Most of us likely have a degree of familiarity with the term “deepfake” – they’ve become increasingly common.
For those who are less familiar, a deepfake is a life-like digital impersonation, usually of a well-known individual. They can take the form of face re-enactment (where software manipulates an individual’s facial features), face generation (where a new face is created), face swapping (where one person’s face is swapped with another’s), and speech synthesis (where voices are re-created).
The metaverse and deepfakes
Given the ability of a deepfake to make it appear as if an individual has acted in a way in which they have not, they pose a direct threat to the accuracy of information relating to any individual in a digital environment.
The advent of the metaverse only serves to increase the risks posed by deepfake technology – there will likely be more opportunities for its use as the metaverse moves from representing individuals as avatars or other similar graphic representations towards representing individuals in more life-like ways.
Time and resource is being poured into the metaverse, and some commentators have predicted that by 2030 we will be spending more time in the metaverse than we are in the real world – shopping, socialising, working and attending events. We are already seeing well-known individuals such as Paris Hilton and Snoop Dogg creating their own virtual worlds, and we should expect more to follow.
Disinformation and manipulation
Many deepfakes we have seen so far have been created as obvious parodies, such as 2020 deepfakes of Richard Nixon announcing the failure of the 1969 Moon landing. However, this evolving technology has the potential to be used for disinformation relating to international diplomacy and even war – in June 2022, it was reported that the mayors of several European capitals had been duped into taking part in video calls with a deepfake of the Mayor of Kyiv, Vitali Klitschko. The pitfalls for journalists here are clear.
It is not difficult to envisage deepfake technology being used by unscrupulous actors to impersonate celebrities and politicians on metaverse platforms and for it to become difficult to distinguish between genuine and fake digital depictions of individuals.
The risk of wrongly ascribing views or actions to individuals is significantly increased in the virtual world, with all of the usual expensive real world legal consequences. Worryingly, there is also clear potential for individuals to deny past actions and to claim that they have been subjected to the use of deepfake technology.
Trust – a disappearing luxury
So, what can journalists who want to report on what is happening in the metaverse do to protect themselves from libel claims as a result of mistaken identity and make sure they are not being duped?
The same rules are likely to apply to the avatars/graphic representations of people who now appear in the metaverse as will apply once more life-like representations of individuals become prevalent.
The first is to exercise the usual caution when it is not possible to identify conclusively the real person behind the digital representation. If the decision to publish is made, qualify any assumptions as to identity appropriately in any reporting, which may help if an issue does arise.
Another is of course to try to verify the identity of the individual behind the digital representation, via online research or real-life sources. In cases where public interest is involved, the public interest defence may be helpful, provided you reasonably believe that publishing the statement complained of is in the public interest and the reporting is what used to be described by the courts as “responsible journalism”.
In due course it is likely that metaverse platforms will adopt digital identification solutions which will help to verify identity in the metaverse. These will either be developed by the platforms or by third party providers who may use blockchain technology to verify identity – this is likely to be needed for robust financial systems to develop in the metaverse. Systems such as the blue tick identification already seen on social media may well be used in the case of well-known individuals.
There is also technology in development which aims to discern between deepfakes and genuine footage/content (including AI, which claims to be able to identify audio deepfakes) which may be helpful.
Until then the position is much as it was at the advent of the internet and social media – laws originally intended to deal with the pre-digital world can often be used to deal with issues relating to the metaverse in the same way. If not, the law will eventually catch up either through case law or legislation.
As all the world becomes a stage, the best advice is to be aware of the potential for digital impersonation. Trust has become an unaffordable luxury, so be cautious – check and verify the real person behind a digital representation where you can.

European markets were mixed on Friday to round out a volatile week, as global investors await a key monthly jobs report out of the United States.
The pan-European Stoxx 600 index was fractionally below the flatline in early trade, with tech stocks falling 1.4% while banks added 0.6%.
The jobs report due at 1:30 p.m. London time is expected to show an increase in payrolls of 275,000 in September, with unemployment projected to remain steady at 3.7%, according to economists surveyed by Dow Jones. The reading will likely influence the U.S. Federal Reserve‘s monetary policy decision in November.
Markets in Asia-Pacific retreated on Friday, with Hong Kong’s Hang Seng index leading losses, while U.S. stock futures also pulled back slightly in early premarket trade. Major U.S. averages closed lower during regular trading on Thursday but are still on course for their best week since June 24.
Stocks on the move: Renault up 4%, AMS-Osram down 4%
Renault shares gained 4.1% in early trade to lead the Stoxx 600, while at the bottom of the index, electronics company ams Osram fell 4.7%.

German industrial production falls in August
German industrial output declined in August, the country’s Federal Statistical Office revealed Friday, as supply bottlenecks persisted due to the war in Ukraine and lingering pandemic-related distortions.
Industrial production dropped by 0.8% month-on-month, below expectations for a 0.5% decline among analysts polled by Reuters.
However, July’s monthly figure was revised up to 0% from its previous -0.3%.

Credit Suisse to buy back $3 billion in debt, sell landmark hotel as credit fears persist

Troubled bank Credit Suisse offered to buy back up to 3 billion Swiss francs ($3.03 billion) of debt securities Friday, as it navigates a plunging share price and a rise in bets against its debt.
The Swiss lender also confirmed that it is selling its famous Savoy Hotel in Zurich’s financial district, prompting some speculation that it is scrambling for liquidity.
In a statement Friday regarding the offer to repurchase debt securities, Credit Suisse said: “The transactions are consistent with our proactive approach to managing our overall liability composition and optimizing interest expense and allow us to take advantage of market conditions to repurchase debt at attractive prices.”

At least two people were killed and half a dozen injured after a man went on a stabbing rampage Thursday near a casino in Las Vegas, police said.
Las Vegas police received a report of a stabbing at 11:42 a.m. Officers arriving at the scene “quickly identified the suspect” and took him into custody “without further incident,” law enforcement said in a statement. The arrest occurred within a “matter of minutes” after the stabbings at 3100 block of South Las Vegas Boulevard, Clark County Sheriff Joseph Lombardo said at an afternoon news conference.
The stabbing attacks occurred in broad daylight in an area frequented by tourists, near the Wynn casino.
The eight victims included one who was pronounced dead at the scene and another who was pronounced dead at University Medical Center, a hospital a few miles from where the incident occurred. Of the six people injured, three are in critical condition, the police said. The victims included both tourists and locals, Lombardo said.
The suspect is a man who appears to be in his early 30s and is probably not a local resident, law enforcement said. Police officers were not able to immediately determine the suspect’s motives, but the stabbing appears to have been unprovoked, James LaRochelle, a senior Las Vegas police official, told reporters.
A “large knife with a long blade” was recovered at the scene, he added.
The suspect initially stabbed two people, before going south, and stabbing five more people. An eighth person was stabbed at a third nearby location, LaRochelle said.
Although police did not release the identities of the victims, witnesses told local media that they included showgirls.
The alleged assailant said he was a chef, witnesses told KTNV Las Vegas, and had asked to take photos with the showgirls. When they declined, he began the attack, KTNV reported.
A witness interviewed by a local television station said she saw one victim screaming that he had been stabbed. He took off his T-shirt, apparently to put pressure on his chest wound, before sitting down at the bottom of an escalator, shaking. It took around ten minutes before first responders arrived to treat the man, she said.

Let’s begin. The Securities and Exchange Board of India on Thursday asked Brickwork Ratings to wind down its operations within six months for failing to exercise proper skill, care and diligence while discharging its duties as a credit rating agency. The regulator has cancelled Brickwork’s certificate of registration, granted in 2008. Brickwork is one of the seven credit rating agencies registered with Sebi. By referencing science-based outcomes like a longer life, improved sleep and some social incentives – like better sex – my hope was that a consolidated presentation would supply the power to grab men’s attention and prompt them to take action. A 2021 paper from Frontiers in Psychology suggests that there is an ever-expanding number of behaviors included under the umbrella of healthy behavior. This prompted the authors to characterize being healthy as a process in which traditional views of physical activity and healthy eating as boring and depriving are replaced by a mindset in which they are appealing and valued, and can ultimately produce a culture in which they are enjoyed!
In short, they argue that mindset matters when it comes to overcoming this barrier to behavior change. Leveraging this expanded menu of behavior will enable you to ditch the notion that fitness is drudgery, find the attraction and sustain your engagement over the long haul.
More tips
With the right perspective in place, here are some additional tips on the widening portfolio of healthy tactics. The Mayo Clinic reminds us that movement outside of normal structured exercise can generate similar benefits. Activities like house cleaning, making the bed, shopping, mowing and gardening are all forms of physical activity that can help, particularly if you log the number of minutes per week recommended for standard exercise – 150 minutes per week of moderate physical activity or 75 minutes of vigorous aerobic activity. In a reference to diet, the Mayo Clinic recommends keeping a journal to track your reaction to meals and snacks so you can modify your diet to maximize achievement.
Another thought on changing your lifestyle comes from the Harvard Medical School, which recognizes that “every individual has his or her own lifestyle and needs an individualized approach to changing it.” For those looking to adopt healthy behaviors, the experts at Harvard encourage their patients to connect their desired behaviors with what matters in their lives, and help them build the confidence so important to behavior change. With an extended and diversified bundle of healthy activities, you can tailor a regimen that works for you and supports the more conventional dimensions of diet and exercise.

Michigan State University presents a number of alternative activities for individuals and families – with fun in mind. They include dancing, walking, swimming and hiking. And the U.S. Department of Veterans Affairs adds bicycling with family or friends, or a beginner’s exercise class.

PITTSBURGH — The afternoon sunshine gave way to a pristine golden hour. There wasn’t a single cloud in the sky.
The Roberto Clemente Bridge, which has been undergoing construction all season, stood tall in the background of PNC Park, donning a fresh coat of paint. The structure is not yet complete, but the finish line is within grasp.
Perhaps in a year or two, the Pirates will view this moment, this sliver of time — one accentuated by a 5-3 win over the Cardinals on the season’s final day — as a bit of foreshadowing.
“There are definitely signs of how we’re moving in the right direction,” said manager Derek Shelton. “It is frustrating as it can be at times. It’s part of the process. But I think our processes is starting to really show that it’s working.”
The Pirates finish the 2022 season, their third with Shelton at the helm, with a record of 62-100. To hit the century mark in the loss column for a second year is, without question, unsavory. But as various members of the team take a step back and evaluate the season, there is a uniform sense of optimism that better days lie in the not-so-distant future.
“I think if you ask anyone here, they’re not happy with the ultimate season, but I also think there were a lot of good things that came out of it,” said Bryan Reynolds. “A lot of good, young players came up and produced well for us. We’ve got a bunch of good, young players in the minors.
“We had [Oneil] Cruz come up, [Roansy] Contreras, [Luis] Ortiz. There’s too many to go through right now, but a lot of guys came up and showed the future’s bright. Obviously, in the moment, [it] didn’t go the way we would have liked, but I think in the future, it will.”
The roster, as currently constructed, features a brevity of foundational parts and pieces. Reynolds and David Bednar are both All-Stars. Ke’Bryan Hayes is a candidate to win a Gold Glove, if not a Platinum Glove. Cruz and Contreras teased their tantalizing talent as rookies. Mitch Keller’s offseason work bore fruit, and he posted the best season of his career. So on and so forth.
Those are just the names on the Major League roster, as the farm system currently features a collection of prospects who could debut as early as next year.
Quinn Priester, Endy Rodriguez and Mike Burrows — the Pirates’ No. 3, No. 6 and No. 8 prospects per MLB Pipeline, respectively — have all gotten a taste at Triple-A Indianapolis. Henry Davis and Nick Gonzales — Pittsburgh’s No. 1 and No. 5 prospects per MLB Pipeline, respectively — will likely begin next season at Indianapolis and could very well be donning the black and gold by season’s end as well. There are also the under-the-radar names that had great seasons, such as outfielder/catcher Blake Sabol and outfielder Matt Gorski, among others, who could earn their way to Pittsburgh.
“Sometimes, it’s frustrating in the process,” Shelton said.
“Sometimes, that process can make you gray, like it’s done me a little bit. But yeah, I think we’re starting to see the growth. That growth comes back to what we’ve done over the last two years. We’re starting to see the guts of that core that’s going to be able to help us do that.”
For all the young talent in the organization, the Pirates stand to benefit from adding veterans into the mix. Pittsburgh had several veteran presences in its clubhouse this year in José Quintana, Chris Stratton and Daniel Vogelbach — a trio just about universally praised for being positive influences — but all three were dealt at the Trade Deadline. For a young team that got younger as the year went on, a couple of veterans would be invaluable, as this core learns to consistently win at the Major League level.
“I think it will be great if they bring in a veteran, especially a pitcher to come over here. When we had Quintana here, Quintana was huge for us,” Contreras said through team interpreter Mike Gonzalez. “The IQ of baseball that he has, the information that he would share with us, even just seeing how he would go about his day, his preparation. I feel like having veterans around here, especially us being such a young team, is going to be very beneficial for us.”
“You can see the common core here, and you know what’s happening, and you know what we have coming,” said Wil Crowe, “but at the same time, you add a piece here, a piece there, and we got a really good chance to be a really, really good team.”

The Walt Disney Company is one of the world’s best-known entertainment brands and is responsible for some of the best-loved children’s stories of all time. For this reason, the much-hyped concept of the metaverse – immersive, experiential online environments ripe with potential for magic and storytelling – is a perfect fit for its business strategy.

Disney’s IP includes Marvel, Star Wars, its vast library of animated movies going back over 60 years, and beloved children’s brands such as Disney Princesses and Disney Villains. It stands to reason that any sort of shared, online digital universe focusing on these worlds and characters would most likely be a huge money earner for “the house of mouse”. Although specific details of this are currently few and far between, it would seem a fairly safe bet that it is cooking something up along these lines!
As well as movies, TV shows, and cartoons, the legendary entertainment brand is, of course, famous for its resorts and theme parks. This ability to bring fantasy to life in the real world also ties in neatly with the metaverse, which many believe will focus on blending the real with the virtual. For these reasons, Disney is probably one of the companies that are best placed to capitalize on the opportunities offered by connected, immersive, and persistent virtual worlds. So here’s an overview of some of the ways we know or expect that it will jump on this exciting new trend.
Getting the team together
To build metaverse opportunities, you need people in place. Disney has shown it is working on this with the appointment of its first “metaverse executive”, Mike White, to start building the metaverse strategy. Mike’s title is SVP of next-generation storytelling and consumer experiences, and it’s thought he will focus on understanding the potential of virtual reality (VR), augmented reality (AR), and other metaverse-aligned technologies. What these technologies offer Disney and other entertainment and media conglomerates is a whole new range of tools for building new audience experiences. Disney has traditionally always been forward-looking and was quick to jump the arrival of previous game-changing breakthroughs such as the arrival of television, computer-generated animation, video games, and the internet, so there’s no reason it will treat the arrival of the age of VR and the metaverse any differently.
Other new hires at Disney that hint at the potential it sees in this technology include Erin Green, formerly head of communications for mixed reality (MR) research at Meta (Facebook). Hiring senior people at this level shows that Disney is serious about establishing itself as a key player in the metaverse industry – an industry that it is predicted could be worth up to $13 trillion by 2030. On top of this, Disney was also highlighted as the company with the greatest interest in hiring AR and VR staff during the first quarter of 2022.
Next-Generation Storytelling
Storytelling lies at the heart of everything that has made Disney great, and it makes sense that it will be the lynchpin that holds together its metaverse strategy. When people think of Disney stories, however, they are most likely to first think of the passive experiences of its movies and TV shows. However, CEO Bob Chapek has made it clear that he intends for this to change, having recently said during an earnings call: “We realize that it’s going to be less of a passive-type experience where you just have playback, whether it’s a sporting event or whether it’s an entertainment offering and more of an interactive, lean-forward, actively engaged type experience.”
A number of virtual reality experiences have already been created based on Disney properties, perhaps most notably the Tales from the Galaxy’s Edge Star Wars-themed experience. While not a true metaverse experience, being limited to one individual player, it shows that Disney is serious about the potential of VR. Some have suggested that recent trademark applications suggest that a metaverse experience of some sort based on the Marvel brand is also under development and could be unveiled soon.
Blockchain and NFTs
Many fans of the metaverse concept believe that blockchains and related technologies such as non-fungible tokens (NFTs) will play a big role in the new worlds that are being built. This is because they enable virtual worlds (and anything else virtual, really) to be built with a degree of decentralization – freedom from centralized control of any one authority. In Disney’s case, it would probably want to keep centralized control of its own digital environments – if it was to make a virtual theme park, for example. But NFTs, in particular, also hold the potential for creating unique digital collectibles and limited-edition virtual assets. All things that fans of Disney’s brands are known to value! The company has already created a series of NFTs called Golden Moments, celebrating some of its most loved characters and moments from its movies. Unlike the huge range of traditional, physical collectibles the company sells, these ones are designed to go on providing revenue for the company. Thanks to the “smart contract” functionality that can be built into NFTs, a fee of six percent is taken by Disney every time they are traded or re-sold among fans and collectors.
Theme Parks And Virtual Worlds
Chapek has said, “We have something no one else has … our parks. If the metaverse is the blending of the physical and the digital in one environment, who can do it better than Disney?”
In fact, this blending has been going on for a while – visitors to Disney parks, resorts, hotels, and cruise ships have long been able to take advantage of “magic” wristbands that can be used to unlock a variety of virtual and real-world interactions, as well as store credits that can be used for purchases in shops and restaurants. These could be thought of as the initial building blocks of a metaverse plan that includes theme parks. More clues could be found in a recent patent application. This hints that the company is interested in building AR environments that don’t require users to wear headsets. According to the application, this would involve a technology known as SLAM – Simultaneous Localization and Mapping. This would theoretically track guests’ movements through a real-world environment – a theme park, for example – and use projectors to bring characters to life in front of their eyes. Similar technology is already used during live performances and parades at the parks; the difference here is that the visuals will be personalized to specific visitors, creating an experience that’s unique to the individual.

So, while concrete details on Disney’s plans for the metaverse are, as of writing, scarce, it seems clear that plans of one kind or another are afoot. WASHINGTON, Oct 7 (Reuters) – U.S. job growth likely slowed in September as rapidly rising interest rates leave businesses more cautious about the economic outlook, but overall labor market conditions remain tight, providing the Federal Reserve with cover to maintain its aggressive monetary policy tightening campaign for a while.
The Labor Department’s closely watched employment report on Friday is also expected to show the jobless rate unchanged at 3.7% last month, with strong annual wage gains.
The labor market has largely been resilient to the higher borrowing costs and tighter financial conditions, with economists saying businesses are reluctant to layoff workers following difficulties hiring in the past year as the COVID-19 pandemic forced some people out of the workforce, partly due to prolonged illness caused by the virus.

“There is obviously no inclination for firms to fire people, but they’re starting to get a little bit more nervous about the economic outlook,” said James Knightley, chief international economist at ING in New York.
Nonfarm payrolls likely increased by 250,000 jobs last month after rising 315,000 in August. While that would be the weakest reading since December 2020, it would be way above the monthly average of 167,000 in the 2010s. Estimates for payrolls growth ranged from as low as 127,000 to as high as 375,000.
“That’s a performance that we feel would not change the Fed’s assessment of a labor market that is still too tight,” said Sam Bullard, a senior economist at Wells Fargo in Charlotte, North Carolina. “And that is not conducive to getting inflation back down to the Fed’s 2% target.”
The U.S. central bank has hiked its policy rate from near-zero at the beginning of this year to the current range of 3.00% to 3.25%, and last month signaled more large increases were on the way this year.
September’s consumer price report next Thursday will also help policymakers to assess their progress in the battle against inflation ahead of their Nov. 1-2 policy meeting. Financial markets have almost priced-in a fourth 75-basis points rate increase at that meeting, according to CME’s FedWatch Tool.
While government data this week showed job openings dropped by 1.1 million, the largest decline since April 2020, to 10.1 million on the last day of August, there are still 4 million more vacancies than there are unemployed Americans. An Institute for Supply Management survey on Wednesday also showed several services industries reporting labor shortages in September.
There is a risk that the unemployment rate fell last month after being boosted in August by 786,000 people who entered the labor force, the most since January.
That together with seasonal adjustment issues around summer employment patterns lifted the labor force participation rate, or the proportion of working-age Americans who have a job or are looking for one to 62.4% in August from 62.1% in July.
But most of the entrants were prime-age workers, which raised the labor force participation rate for this cohort above the average rate for 2019. A repeat was not expected.

“This suggests still positive monthly job gains, in excess of 100,000, will continue to put downward pressure on the unemployment rate,” said Veronica Clark, an economist at Citigroup in New York. “Evidence of a still very tight labor market will likely keep the Fed hawkish.”
The Fed is projecting that the unemployment rate will rise to 3.8% this year and to 4.4% in 2023. That would be above the half-percentage-point rise in unemployment that has been associated with past recessions.
With the labor market still tight, wage gains remain solid. Average hourly earnings are forecast increasing 0.3% after a similar rise in August. That would lower the annual increase in wages to 5.1% from 5.2% in August. The Atlanta Fed’s wage tracker, which controls for compositional effects like skill level, occupation and geography, is running above 6%.
The average workweek is forecast unchanged at 34.5 hours, indicating firms are opting to hang on to their workers instead of cutting jobs for now. Indeed, first-time applications for unemployment benefits remain at very low levels.
“It tells you that the economy is not exactly booming but not contracting either,” said Sung Won Sohn, a finance and economics professor at Loyola Marymount University in Los Angeles.
But with the headwinds from higher borrowing costs and slowing demand rising, economists expect companies will significantly pull back on hiring, with negative payrolls likely next year. Economists say businesses have been backfilling open positions as they struggled to expand headcount to match increased demand for their products, driving up job gains.
The economy has created 3.5 million jobs so far this year, even as gross domestic product contracted in the first half.
“The boost to job growth from backfilling may end sooner rather than later,” said Ellen Zentner, chief U.S. economist at Morgan Stanley in New York.
“Given the slowing in labor demand we foresee coming from higher interest rates should continue, removing the pillar of support that labor backfilling has provided so far this year could lead to a faster collapse in jobs growth than normal.”

The United States Defense Department (DoD) has added more than a dozen Chinese companies, including the world’s largest drone manufacturer, to a blacklist of firms with alleged ties to the Chinese military, clearing the way for restrictions on their business.
Shenzhen-based DJI Technology, which is estimated to control more than half of the global market for commercial drones, is among the 13 firms added to the blacklist released by the Pentagon on Wednesday.
The blacklist grants the US president authority to impose sanctions against companies deemed to have connections to the Chinese military.
The announcement comes after the US Treasury Department last year banned US-based persons from trading shares of DJI and seven other Chinese companies over their alleged involvement in the surveillance of ethnic minority Uighurs in China’s far-western region of Xinjiang.
BGI Genomics Co, a genetic testing company; CRRC Corp, which manufactures rolling stock; and Zhejiang Dahua Technology, a Hangzhou-based surveillance equipment maker, were also added to the updated list.
The blacklist includes more than 60 Chinese firms, including tech giant Huawei Technology and semiconductor maker SMIC.
“The Department is determined to highlight and counter the People’s Republic of China’s Military-Civil Fusion strategy, which supports the modernization goals of the People’s Liberation Army by ensuring its access to advanced technologies and expertise are acquired and developed by PRC companies, universities, and research programs that appear to be civilian entities,” the Pentagon said in a statement.
Charles Rollet, an analyst at Pennsylvania-based surveillance research group IPVM, said the moves against DJI, which is estimated to control more than half of the global market for commercial drones, were a warning to investors to steer clear of the company.
“DJI had already been added by the US Treasury to the Non-SDN Chinese Military-Industrial Complex Companies list in December 2021, barring US investment into the firm. So the DoD listing confirms the US government firmly considers DJI to be a contributor to the People’s Republic of China (PCR) military,” Rollet told Al Jazeera.
“Note that DJI has received investment from a PRC state-owned fund, China Chengtong, which openly touts Military-Civil Fusion as a core goal.”
Al Jazeera has contacted DJI, Dahua, BGI and CRRC for comment.
US President Joe Biden has pushed to isolate Chinese companies with alleged military ties as part of a sweeping effort to counter Beijing in areas ranging from defence to technology and trade.
China has described US sanctions against Chinese firms as “typical political manipulation” and warned scientific and technological advancements should not be used as tools to restrict the development of other countries.

A current Family Court judge and a public defender who works with appellate cases are squaring off for a vacant spot on Nevada’s Court of Appeals.
Chief Deputy Public Defender Deborah Westbrook is running against Family Court Judge Rhonda Forsberg to join the panel of three judges who sit on the appellate court, which rules on about a third of the cases that are submitted to the Nevada Supreme Court. Judge Jerome Tao, who currently presides over the Court of Appeals’ Department 1, did not file for re-election this year.
The race in the November general election will be nonpartisan.
Forsberg, 59, was appointed to Family Court Department G in 2019, and then won the 2020 election for the seat with 70 percent of the vote. She has not vacated her seat in Family Court, and will continue to serve on the bench if she loses the election for the appellate court.
Forsberg said the appellate court needs a judge who specialized in family law.
“We don’t have anybody that has such in-depth family law experience,” she said.
Westbrook, 46, started her career in labor and employment law before joining the Clark County public defender’s office’s appellate team in 2013. Westbrook said she’s a “rare candidate” who has practiced both civil and criminal law for roughly the same amount of time.
“I really want to put my diverse experience to work for the people of Nevada,” she said.
Westbrook graduated from the University of Washington School of Law in 2002, and moved to Las Vegas in 2004. She has also served on the editorial board for the Nevada Lawyer magazine, and was appointed to the Commission on Nevada Rules of Appellate Procedure last year.
Forsberg worked in the insurance industry before graduated from Boyd Law School in 2005. She opened her own law firm in 2008, primarily handling family law. She’s also served as a pro tem hearing master in Family Court, overseeing domestic violence and temporary protective order cases.
Forsberg said she has worked on about 15 appellate cases before she became a judge. She said covering complex Family Court cases that touch on different areas of the law has prepared her to serve on the appellate court.
“In a family case, it’s the only area of law that I know that has to handle a lot of each kind of law,” she said.
Westbrook said she is best suited for the appellate court because she understands the “unique issues” related to appellate law.
“When it comes to being ready to start on Day 1 of a new job as a Court of Appeals judge, I’ll be ready to hit the ground running,” she said.

Not unexpectedly, the global celebration of clean air for healthy living was large without impact in Nigeria; no thanks to the myriad of economic, political and insecurity problems that have made other important issues look insignificant.
Yet, this country, perhaps more than most others, needs a searchlight on her environmental matters, given its huge population of about 200 million, the massive neglect of the environment and the corresponding negative impact on health. Certainly, air pollution is a problem that has not been sufficiently acknowledged as one. The time to address it concertedly should not be further postponed.
In the wake of the apparently unending air pollution across the world especially among industrial nations like China, America and Britain, the United Nations had every reason to take the gong the other day ahead of the third-year celebration of International Day of Clean Air for blue skies and called for cleaner air globally. Indeed, the UN is right to be worried as the world continues to face the ordeal of air pollution.
Over the years, the evidence base for the harm caused by air pollution has been growing rapidly and points to significant risks to the world and particularly so, to people living in lower-income countries.
In its bid to achieve cleaner and safe air globally, the UN has outlined certain steps to reduce air pollution and keep people and the planet healthy and safe. This year’s event aimed to raise awareness and facilitate actions to improve air quality around the world.
According to the UN Secretary-General, Antonio Guterres, climate change and air pollution are a deadly duo. Therefore, all countries must strive and work together to combat air pollution and invest in renewable energy and swiftly transit from fossil fuel as well as rapidly move to zero-emission vehicles and alternative modes of transportation. In addition, efforts need to be made to increase access to clean cooking, heating and cooling; and recycle waste instead of burning it.
Insofar as air pollution persists globally among both the rich and poor nations, polluted air may continue to be one of the burdens and greatest environmental threats to public health even as it accounts for an estimated seven million premature deaths every year. Air pollution and climate change are closely linked as all major pollutants have an impact on the climate and most share common sources with greenhouse gases.
As the UN scribe noted: “Today, air pollution is denying billions of people their rights. Dirty air affects 99 per cent of people on the planet, and the poor suffer worst; especially women and girls who suffer from cooking and heating with dirty fuels.”
Indeed, the consistent lamentations of the UN about air pollution and the gloomy picture it paints about the planet, especially with climate change belie the fact that there are regulations on air pollution which, unfortunately, many nations are not obeying.
Failure of the major pollutants to strictly adhere to regulations constitutes a major problem. The unrelenting air pollution and climate change around the world would impact negatively on the people’s livelihood and increase restiveness among regions in Africa.
In Nigeria, the environment is a largely neglected issue over the years. Hence, oil pollution and gas flaring in the Niger Delta region have lasted for decades with no end in sight as the goal post to stop gas flaring continues to be shifted due to a lack of political will by the government as well as the pretext that oil industries cannot stop flaring gas so long as they prospect for oil.
As expected, the unabated pollution and gas flare has degraded both land and water surfaces, thereby rendering fishing and farming impracticable in the region. To make matters worse, the few fertile portions of land have become a regular disorder between farmers and herders overgrazing and destruction of farm produce.
The danger and health implications these portend are enormous, as people are dying from hunger and disease, much against the Sustenance Development Goal (SDG) 3 2030 that stipulates the imperative to ensure healthy lives and promote well-being for people of all ages. Regrettably, neither the Federal Government nor state governments see air pollution as a national security threat.
Aside from the deadly situation in oil-producing areas, air pollution is pervasive in cities through industrial and vehicular emissions, cooking with firewood, refuse to burn, improper disposal of waste and other uncontrolled human activities. Most of these activities undermine existing laws that governments, even at the local level, could enforce but for negligence and official ineptitude. It is important for all governments to have a change of attitude in this regard.
Findings have prompted the United Nations to annually highlight the importance of clean air for blues skies. The theme for this year is, “The Air We Share,” essentially, these are mere expressions used by the international body to deliver beautiful keynote speeches and rehearse the same air pollution problems plaguing the world without holding pollutants to account.
Over the years, the world has been unable to be on the same page in tackling climate change and air pollution in order to ensure a healthy and sustainable planet. There has been no curtailment of the massive annual air pollution and climate change crisis. The consequence of climate change and the catalogue of air pollution plaguing the world is too numerous to mention.
For instance, the sustainable management of water resources and access to safe water and sanitation which are essential for unlocking economic growth and productivity should be sustained in order to fulfil the needs of the growing population as well as provide significant leverage for existing investments in health education. It remains worrisome that the issues often end up as the subject of international diplomatic discussion leaving the people and planet to suffer.
It is time for the UN to work out a coherent approach and call on all countries to work together and combat air pollution. Such collective and affirmative action would save millions of lives each year, slow climate change and speed up sustainable development. It is important for the world body to monitor air pollution, make laws to implement WHO guidelines and deliver credible plans to reduce emissions from vehicles, power plants, construction and industry. It is more important for individual countries, including Nigeria, to take the campaign for clean air beyond the present rhetorical level.

The much-discussed “metaverse” has brought a disruption to the market but also declared a possibility for future innovation, stated Lee-Feng Chien, former managing director of Google Taiwan and current board member of Appier and iKala. With Web3 as a basis, developers, governments, and users are all looking forward to more new technological development.
Chien rasies three perspectives worth noting regarding mertaverse: First, allows everyone to examine new technological opportunities. For instance, past blockchain technology was originally meant for confidentiality. Now, it’s able to create trust and decentralization. AR/VR is a technology, but they also provide content that’s a fusion of virtual and reality.
The second is the indication of technology trends. We’ve already observed that investment is increasingly directed toward Web3, with trends in credibility, high-speed transfer, and 3D content.
The third is that everyone needs to pay attention to the possible impacts of these technologies, such as information security, privacy, and equality. AI technology has already caused racial controversy and increased the economic gap. The metaverse will affect the development of technology and society, causing the strong to get stronger and the weak to get weaker.
Chien mentioned that right now, the region that has been paying the most attention to the metaverse is East Asia. In addition, non-fungible tokens (NFTs) have been the biggest beneficiary. The metaverse is an open and fair virtual world built using blockchain technology, thus everyone can play games, purchase items and socialize through NFT virtual property.
The pandemic also worked to the metaverse’s advantage as it allowed more people to imagine digital life. Chien emphasized that “the metaverse is like an elephant.” It is so big that each person and each industry has only grasped a tiny portion of it so far. Everyone is still feeling it out and trying to describe their understanding of the metaverse. Even those who aren’t familiar with the internet and the digital world are forced to experienced digital life.

Shares in the Asia-Pacific fell on Friday ahead of the monthly U.S. jobs report, which is likely to guide the Federal Reserve’s monetary decision in November.
Payrolls are expected to increase 275,000 in September, and unemployment is predicted to be steady at 3.7%, according to economists surveyed by Dow Jones.
The Nikkei 225 in Japan fell 0.59% and the Topix index slipped 0.6%. South Korea’s Kospi was flat and the Kosdaq dropped 0.33%. The Hang Seng index in Hong Kong lost around 1% and the Hang Seng Tech index shed 2.66%.
In Australia, the S&P/ASX 200 fell 0.6%. MSCI’s broadest index of Asia-Pacific shares outside Japan fell 0.88%. Markets in mainland China remain closed for a holiday.
Overnight in the U.S., major indexes fell — the Dow Jones Industrial Average shed 346.93 points, or 1.15%, to 29,926.94. The S&P 500 declined 1.02% to 3,744.52, while the Nasdaq Composite was 0.68% lower at 11,073.31.
“Equities struggled as markets await the much-anticipated U.S. payrolls data … and as comments from Fed officials maintained a ‘more is needed’ vibe,” ANZ Research analysts wrote in a Friday note.
Malaysia set to announce its budget for 2023
Malaysia’s budget will carry an “even more pronounced” election focus now that speculation of a vote happening this year has grown, according to Mizuho.
Economist Lavanya Venkateswaran wrote in a note, “higher allocations towards cash handouts and other social transfers” are expected, but the government also needs to balance that with the “reality of fading commodity tailwinds in 2023,” which will affect Malaysia’s tax revenues.
“In walking a fine line between sticking to its fiscal consolidation agenda and playing up the election card, we suspect the governments’ scope to announce more medium-term tax reforms (diversifying the tax base away from oil, for example) is limited,” she wrote.
“The underlying assumption is that the government sticks to its stated fiscal consolidation agenda of narrowing the deficit to 5.0% of GDP from 2022-2024; this implies a deficit of 4.5-5.0% of GDP in 2023,” the note said.

Samsung posts decline in operating profit for the first time since late 2019
South Korean chipmaker Samsung Electronics announced a 31.7% drop in operating profit in the third quarter of 2022 compared with the same period a year ago, according to a preliminary earnings release.
Demand for semiconductors has slowed, the release showed.
Operating profit fell to 10.8 trillion Korean won ($7.65 billion), compared with 15.8 trillion won in the third quarter of 2021. That’s the first decline in quarterly profits since the fourth quarter of 2019, data from Refinitiv Eikon showed.
Sales rose to 77 trillion Korean won in the July-to-September quarter, from 73.98 trillion won in the same period last year.
Shares of Samsung Electronics fell as much as 1.95% in Asia’s morning.

Melissa Busch travels throughout rural Columbia County as a Providence Home Health nurse. Her conversations with patients would shape her priorities as legislator if she wins election.

Oregon Nurses Association (ONA) member Melissa Busch wants to bring union values to the statehouse in Salem.
A resident of rural Columbia County, Busch works as a nurse for Providence Home Health, visiting patients in the southern part of her county and parts of rural Multnomah and Washington counties.
This year she’s running for Oregon Senate in District 16, which covers those areas, all of Clatsop County and—when new district boundaries take effect in 2023—all of Tillamook County. The district was long held by former Senator Betsy Johnson, who stepped down to run for governor this year. It’s currently represented by Senator Rachel Armitage, appointed in January by votes of all county commissioners within the district. Armitage did not file to keep the position and has endorsed Busch in the race.
Busch, 41, lived in Topeka, Kansas, until she was 17, when she and some friends headed for Oregon after graduating high school.
Busch earned a degree in religious studies from Lewis & Clark, but didn’t want to pursue an academic career. She spent four years working in the food service industry, trying to figure out her next steps.
“I wanted to be in a profession where I was working with people in some kind of helping and caring capacity,” Busch said.
She returned to school to become a nurse, attending the University of Portland.
Busch has been with her husband for 14 years, and they married this past June. They have two children together, ages 9 and 11, and a 17-year-old who is Busch’s stepson. He turns 18 at the beginning of November, meaning Busch will be on the ballot for the first election he can vote in. All three attend public schools in Columbia County. With a laugh, Busch says her kids are “mostly supportive of the campaign,” although the time she’s away from home campaigning can be challenging.
In her day job, Busch typically visits four to seven patients in their homes per day. She provides hands-on care, servicing and cleaning any surgical tubes after an operation, for example. When a patient gets a new diagnosis or medication, she gives basic education. She also helps patients with chronic or terminal illness learn how to live with the condition.
Her job puts her in contact with older people, people with disabilities, and their families.
Busch sees plenty of people in hard situations. She knows patients who have worked their whole lives and still struggle to afford health care. She sees lots of working people who are trying to care for their own children and elderly family members at the same time.
“People feel like they’re up against such great odds trying to access the basic care to stay healthy, to stay out of hospitals, to raise healthy families,” Busch told the Labor Press.
The current health care system is failing a lot of Oregonians, Busch says, especially in rural areas. And the cost is a key problem, she says.
“Even with nonprofit health care institutions, the reality is it’s still a profit-driven system,” Busch said. “That falls heavily on the backs of the people that do the work, but ultimately it also is really a disservice to the people that we serve.”
While knocking doors throughout Senate District 16, she’s heard stories of people choosing between paying for prescriptions and paying an electric bill, or weighing the cost of a medical appointment against buying groceries for family for the week. She’s seen patients refuse ambulance service, risking their own lives instead of paying the cost for timely medical transport.
Busch favors a universal health care system, and supports the work of Oregon’s Task Force on Universal Health Care, established by the legislature in 2019. The task force is charged with recommending an affordable, comprehensive, publicly funded health care system for Oregonians. It would be a huge shift from private health insurance, and Busch says such an overhaul would benefit more people than previous improvements, like expanding Medicaid.
“The reality is we’re working under a system that is clearly not working for people,” Busch said.
Until there’s a system overhaul, Busch says increasing Medicaid reimbursement rates would make assisted living services and other long-term care more accessible to Oregonians. Increasing reimbursement rates would also help cover costs for clinicians who primarily serve Medicaid-covered patients, she says.
Busch has been an ONA member for 13 years. Before moving to home care, she worked for Providence Portland Medical Center for 10 years. At the hospital, she served on the joint labor-management committee that sets minimum nurse staffing levels for each department. In 2017, Busch joined ONA’s Political Action Committee, which decides the union’s legislative endorsements. As a committee member, she took part in the union’s endorsement process for the 2018 and 2020 elections. Then she decided to run herself.
To prepare, Busch also graduated from the Oregon Labor Candidate School, which trains union members on how to run for political office. Busch enrolled after an ONA government relations rep recommended it during her time with the political committee. During the six-month course, she connected with members of other unions, and came to see the values shared across unions: Solidarity, fairness, teamwork, and a commitment to stand up for the underdog.
She sees the underlying principles of the labor movement as very much part of her electoral campaign.
Busch ran unopposed in the Democratic primary for the seat, and she is cross-nominated by the Independent Party. She’s endorsed by ONA, the Oregon Education Association, Oregon AFSCME, Oregon AFL-CIO, SEIU, the Oregon State Building Trades Council, IBEW Local 48, Northwest Carpenters Union and the Working Families Party. Her campaign is considered a labor priority this year; a win would add a solid labor champion to a Senate that has too often struggled to find majorities for pro-labor legislation.
Busch faces Republican nominee Suzanne Weber, who’s currently the state representative for House District 32, which covers half the population of Senate District 16. Weber, a longtime elementary school teacher, hasn’t received any union endorsements, not even that of her own union.

If you have a flight out of Seattle-Tacoma International Airport in the next several weeks and are hoping for an empty terminal, think again. The leaves may be on the ground, and the kids may be back in school, but the airport is still bustling.
Usually, the end of summer would bring a drop-off in Washington residents jetting away on vacation. But that is not the story in 2022.
Port of Seattle spokesman Perry Cooper said the airport gets projections from airlines for passenger numbers a couple of weeks in advance of flights, and so far, there does not seem to be any remarkable dip in travel in October.

“We are seeing higher numbers here in the fall than we have in the past. It’s not quite the numbers that we’ve seen up into the summer, where we would get 60,000 passengers per day outbound; probably our high points over the next couple of weeks are in the 55,000-passenger range,” Cooper said. “That’s still pretty high. For this time of year [typically], we would probably be down near the higher 40s, and the super slowest days, even lower than that.”
He believes this has to do with COVID-19, noting that people are now eager to get back into the sky after years of staying home.
“It is kind of that ‘revenge travel’ term that we’ve heard over the last year,” he said. “People just want to get out of the house we’ve been in so long throughout the pandemic.”
That goes for international travel, as well.
“Our European travel is above 100% of where it was in pre-pandemic 2019 levels,” Cooper said. “So we’re seeing people getting out in different places, wherever they can — Mexico, the Caribbean.”
Sea-Tac does not expect another day as busy as the one a couple of weeks ago when security lines stretched to the parking garage, and passengers told KIRO Newsradio they waited up to three hours. However, it is very possible that travel may not let up from now through the holiday season.
There are several reasons why the increase in travel can be overwhelming for Sea-Tac. Like so many other businesses, the airport is suffering from staffing shortages. Additionally, Cooper said the airport is smaller, space-wise, than other American airports serving the same number of passengers. There are several construction projects in the works that are building up, rather than out, to accommodate more people.
To deal with the extra people this fall, the airport is trying to have more staff scheduled during its busiest times.
“We’re working to ensure we’ve got as much staff as we can in those peak periods,” Cooper said. “Specifically, between 4:00 a.m. and 11:00 a.m. is always the busiest time because that’s about 70% to 80% of our traffic outbound.”

Airport staff can help direct people to security lines, but they cannot screen passengers. Like the airport, TSA is also experiencing staffing shortages. Extra TSA agents who would normally be based elsewhere were brought in during the summer to accommodate the larger passenger loads, but this program ended in early September.
TSA did not respond to KIRO Newsradio’s requests for information about how the agency would be dealing with the busier-than-usual autumn at Sea-Tac.
If you have a flight in the coming weeks, get to the airport early. Arrive two hours before a domestic flight and three hours before an international one. Punctuality is essential if you are flying out during those peak morning hours.
If you do not have TSA PreCheck, you can still cut down on your time in the security line without spending a dime. The airport is offering the free SEA Spot Saver service, which lets passengers reserve a security screening time. Appointments are limited; you can make one up to 72 hours before your flight.

For a developer with such a long history on Long Island, it’s not surprising that the name of the family-owned builder’s newest community is a nod to the area’s past.
Commack-based Heatherwood Luxury Rentals recently opened Heritage Spy Ring Golf Club in South Setauket, a 200-unit luxury apartment complex and nine-hole golf course named for the Culper Spy Ring, which operated in the Setauket area, providing intel for General George Washington on enemy troop movements during the British occupation of New York City in 1778.
And while its name may harken back to the Revolutionary War some 244 years ago, Heatherwood’s latest development is anything but an antique, offering a comfortable contemporary lifestyle to renters aged 55 and over.

Amenities at the new $70 million South Setauket rental community feature a 6,500-square-foot clubhouse with a fully equipped fitness center, clubroom, conference room, event space and game room. There’s also an outdoor pool and splash pad, fire pits, tennis and pickleball court, bocce court, playground, 2-acre great lawn and walking trails.
As the name implies, one of the main attractions of the 70-acre Heritage Spy Ring Golf Club is a new nine-hole rolling layout designed by noted golf course architect Tyler Rae. In fact, the entire development was built on the former 18-hole Heatherwood Golf Club, originally built in the early 1960s by Heatherwood founders Donald Partrick and Stanley Neisloss.
Established in 1950 by Partrick and Neisloss, Heatherwood started out by building several single-family-home subdivisions on Long Island before the company turned its attention to multifamily rental developments. The firm’s very first apartment community was the 272-unit Heatherwood House at Port Jefferson, which opened in 1962 and is still owned by the developer.

Today, Heatherwood’s portfolio has grown to about 7,000 apartments in Queens, Brooklyn and throughout Nassau and Suffolk counties.
“Everything we own, we’ve built,” says CEO Douglas Partrick, Donald Partrick’s son, who first came into the business in 2002 soon after Neisloss died. “To this day, Heatherwood hasn’t sold any of its developments.”
In the last couple of years, Heatherwood has made some key additions to its executive team. Christopher Capece, formerly with AvalonBay Communities, came on board as president in Jan. 2020 and this spring, Heatherwood added Sean Sallie, former deputy commissioner for planning at the Nassau County Department of Public Works, who is now the company’s director of Planning and Development.
“Although we sometimes consider acquisitions, our growth has historically been via new development. That’s part of Heatherwood’s DNA,” Capece said. “One of the strategic advantages of Heatherwood is that we’re a fully integrated development firm, including design, development, construction, operations and golf and recreational facilities.”
That strategy has been paying off, as the company can claim some major recent achievements. In 2018, Heatherwood opened Tower 28, a 450-unit apartment building in Long Island City. The 58-story complex, which cost well over $200 million, was at the time the tallest residential building in New York City outside of Manhattan.
Another ongoing Heatherwood project will bring 125 apartments and 14 attached ranch-style homes to a 26.9-acre site just south of the company-owned-and-operated Pine Hills Golf Club in Manorville. Dubbed Sun River Town Homes, the $31.16 million project will complement the company’s existing Villas at Pine Hills community where residents will share amenities that include a clubhouse, fitness center and pool.
Heatherwood is also planning on redeveloping the 9-acre site in West Hempstead formerly occupied by National Wholesale Liquidators. That project will transform the property, located across from the West Hempstead Long Island Rail Road station, into a 428-unit, transit-oriented rental complex. Currently in the permitting process, the company hopes to start construction before the end of next year.
And though Heatherwood is always looking for opportunities to expand its portfolio, it hasn’t forgotten about its existing communities. The company has recently embarked on a multi-million-dollar program to renovate and refresh its legacy rental complexes, adding amenities like turf soccer fields, new playground equipment, basketball and pickleball courts, even beach volleyball facilities.
“We did a full market assessment of our entire portfolio, considering demographics and competition, and we identified our communities where we want to begin our re-investment back into the properties,” Capece said.
The renovation work is nearly completed at the 348-unit Norwich Gate apartments in Oyster Bay, where the company built a brand-new clubhouse, courtyard area and added amenities. Next up is extensive renovations at Heatherwood House at Port Jefferson, the firm’s first-ever rental development. The project also includes redeveloping the community’s clubhouse and adding new amenities.
“Even though we’re constantly investing in all of our communities, we’ve just taken a more pointed approach to giving them an enhanced lifestyle,” Partrick said. “It’s not just re-investment. It’s a re-imagining and creating a lifestyle.”

Heatherwood offers a wide range of monthly rents at its rental properties, starting at around $1,500 at some of its Long Island communities to more than $10,000 at some of its New York City buildings.
Monthly rents at the Heritage Spy Ring Golf Club range from around $3,600 for a one-bedroom, one-bath apartment to more than $6,600 for a three-bedroom, two-bath residence. Thirty of the new apartments are designated as workforce housing and priced with reduced rents, with half of those restricted to people earning up to 80 percent of the area median income and half for people earning up to 120 percent of the AMI. The South Setauket development is about 20 percent leased and move-ins began a couple of months ago.
Mitch Pally, CEO of the Long Island Builders Institute, said Heatherwood is a major player in the development of rental housing in Long Island, which is sorely needed.
“There’s no doubt that Heatherwood has been re-invigorated over the last couple of years, as you can see with both new projects like up in South Setauket and hopefully soon in West Hempstead, and refurbishing of their existing product line all throughout the Island,” Pally said. “They are very community oriented. They’ve done a lot through our charitable arm and with LIBI itself over the years. Doug is a former president of LIBI and Chris has been involved with our executive committee for many years, so they take a great role in the need for and the importance of rental housing on Long Island of all types to make it easier to meet the great demand that there is for rental housing.”

Attorney Howard Stein, who heads the Real Estate Practice Group at East Meadow-based Certilman Balin Adler & Hyman and has worked on many Heatherwood projects, echoed that sentiment.

Meanwhile, as the company continues to grow on Long Island, the difficult development environment here poses a challenge and Heatherwood may eventually look to expand in other regions.
“Our preference is to invest in our home market,” Partrick said. “We strive to continue to keep our investment dollars on Long Island even in the face of often challenging entitlement hurdles, but we are also aware that there is capital flight out of the region for a reason.”
