis: The Dolphins’ defense came down to earn against the passing of the Bengals and their offense took a tough setback of seeing Tua Tagovailoa going down. The agreement follows a routine compliance evaluation by the department’s Office of Federal Contract Compliance Programs that alleged  – from April 3, 2017, through April 3, 2019 – Loomis Armored US LLC discriminated against 355 Black male and female applicants, and 181 other female applicants, when hiring for cash management service teller positions. The alleged actions violate Executive Order 11246, which prohibits federal contractors from discriminating in employment based race, sex, color, religion, sexual orientation, gender identity or national origin. Loomis Armored US has agreed to pay $375,000, in back wages to 536 Black and female applicants, and to revise its recruiting and selection procedures to ensure its personnel practices meet legal requirements. In addition, the employer will extend job opportunities to 24 affected Black and female applicants at its facilities nationwide. “Our agreement with Loomis Armored US LLC will resolve alleged violations discovered in a routine compliance audit, compensate affected job applicants, and ensure the employer complies with federal hiring and employment laws,” explained Office of Federal Contract Compliance Programs Regional Director Melissa Speer in Dallas. During the period that OFCCP reviewed, the company had federal contracts with the Bureau of Engraving and Printing, IRS, Department of Veterans Affairs, the National Park Service and the Defense Commissary Agency. Founded in 1925 as Loomis Armored Car Service, the company was the first to transport cash in the Western U.S. in armored vehicles. Today, Loomis Armored US LLC has nearly 200 locations, and more than 9,000 employees and 3,000 vehicles. Goldizen is one of many St. Joseph area residents who deal with an influx of spam calls. She said she gets calls as late as 9 p.m. and is sometimes woken up by them. She said she wishes scammers would quit harassing people. “I wish there was something that (the phone company) could do because sometimes I think my blood pressure rises because it makes me so mad that they call back-to-back like that,” Goldizen said. He said even when people are giving their numbers to verified companies, there’s a chance that business is selling information to a third party, where they potentially can land on the dark web. “The challenge with smartphone phone numbers is that people are using them as their primary number and you get into the habit of giving that number out to everyone,” Kelso said. “And in the case of handing out your phone number to everyone, there is a good chance that your cell phone number will be leaked in a large-scale data breach.” Shawn Kobzej also has been struggling with spam calls and said this is what happened to him a couple of months ago. “I signed up for something one day, I don’t remember exactly what it was, but I just remember the next day that I got 13 or 14 spam calls,” Kobzej said. “My phone just wouldn’t stop ringing all day long and it was just terribly annoying.” Along with not giving out personal numbers, Kelso said people can set up a second, free number through companies like WhatsApp or Google voice or talk to phone companies about programs to reduce robocalls. He said the do-not-call list works for reputable marketers, but cybercriminals find ways around the list and contact those numbers anyways. Darren Doyle’s landline phone used to receive a lot of incoming spam calls, but now, he has a new problem. “Those calls stopped and we’re getting random calls from other people that think we called them, and we’ve never called them,” Doyle said. After phone numbers are in the hands of scammers, Kelso said cybercriminals can spoof, or mimic, numbers and use them to call people in that area, making the call seem more realistic. Doyle asked his phone company what he can do about this but hasn’t acted on anything yet. “They said, of course, you can change your phone number, but I mean, we’re just not really in the place where we can do that,” Doyle said. Kelso said the reason cybercriminals do this is to get victims to react. “Ninety-nine percent of cybercrime requires user interaction,” Kelso said. “So, it’s not that criminals are going to be able to hack into your smartphone or mobile device, you have to be the person to click on the link or give out the information for criminals to take advantage of you.” He said ways to recognize a spam call include a long pause before someone talks on the other end of the phone, if the caller has a foreign accent, if the caller claims they’re from the government or if the caller asks for personal information. “Voicemail is probably your best friend because at least then you know if it’s a legitimate call, someone is going to leave a voicemail message for you to call back,” Kelso said. “But, if it’s someone who is just reaching out and trying to spam you, chances are they’re not going to leave you a voicemail message and you can just ignore that.” If you do fall victim to a scam, Kelso said to get identity theft protection and contact your bank and credit card companies and let them know your accounts are compromised. The lawyer for Ezekiel Kelly, 19, entered the plea during a brief hearing in Shelby County Criminal Court. The lawyer, public defender Jennifer Case, was appointed by a judge after Kelly said he could not afford a private attorney. Kelly was indicted last week on 26 charges stemming from a series of shootings Sept. 7 that killed three people and wounded three others in Memphis. The indictment includes two first-degree murder charges in the deaths of Richard Clark and Allison Parker, plus other alleged offenses including attempted murder, reckless endangerment with a deadly weapon, commission of an act of terrorism and evading arrest. Kelly already had been charged with first-degree murder in the fatal shooting of Dewayne Tunstall outside a home in east Memphis on Sept 7. That case remains in a lower court, and a preliminary hearing has been set for Oct. 18. The indictment and the single murder charge could be combined at some point, prosecutor Chris Lareau said outside court. At least three witnesses saw Kelly shoot Tunstall at about 1 a.m., according to a police affidavit. Clark and Parker were shot later that day as Kelly was driving around Memphis, livestreaming some of his activities, including one shooting inside a business, police said. The shootings led to the shutdown of Memphis’ public bus system, the lockdown of two college campuses and the stoppage of a minor-league baseball game. Kelly carjacked at least two vehicles and he was arrested after crashing a stolen car while fleeing police, authorities said.

The survey, conducted by personal finance comparison website Finder, found that those looking to cash out amid recent market volatility may also be doing so because they’re feeling a pinch in their budget. Romana King, a personal finance expert with Finder, said Canadians are feeling the pressure when it comes to rising costs and may be looking to increase the amount of money they have on hand to make ends meet. If Canadians have high interest loans, for example, they may be looking at their budget and wondering where else they can find money to lower their debts, she said. Jason Heath, managing director of Objective Financial Partners Inc., said he wasn’t surprised that some Canadians have lost confidence given that the TSX is down about 10 per cent over the past year and the S&P 500 is down about 17 per cent. “Some of the high-flying tech and meme stocks from 2021 have had a terrible year in 2022,” he said. He explained that investors can often make the mistake of being emotional or reactive to short-run performance as opposed to investing for the long-term. “These findings are supportive of the idea that stock investing success generally requires patience and a five-plus-year time horizon. But short-term losses tend to cause some investors to panic,” he said. The report said that of those looking to cash out, lower and middle income households made up the majority. The findings also differed along generational lines. The younger the investor, the more certain they are that the market will go from bear to bull again, the report found. They were also more confident they would earn a profit in 2022, regardless of current conditions. Baby boomers, on the other hand, had less confidence that they’d be able to meet or exceed their investment return projections for the year, and were more likely to want to cash out. In this scenario, older investors may also be looking to make retirement withdrawals. For Canadians planning to stay in the market and navigate a downturn, their top three investing strategies are to buy and hold (41 per cent), income investing (nine per cent), and index and a few select holdings (seven per cent). If stock market volatility makes investors uncomfortable, Heath said they may need to assess their asset allocation and consider having less risk in their investment portfolio. “Times like this are a good test for investors,” he said. “If you have a long-term time horizon, I would avoid panicking and trying to sell and buy back in at a lower level.” “It can be hard enough to be right once, let alone twice, with market timing. Even the experts tend to do a poor job of wholesale moves in and out of stocks.” Young investors should consider whether there is a buying opportunity to get stocks at a lower price, he said. “Others should remember that North American stocks returned over 25 per cent in 2021, which is like three good years of investment returns in a single year – so, arguably, we have just given back some of that temporary wealth.”

The 105-page document was published as many people who had been anxiously awaiting it assembled in Washington, D.C., for the White House Conference on Hunger, Nutrition and Health. The proposed measure was seven years in the making. In 2015, the FDA asked Kind to remove the “healthy” claim from its labels because of fat content — which came from the nuts in the company’s bars. The company formally petitioned for an update to its regulations.  The snacking brand, which is now owned by Mars, was gratified to see the new definition, Daniel Lubetzky, Kind’s founder and chief impact officer, said in a written statement. And while it’s still a proposed rule, Kind got what it wanted. “The proposed rule is a win for public health — and that’s a win for all of us,” Kristin Rubin, Kind’s head of nutrition, said in a written statement. “The proposed definition is consistent with our past position, and we are energized to continue to advocate for nutrition education, transparency and making nutrition as convenient as possible.” The proposed rule doesn’t apply a single description to what is a “healthy” food, for the most part. That depends on what the product is, how much of a serving it has of one of the key food groups — fruits, vegetables, grains, dairy or protein — as identified by the Dietary Guidelines for Americans, and whether it exceeds limits on salt, added sugars and saturated fats, which are different for varied types of food products. Raw, whole fruits and vegetables and water are automatically classified as “healthy.” The proposed rule also seeks to classify natural nutrient-dense items as “healthy,” even though they don’t necessarily meet other nutrient guidelines, including skim and fat-free dairy products, eggs and seeds and nuts. While many people have not done a detailed parsing of the proposed rule yet, Amaru Sánchez, an associate at law firm Wiley Rein, has started to go through it. In an email, he said he’s found a couple of places where terminology needs to be explicitly defined. “Nutrient density” is not well defined, and neither are “vegetables.” After all, many of the things a consumer thinks of as vegetables, including bell peppers and tomatoes, actually fit the botanical definitions of fruits. It’s also unclear what the difference is between vegetables and “high protein foods,” considering beans and peas can be considered both. The rule, he wrote, also needs to figure out exactly how nuts, which can be naturally high in saturated fats, can fit into the “healthy” definition. The fats naturally occurring in nuts appear on the Nutrition Facts panel as a percentage of a person’s recommended daily intake, which the rest of the “healthy” definition is also built around. The California Walnut Board and Commission said in a statement it was glad to see the FDA is including nuts as “healthy” foods.   “[The] announcement affirms the decades of nutrition research that reinforce the important contribution of walnuts in a healthy lifestyle, providing additional reason to move walnuts beyond the baking aisle and highlight them among other healthy foods, such as fruits and vegetables,” Robert Verloop, its executive director and CEO, said in the statement. Emily Metz, president and CEO of the American Egg Board, said in a statement that including eggs as “healthy” foods “is more good news for egg lovers as it affirms the science showing that eggs are an all-around nutrient powerhouse, supplying nutrients such as choline, vitamin D, and essential fatty acids that are necessary for healthy living.” Despite what some industry groups saw as good news in the proposed rule, Sánchez notices that the way it is written seems to marginalize food tech companies. He noted there was no mention of mycoproteins or cell-cultivated meat. “Apart from soy and peas, there is no recognition of the various types of alternative proteins currently in the market as well as soon to be in the market,” Sánchez wrote. “I expect to see a lot of comments from food tech companies regarding their exclusion and/or lack of recognition as an important source of nutrient-dense food.” Comments can be made on the proposed rule until Dec. 28.

The aptly named Mirror kicked off the trend, but we’ve cataloged a slew of formidable alternatives in our roundup of the best workout mirrors. For the last few months, I’ve been working out with the Fiture, and this new Mirror competitor brings a lot to your exercise room. Photographer Dave Johnson For Forbes Fiture is a true workout mirror in that it’s a highly reflective mirror; you can use it to check out your outfit when you’re getting dressed in the morning. And when you’re working out, you can easily see yourself—and your form—reflected back at you through and around the trainer’s video. But the field is getting crowded, with excellent options such as Tempo, Tonal, Mirror and others to choose from. Does the Fiture deserve a spot in your home near the treadmill? Here’s what I found. Screen Size: 43-inches | Subscription: $39 per month for up to seven users, cancel anytime | Installation: Free delivery and installation Best for: A body-length mirror to get ready for work when you’re not exercising. A wealth of exercises including kid-friendly fitness games. Apartment dwellers and folks who don’t want to put holes in the wall. Skip if: You must have live classes. You want to listen to your own (or at least recognizable) music. You want an all-in-one package with weights and accessories. Fiture Design: A Real Beauty It’s hard not to compare Fiture to the Mirror because it’s the granddaddy of all workout mirrors and its slick, mirrored display and clean design lines make this device a close cousin inviting comparison. Like the original Mirror, Fiture is a highly polished, reflective mirror that works as a piece of home décor when you are not exercising. Moreover, it’s a full-length mirror that stands 68 inches high—just shy of six full feet—and the mirror extends down to all but a foot off the floor. If you didn’t know it was exercise gear, you’d think it was just a mirror, which means you can feel good about displaying it in your home. You don’t have to bolt it to the wall, either, which makes it apartment-friendly and suitable for anyone who doesn’t want to sink anchors into their wall. There is a safety strap in back to secure to the wall if you want to, but I never had any concerns with the way Fiture leans against the wall. These days, it seems like everything has a touchscreen, and after months of testing the Tempo, I missed not being able to directly interact with classes and workouts on the Fiture screen. Instead, you’ll usually turn to the mobile app to make class choices and tweak other settings. Would it be better if Fiture let you touch it? Sort of. It would certainly make using it feel more modern and interactive. But then the screen would be covered in fingerprints, ruining the elegant mirror. So perhaps it’s for the best. I should point out you’re not tied to your phone, though. Fiture responds to gestures—you can browse for classes by swiping your hand to the left or right, and when you want to start a class, just raise your hand like you’re asking the trainer a question. That’s kind of cool, though honestly, it’s often easier to use your phone, and that’s how I interacted with Fiture most of the time. While the built-in speakers are perfectly fine for hearing your trainer during workouts, Fiture also lets you connect Bluetooth speakers or headphones. Personally, I mostly don’t see the point. The background music is a boring collection of generic rights-free tunes, and you can’t pipe in music from a streaming service or your phone—or even select the genre of music. Let’s hope all that’s going to be improved in a later update. Speaking of connecting stuff, Fiture barely acknowledges this feature except in its help files, but you can use your Apple Watch as a heart rate monitor. Even better, if you connect your watch, you can play and pause the workout from your wrist. Photographer Dave Johnson For Forbes Fiture Classes and Workouts: More Than You’d Expect You wouldn’t go to a gym that specializes exclusively in HIIT classes if you’re more interested in cardio boxing, and likewise, it doesn’t matter what Fiture’s hardware is like if the workout selection is too narrow. Thankfully, the service—which is still pretty young compared to many other workout mirrors—has a generous array of classes on tap. Like most of the competition, it’s $39 per month, but that buys seven user accounts with month-to-month billing that can be cancelled anytime. Classes are led by a generally enthusiastic and likable cadre of trainers who mostly stick to the basics without sharing a ton of personal anecdotes or letting their personalities dominate the classes. Content includes HIIT, strength training, barre, boxing, yoga, Pilates, cardio sculpting and stretching. You can filter your search from the mobile app by class length, difficulty, body focus (core, arms or full body), low impact and equipment needed. If you choose a class that includes the so-called Motion Engine (not all do), Fiture uses the onboard camera to count your reps and make corrective suggestions as needed. It worked well, but like all workout mirrors with this feature, it can be hard to read the onscreen corrections if your exercise has you oriented perpendicular to the screen, such as during a push-up or plank. On balance, though, this is a great feature that works well. Many workouts require equipment that isn’t included. You might need dumbbells, for example, so it might not be a bad idea to buy some great adjustable dumbbells to accompany your Fiture. Federal Reserve Chair Jerome Powell recently described it as “extremely tight” and “out of balance,” with demand for workers far outstripping supply.  I beg to differ. It is true that quit rates had risen as employees didn’t worry about finding new jobs. Also, job-switchers got annualized pay hikes of 8.4% in August, up from 5.8% early this year, according to the Federal Reserve Bank of Atlanta. That encouraged people to change jobs or strike for higher pay. There were 180 strikes involving 78,000 workers in the first half of 2022, up from 102 strikes covering 26,500 a year earlier.   Job openings are about twice the number unemployed, which means that to return to the 63.4% labor participation rate of February 2020, before the pandemic, it would require 2.8 million people moving into the labor force. Layoffs in July of 1.4 of million were about 23% below the average in 2019. If there really isn’t any slack in the labor market, then why are real wages falling? Corrected for inflation, average hourly pay in August had fallen 2.1% this year, with the year-over-year jump in the consumer price index at 8.2%. The many employers who scrambled to add employees are now reluctant to cut staff even as the economy slips on concern that they may not be able to find workers when things turn around. The recent weakness in productivity growth — and actual declines in the first half of this year — adds fuel to the fire since it takes more hours worked to produce the same output. In the first quarter, output per hour worked fell at a 7.4% annual rate and by 4.1% in the second quarter. Furthermore, immigration, which can substitute for native-born workers, has slowed to a trickle. From 2019 to 2021, annual immigration dropped from 1.3 million to 505,000. Also, the rapidly aging postwar babies, now age 58 to 76, are dropping out of the labor force as they retire.  The labor participation rate for those 65 and older is 19.1%, compared with 82.8% for those in prime working ages, 25 years to 54 years. My analysis indicates that current labor market stringency isn’t due to robust demand for workers but because Americans are limiting the supply after the pandemic. After staying at home for two years due to the lockdowns, many people became accustomed to working remotely and putting in fewer hours while others dropped out, retiring early. In late September, office occupancy as measured by workers at actual desks was only 47.5% of early 2020, according to Kastle Systems.   Many switched to part-time from full-time work. In August, 21 million worked part-time because they wanted to while a declining number of part-timers — 4.1 million — wanted full-time jobs but were only offered part-time work. Surveys by the Federal Reserve Bank of New York, among others, reveal that the pandemic-induced changes in attitudes toward work, with men, women, the young, middle-aged, full-time and part-time all wanting to work fewer hours than before Covid-19 struck. Consumers can maintain their real spending in the face of falling real wages by liquidating assets, but that isn’t happening or likely. Much of the earlier three rounds of pandemic-related federal fiscal stimulus in 2020 and 2021 went into single-family housing, as Americans fled cities for suburban and rural areas, and into equities. But stock prices fell into a bear market and house prices are beginning to decline. With rising mortgage rates, cash-out refinancing, which provided money for other spending, is history. Household net worth dropped 4.1% in the second quarter as stocks and mutual funds tanked, according to the Fed. Borrowing is getting more expensive as witnessed by the jump in credit-card interest rates from 16% in early March to 18% in September. Low levels of consumer confidence signals that Americans are too scared to support the economy with a spending binge, but are hunkering down instead. With all these forces weighing on consumers, who account for 68.4% of total output, it’s not surprising that real retail sales in August were down 4.4% from March 2021 and 1.2% from last November. Unemployment lags the economy in business cycles. Only when business sales and profits nosedive do employers cut staff. And this time, as the recession I’ve been predicting unfolds, employers may be slower than usual to make the switch from recruiting to firing. But it will occur. In recent months, job openings are falling and so is hiring. Ditto for quit rates as employees begin to worry about finding new jobs. And the unemployment rate ticked higher from 3.5% in July to 3.7% in August. Don’t be surprised if labor market data moves quickly from feast to famine. That will put further downward pressure on corporate earnings and stock prices. The evaluation was done while she was a third-grader, meaning despite the improvements she is still below grade level and in the bottom 25 percent of her peers in this category and others. The evaluation, her parents said, is evidence that this was a model that worked for her. When they showed it to school officials, however, they thought it was ignored. Today, with her routine snapped, Belle struggles to speak coherently. James, her father, said it’s as if the progress made from years they spent working with her had disappeared. “We were told we were wrong for telling them we wanted these things for our daughter and why she belonged in a general education program,” he said. “But I’ve seen her do more than she’s doing right now. I know what she’s capable of. It’s like we’re back to square one, and now she’s pushing against support.” Staffing constraints In her eight years as a paraeducator in Evergreen, Ellen Townsen said this year has been unlike anything she’s ever seen. Severe staffing shortages have limited her ability to provide one-on-one assistance to students who need it most. In some cases, Townsen said special education students are going entire days without receiving the assistance required by their IEPs; in others, students are working with paraeducators who haven’t received training in dealing with that specific disability. “Special ed students are entitled by law to get the help and support they need. And many of them are not getting it,” Townsen said. “According to their IEPs, they are entitled to support. If that’s not being fulfilled, it could be violating their civil rights.” According to Mindy Cooper, the president of Evergreen’s Public School Employees union — which represents an estimated 650 paraeducators in the district, among other classified positions — the district had as many as 300 unfilled paraeducator positions in the 2021-2022 school year. The shortage is not unique. A study from the National Education Association found that there’s as many as 300,000 unfilled educator positions nationwide. “We don’t mind picking up the slack, but there’s no incentive, there’s no motivation to continue working for the district when (employees) can get something better elsewhere,” Townsen said. “And I don’t mean another school district, but I mean elsewhere in the workforce in general.” District officials repeatedly acknowledged these staff shortages, but say they are committed to furthering the inclusive school model under state guidelines. “Regardless of the job shortage that is pervasive across Washington state school districts, Evergreen Public Schools is committed to increasing inclusive practices where students receiving special education services are not segregated in separate settings due to their disability or staffing and have opportunities to meaningfully access and participate in the general education setting, curriculum and learn alongside their typically developing peers,” Hill said. IEPs hard to enforce Although the law says conditions of established IEPs are to be followed, families are the only ones who can really do much to hold schools accountable. But they may find themselves at a practical disadvantage. “When a district doesn’t do what they need to do, a parent has options, but I would say that the deck is stacked in the school district’s favor,” said Diane Wiscarson, a Portland-based special education lawyer who practices in both Oregon and Washington. “Due process is very expensive and takes about a year. Parents have to use their own money but the districts use public money to defend it. There’s a power and resource imbalance there.” Wiscarson works to represent families who find themselves seeking mediation with a school district over their child’s IEP. In her experience, school districts need to be doing more to retain and attract paraeducators to support theses students, as well as making more classroom teachers aware of the conditions of IEPs. “We have clients who are supposed to have one-on-one assistants but there’s nobody to hire,” she said. “There’s a lack of professional development, there’s a lack of training.” When schools press to reevaluate an IEP, Wiscarson said she always asks for evidence that supports that decision. In Belle Jackson’s case, for example, her most recent evaluation showed the conditions of her IEP were actively improving her academic performance. “I’m picky about data. Schwartz of the Yale School of Public Health, and Paul Goldsmith-Pinkham of the Yale School of Management wrote. “Overall, the excess death rate for Republicans was 5.4 percentage points (pp), or 76%, higher than the excess death rate for Democrats.” The researchers used data from Ohio and Florida and matched 2017 voter registration data with mortality data from 2018 to 2021. They also found a link between political affiliation and views on vaccines, with Republican-leaning counties showing far lower vaccination rates.
