Binance Smart Chain hit the brakes Thursday after the blockchain with ties to the world’s largest crypto exchange suffered what it called a “potential exploit” that on-chain evidence suggested could have targeted hundreds of millions of dollars in crypto. “Due to irregular activity we’re temporarily pausing BSC,” BNB Chain tweeted from its official account, later confirming that the activity was a “potential exploit,” that it characterized as contained. Initial token movements suggested that up to two million BSC tokens were targeted by an attacker late Thursday, but the true losses may be much lower. BNB Chain estimated $100 to $110 million in assets were moved off chain but said in a tweet that $7 million was already frozen. That such a small (comparatively speaking) sum of assets were stolen underscored the upside of BNB’s gamble to halt the chain rather than risk more assets escaping. Blockchains are purportedly decentralized beasts designed to operate beyond the whim of singular entities: you aren’t supposed to just flip an off switch. BSC confirmed that it coordinated a shutdown of the chain after spotting issues with the BSC Token Hub protocol, the clearinghouse for crypto transactions moving between the Binance-linked blockchain’s interlocking parts. It thanked validators for moving quickly. “We are humbled by the speed and collaboration from the community to freeze funds,” one tweet read. The specter of an attack rocked BSC’s native BNB token, which after a sleepy day of trading dipped to $280.40 from $293.10, according to CoinMarketCap, which Binance owns. On-chain data shows that this afternoon two massive withdrawals of 1 million BSC tokens from BSC token hub by an attacker that nabbed crypto assets with cross-chains swaps, bridges, and borrows. Regardless, BNB’s Twitter promised “all funds are safe” and said it will “help freeze any transfers.” Twitter sleuths point out that Tether – the largest stablecoin provider – has blacklisted the offending address, suggesting that the firm suspects the movement of tokens was the result of an attack rather than something more benign. The so-called No Oil Producing and Exporting Cartels (NOPEC) bill gained interest after OPEC+, a group led by Saudi Arabia and Russia, decided on Wednesday to cut oil production by 2 million barrels per day. OPEC+ made the move despite tight oil global supplies worsened by Russia’s war in Ukraine. “What Saudi Arabia did to help (Russian President Vladimir) Putin continue to wage his despicable, vicious war against Ukraine will long be remembered by Americans,” said Senate Majority Leader Chuck Schumer, a Democrat. “We are looking at all the legislative tools to best deal with this appalling and deeply cynical action, including the NOPEC bill,” Schumer said in a statement. NOPEC easily passed the Senate Judiciary Committee in May, with support from Democrats including Senator Amy Klobuchar, a former 2020 presidential candidate. It passed a House committee last year. If passed by both chambers of Congress and signed by President Joe Biden, NOPEC would change U.S. antitrust law to revoke the sovereign immunity that has protected OPEC+ members and their national oil companies from lawsuits. It would give the U.S. attorney general the option to sue the oil cartel or its members, such as Saudi Arabia or Russia, in federal court. “OPEC and its partners have ignored President Biden’s pleas for increased output, and now they are colluding to reduce production and further raise global oil prices,” Grassley said in a statement. “We should at least be able to hold them accountable for their unfair price fixing,” he said. It was uncertain whether an amendment would gain enough support to pass. Congress is unlikely to tackle major legislation until after the Nov. 8 midterm elections. If Washington were to sue other countries for collusion, the United States could face criticism for its attempts to manipulate markets by, for example, its release of record amounts of oil from emergency reserves between May and November. The time to complete the project is expected to jump by about two years, according to the memo. Kelvin Goertzen, the minister responsible for the Crown corporation, said replacing a system that is 20 or more years old is a bigger project than originally thought. Security upgrades a focus He said much of the extra cost is to ensure the new system is secure against data breaches, but it will not affect the rates motorists pay. “They had to rescope the project. They recognized it’s going to be a bit more in-depth than they thought,” Goertzen said Thursday. “There is an ongoing sort of set-aside of funds to pay for upgrades of technology … and I’ve been assured this is a long-term plan that doesn’t impact rates but will benefit service and ensure that the service is secure.” In a written statement, Manitoba Public Insurance said it has used outside consultants to plan the transformation and later found “unidentified gaps … that were crucial to successfully completing Nova.” The corporation also said it has shared all the information with the Public Utilities Board, the provincial regulator.

In the past few years, ranked-choice voting has been adopted in voting jurisdictions across the country, from New York City to more than 20 cities in Utah to statewide elections in Alaska. And advocates for the alternative voting method are hoping to see further expansion this fall. One state, a handful of major cities and smaller jurisdictions have put RCV on the ballot this fall, giving voters the power to change how they elect their government officials. The RCV community is optimistic about the outcomes of those ballot measures. “They are all in play to win,” said Rob Richie, president and CEO of FairVote, which works on election reforms including RCV. As Richie noted, with the exception of a statewide ballot initiative in Massachusetts in 2020, RCV measures have been succeeding across the country. Alaska’s campaign, which went a step further by adding nonpartisan primaries, was one of the most recent victories. The state’s first RCV election made news nationally when former vice presidential candidate Sarah Palin lost a race for the state’s U.S. House seat. While the Nevada RCV campaign is the result of a citizen-led initiative, this fall’s other proposals were the result of actions taken by city councils or charter commissions. Sign up for The Fulcrum newsletter “That’s why they all start off in a good position,” Richie said. “They have a certain level of institutional support that’s been earned. And that makes us feel confident.” While a standard election assigns victory to whichever candidate gets the most votes – even if that total is not a majority of all ballots cast – RCV uses a process that ensures the winner has received support from more than 50 percent of voters. In an RCV election, voters may rank candidates in order of preference. If someone received a majority of the votes, the election is over. But if not, the candidate with the fewest votes is eliminated and the ballots cast for that person are redistributed to voters’ second choices. The process continues until someone has a majority. It is also known as an instant runoff election. There is a heavy concentration on RCV proposals on the ballot in the Pacific Northwest, which Richie credits to the work of groups like FairVote Washington, More Equitable Democracy and Sightline. Other organizations working more broadly on democracy reform, such as RepresentUs, have identified RCV as a significant advancement in U.S. politics and have been supporting such efforts. “It’s no coincidence that RCV is on the rise across the country; it’s happening because people across the country want elections that hold politicians accountable and offer better choices,” said Jen Johnson, movement director for RepresentUs. “Ranked-choice voting is a simple change that makes a powerful difference – it means that politicians can’t get elected unless they have a majority of the vote, and voters no longer have to choose between the lesser of two evils. It’s a proven voting method that’s been used in American elections for over a century.” Here’s where RCV is on the ballot this fall, according to FairVote: Clark County, Wash. The state’s fifth largest county, Clark would use RCV for all county-level general elections. Evanston, Ill. If adopted by the voters, this proposal would institute ranked-choice voting for local general elections. Fort Collins, Colo. In 2021, the state’s General Assembly passed a law allowing cities to switch to RCV elections. Fort Collins would be the sixth to do so, following Basalt, Boulder, Broomfield, Carbondale and Telluride. Multnomah County, Ore. Voters in Oregon’s most populous county will decide whether to use RCV in future elections. Nevada This is the only statewide RCV initiative this year, and it’s similar to the new system adopted by Alaska in 2020. If successful, state and federal elections (except for presidential voting) would become “top five” primaries with ranked-choice general elections. All candidates would run in a single, open primary and the five who receive the most votes all advance to the general election, which would be decided by ranked-choice voting. (Alaska has a “top four” system.) The proposal needs to win approval twice – this year and again in November 2024. Ojai, California A half-dozen California jurisdictions already use RCV, including San Francisco and Oakland. Ojai would use it in general elections for local races. Portland, Maine Maine already uses RCV for federal and statewide elections, and Portland uses it for all city races. But the city council has put forth an initiative to use proportional RCV for multiwinner elections. Portland, Ore. While New York City is the largest jurisdiction using RCV, Portland hopes to become the biggest U.S. city using a variation known as proportional ranked-choice voting. While PCRV would be used for city council elections, traditional RCV would be used for other municipal races. Portland would be divided into four city council districts that would each be represented by three people. Voters continue to use RCV, but their support can be transferred to additional candidates if their top choice is election. FairVote is a good explainer. San Juan County, Wash. Like Clark County’s proposal, this one would establish RCV as the election method for county elections in San Juan. According to FairVote, this was the first RCV measure to be placed on a ballot this year. Seattle Washington’s largest city offers a rare competition of alternative voting systems. After first granting a ballot question to supporters of approval voting (in which voters may support as many candidates as they wish, with the person receiving the most votes winning), the city council then agreed to allow consideration of RCV as well. So that has created a two-step process in Seattle, where voters will first decide whether they want to make a change and then whether they want RCV or approval voting. If the voters pick one of those systems, it will be used in party primaries to select nominees who advance to a standard general election.

With most pandemic travel restrictions gone, the nation’s tourism leaders say delays by the federal government in approving tourist visas are now robbing L.A. and other U.S. tourist destinations of millions of visitors and billions of dollars in tourism spending. “Outrageous wait times send a message to travelers that the United States is closed for business,” Geoff Freeman, chief executive of the U.S. Travel Assn., the nation’s travel trade group, said Thursday. The U.S. Travel Assn. released a study Thursday, estimating that in 2023, the U.S. is projected to lose $11.6 billion in tourism spending because 6.6 million international travelers will be unable to get visitor visas to travel to the U.S. in a timely manner. Wait times of 400 days and longer to get an interview for a visitor’s visa have deterred potential tourists primarily from Brazil, India and Mexico, according to the study. Instead of visiting the U.S., most of those travelers would probably choose another vacation destination if visa wait times exceeded a year, the survey of nearly 2,500 potential tourists from Brazil, India and Mexico determined. Adam Burke, chief executive of the Los Angeles Tourism and Convention Board, agreed that longer waits for visa interviews are keeping international tourists from visiting the region, but he commended federal officials for trying to address the problem. “We know there is tremendous pent up demand for travel to the U.S., which is being hindered by these delayed visa wait times,” Burke said in a statement. The tourism and convention board is forecasting 5.3 million international visitors for the fiscal year that ends June 30, 2023, a 58% increase over the prior year. The U.S. Department of State, which oversees approval of visas for travelers from certain countries, has been hampered by the COVID-19 pandemic, and many embassies and consulates “continue to face staffing challenges that began during the pandemic,” a spokesperson for the agency said in a statement. The department has bolstered staffing levels, partly by hiring diplomats’ family members, to cut the wait times for visa interviews, the agency said. “Visa processing is rebounding faster than projected, after a near-complete shutdown and freezing of resources during the pandemic,” the statement said. International visitors spent $13.7 billion in the U.S. in August, according to the U.S. Department of Commerce, up from $6.8 billion in 2021 but less than the $19.5 billion spent in 2019. In Los Angeles, international visitors have accounted for less than 10% of all tourists but generated more than their share of spending because they tend to stay longer and buy more meals, drinks and souvenirs than domestic visitors. Before the pandemic, the number of visitors from China was growing dramatically, prompting several shopping centers in Los Angeles to hire Mandarin-speaking translators to accommodate the tourists. The U.S. Department of Commerce announced plans in June to launch a five-year plan to attract 90 million international visitors, who would spend an estimated $279 billion annually by 2027. When asked during a news conference about the long waits to get visa interviews, Grant Harris, the assistant secretary of commerce for industry and analysis, put part of the blame for the delays on the pandemic and said his department was working to reduce the visa wait times. “This is going to be something that we want to continue to work on so that we are facilitating travel to and within the United States,” he said.

It is projecting world economic growth lower by $4 trillion through 2026. Kristalina Georgieva, managing director of the IMF, told an audience at Georgetown University on Thursday that “things are more likely to get worse before it gets better.” She says the Russian invasion of Ukraine that began in February has dramatically changed the IMF’s outlook on the economy. Georgieva said the institution downgraded its global growth projections already three times, to 3.2% for 2022 and now 2.9% for 2023. ___ US applications for jobless benefits increased last week WASHINGTON (AP) — More Americans filed for unemployment benefits last week, the largest number in four months, but the labor market remains strong in the face of persistent inflation and a slowing overall U.S. economy. Jobless claims for the week ending Oct. 1 rose by 29,000 to 219,000, the Labor Department reported Thursday. The Federal Reserve, determined to bring down decades-high inflation by raising its main borrowing rate, takes labor force data into consideration when making its rate decisions. But the more important data comes Friday in the form of the September jobs report. ___ In a first, Netflix’s ‘Glass Onion’ to play in major chains NEW YORK (AP) — For the first time, the major U.S. theater chains will play a Netflix release after exhibitors and the streaming service reached a deal for a nationwide sneak-peak run of Rian Johnson’s “Glass Onion: A Knives Out Mystery.” Netflix announced Thursday that AMC, Regal Cinemas and Cinemark will all carry the “Knives Out” sequel for an exclusive one-week run beginning Nov. 23, one month before it begins streaming on Dec. 23. Up until now, those chains have largely refused to program Netflix releases. The deal stops short of a full theatrical release window for “Glass Onion.” The film will play in about 600 domestic theaters. ___ Munich Re to stop its backing for new oil, gas fields BERLIN (AP) — Munich Re, one of the world’s biggest insurance companies, says it will stop backing new oil and gas fields beginning next April. The company said it will also no longer invest in or insure new oil pipelines and power plants that weren’t already under construction by Dec. 31, 2022. The company said Thursday the moves were part of its effort to reduce the harmful impact its business has on the environment. The burning of oil and gas is one of the main sources of greenhouses gases fueling climate change. It also invests the insurance premiums it receives from customers and third-party assets, making it a major institutional investor. ___ Fed’s Cook says more rate hikes needed to combat inflation WASHINGTON (AP) — Federal Reserve Governor Lisa Cook says more interest rate increases will be necessary to wrestle inflation under control. Her remarks Thursday echo several tough speeches by other central bank officials this week. Cook also says she has revised her views on inflation in the past several months and now sees it as more persistent. She says that while real-time, private-sector data is showing signs that inflation could cool in the coming months. But she adds that the Fed should only slow rate hikes when inflation actually falls. Cook’s speech at the Peterson Institute for International Economics was her first as a Fed governor. ___ The S&P 500 fell 38.76 points, or 1%, to 3,744.52. The Dow Jones Industrial Average fell 346.93 points, or 1.1%, to 29,926.94. The Nasdaq fell 75.33 points, or 0.7%, to 11,073.31. The Russell 2000 index of smaller companies fell 10.18 points, or 0.6%, to 1,752.51.

The resurgent Saquon Barkley — who is genuinely awesome to watch when he’s healthy — should be able to run the ball decently against Green Bay. But the Packers will be able to press Danny Dimes and I’m not sure New York can stop the Green Bay ground game. The Pick: Jaguars 23, Texans 17 Bets: Pass Chargers at Browns Sunday, 1 p.m. ET TV: CBS | Stream: Paramount+ (click here)   Featured Game | Cleveland Browns vs. Los Angeles Chargers At first glance, this game just “looks” kind of bland from a scoring perspective. But these two teams topped 100 points (!) last year in the highest-scoring game of the season and we might see more fireworks this week, too. The Chargers remain extremely questionable against the run; the Browns are a top-five team running the ball. Nick Chubb could have a big day here. The Browns will probably get Myles Garrett back for this game (if their tweets are to be believed) and Rashawn Slater’s absence looms. But the Chargers sling it more than anyone in the NFL and they can attack Cleveland deep. Austin Ekeler could be set for a huge game.  The Pick: Browns 42, Chargers 39 Bets: Over 47.5, Browns +3.5, Austin Ekeler rush/rec over Falcons at Buccaneers Sunday, 1 p.m. ET TV: Fox | Stream: fuboTV (click here)   Featured Game | Tampa Bay Buccaneers vs. Atlanta Falcons Just a hunch, but I’m thinking we see Angry Tom Brady over the next few weeks. His receivers are rounding back into shape and he has the sort of off-field noise brewing that’s consistently resulted in him getting laser focused and playing some elite football. The Falcons are a really impressive story so far this season, but they need to run the ball with their scheme and the Bucs are not afraid to lock down a run game. Cordarelle Patterson being out is a huge loss; Arthur Smith deserves tons of credit for turning him into the player the Vikings thought they would have after the first round of the 2013 draft. Brady has never lost to the Falcons in his career, and I don’t see it happening here.   The Pick: Buccaneers 35, Falcons 15 Bets: Buccaneers -8.5 Dolphins at Jets Sunday, 1 p.m. ET TV: CBS | Stream: Paramount+ (click here)   Featured Game | New York Jets vs. Miami Dolphins Very tough game to pick here. Zach Wilson’s fourth quarter has to be inspiring for the Jets’ front office and coaching staff (not to mention their fans). It shouldn’t eclipse the first three quarters. No Tua here but Teddy Bridgewater looked more than competent — maybe downright explosive — in backup duty against the Bengals. I think we could see more points than expected here. I want the Jets to win mainly so Brady Quinn will donate $1,000 to charity for every Jets win the rest of the season, and where he donates will be based entirely on Pick Six Podcast five-star review suggestions.  Tell your friends! The Bears are a bottom tier run defense having lost Akiem Hicks and Khalil Mack this past offseason and Dalvin Cook/Alexander Mattison should eat here in a big way. Unless Chicago can slow down the Vikings run game, Justin Fields is a mortal lock to set a season high for pass attempts, the previous being 22.  The Pick: Vikings 27, Bears 14 Bets: Tease Vikings with Chiefs, Cook over rush yards Steelers at Bills Sunday, 1 p.m. ET TV: CBS | Stream: Paramount+ (click here)   Featured Game | Buffalo Bills vs. Pittsburgh Steelers A rematch of the Week 1 stunner from last year features an entirely new Pittsburgh QB situation, which has evolved over the last 96 hours or so. Kenny Pickett is in and Mitchell Trubisky is out. Pickett threw three picks against the Jets in a loss, but Pro Football Focus didn’t give a turnover-worthy grade on any of those throws. Pickett became the first quarterback in NFL history to run for two touchdowns in his debut. The Bills are just too much — Pittsburgh has never won without T.J. Watt and slowing down Stefon Diggs will be problematic for a secondary that’s allowed top-tier wideouts to explode. Three great stats here in addition to the Watt thing: 1) Sean McDermott/Mike Tomlin are 3-0 to the under all time, I expect it to continue; 2) the Bills have allowed seven total second-half points this season; 3) the Bills have the most wins (12) by 14-plus points since the start of 2021 and the next-closest team has seven.  The Pick: Bills 28, Steelers 10 Bets: Under 47 Lions at Patriots Sunday, 1 p.m. ET TV: Fox | Stream: fuboTV (click here)   Featured Game | New England Patriots vs. Detroit Lions Finally a test of the “bet the Lions over until it loses” theory. This total has dropped a point and a half from the open, likely based off the bad matchup for Detroit against the Patriots run defense. It sounds like Bailey Zappe will get the start again, unless Mac Jones can get ready in time for this game. There’s a Matt Patricia revenge factor here, I suppose, but maybe the Lions should be the ones looking for that angle. The Pixel Tablet doubles as a smart display and speaker with the dock stand accessory, so it should be useful even if it’s across the room.  Here’s everything announced at the Google Pixel event.  Google event products Pixel 7 Pro: Google’s newest $899 flagship is sure to impress. The Pixel 7 Pro gets a Tensor chipset, 6.7-inch OLED display and lots of camera upgrades. These include a powerful 5x telephoto lens and new macro focus mode for closeups. The Pixel 7 Pro also gets its Cinematic Blur for video, which utilizes Tensor’s power to add an artistic blur effect and shallow depth of field to your videos. The Pixel 7 Pro can also lock on your subject while zoomed in with photos and videos. Tensor also powers the new Photo Unblur, which can unblur your photos much like Magic Eraser can remove things. Biden said thousands of people with prior federal convictions could be denied employment, housing or educational opportunities and his executive action would relieve such “collateral” consequences. Nearly 40 U.S. states have legalized marijuana use in some form, but it remains completely illegal in some states and at the federal level. Reclassification would be a first step toward wider legalization, a move backed by a majority of Americans, and usher in sweeping changes for companies and law enforcement and impact millions. It’s time that we right these wrongs,” Biden said. He urged state governors to follow suit. “Just as no one should be in a federal prison solely due to the possession of marijuana, no one should be in a local jail or state prison for that reason, either,” Biden said. A senior administration official said more than 6500 people with prior federal convictions could be affected by the pardons. Shares of cannabis growers and sellers surged following Biden’s comments, with Tilray Brands (TLRY.O) and Canopy Growth (WEED.TO) both jumping more than 20%. At present, the drug falls under the same classification as heroin and LSD and is in a higher classification than fentanyl and methamphetamine, the president said. If marijuana classification were to ease at the federal level, that could allow major stock exchanges to list businesses that are in the cannabis trade, and potentially allow foreign companies to begin selling their products in the United States. While many states have legalized the medical or recreational use of cannabis, its illegal status under U.S. federal law has forced most major banks to deny their services to cannabis-related businesses. The issue has forced U.S. marijuana companies to trade their shares over the counter or by listing in Canada, with the Nasdaq and New York Stock Exchange prohibited from listing them. The president’s action drew praise from some members of Congress and from the industry. “The Progressive Caucus applauds this action by President Biden today to advance criminal and racial justice,” said Representative Pramila Jayapal, who chairs a group of left-leaning lawmakers, in a statement. “This represents a major step in righting the wrongs of the past and amending policies that have negatively impacted so many,” said Khari Edwards, head of corporate social responsibility at Ayr Wellness Inc , one of the top U.S. cannabis retailers. Biden said he had directed Attorney General Merrick Garland to develop an “administrative process” to issue certificates of pardon to those who are eligible. “The Justice Department will expeditiously administer the President’s proclamation, which pardons individuals who engaged in simple possession of marijuana, restoring political, civil, and other rights to those convicted of that offense,” the department said in a statement. Biden said certain rules needed to stay in place even as regulations around the country loosened. “Finally, even as federal and state regulation of marijuana changes, important limitations on trafficking, marketing, and under-age sales should stay in place,” Biden said. The global cannabis industry is forecast to hit $55 billion in sales by 2026, with the U.S. market growing to $40 billion by then, up from $25 billion last year, according to cannabis focused research firm BDSA’s September projections. Top story Key figure accused of embezzling from failed Bridgeport bank lost $1 million at casinos, sources say Since a Bridgeport bank was shut down in late 2017 over what federal authorities have described as a brazen embezzlement scheme involving the bank’s CEO, a key question has gone unanswered: Where did tens of millions of dollars in missing money go? Now, sources tell the Sun-Times, authorities have determined that Marek Matczuk — one of the central figures charged in the ongoing criminal investigation into the failure of Washington Federal Bank for Savings — lost at least $1 million gambling at Chicago-area casinos. And they’re trying to determine whether the money he lost gambling came from the millions of dollars he never repaid the bank, the sources say. Matczuk, 59, is a roofing contractor and handyman from Park Ridge. According to federal regulators, he had $13 million in delinquent loans from Washington Federal when suspended bank CEO John F. Gembara was found hanged in Matczuk’s bedroom shortly before the bank’s shutdown. The Park Ridge police and the Cook County medical examiner’s office said Gembara died by suicide, though his wife has questioned that finding. Matczuk has been charged with siphoning $6 million from the bank as part of what prosecutors have said was a scheme in which Washington Federal handed out loans to favored insiders with no documentation, no collateral and no expectation the money ever would be repaid. Matczuk lost $182,000 gambling at Rivers Casino between 2011, when the Des Plaines venue opened, and 2018, soon after Washington Federal was ordered closed, plus more than $800,000 at other Chicago-area casinos, according to knowledgeable sources. It’s a strong indicator of the opportunities for brands and businesses in the growing decentralized metaverse economy, if they enter this new space strategically. What does that look like? Yonatan Raz-Fridman, CEO of Supersocial and host of the Into the Metaverse podcast, sat down with Marty Berman, vice president of North America/LATAM for LandVault to dive into what this means for brands that make a move now to establish a presence in blockchain-based metaverse-type platforms — from gaining a foothold to developing a long-term metaverse strategy. “So many brands right now think of the metaverse as an extension of the internet, the next version of the internet, but it just isn’t there yet,” Berman explained. “It’s not a scale-and-reach opportunity right now. There aren’t 70 million consumers there. It’s about quality over quantity — it’s about inviting consumers in to experience your brand in a new and exciting way, that you just can’t in other mediums.” The decentralized metaverse, which encompasses platforms like Decentraland, Sandbox, Somnium Space, TCG World and more is all about community, and built on blockchain ownership. They’re digital experiences that initially evolved out of gaming spaces like Minecraft, but have come to embrace a variety of social worlds and events, whether you’re on a VR headset or in a browser. From a decentralized standpoint, the metaverse is made up of a broad array of platforms, and the number of platforms is only going to increase in the next few years. What’s happening now is an opportunity, within those ecosystems, to define how much land is available for companies to buy or lease, and then build value on that chunk of virtual real estate. It’s important to understand that these are real-world economies, Berman said, and land value will fluctuate, especially here at the beginning. Because of that, brands should consider land as a long-term asset, or consider leasing short-term or long-term, in order to test and learn. Leasing also means brands aren’t locked in to one platform, as the market grows and new platforms launch. LandVault is betting on the long term, buying land and leasing it, confident that land ownership is what’s ultimately going to drive value from an economy standpoint. Best practices for brands ready to take the leap What does a brand metaverse experience look like? Instead of making replicas of real-world encounters in the metaverse, it’s creating what Berman calls “digital experiential.”   “From a best practices standpoint, you have to take that web2 lens off and really look at it from a web3 perspective: what is the platform capable of?” Berman says. “The question is how do we push the boundaries of the technology and the capabilities of each platform to be able to take advantage and leverage these new experiences?” It requires diving in deep to figure out what your platform can do, and how to take advantage of it to represent your brand. You’ll need to figure out how to measure this in terms of success within that web3 lens, how to leverage current initiatives within that space, and bring those to life in a way that illuminates your brand in a three-dimensional way. Brands can engage consumers with brand-new metaverse opportunities, like quests with rewards, a place to earn or buy wearables or NFTs, a place to socialize with and play with other fans of the brand. It’s especially important to always keep the end goal front-of-mind as you build — what’s going to keep users coming back, after their initial visit? From that perspective, it’s about pushing the boundaries of the technology and the capabilities of each platform to find brand-new ways to excite a visiting consumer. One of the most successful strategies to drive consumers to new metaverse experiences is to build them as part of an ongoing initiative. Berman pointed to the success of Mastercard’s Pride Plaza, which Ad Age hailed as one of June 2022’s top metaverse builds. Why brands should start now Establishing a presence in the metaverse is a longer-term commitment Berman said. It’s also a brand-new challenge. You’re going from a consumer sales standpoint to an invitation to connect in a whole new world, building an interactive narrative rather than a one-way conversation. That takes time to click. “As I like to say, aim small and miss small right now,” Berman says. “Right now the opportunity is to get in and before consumers. Think of it as an 18-24 month journey that you’re going to take your brand and your team on to understand what consumers interact with. Before this takes off, you want to be able to understand what engages your consumers, so you can iterate and test and learn as you continue to build on the experiences.”

Canada’s Supreme Court Considers Safe Third Country U.S. Border Agreement – The Washington Post https://clarkcountynewsnow.com/canadas-supreme-court-considers-safe-third-country-u-s-border-agreement-the-washington-post/ TORONTO — Advocates told Canada’s top court on Thursday that a nearly 20-year-old deal under which Canada and the United States share responsibility for migrants in need of protection should be struck down because the United States is not a safe destination for asylum seekers. At issue in the hearing, which was being closely watched in Ottawa and Washington, was the constitutionality of the Safe Third Country Agreement, the 2004 pact between the two countries. Under the deal, asylum seekers who enter Canada at official land border crossings are sent back to the United States — and vice versa. The premise is that both nations meet their obligations under international refugee law and are safe for those seeking refuge, so claimants must request protection in the country where they first arrive. They appellants included several refugee advocacy groups; a Salvadoran woman and her daughters who fled gender-based persecution and gang violence; a family from Syria who sought asylum in Canada after President Donald Trump issued an executive order barring entry to people from seven majority-Muslim countries; and a Muslim woman from Ethiopia who feared her Oromo ethnicity made her a target for persecution. They said they are not opposed to “safe third country” agreements in theory but argued that this one violates the right of “life, liberty and security of the person” guaranteed by Canada’s constitution because it subjects asylum seekers who are bounced back to the United States to possible detention on the U.S. side and removal to the countries and persecution they sought to flee. That, they said, puts both countries at risk of violating international conventions on refugees that commit signatories to the principle of non-refoulement — refraining from sending refugees and asylum seekers back to countries where they could face the very persecution or torture they sought to flee. “The underlying issue is whether or not the obligation to provide effective protection and to ensure effective protection is being respected by the country to which Canada is transferring refugee claimants,” Andrew J. Brouwer, a lawyer for the appellants, told the court. “Our submission on the evidence is that it’s not.” Lawyers representing Canada’s ministers of immigration and public safety countered that the agreement complies with the country’s constitution and features adequate “safety valves” and “different avenues of relief in exceptional cases.” “We start from the proposition that the general return to the United States is safe,” Marianne Zoric, a government lawyer, told the court. “The necessary elements of what is required for a safe third country are met in terms of international law.” The government noted that two of the families were granted a judicial stay from a Canadian court after their lawyers launched a constitutional challenge of the agreement, which prevented them from being turned back to the United States while their case was being heard. “How can we possibly say that these safety valves are illusory if there they are?” Zoric asked. Lawyers for the asylum seekers argued that these cases were “extraordinary” because the families had contacted Canadian lawyers before they arrived at the border, allowing them to bring a court motion. “They had counsel, and the vast, vast, vast, vast majority of claimants who show up at the border don’t,” Jared Will, one of their lawyers, told the court. “There is in 99.999 percent of cases no opportunity to seek a judicial stay.” In a 2020 decision, a Canadian federal court in Ottawa said that while it was not the “role of the Court to pass judgment on the U.S. asylum system,” the Safe Third Country Agreement violated the constitutional right to life, liberty and security of the person. “The evidence establishes that … applying” the agreement “will provoke certain, and known, reactions by U.S. officials,” Justice Ann Marie McDonald wrote. “Canada cannot turn a blind eye to the consequences.” A federal appeals court last year overturned the lower court’s decision — in part, it said, because the evidentiary record on key issues was “thin” and the “alleged constitutional defect … stems from how administrators and officials are operating the legislative scheme, not the legislative scheme itself.” The Safe Third Country Agreement has long drawn criticism from refugee advocates and human rights groups. In 2007, they successfully petitioned a court to declare the United States unsafe for refugees, but that was also overturned on appeal. The deal has drawn broader attention here in recent years because it has a loophole. While asylum seekers who enter the country at official land border crossings are sent back to the United States, those who make unauthorized entries elsewhere along the 5,500-mile border may stay and file their claims. Since 2017, more than 67,800 asylum seekers have entered Canada at such crossings and filed claims for protection. Around 28,300 claims have been accepted; around 19,600 have been rejected. The number of asylum seekers crossing into Canada at unofficial points of entry rose sharply under Trump, who sought to limit illegal immigration, legal immigration and asylum. Such crossings have not abated under President Biden. The Royal Canadian Mounted Police has “intercepted” more than 23,000 asylum seekers at unofficial border crossings during the first eight months of this year — the most since Canada began tracking the number in 2017. Prime Minister Justin Trudeau’s government has pressed U.S. officials to extend the Safe Third Country Agreement to cover the entire U.S.-Canada border, not just official crossings. Advocates argue that that would push migrants to pursue more dangerous routes to avoid authorities. The Department of Homeland Security did not respond to a request for comment. The Canadian ministers of immigration and public safety, in a submission to the court, asked that any declaration that the agreement was invalid be suspended for 12 months so that the government could respond. “It is vital during that time to preserve certainty and order at Canada’s land border,” the ministers wrote. “There may be a range of remedies available to the government to respond to the declaration and there are significant competing and complex policy matters including foreign policy considerations that must be accommodated.”

The Las Vegas Review-Journal filed a request for the emergency order earlier this week, after officials investigating German’s killing asserted that they could search the devices as early as Tuesday evening. District Judge Nadia Krall signed the temporary restraining order on Wednesday, the Review-Journal reported. It prevents officials from conducting a search for the next 15 days. A hearing on the matter has been set for Oct. 12. Robert Telles, a Clark County public administrator, has been jailed without bail on a murder charge since Sept. 7, five days after German, a 69-year-old Review-Journal reporter, was stabbed outside his home. According to authorities, Telles’ DNA was allegedly found on German’s body during an autopsy and evidence was found in his home connecting him to the killing. Prosecutors have said German’s reporting on strife in the public administrator’s office likely contributed to Telles’ loss in the Democratic primary election in June. Police seized personal electronic devices that Review-Journal editors believe German used for work, including a cellphone, hard drive and multiple computers. Prosecutors and the public defender’s office now want to search those devices in connection with Telles’ criminal case. Review-Journal Executive Editor Glenn Cook said the restraining order was requested to protect the identities of German’s confidential sources and the information they provided him. “We’re grateful that Judge Krall saw the urgency of the situation and the clear threat of irreparable harm to the Review-Journal and Jeff German’s sources,” Cook said Wednesday. The newspaper also filed a separate motion in District Court on Tuesday demanding that a third party help review German’s devices, and that his information be returned to the Review-Journal following the review process. District Attorney Steve Wolfson, Metropolitan Police Department attorney Matthew Christian and Edward Kane, Telles’ public defender, did not reply to requests for comment. It is not known whether authorities began searching German’s devices before the temporary restraining order was granted. Attorneys for the police department previously have argued that Telles’ constitutional rights “take precedence over any reporter’s rights,” the Review-Journal reported. The Reporters Committee for Freedom of the Press and 43 other media organizations including The Associated Press asked last week to file a friend-of-the-court brief in support of the newspaper’s motion. Attorneys representing the newspaper have argued that Metro’s seizure of German’s devices violated Nevada’s shield law, designed to protect journalists, and the federal Privacy Protection Act, which is designed to prevent unlawful searches of journalists. On Wednesday, District Court Judge David Jones ruled that Telles, 45, can be removed from his job as a county administrator. The county filed to remove Telles from office last month, saying he was unable to fulfill his job responsibilities and was neglectful in his duties. Telles heads the county office that handles the assets of people who die without a will or family contacts. Authorities said the county will now move forward in appointing someone to fulfill the end of Telles’ term, which expires Jan. 1 when the new public administrator elected in the Nov. 8 general election takes office.
