He broke the receiving record set by current New York Jets wide receiver Elijah Moore by getting 247 yards against Vanderbilt. It was the most yards of any FBS player in a game this season and vaulted Mingo into the Southeastern Conference lead with 507 yards entering Saturday’s game with Auburn. Mingo has battled injury in his career and been overshadowed by 1,000-yard receivers Moore and Dontario Drummond. Now, he’s among the elites for No. 9 Ole Miss. KNOXVILLE, Tenn. (AP) — Tennessee starting safety and captain Jaylen McCollough has been arrested for aggravated felony assault. That puts his status for Saturday’s game against No. 3 Alabama in question for the sixth-ranked Volunteers. Coach Josh Heupel said the team learned about McCollough’s arrest on Sunday night. According to an arrest warrant obtained by Knox News, a man reported that he went inside the wrong apartment after drinking with friends, and a man followed him out and punched him, causing him to fall down stairs and knocking him unconscious. Police said McCollough had blood seeping through a bandage on his hand, declined to answer questions and was arrested. UNDATED (AP) — It could well be among the marquee quarterback matchups of the season: Alabama’s Heisman Trophy winner Bryce Young versus Tennessee’s rising star Hendon Hooker. Young’s sprained right shoulder was being re-evaluated, but coach Nick Saban seemed somewhat optimistic about his status for the Saturday’s game. Hooker and Young are still among the leading Heisman Trophy candidates. Jalen Milroe started for Alabama in a squeaker over Texas A&M. UNDATED (AP) — Georgia has taken back the top spot in The Associated Press college football poll from Alabama. The Crimson Tide slid to No. 3. The Bulldogs received 32 first-place votes and 1,535 points in the Top 25 to easily reclaim No. 1 on Sunday after being just two points behind Alabama for the No. 2 spot last week. Georgia thumped Auburn 42-10 on Saturday. The Tide escaped an upset bid at home by Texas A&M with Heisman Trophy winning quarterback Bryce Young sidelined by injury. UNDATED (AP) — Beating Oklahoma has been a way to get ranked in the Big 12 — which is odd considering how poorly the Sooners have played lately. No. 22 Texas became the third Big 12 team in the last three weeks to defeat Oklahoma on Saturday and end up in the AP Top 25 on Sunday. Often complaints about the preseason poll and how it shapes the rankings in the regular-season can be overblown. But Reality Check can’t help but wonder if those Big 12 teams would have gotten such a big boost if the Sooners didn’t start the season as a top-10 team. UNDATED (AP) — Air Force has reached the halfway point of the season on track for its third straight national rushing title. Ohio State is on pace to be the top scoring team again. The Falcons are running for better than 352 yards per game and the Buckeyes are averaging nearly 49 points. Texas Tech is first in passing yards per game at 365 and Tennessee is the total offense leader at 548 per game. Defensively, Illinois is giving up just eight points per game. Other leaders are Minnesota in total defense, James Madison in rushing defense and Boise State in passing defense. Fund Fights: Fidelity, LGIM And Franklin Templeton Enter The Metaverse – ETF Stream https://clarkcountynewsnow.com/fund-fights-fidelity-lgim-and-franklin-templeton-enter-the-metaverse-etf-stream/ Fund Fights is a series where ETF Stream analyses the strengths and weaknesses of similar ETFs. This month, recently-launched metaverse ETFs from Fidelity, Franklin Templeton and Legal & General Investment Management (LGIM) go head-to-head Three metaverse ETFs from established issuers launched in as many days in September, with Europe’s product line-up targeting the hard-to-define theme extending to five strategies. Metaverse strategies wrapped in ETF format in Europe started in March with HANetf and ETC Group partnering with Solactive to launch the $5m HANetf ETC Group Global Metaverse UCITS ETF (METR), narrowly pipping the $2m Roundhill Ball Metaverse UCITS ETF (METV) which launched four days later. However, after a tough start to life, other ETF issuers held off from launching metaverse strategies – and thematic ETFs generally – during most of summer, until the first week of September when asset managers rolled out 13 new thematic products in five days. First among these in the metaverse context was the $5m Fidelity Metaverse UCITS ETF (FMTV) which came to market on 5 September. As with the majority of Fidelity’s ETF range in Europe, METV sets itself apart from its peers by tracking an investment strategy built inhouse by its issuer, the Fidelity Metaverse ESG Tilted index. The product passively tracks its index, with portfolio managers choosing constituents that develop, manufacture and sell “products and services related to establishing and enabling the metaverse”, which it defines as a future state of the internet built upon augmented reality and virtual worlds. Within this, METV captures companies that pass “theme-specific criteria” and are involved in manufacturing computing hardware, components, digital infrastructure, design and engineering software, gaming, web development, smartphones or wearable technology. The next day, Franklin Templeton launched its metaverse ETF, the $2m Franklin Metaverse UCITS ETF (FLRA), which offers exposure to the 60 constituents of the Solactive Global Metaverse Innovation Net Return index. FLRA tracks companies selected by Solactive’s ARTIS natural language processing algorithm, which sifts through financial news, business profiles and company profiles to find candidates that have or will have “significant exposure” to the theme. These include those engaged in metaverse technology, metaverse platforms, metaverse devices, interchange standards, data processing, blockchain technology and digital asset platforms. Company scoring for theme exposure is based on the prevalence of keywords such as “metaverse” and “virtual reality” within public documents. In this sense, FLRA’s methodology has some overlap with HANetf’s METR, which also relies on Solactive’s ARTIS algorithm, albeit the latter places more focus on augmented reality and the creator economy. Finally, just a day later, LGIM unveiled the $2m L&G Metaverse ESG Exclusions UCITS ETF (MTVR) which tracks the iSTOXX Access Metaverse index of 52 stocks. The benchmark relies on data from Syntax’s Functional Information System to identify companies deriving at least 20% of their revenues form metaverse-related sectors. Reviewed semi-annually, the index is market cap weighted with a maximum allocation of 5% per holding. Between review dates, the weight of individual companies is revised at the end of each month to ensure no company makes up more than 15% of the index. LGIM said the metaverse represents the next stage of the internet, placing users in shared virtual environment which is “live in its interaction with the real world and affords individuals a sense of social and economic participation”. Despite the lack of common understanding of what constitutes the metaverse – and the different methodologies for capturing the theme – there is a good degree of overlap between the different strategies on offer. For instance, all allocate almost a fifth of their baskets to blue-chip tech names such as Apple, Alphabet, Meta and Nvidia, while Microsoft appears in two of three of the ETFs. All also apply ESG screens based on exclusions for controversial business activities. FMTV adds at least 50% of its constituents must maintain sustainable characteristics. A key difference might be in how the three allocate to different metaverse sectors, with Fidelity’s offering allocating more weight to gaming companies such as Tencent and Nintendo while Franklin Templeton’s FLRA places virtual payments companies Mastercard and PayPal among its top allocations. Of the three products, FLRA carries the lowest total expense ratio of 0.30%, shy of not only its longer standing metaverse competitors but also the 0.39% charged by LGIM’s MTVR and the 0.50% fee for Fidelity’s FMTV alongside its 0.50% exit charge. Looking ahead, the barrage of metaverse launches this year seems to indicate this is the new ‘must-have’ for thematic issuers. It will be interesting to see whether others such as BlackRock, Invesco, First Trust and Rize ETF follow suit, or whether the modest $16m amassed collectively by the existing strategies will make them focus their efforts elsewhere. If you build your own shortcuts in the Shortcuts app, there are a few things you’ll definitely want to know about the new software. It’s not a massive feature drop as with iOS 16.0, but they are important changes. You can use a few more actions in your shortcuts, but the most significant changes in Shortcuts affect glyphs. The changes below also appear on iPadOS 16.1 for iPad and macOS 13 Ventura for Mac, which are still in beta. More Shortcut Actions Apple added almost 60 actions to Shortcuts with iOS 16.0, but you’ll see a few more new ones on iOS 16.1. Here they are and what they do: Get Current Focus (Scripting, Device): Returns the currently active focus. Open Smart List (Reminders): Opens a specific smart list in Reminders. Search in Shortcuts (Shortcuts): Opens Shortcuts and performs a search for the specified text. However, one action has been removed on iOS 16.1: Open Folder (Notes): Get quick access to one of your Notes folders. And at least one received a minor name change: Change Recording Playback Setting (Voice Memos): Changes playback settings in Voice Memos. (It used to be Change Playback Setting.) Some of the new actions on early iOS 16.0 betas were absent on the stable iSO 16.0 release, such as seven additional actions for the Books app and “Delete Messages” for the Messages app. Those are still missing on iOS 16.1, but the new update did bring back the “Search in Shortcuts” option seen above. 2. Better Glyph Categories Before iOS 16.1, there were only three categories — Objects, People, and Symbols — to sort glyphs in Shortcuts’ icon picker. With so few groupings, browsing for an icon you didn’t know the name of was exhausting. (Left GIF below.) Now there are 29 total categories for easier glyph browsing. They are all listed alphabetically below, not in the order they appear in Shortcuts). (Right GIF below.) Glyphs Show in Multiple Categories Having 29 categories for browsing glyphs is helpful, and you would expect all of the glyphs to appear in one category only. That’s not the case. For even faster browsing, some glyphs appear in multiple categories. So if you’re looking for a sun, you’ll find it under the Nature, Weather, and Keyboard categories, not just one of them. Some glyphs might show in multiple sections, as seen below. The names in parentheses are the names according to Voice Control. If there are no parentheses, Voice Control also uses the listed name. From my count, Apple removed 100 glyphs when it introduced categories. It’s possible the Apple developers didn’t immediately know which category the glyphs should go in or left out entire categories by accident or with the intention to add them back later. Cardano aims to solve the blockchain trilemma through its sophisticated proof-of-stake (PoS) protocol called Ouroboros. Vasil Upgrade a Stepping Stone The Cardano team, led by former Ethereum co-founder Charles Hoskinson, has been deploying upgrades. The latest is the Vasil hard fork, which makes the peer-reviewed blockchain more scalable with minimal user cost. However, the team is not done yet, with even more scheduled upgrades expected in the future. At the moment, Cardano is reaping the benefits of the Vasil Upgrade, although its native token price has not reflected this. Since the deployment of the hard fork, the transactions on Cardano’s layer-1 blockchain have doubled. Over 3,445 smart contracts have been deployed on its Plutus V1 Scripts. The figure for its Timelock Scripts has also risen. According to data from the Cardano Blockchain Insights team, there are now 69,670 self-executing commands on the blockchain. Cardano Only Second Behind Bitcoin in On-chain Transactions Aside from the recently concluded Vasil Upgrade, the Cardano team has several targets to hit before launching fully into the marketplace. But this delay has not deterred investors and blockchain users, as all indicators show. According to a recently released Messari on-chain activity log, Cardano is the second most active blockchain network, only behind Bitcoin. The Ouroboros protocol has so far processed $3.09 billion in smart contracts transactions, beating Ethereum’s $1.7 billion figure. This is despite Ethereum’s transition to a full PoS protocol in September. With Cardano showing strong on-chain activity, the idea of it being a ghost chain is debunked. Other data revealed that over 25% of all blockchain transactions were generated in the past year in a period in which Bitcoin and Ethereum gained the most attention from investors and the media. This shows strong investor awareness about Cardano’s long-term potential and ability to deliver on its promises.  Cardano Trees Pointing to ESG-Minded Investors The Cardano monthly on-chain stats have shown how far the blockchain has come, with over 3.6 million ADA wallets created.  But its efforts to enable a greener ecosystem are what has gained the attention of environmentally conscious investors. Its Ouroboros protocol requires minimal energy for network transactions to be confirmed. Cardano has been working to create a more sustainable environment with Veritree. According to Veritree and Cardano, the Cardano Trees initiative recently crossed the 35% landmark; they are working towards planting 1 million trees globally. At press time, the ADA token is trading at $0.39, indicating a downtrend of 5.05% in the past day. By late Tuesday, hours before a new restriction took effect, South Korean memory chipmaker SK Hynix Inc (000660.KS) said it got authorization from the United States to receive goods for its chip production facilities in China without additional licensing imposed by the new rules. The Biden administration had planned to spare foreign companies operating in China such as SK Hynix and Samsung Electronics Co (005930.KS) from the brunt of new restrictions, but the rules published Friday did not exempt such firms. And as of midnight Tuesday, vendors also cannot support, service and send non-U.S. supplies to the China-based factories without licenses if U.S. companies or people are involved. As a result, even basic items like light bulbs, springs, and bolts that keep tools running may not have been able to be shipped until vendors are granted licenses. And without the minute-by-minute support the foundries need, they could begin shutting down, one source said. “Our discussions with the Department of Commerce led to an approval to supply equipment and items needed for development and production of DRAM semiconductors in Chinese facilities without additional licensing requirements,” SK Hynix said in a statement. The company said the change would help avoid disruptions to the supply chain and that the authorization is for a year. Samsung Electronics declined to comment. Another source said the temporary fix was until a longer-term solution could be worked out. At least one other non-Chinese company received a similar authorization, a third source said. A U.S. Commerce Department spokesperson did not directly respond to a request for comment on the authorizations, but said the department hopes to get input from stakeholders about the rule and may consider changes. A White House spokesperson also did not respond to a request for comment. “Unless the authorization was issued, a variety of equipment and other suppliers would have had to pull their personnel from the fabs in China,” one of the sources said. The U.S. planned to review licenses for non-Chinese factories in China hit by the new restrictions on a case-by-case basis, but even if approved that could create delays in shipments. Licenses for Chinese chip factories were likely to be denied. Taiwan Semiconductor Manufacturing Co.(2330.TW) and Intel Corp (INTC.O) also operate chip factories in China. The Chinese chip facilities are not expected to get any reprieve. Gohlke, associate professor of environmental health in the Department of Population Sciences at the Virginia-Maryland College of Veterinary Medicine, has been awarded a $1 million grant from NASA. She will work alongside co-principal investigators Ryan Calder, assistant professor of environmental health and policy at the college; Samarth Swarup of the University of Virginia; and Benjamin Zaitchik of Johns Hopkins University.    With this grant, Gohlke hopes to improve the ways that government agencies estimate damage caused by extreme weather events.   Current analyses don’t fully take into account health damages, which means that total damages are underestimated and Americans may not be receiving the support they need to fully recover from extreme weather events. Gohlke uses mold as an example: If a family gets sick because their houses are full of mold after a flood, the government’s damage estimate would not include the damage to their health. With improved methods of estimation, experts can make better informed decisions about disaster relief spending and more.   These calculations are used in the formation of policy, and agencies such as the U.S. Environmental Protection Agency (EPA) use such data to write regulations. Better health damage accuracy also will change the way the government calculates the cost of climate change. This information will be of particular use to the National Oceanic and Atmospheric Administration’s list of billion-dollar weather and climate disasters and the EPA’s Social Cost of Carbon (SC-CO2) calculations.   In addition to calculating overall cost, the research team will examine damages at the census tract level to see who is hardest hit by these events.   * * * Virginia Tech to illuminate Torgersen Bridge for homecoming In honor of the Virginia Tech’s Sesquicentennial and as part of the university’s Homecoming celebration, a special projection will be displayed after dark on Alumni Mall’s Torgersen Bridge this weekend.  This portrayal of 150 years of the university will explore history with photos, videos, and sound played on a loop. Tech grad student receives NIH award Virginia Tech graduate student Zach Williams has been awarded a two-year, $86,330 grant from the National Institutes of Health’s Ruth L. Kirschstein Predoctoral Individual National Research Service Award program. During a trial stint in the lab of Rob Gourdie, a cardiovascular scientist who is a professor and director of the Center for Vascular and Heart Research at the Fralin Biomedical Research Institute at VTC, Williams discovered something new about a molecule the lab was studying. That observation could lead to new ways to treat arrythmias and reduce sudden cardiac death. That discovery led to the grant. Now Williams has joined the Gourdie lab full time.

When the officer arrived, he made contact with the victim. The victim reported that his 2018 Subaru Outback was stolen at approximately 8:00 a.m. that morning. The victim explained that he left the vehicle unlocked with the keys inside.  The victim obtained surveillance video of a female entering the vehicle and driving away. The victim stated that his Subaru has Starlink, which allows its location to be tracked. The victim contacted Starlink and reported the theft. Starlink later notified law enforcement that the stolen Subaru was parked at the Days Inn on E. Broadway. Police Public Information Officer Lydia Arnold explains.  “Officers took a report of a stolen vehicle,” Arnold said. “The victim was able to provide video surveillance, which showed a person, Nacheyla Dempsey, entering the vehicle and driving away. The victim was able to use Starlink to get the location of the vehicle. Officers located the vehicle, but at the time, the vehicle was unoccupied.”  According to court documents, another officer also responded to that location. When he arrived, he observed a female walk by wearing the exact same clothing depicted on the victim’s surveillance video. The officer stopped the female and identified her.  “While at the vehicle, a female who had been seen on video surveillance was located near the area,” Arnold said. “Officer reviewed other business surveillance and under Miranda, spoke with Dempsey. During the search incident to arrest, officers located items belonging to the victim on Dempsey’s person.”  Inside Dempsey’s pocket, the officer discovered a checkbook belonging to the victim and a wallet containing the victim’s identifying information. According to the stats, Malloy is one of the most successful creators in Decentraland, especially if we were to count how many items he has sold over his time here. All the people I talked to have recommended Malloy as someone who can do incredible things. He is a 3D artist and art director. He has worked in-house in the games industry during the new console gold rush frenzy (first games to market) and has been an outsource artist, indie game developer, and design consultant since then. I am talking to him today, not for the first time! Tell us a little about what has changed since you learned about the Metaverse and what you can do here. I entered the Metaverse space in March 2021 before the insanity of the “NFT Summer” was ramping up. The attraction was the concept of scarce digital assets that the artist could not only be a manufacturer but also a distributor and publisher. The evolution of that attraction is now how to embolden the value of the game asset regardless of the “hype” social factors that play into it. An asset should sell itself without the need of populism, and I don’t think NFTs in games have even scratched the surface of their potential. Creating digital fashion does sound like a challenge. So why did you choose Decentraland as a platform? I came across Decentraland a long while before I created my first asset and what drew me to it was the concept of the project and the ideology. You are one of the most successful creators in Decentraland. Please share your thoughts about it. Did you have a goal when you published your very first wearable? I find that statement a little jarring due to my work being mainly uncredited and for 3rd parties. Although I was only made aware of the numbers involved in the trading of my wearables recently, I am humbled. I think the most accomplished feeling I’ve had is making assets for myself, but the most joy I have had making wearables has been in collaboration with my business partner, Sam, making wearables enjoyed by many citizens of Decentraland over various events that have gone on over the last one and a half years.  Ironically my goal when I started out was to see if, as a 3D artist, it was possible to not be at the mercy of traditionally established dependencies (working for middlemen or studio producers). However, increasingly, we see the rise of the “metaverse consultant” charging ridiculous fees for their services and subcontracting to the real talent for peanuts. The long and short of it, my goal was to see if the technology/platform could be used to fight the swathe of abusive business practices conducted in established industries. It appears it can! But collectors should be vigilant in regards to whom they part with their hard-earned money. The profiteering middleman or the talent? Starting something on your own can be overwhelming. What would you advise for someone who is still in doubt? Share your “work in progress” with the community. It reveals the authenticity of you as an artist and establishes rapport. It is what I did, and I was approached by multiple people (including the Foundation, of whom I am very grateful for subcontracting myself and Sam to create wearables for their outstanding events!). You never know who is looking in Discord or on Twitter, don’t be afraid of people stealing your ideas at the expense of people not knowing your worth as an artist. Do you remember your very first Decentraland experience? Can you tell us a little bit about it? I think it was like for many others, Wonderzone & Tominoya Casino, haha, but I then went to Discord and found super cool scenes like the Puzzle Museum, etc. I know that the community in Decentraland is very strong. Have you ever met any of them IRL, and how do you feel about your anonymity in the space? I am pretty open. I think anonymity helps to feel a sense of protection from abusers. For others, it serves as a protection to abuse others. So I figure I’d rather be transparent as I have no intention to abuse anyone, but I respect others’ needs for privacy. I have had the joy of meeting many DCL citizens in person at the NFTxROADS event in Valencia. I can’t wait to meet up with people again and chat about nerdy/art stuff! What is your inspiration, and how do you manage your creative process? My creative process is often at the mercy of my ambition. Luckily I have a great business partner who keeps me anchored. I am inspired by many things, including the historical repertoire of game art styles, but mainly I am inspired to push boundaries, not just be the first to execute something like a silly badge of honor to gloat about, but something that utilizes NFTs to give power to the collector other than to just sell it. Digital fashion inspires me in that capacity, also. If you could say just one thing about what is the key to digital creativity? What would it be? Think about the technology and how it can be utilized in new dynamics and not in a gimmicky way to make quick cash. But a way that digital assets can be enjoyed by people in a way where their purchases aren’t just a weak excuse for wealth extraction. How do you see the future of digital wearables? I believe in the future. Maybe this is naïve and even a little pessimistic, but people will prefer to tune into the digital worlds over the real one (it’s already been happening for the last 20 years), but with digital asset scarcity and certificate of ownership, digital wearables will be highly coveted items that not only give people a sense of identity and social status but also affect their experience within these digital worlds. The expanse of experience is highly desirable in any circumstance. It’s why folks enjoy roller coasters or partake in various mind-altering state drugs. Decentraland is ahead of the curve on this by means of decentralized application of utility to digital wearables. Newer flashy projects with stock assets will crop up, but the infrastructure of Decentraland takes time and an organic democratic process that other projects haven’t even started to conceive. Most other “metaverses” are still trying to monopolize at the expense of the digital wearable buyer to appease VC expectations. How do you see the future of the Metaverse(s)? I see the future of Metaverses being like a street of 100 coffee shops. People will try each of them out now and again but will ultimately stick to their favorite one until it goes out of business. Then move on to the next. The real question will be, can they redeem the loyalty card they’ve fully stamped in the previous shop, and who funds these franchises? Does the retail user’s money go back into an ecosystem that serves them (in this hilarious parallel, the coffee bean growers?) and the project or increasingly pays out to a series of individuals who happened to be early (investors at the expense of every worker in the hierarchy)? The dollar strengthened 0.22% to 146.18 yen in Asian trading, after pushing as high as 146.39 for the first time since August 1998. The Japanese currency is particularly sensitive to the gap between U.S. and Japanese long-term bond yields. The benchmark 10-year Treasury yield jumped to the cusp of a 14-year high overnight at 4.006%, while the equivalent Japanese government bond yield is pinned near zero by the Bank of Japan. Japanese authorities staged their first yen-buying intervention since 1998 on Sept. 22, when the yen tumbled to as low as 145.90 per dollar. Chief Cabinet Secretary Hirokazu Matsuno said at a regular media briefing on Wednesday that officials remain ready to take appropriate steps to counter excessive currency moves. “Given the overriding strong dollar trend in place, it’s possible that instead of defending the yen at a particular level, the Bank of Japan would try to slow down the pace of the dollar-yen’s rise by defending at a higher level” than previously, said Alvin Tan, head of Asia currency strategy at RBC Capital Markets. Tan, who expects Japan’s currency to weaken to 150 per dollar by the turn of the year, added: “However, the Bank of Japan is also mindful of the rising volatility at the global macro level, (which) is now a bigger driver for potential further intervention than the volatility in any individual currencies.” The BOJ is a major outlier among developed-nation central banks, committing to maintaining its massive bond-buying stimulus even as global policymakers have embarked on a wave of tightening to curb inflation. The company said Tuesday that the unit, called GM Energy, will create systems for households and commercial customers that link electric vehicles to power storage and generation. The division should have the capacity to sell energy from electric vehicle and stationary storage batteries back to utilities during peak periods of energy usage. “GM Energy has the opportunity to help deliver sustainable energy products and services that can help mitigate the effect of power outages and provide customers with resilient and cost-effective energy management,” Travis Hester, vice president of GM EV Growth Operations, said in a statement. GM’s Energy Services Cloud will include data and energy management tools and let customers manage their energy usage. Ultium Charge 360, which includes several charging station networks and software, will expand its portfolio of integrated public charging networks, integrated mobile apps, and additional product and service offerings over time as part of the division. GM said it also has partnerships with several companies, including solar technology and energy services provider SunPower. In the deal with SunPower, the two companies will develop and offer customers a home energy system that includes integrated electric vehicle and battery solutions, solar panels and home energy storage. The system will be available at the same time as the retail launch of the 2024 Chevrolet Silverado EV, which is expected to start production in the fall 2023. There’s also a pilot project with Pacific Gas and Electric to allow residential customers to use their compatible electric vehicles with a bi-directional charger as backup power for essential home needs during power outages. After initial lab tests, the companies anticipate expanding the offer to some residential customers within PG&E’s service area. Clark County District Court Judge Susan Johnson said the pause will last until all sides craft a way for a neutral party to screen the records. The judge granted a Las Vegas Review-Journal request to block immediate review of the records, which are expected to include source names and notes by reporter Jeff German. Police and prosecutors say they need access to German’s records for evidence that Robert “Rob” Telles, a former Democratic elected county official, fatally stabbed German on Sept. 2 in response to articles German wrote that were critical of Telles and his managerial conduct. The newspaper — with backing from dozens of media organizations including The Associated Press and The Reporters Committee for Freedom of the Press — maintains that confidential information, names and unpublished material are protected from disclosure under state and federal law. Telles, 45, the Clark County public administrator, was arrested Sept. 7 and remains jailed without bail on a murder charge. Authorities say surveillance video, Telles’ DNA on German’s body and evidence found at Telles’ home connect him to the killing. Johnson acknowledged that because it is rare for U.S. journalists to be killed allegedly because of their work, there was little legal precedent that could be followed to allow investigators to search German’s files. German, 69, was widely respected for his tenacity and confidential contacts in 44 years of reporting on organized crime, government corruption, political scandals and mass shootings — first at the Las Vegas Sun and then at the Review-Journal. Attorney David Chesnoff, representing the Review-Journal, said the judge needs to balance First Amendment rights of the media with the interests of police and prosecutors. He also acknowledged Telles’ defense team’s constitutional right to access to information about German’s killing, including identities of other people who might have had a motive to attack him. “It will have a long-term and chilling effect on sources and journalists receiving information from sources,” Chesnoff said, “if it’s OK to kill a journalist so that then everything that journalist dedicated himself to” can be exposed. “That would be outrageous,” he said. The Review-Journal argues that police should never have seized German’s cellphone, computers and hard drive. It cites Nevada’s so-called “news shield law” — among the strictest in the U.S. — along with federal Privacy Protection Act and First Amendment safeguards. “We are dealing with something unique,” the judge observed from the bench. “Everybody in this room is probably on his phone as far as a contact, right? I may be in his contact list.” Johnson said Las Vegas Metropolitan Police Department homicide detectives should have access to relevant electronic information. She said German’s files and contact lists could first be reviewed by a three-person team appointed by the court. “I’m leaning toward two trusted Metro officers that are higher-ups,” along with a respected former U.S. magistrate judge, Johnson said. She set an Oct. 19 date for ruling and added that she “wouldn’t be horrified” if the seven-member Nevada Supreme Court reviewed her decision to provide guidance about how to proceed. Chesnoff, with Ashley Kissinger also representing the Review-Journal and media, said there was no way to know who in Las Vegas police ranks had ties to the slain reporter. Chesnoff urged Johnson to enlist police investigators from outside Las Vegas for the review panel. Attorney Matthew Christian, representing the police department, acknowledged the issue might need state high court review. But Las Vegas police “have a duty to run down a complete investigation, and the victim’s devices are always part of that,” he said.

However, while the intention is to better protect Australia’s critical infrastructure, this new cybersecurity framework could do the opposite.  Originally designed in 2018 the reformed ‘Critical Infrastructure Protection Act 2022’ came into effect in July this year. With an improved framework for handling cyber threats, it includes an array of measures to which Australian businesses and services must adhere.  In theory, the new act is imperative for safeguarding a modern Australia. Its existence provides a benchmark for IT and OT professionals across a greater variety of industries, and ensures security is a collective responsibility.  The importance of addressing this responsibility cannot be overstated in an environment of increased cyber threats to essential services and businesses over the past few years – including federal parliamentary networks, the medical sector, universities, and key software businesses.   Take the most recent attack on Optus’ network as an example, which has seen millions of customers potentially affected, with full names, date of births and contact details stolen. While Optus was covered by insurance, it’s a reminder that sufficient scenario planning and risk mitigation is integral to preventing these increasingly sophisticated attacks. Potentially one of the largest attacks Australia has seen to date, it’s a warning to us all that cybersecurity has never been more critical.   The introduction of the new act then is a positive sign that Australia is taking cybersecurity threats more seriously. However, some of the amendments foreshadow an evolution of increasingly stringent rules that could become unrealistic and unachievable – ultimately threatening system effectiveness and integrity. One such update is the change to incident reporting deadlines. In line with the new law, organisations are now required to notify the Australian Cyber Security Centre (ASCS) within 12 hours of becoming aware of an incident. Failure to comply can result in fines starting at $11,000.   Not only could this have implications for smaller businesses, which often have fewer resources to identify and manage attacks on their assets, it detracts from what should be the priority of risk management. The standard 12-hour reporting deadline also doesn’t take into consideration the challenges and processes of different industries – finance vs the food sector, for example. The sophistication and complexity of cybercrimes mean that, in many instances, the time it takes to correctly identify an attack and potential solution is also difficult to predict. On a global scale, reporting time for incidents was previously around 72 hours, meaning deadlines have reduced from three days to one. The risk in this continued reduction of reporting times is that requirements may get so low – potentially to immediate notification or ‘zero hours’ – that it’s simply unsustainable. Organisations must have adequate time to identify a breach, investigate the incident and produce an accurate report without fear of potentially devastating legal, cost and brand ramifications. While the latest guidelines hint at a stricter framework in future, the current requirements are achievable for organisations that are prepared. The Meta CEO said that the company is in a “philosophical competition” with Apple as both companies work on the future of what he calls the metaverse. The executive used the example of PC versus Mac and Android versus iOS to illustrate how Apple tries to lock users into its ecosystem while other platforms can together take advantage of the “upside of what is created”. He argued that the metaverse should be “interoperable” and built by many different developers and companies. According to Zuckerberg, Apple can hurt both competitors and consumers with its rumored mixed reality headset since the company already has full control over the iPhone, which is used by billions of people around the world. “The things that they’re doing are not as altruistic as they claim them to be,” he said about Apple. Meta has been working with partners such as Microsoft, Autodesk, and Accenture to build its metaverse platform. The new Meta Quest Pro is one of the company’s bets to make the metaverse a reality for more people. Based on rumors, Apple has been working on at least three new AR/VR headsets. The first will be “Apple Reality Pro,” an advanced mixed reality headset that will compete directly with the Meta Quest Pro. The device is expected to feature 8K displays and advanced sensors for gesture and environment detection. Analysts believe the product will cost between $1,000 and $3,000. At the same time, Apple has also been developing a cheaper version of its headset, as well as lighter augmented reality glasses. These, however, won’t be ready until 2024 at the earliest. In a recent interview, Apple CEO Tim Cook suggested that he disagrees with Meta’s vision of the metaverse. According to Cook, the average person likely doesn’t even know what the metaverse is, and he doesn’t believe that people should be encouraged to “live their whole lives” in a virtual world. Unsurprisingly, Cook didn’t say a word about Apple’s upcoming products in this category. All of that is enough to make anyone curious about this metaverse thing Mark Zuckerberg keeps touting as the future of the internet. This is the digital destination where Zuck expects us to spend more and more of our time — at work, but not really, or hanging out with avatar friends at not-real coffee shops. He’s so convinced of this future that last year he renamed Facebook, the company he founded, to Meta, and is plowing billions of dollars into building the hardware that will transport us there. On Tuesday, Meta unveiled its latest effort in that mission, the Meta Quest Pro headset. As my colleague Rachel Metz reports, this thing is slick, powerful, and much improved from earlier iterations. And still super impractical. In short: It’s a cool gadget in search of an audience. It can display text and fine details in VR, making it possible to read even small type with ease. It can track your eyes and facial features, giving you a sense of connection with other people in virtual spaces: If you arch your eyebrows or they puff up their cheeks in real life, so too will the VR avatars. And it can be used as a mixed-reality headset, showing you a view of the world around you in color while letting you interact with digital objects — whether you’re painting on an ersatz easel or putting on a faux mini-golf course. But it costs $1,500 — nearly four times that of the company’s cheapest Quest 2 headset. That might be OK for deep-pocketed professionals like architects and designers, or perhaps for the well-to-do VR faithful who are emotionally invested in the metaverse idea. But for normies, that’s a lot of dough. Too much, you might say, in an economy that’s hobbled by high prices and potentially tumbling into a recession. For that price, you could buy two Xbox Series X gaming consoles and still have money left over for brunch. You could buy a top-of-the-line iPhone and a flight to Denver. Heck, you could skip the gadgets, book a flight to Italy and sip some very real, delicious wine food for a few days all for the price of a single Quest Pro, which promises… I dunno, some nice graphics? Time will tell: Customers can pre-order the headset starting today and it’ll ship later this month. As Rachel notes, the Quest Pro may not be the Tickle Me Elmo of the 2022 holiday season (Gen Zers, you can ask your parents about that one). But its improved design is a milestone for Zuck and his Meta dream, which cost the company $2.8 billion in losses the second quarter alone. The lenses are thinner, the headset itself less front-heavy than earlier iterations, and it reportedly does a better job blending the real and virtual spaces around the user. Which all sounds like a step in the right direction, if you’re someone who believes the right direction is ultimately one in which our lives eventually revolve even more than they do now around being digitally connected to one another. Lyft shares tumbled 12% while Uber’s sank 10% after the Biden administration announced a new proposed labor rule that could reclassify gig workers — the bulk of those companies’ drivers — as employees. Such a change, which the rideshare companies have fought in the past, could entitle millions of gig workers across industries to benefits such as minimum wage and overtime pay. A constant theme of the 2020s so far is that nothing is quite as expected. Not our politics, not our grasp of Covid-19, and, perhaps more than anything else, you can pretty much throw out what you thought you knew about the US labor market. See here: The pandemic’s upheaval of global supply chains pushed manufacturers at home to ramp up production as it got harder and harder (and took longer and longer) to move goods around the globe. Suddenly the domestic producer that used to cost more made a lot more sense than the cheaper one overseas. The upshot is that US factories are suddenly humming, my colleagues Chris Isidore and Christine Romans report. Last week, the September jobs report showed US manufacturers added another 22,000 workers. And right now, the nearly 13 million people employed in American factories make up the industry’s largest workforce since the Great Recession that began in 2007. It’s not all good news (because, honestly, what is these days?). The problem now is finding enough skilled workers to keep up. And it’s not just a problem of pay. Wages are up an estimated 5% this year in manufacturing — that’s not keeping up with inflation, but it is in line with the national average. Factory jobs also tend to pay more than other private sector jobs overall — about $65,000 annually, according to the Labor Department. For one, you can’t just let factories decline for years and then expect them to snap back to peak production with the flip of a switch. “I think we’re in uncharted territory,” said Jay Timmons, CEO of the National Association of Manufacturers. “For every 100 jobs openings in the sector we only have 60 people who are looking. I think it’ll take quite a while to fill that pipeline.” Then there’s the perception problem: Factory life conjures images of an industry in decline, as it was for so long between 2007 and 2020. That’s a tough reputation to reform. “We often take a look at the images of manufacturing and we see the sparks flying … and perhaps it’s a little bit dingy, dark,” says Eric Esoda, CEO of a not-for-profit manufacturing consultancy. “But by and large our manufacturing jobs today are high tech.” Bottom line: The labor story in America remains one where the narrative of recent history doesn’t quite hold. In most downturns, we’ve seen manufacturing decline, giving it a bad rap as a job that’s going extinct. Factories aren’t alone. And managers are going to have to figure out the right combination of pay (humble suggestion: raise it), benefits and growth potential if they want to attract any of the millions of people (especially women) who are opting out of the labor force completely. The exploit was initially reported on Twitter by blockchain auditors OtterSec, who say “the attacker was able to manipulate their Mango collateral.” “The [MGNO] governance token was valued for far more than it should be,” OtterSec’s Robert Chen told CoinDesk. “With that, [the attacker] was able to take out large loans against it and then drain Mango’s [liquidity] pools. It’s like a lending-borrowing race: if you have overvalued collateral, you can then borrow against that collateral, and that’s what they did.” According to Chen, it remains unclear how, exactly, the attacker managed to inflate MNGO’s value in the eyes of the Mango protocol, though there are already several theories floating around on Twitter suggesting how the heist could’ve been pulled off. Mango confirmed the exploit in a Tweet on Tuesday, stating that it was “investigating an incident where a hacker was able to drain funds from Mango via an oracle price manipulation.” The drained funds remained, at press time, on the Solana blockchain. In similar cases, centralized exchanges like Coinbase, Binance and Kraken – the only entities with enough liquidity for someone to cash out amounts this large – have blacklisted offending addresses. In its initial statement, Mango said it was “taking steps to have third parties freeze funds in flight” and “disabling deposits on the front end as a precaution.” Mango is a decentralized crypto exchange on the Solana blockchain that offers users the ability to make spot trades and loans. Mango’s MNGO token was down over 42% in the past 24 hours amid fears that the platform may have been exploited, according to price data from CoinMarketCap. CoinDesk has reached out to Mango for comment. Tuesday’s exploit was the second major decentralized finance attack in less than a week, coming hot on the heels of an $80 million hack last week of Binance’s BNB blockchain. Defense analysts say increasing the two militaries’ ability to operate together would be critical in responding to any Chinese attack should the United States choose to do so, as President Joe Biden recently suggested. POSSIBLE SANCTIONS AGAINST CHINA The bill lays out specific sanctions for the president to impose in the event of “significant escalation in aggression” against Taiwan by China, language intended to increase U.S. deterrence. That would include sanctions against high-ranking Chinese Communist party members, government officials and agencies, as well as state-owned and controlled banks. Other sanctions would block and prohibit property-related transactions in the United States and bar those targeted from obtaining visas to enter the country. CONTROVERSIAL PROPOSALS Some elements of the Taiwan measure have raised concerns about increased tensions with China at the State Department and White House. Congressional aides said these are unlikely to make it into the NDAA. For example, the bill calls for Taiwan to be treated as a “major non-NATO ally” to facilitate the transfer of defense materials and services. And it would require Washington to assess renaming its de facto U.S. embassy from the Taipei Economic and Cultural Representative Office to the Taiwan Representative Office. The suspect, Yoni Christian Barrios, stood in shackles during his brief arraignment and spoke only to say he understood he was being charged with two counts of murder and six counts of attempted murder. He was not immediately asked to enter a plea. Las Vegas Justice of the Peace Harmony Letizia set a Jan. 12 hearing to determine if Barrios will face trial in state court on charges that could have him confronting a possible death penalty, and ordered him to remain jailed without bail. A grand jury could indict Barrios before that time. “We’re doing an evaluation regarding competency based on the nature of everything we know so far,” deputy public defender Scott Coffee said outside court after the hearing. “Obviously there are mental health concerns.” Authorities say Barrios, 32, asked sidewalk showgirls to pose with him for a photo before wielding a large chef’s knife to fatally stab Maris DiGiovanni, 30, and Brent Allan Hallett, 46, on Oct. 6 outside the Wynn Las Vegas resort. Two other women dressed as showgirls were among the six people injured in the midday attack, according to police. Coffee and Tuesday he and defense attorney Jeff Maningo were investigating their client’s background, but Coffee said they believed Barrios was born in Guatemala and has lived in the U.S. for at least several years. It was not immediately clear if Barrios is a documented immigrant. Prosecutor John Giordani declined to comment on Barrios’ citizenship and mental status. He said surveillance video clearly shows the attack. Coffee said he was aware that a man who identified himself as Barrios approached a videographer for Los Angeles NBC sister station Telemundo 52 outside Los Angeles City Hall on Oct. 4 and asked for help, saying he had lost his home and everything he had. The defense attorney said Barrios may have been under enough stress to trigger what Coffee termed a psychotic episode. A Las Vegas police arrest report said that after arriving in Las Vegas, Barrios sought work at the Wynn and asked a hotel janitor to contact U.S. Immigration and Customs Enforcement to return him to Guatemala before the alleged sidewalk attack. Barrios told police he was trying to sell his chef’s knives so he could go back home, and police said he was wearing a chef’s long-sleeved white jacket that was stained with blood when he was arrested after a short chase. Officers also retrieved a knife that Barrios was believed to have thrown into bushes as he fled, according to the authorities. Clark County District Attorney Steve Wolfson has said prosecutors will decide in coming weeks whether to seek the death penalty in the case.

Nike was overwhelmingly teenagers’ favourite apparel choice, with 31 per cent of 14,500 surveyed teens selecting that brand. Lululemon and American Eagle each tied for second place, with six per cent of teens surveyed naming those brands. Tied for fourth spot was H&M and SHEIN.  Teenagers also gave high marks to Lululemon’s e-commerce website. While e-commerce juggernaut Amazon.com was unsurprisingly teenagers’ favourite online retailer, the next favourite e-commerce websites, in order, were SHEIN, Nike and Lululemon. The average age of those surveyed was 15.8, with 52 per cent being boys, 46 per cent being girls and two per cent being non-binary.  Appealing to teenagers is important for brands because it bodes well for potential future sales. As teenagers age, and become more affluent, they are better able to spend more at businesses that they have an affinity for. Only 39 per cent of surveyed teenagers had a part-time job. Lululemon CEO Calvin McDonald on a Sept. 1 conference call discussed his company’s customer-acquisition strategy. “The strategy is, obviously, bring them in – new guests – migrate them up, and expand and increase the share of wallet,” he said.  McDonald has also been trying to broaden his company’s customer base by appealing to men. One initiative, for example, was to have Lululemon launch what he called a “digital flagship store” on JD.com, a popular online retailer in China. “JD’s customer base skews more heavily towards men, and represents a compelling new guest acquisition tool for us as we continue to grow our brand in the region,” McDonald said. Lululemon has historically aimed to appeal to younger and middle-aged women. Former Lululemon CEO Christine Day, in 2009, told BIV in an exclusive interview that the company’s target demographic was women aged around 32 years who were healthy and active.  “We know that when we build and design our stores toward her and around her that the brand is attractive to the core customer who is slightly older and a bit more affluent, but who wants to be that 32-year-old,” Day said.
