Christian Alejandro Ocampo In conjunction with Healthy Aging Month, Laredo Medical Center invited residents of all ages to their Healthy Connection Fair on Tuesday to promote preventative measures and a general good sense of the services available in Laredo. The inaugural event also was an opportunity for hospital staff, nursing students and residents to come together and work together in the spirit of stronger health care. “Whether you are 25 years old, 50 or better, the goal of this event is to raise awareness on the positive aspects of growing older,” Jorge Leal, FACHE and CEO of LMC said. “The fair will feature exhibits by many of our health care providers to help you take charge of your physical and mental health, as well as learn about healthy eating, fall prevention and much more. All of these factors contribute to successful aging.” Leal added that the goal of the fair was to kickstart and encourage residents to visit a doctor for initial check-ups and monitoring one’s own levels. These routine check-ups should be increased as one gets older, and the fair can be a starting point to get on that track. With the inaugural fair done, residents can most likely expect similar or more booths to be set up next year, that include booths for drawing blood, stroke prevention, heart care, sleep aid, blood pressure and more. “That’s the whole point of this fair, bringing everybody together as we continue to age, and not going through critical moments because there is so much that can be done by actually going to speaking with a physician or a clinician, nurse practitioner or physician assistant,” Leal said. “And by you having that conversation with your doctor, there is so much you can prevent at the same time.” The fair was held at the LMC main entrance foyer, where attendees were greeted by nursing students and booths with specialized focuses on different aspects of health. In one booth, sleep and sleep aids could be discussed, while in the next one strokes were the main topic. As Laredo’s biggest health issues, hypertension and diabetes both are causes for concern among residents, and LMC Stroke Coordinator Chantel Molina hosted the stroke booth to inform residents about the causes and symptoms of a stroke. She outlined the BE FAST campaign, which is as follows: B — Balance. E — Eyes. F — Face. A — Arms. S — Speech. T — Time. Molina said that doctors recommend and urge anyone who experiences or recognizes stroke symptoms to rush to the hospital. Waiting for too long may exacerbate any disability or their mortality rate. A treatment window is 24 hours, and LMC has a medication that breaks down the clot blocking the area in brain, but the window for that medication is 4-5 hours. “Stroke is not very discriminating,” Molina said. “Pediatrics can have strokes, we are seeing adults as of 30-40 years old, and a lot of them, its not just minute numbers. Again, it doesn’t discriminate, strokes can be seen throughout your lifespan.” In August alone, LMC treated 59 strokes. Molina said that it was a relatively higher number than previous figures recorded. She explained that heat strokes were not the same as the strokes LMC has treated, which are from brain clots due in part to family health issues, diabetes and COVID-19, with smoking being a major risk factor. “A lot of this is very preventive,” Molina said. “Don’t get me wrong, there’s people that do everything. They take their meds, they control their blood pressure, diabetes, and they still have the stroke. Most cases are that they did not take care of themselves.” Blood pressure checks were also available, with attendees and nursing students from both Laredo College and TAMIU striking up conversations with those at their booths. The setting was an opportunity for residents to meet the new nursing talent and for the students to get hands on creating a bond with Laredo’s patients. Calixto Cerna, a TAMIU fourth-semester nursing student, praised the university’s nurturing of nursing students’ careers and the focus on ethical practice. He said that he feels that he has been prepared adequately when interacting with patients and highlighted the avoidance of simple interactions without creating a relationship with said patients. “Its more patient centric care where we want to treat them based on how the patient themselves is presenting and experiencing the disease,” he added, stating he takes his experience to the hospital setting in order to be the pillar of support patients look for in their health care staff. Between the course at school and the rotations at the hospital, Cerna said that students to learn more in-depth in the hospital setting while also making connections with hospital staff. Cerna, whose mother was a nurse, said that her encouragement and the flexibility of a nurses’ specialization led him to take on the nursing career. With the drive to help others and the flexibility of jumping into the ICU or any specialty, he ultimately wishes to teach nursing after a long and helpful career at the hospital. As a first semester LC nursing student, Lindsey Reyes said that her class is currently learning the fundamentals of nursing and called the connections fair an eye-opening experience in regards to meeting with patients, hospital staff and fellow nursing students. This benefits her communication with the community and is an aspect of a tough program that rewards those that put their all into it, she said. As a former city employee at the Laredo Health Department, Reyes emphasized the importance of outreach in the community to promote healthy living and health check-ups at schools and rural areas with residents who may not have the capacity to visit the hospital. As a medically underserved community, residents in the colonias face the added obstacle of not always having reliable transportation to health care facilities. Reyes said that reaching out to the community is a vital area of health care and was a major component of her seven-year position at the health department. Leal said that to address the medically underserved designation, more recruitment efforts have been made to attempt to bring more providers to the community. He added that with more staff brought to Laredo, that could shorten the federal designation.

It plans to have those cities available across multiple platforms, including Meta’s Oculus.  As part of the investment, GEM will give the California-based platform a share subscription facility of up to $200 million for 36 months following an equity exchange listing.  The transaction allows LootMogul to withdraw funds by issuing equity shares to GEM.  Blockchain and Metaverse Deals  Software and venture firm Animoca Brands recently raised $110 million, valuing the NBA Top Shot and blockchain gaming investor at more than $5 billion. In July, metaverse builder Infinite Reality closed its deal to acquire esports and entertainment conglomerate ReKTGlobal, Inc. for $470 million, valuing the combined entity at $2.47 billion. That same month, gaming-focused VC firm Konvoy Ventures raised $150 million for Konvoy Fund III, which will have 20% to 30% of its funds allocated toward blockchain-related games.

You navigate Milo, a button-sized spaceman, around the interior of an earthly house. No sooner are you getting your bearings than you’re introduced to your mission: Fix a strange machine. Luckily, the Tinykin can help – teensy organisms that have different aiding abilities depending on their look. Tinykin is a platformer full of vibrancy, mystery, and satisfying gameplay, but here are some things that could push the game to even greater heights. 8 Adding Enemies You’re probably going to notice the vast comparisons being drawn between this game and Pikmin throughout the read. That’s because it tries so brazenly to capture Pikmin on its own terms. Whilst it does a good job treading down a familiar Pikmin path, the absence of enemies in Tinykin is noticeable. With the exception of environmental dangers, no enemies will try to kill you or your little Tinykin buddies. This type of game would have excelled at combat scenarios, especially considering the variety of Tinykin. Having little to no threats at all, whilst being very accessible to younger players, diminishes the stakes dramatically – leading to one of the biggest things that should have been looked at… 7 It Could Have Been More Difficult Now, video games don’t need to be difficult to be fun. But having some form of tangible obstacle or introducing sections that make you think carefully does add to an experience. Tinykin leans too far on being too easy, which is polarizing to its Pikmin love-lettering. If Milo falls from a great height or touches water, they die, but are instantly recovered without any consequence. Those looking for even a slither of a challenge in Tinykin will be disappointed in its sacrifice of difficulty in order to appeal to a wider audience. Just making the world a little more hostile would have solved this issue and combated an otherwise shallow area of the game. 6 Make Tinykin Vulnerable Those who have played Pikmin need no reminder of how heart-crushing it is when you let one die. Those games require careful management and maneuvering for your little army to survive. Here, the Tinykin are invincible and will never be in any danger. You never actually control them outright, and they always follow you loyally – traversing great distances like magic to be right by your side. Again, removing the mortality of the Tinykin removes any form of challenge. If the Tinykin had to look to Milo for safety a bit more, this would improve the bond between them, adding value to the times when you need to use them. 5 The Expedition Timer Could Have Played More Of A Role Whenever you pause the game, you’ll notice an expedition timer counting up. Even pausing doesn’t stop this timer, and it counts the overall time you’ve spent in the game. This clock doesn’t affect anything in the game, and begs the question of why is it there. Sure, the likes of speedrunners could use it as a nifty in-game timer, but it would have been cool to see it make an in-world difference. The original Pikmin gave you thirty in-game days to complete it, for a narrative purpose. Tinykin’s timer just looks out of place, and needs the same level of narrative hook to warrant its inclusion. 4 Variety In The Side Ventures Outside the main objectives of each area, you can come across insect characters who have side missions. These range from returning toy animals to a toy zoo to navigating deadly pipes to retrieve a ring. Whilst these side quests are novel distractions, they don’t quite ever feel necessary. The aforementioned ring retrieval mission is recycled in every area, and all the side ventures equate to feeling a bit samey – gifting you a collectible for completing them. However, if they meant something a bit more, or perhaps if there were more of them to seek out, it could have enriched the overall experience. 3 Even More Unique Environments Traversing a house as a tiny entity is rarely boring. The same can be said for Tinykin, with each section of the game belonging to a different room in the house; themed in an interesting way. It’s a tonne of fun to navigate and explore, but a lot of the areas recycle the same platforming assets. You’ll grow used to climbing drawers, plants, and shelves, which are staples of any household, but no less repetitive. If the ways in which you traversed this environment were spiced with variety, it could have made every section unique. A game that does this exceedingly well is It Takes Two. 2 Upgrades To The Binocular Goggles One of the gadgets that Milo can use to help get his bearings is the binocular goggles. Pulling these from your inventory allows you to scope out the level and seek out glowing interactives. Collectible upgrades for these would have been a major boon. For example, the binoculars could gain the ability to show hints of where any remaining collectible pollen is hiding. There’s an awful lot of pollen to collect in the game that completionists will hone in on, and it works the same way as music note collecting in Banjo-Kazooie games. When you’re one or two pollen short, there’s no discernible way to know where to look. Hence why a binocular upgrade could have improved this. 1 Less Confusing Ending One of the best things about Tinykin is its sense of mystery. There’s a bigger picture happening under the surface, and a lot of storytelling is baked into environmental detail. When it comes to the ending, the story is wrapped up just as mysteriously, but still leaves many questions. What doesn’t help is how much information is packed into the conclusion. Without giving too much away, you’re introduced to a character the game has been building up, and who also has been undergoing a vague quest that is never quite explained. Unfortunately, the number of traffic and bicyclist fatalities is increasing in these cities and around the country. According to the National Highway Transportation Safety Administration (NHTSA), traffic fatalities increased 13% to 7,342 in 2021 versus 2020 and bicyclist traffic fatalities increased 5% (for a total of 1,000) during the same time period. Ford is aiming to improve that number with a new concept smartphone app that helps alert drivers to people on two wheels or two feet on the road. The technology harnesses Bluetooth Low Energy (BLE) to notify connected Ford vehicle drivers of pedestrians and bicyclists, even if they’re hidden from view. BLE was created in 2011 to use the same radio wavebands as typical Bluetooth, but to do the same function using less battery power. The way that works is BLE devices remain asleep in between connections, transferring data with the smallest amount of power as possible. In conjunction with Commsignia, PSS, Ohio State University, T-Mobile and Tome Software, Ford developed the concept, and the automaker is demonstrating it at the Intelligent Transportation Society of America’s (ITSA) World Congress in Los Angeles. Ohio State University and T-Mobile are household names, but less so is Commsignia, which was launched a decade ago and focuses on research and application of vehicle-to-vehicle and vehicle-to-everything technology. PSS provides safety innovation and education, and Tome Software has worked with Ford before on bicycle-to-vehicle communications. This new smartphone-based concept technology works as an app on a pedestrian’s or cyclist’s phone to communicate their location to a connected Ford vehicle. When a potential crash risk is detected, Ford’s in-car Sync system alerts the driver with graphics and audio alerts. Ford says its newer vehicles equipped with Ford Co-Pilot360 Technology can use this app to avoid a crash and apply the brakes if the driver doesn’t respond in time. “We see other possible applications for this technology, including detecting road construction zones and construction workers,” said Ford’s Executive Director, Research and Advanced Engineering, Jim Buczkowski in a press release. Unlike radar or cameras, both of which rely on line-of-sight to assess a risky situation, BLE can detect pedestrians and bicycle riders even when hidden behind obstructions such as buildings, poles, signs and other common city obstacles. While typical Bluetooth connections require pairing, this BLE connection does not, which gives it better opportunities to help. The concept app has the potential to save more lives and keep distracted drivers from veering into a bike lane or onto a soft shoulder where fellow humans may be walking.

A district judge has thrown out the State Bar of Texas’ professional misconduct case against Brent Webster, Attorney General Ken Paxton’s top aide, for his work on a case that challenged the results of the 2020 presidential election. Judge John Youngblood, a judge in Milam County who was assigned to the case in Williamson County court, sided with an argument by Webster that said letting the case move forward would violate the state constitution’s separation of powers because the state bar, an agent of the judicial branch, would be limiting the actions of the attorney general’s office, which is part of the executive branch. “[T]he separation-of-powers doctrine deprives this Court of subject-matter jurisdiction,” Youngblood said in a brief letter. “To hold otherwise would stand for a limitation of the Attorney General’s broad power to file lawsuits on the State’s behalf, a right clearly supported by the Texas Constitution and recognized repeatedly by the Texas Supreme Court.” A spokesperson for the state bar said the body does not have comment on the dismissal and said no decision has been made on an appeal. Paxton is facing a similar lawsuit in Collin County, in which he has made the same argument to the court. The judge in Paxton’s case has made no ruling. Still, Paxton celebrated the dismissal of Webster’s case, which he called “meritless and politically-motivated.” “The State Bar’s politicization is an insult to all Texans who oppose the abuse of governmental power in pursuit of liberal political retribution,” he said in a statement. “No matter how much the partisan activists at the Texas State Bar retaliate against me and my staff for working to promote election integrity, secure our southern border, and fight for conservative values, I will not back down.” The case stemmed from complaints received by the state bar about Webster’s filing of the case to overturn the results of the 2020 presidential election in four states. The state bar’s Commission for Lawyer Discipline investigated that complaint and found that Webster’s representations in that suit were “dishonest,” noting in its complaint that “his allegations were not supported by any charge, indictment, judicial finding and/or credible or admissible evidence, and failed to disclose to the Court that some of his representations and allegations had already been adjudicated and/or dismissed in a court of law.” The complaint accused Webster of violating the Texas Disciplinary Rules of Professional Conduct by engaging in conduct involving dishonesty, fraud, deceit or misrepresentation. Franklin) The Associated Press By TIM REYNOLDS, AP Basketball Writer Robert Sarver says he has started the process of selling the Phoenix Suns and Phoenix Mercury, a move that comes only eight days after he was suspended by the NBA over workplace misconduct including racist speech and hostile behavior toward employees. Sarver made the announcement Wednesday, saying selling “is the best course of action,” although he initially hoped that he would be able to keep control of the franchises — pointing to his record that, he claims, paints a dramatically different picture of who he is and what he stands for. “But in our current unforgiving climate, it has become painfully clear that that is no longer possible — that whatever good I have done, or could still do, is outweighed by things I have said in the past,” Sarver wrote in a statement. “For those reasons, I am beginning the process of seeking buyers for the Suns and Mercury.” Sarver bought the teams in July 2004 for about $400 million. He is not the lone owner, but the primary one. Political Cartoons Assuming no other team is sold in the interim, it would be the first sale in the NBA since a group led by Qualtrics co-founder Ryan Smith bought the Utah Jazz in 2021 for about $1.7 billion. It’s not known if Sarver has established an asking price. Forbes recently estimated the value of the Suns at $1.8 billion. An independent report that was commissioned by the NBA last November and took about 10 months to complete found that Sarver “repeated or purported to repeat the N-word on at least five occasions spanning his tenure with the Suns,” though added that the investigation “makes no finding that Sarver used this racially insensitive language with the intent to demean or denigrate.” The study also concluded that Sarver used demeaning language toward female employees, including telling a pregnant employee that she would not be able to do her job after becoming a mother; made off-color comments and jokes about sex and anatomy; and yelled and cursed at employees in ways that would be considered bullying “under workplace standards.” Once that report was completed, NBA Commissioner Adam Silver suspended Sarver for one year and fined him $10 million — the maximum allowed by league rule. “Words that I deeply regret now overshadow nearly two decades of building organizations that brought people together — and strengthened the Phoenix area — through the unifying power of professional men’s and women’s basketball,” Sarver wrote. “As a man of faith, I believe in atonement and the path to forgiveness. I expected that the commissioner’s one-year suspension would provide the time for me to focus, make amends and remove my personal controversy from the teams that I and so many fans love.” Barely a week later, Sarver evidently realized that would not be possible. His decision comes after a chorus of voices — from players like Suns guard Chris Paul and Los Angeles Lakers star LeBron James, to longtime team sponsors like PayPal, and even the National Basketball Players Association — said the one-year suspension wasn’t enough. Suns vice chairman Jahm Najafi called last week for Sarver to resign, saying there should be “zero tolerance” for lewd, misogynistic and racist conduct in any workplace. Najafi, in that same statement, also said he did not have designs on becoming the team’s primary owner. “I do not want to be a distraction to these two teams and the fine people who work so hard to bring the joy and excitement of basketball to fans around the world,” Sarver wrote. “I want what’s best for these two organizations, the players, the employees, the fans, the community, my fellow owners, the NBA and the WNBA. The men’s release was startling development, its announcement coming hours after Russian President Vladimir Putin said he had ordered the mobilization of 300,000 military reservists to shore up the Kremlin’s staggering battlefield losses over the last seven months. Officials at the U.S. Embassy in Saudi Arabia called the Americans’ families on Wednesday morning, said Dianna Shaw, Drueke’s aunt. Drueke’s mother, Lois Drueke, spoke to him for about 10 minutes, and said her son appeared to be in good condition, Shaw said, noting that Dreuke and Huynh were expected to receive medical screenings later in the day. “He sounded clearheaded, with clear speech,” Shaw said. “He sounded like himself.” Shaw expressed amazement at how the men’s release had come about, even as they awaited additional details. “I never dreamed it was a possibility that the Saudi government would be able to do something like this,” she said. “But any port in a storm.” The Saudi government said in a statement that the other prisoners released were from Britain, Morocco, Sweden and Croatia. The first such call-up in Russia since World War II is sure to further fuel tensions with the Western backers of Ukraine, who derided it as an act of weakness and desperation. The move also sent some Russians scrambling to buy plane tickets out of the country and reportedly sparked some demonstrations. The Kremlin has struggled to replenish its troops in Ukraine, reaching out for volunteers. There even have been reports of widespread recruitment in prisons. In his seven-minute nationally televised address, Putin also warned the West that he isn’t bluffing over using everything at his disposal to protect Russia — an apparent reference to his nuclear arsenal. He has previously told the West not to back Russia against the wall and has rebuked NATO countries for supplying weapons to Ukraine. The total number of reservists to be called up could be as high as 300,000, officials said. However, Putin’s decree authorizing the partial mobilization that took effect immediately offered few details, raising suspicions that the draft could be broadened at any moment. Notably, one clause was kept secret. Even a partial mobilization is likely to increase dismay or doubt among Russians about the war. Shortly after Putin’s address, Russian media reported a spike in demand for plane tickets abroad amid an apparent scramble to leave despite exorbitant prices. The Vesna opposition movement called for nationwide protests, although it was unclear how many would act, given Russia’s harsh laws against criticizing the military and the war. “Thousands of Russian men — our fathers, brothers and husbands — will be thrown into the meat grinder of the war. What will they be dying for? What will mothers and children be crying for?” the group said. As protest calls circulated online, the Moscow prosecutor’s office warned that organizing or participating in such actions could lead to up to 15 years in prison. Authorities issued similar warnings ahead of other protests recently. The state communication watchdog Roskomnadzor also warned media that access to their websites would be blocked for transmitting “false information” about the mobilization. It was unclear exactly what that meant. Within hours, police arrested scores of people at antiwar protests across Russia, including at least a dozen in Moscow. An Associated Press crew in Moscow witnessed at least dozen of arrests in the first 15 minutes of a protest. Kremlin spokesman Dmitry Peskov, asked what had changed since he and others previously said no mobilization was planned, said Russia is effectively fighting NATO because the alliance’s members have supplied weapons to Kyiv. The partial mobilization order came a day after Russian-controlled regions in eastern and southern Ukraine announced plans for referendums on becoming integral parts of Russia — a move that could eventually allow Moscow to escalate the war. The referendums will start Friday in the Luhansk, Kherson and partly Russian-controlled Zaporizhzhia and Donetsk regions. The balloting is all but certain to go Moscow’s way. Foreign leaders are already calling the votes illegitimate and nonbinding. Ukrainian President Volodymyr Zelenskyy said they were a “sham” and “noise” to distract the public. U.S. national security council spokesperson John Kirby said Putin’s speech is “definitely a sign that he’s struggling, and we know that.” Added White House press secretary Karine Jean-Pierre on MSNBC: “It’s all because Russia is losing ground on the battlefield.” Kirby told ABC’s “Good Morning America” that Russia has suffered tens of thousands of casualties, has command and control issues, terrible troop morale, desertion problems and is “forcing the wounded back (into) the fight.” But Russian Defense Minister Sergei Shoigu, who also spoke on Russian TV, said 5,937 Russian soldiers have died in the conflict, far lower than Western estimates. Shoigu also said that only those with relevant combat and service experience will be mobilized, adding that about 25 million people fit this criteria but only about 1% of them will be mobilized. Neither Shoigu nor Putin offered any other criteria for the call-up, so it wasn’t clear how many years of combat experience or what level of training those to be mobilized must have. The decree, signed by Putin and released on the Kremlin website, provided even less clarity, stipulating only that “citizens of the Russian Federation” will be drafted in the partial mobilization. Another key clause in the decree prevents most professional soldiers from terminating their contracts and leaving service until the partial mobilization is no longer in place. Russia’s invasion of Ukraine has been the target of broad international criticism at the U.N. General Assembly that has kept up intense diplomatic pressure on Moscow. Zelenskyy is due to speak to the gathering in a prerecorded address later Wednesday. Putin is not attending. U.S. President Joe Biden used the global forum to say Russia has “shamelessly violated the core tenets” of the U.N with its “brutal, needless war” in Ukraine. He said Putin’s new nuclear threats against Europe showed “reckless disregard” for Russia’s responsibilities as a signer of the Treaty on the Non-Proliferation of Nuclear Weapons. Putin’s mobilization gambit has a strong element of risk: It could backfire by making the war unpopular at home and hurting his own standing. It also concedes Russia’s underlying military shortcomings. A Ukraine counteroffensive this month has seized the military initiative from Russia, as well as capturing large areas in Ukraine that the Russians once held. Its speed saw Russian troops abandon armored vehicles and other weapons as they retreated. A spokesman for Zelenskyy called the mobilization a “big tragedy” for the Russian people. In a statement to The Associated Press, Ukrainian presidential spokesman Sergii Nikiforov said conscripts sent to Ukraine would face the same fate as ill-prepared Russian forces who unsuccessfully tried to take Kyiv early in the war. “This is a recognition of the incapacity of the Russian professional army, which has failed in all its tasks,” Nikiforov said. The Russian mobilization is unlikely to produce any consequences on the battlefield for months because of a lack of training facilities and equipment. British Defense Secretary Ben Wallace described Putin’s move as “an admission that his invasion is failing.” Russian political analyst Dmitry Oreshkin said it seemed “an act of desperation.” He predicted that Russians will resist the mobilization through “passive sabotage.” “People will evade this mobilization in every possible way, bribe their way out of this mobilization, leave the country,” Oreshkin told the AP. The announcement will be unpopular, he said, describing it as “a huge personal blow to Russian citizens, who until recently (took part in the hostilities) with pleasure, sitting on their couches, (watching) TV. And now the war has come into their home.” The war in Ukraine, which has killed thousands of people, has driven up food prices worldwide and caused energy costs to soar. It has also brought fears of a potential nuclear catastrophe at Europe’s largest nuclear plant in Ukraine’s now Russia-occupied southeast. Investigations are also underway into possible war crimes atrocities committed by Moscow’s forces. In his address, which was far shorter than previous speeches on the war, Putin accused the West of engaging in “nuclear blackmail” and noted “statements of some high-ranking representatives of the leading NATO states about the possibility of using nuclear weapons of mass destruction against Russia.” He didn’t elaborate. “To those who allow themselves such statements regarding Russia, I want to remind you that our country also has various means of destruction … and when the territorial integrity of our country is threatened, to protect Russia and our people, we will certainly use all the means at our disposal,” Putin said, adding: “It’s not a bluff.” In a speech hours later in Novgorod marking 1,160 years of Russian statehood, Putin hailed the “heroes” fighting in Ukraine and stressed the “colossal responsibility” of protecting the nation’s sovereignty. Brick-and-mortar retail has been in decline since the dawn of the internet, even as retail sales from all platforms have boomed. This has left empty storefronts on Main Street and mannequins gazing into nothing at shopping malls. Restaurants would be thriving, by all accounts, if not for the workforce shortage across the country, which is acute in Vermont. Some eateries have closed or reduced staff or hours simply because they can’t find qualified help. Both are paying historically high wages to lure staff. Retail may have finally found its footing, with many malls and downtown shopping districts reporting an uptick in business since early summer. When the pandemic is eradicated — and that can be wishful thinking given that COVID cases are higher now than they were a year ago — we may begin to find that new normal of shopping and eating right around the corner. But other aspects of real estate may never be the same. Warehousing, necessitated by remote shopping, keeps growing colossus-sized structures along the interstates. Demand for hard-to-site manufacturing plants is also on the rise. This could continue if the globalization of the supply chain will be forever altered by the flaws in the system exposed by the pandemic. But the most profound changes appear to be in housing and office space. Typically, home prices do not come down, even during a recession. They may reach a point of stasis for an extended period (like the early 1990s here in Vermont), but homeowners are loathe to low-ball their own place — unless, of course, the housing bubble bursts, foreclosures lower prices and a recession suppresses demand. Homeowners may dump their car, their furniture, perhaps even their stocks, but most draw the line at putting their house on the market. Office space, on the other hand, appears to have little future in the grand scheme of things. Like an oligarch’s yacht, gleaming glass towers draw little interest during a downturn. Commercial real estate agents tell us smaller office buildings or co-working spaces are the future. This is driven by the pandemic, yes, but also by the changing nature of business. Smaller companies and sole proprietors don’t need enormous work spaces, in any case, and large white-collar firms have downsized their workforces by finding efficiencies. The story is the same in Vermont as it is across the nation. Commercial office space has largely been downsized for going on 2-plus years now, according to an industry innovator Repvblik. At this point, it’s clear many commercial landlords will have to rethink the way they do things, even in places as old school and hard-nosed as New York City.  But Richard Rubin and his firm Repvblik have a plan to help distressed commercial real estate by buying properties and turning them into affordable or workforce housing.  Rubin, who has done similar work in his native South Africa, is now applying this model to US markets especially during the COVID-19 crisis. Richard and Repvblik are involved with projects around the US now, from LA to New York and many midwestern states.  Rubin said: “Commercial is going to be massively hit. When tech companies – always the early adopters, themselves historically large tenants and owners of commercial office – are telling their respective employees not to come back to work and to continue to work from home; the writing is on the wall.” Repvblik is an independent property developer and a pioneer in non-federal funded, non-LITC (Low Income Tax Credit) commercial marketplace solutions to achieve quality workforce housing, affordable student housing, and 55-plus senior housing in communities nationwide. Meanwhile, HULA, on Burlington’s waterfront, is a sumptuous work and community space offering state-of-the-art technology. And like other co-working spaces that have sprouted across the nation, it is sited adjacent to restaurants and bars to meet the leisure demands of its clients. HULA took the former Blodgett Oven manufacturing plant and turned it into a new-age space. Blodgett itself moved into a modern facility in Essex Junction. It may take time for this new paradigm to sort itself out, but there is little question the office environment of “Working Girl” and “Office Space” is as dated as the movies themselves. This is a boom time for construction in Vermont That brings us to CityPlace Burlington. Conceived as a 14-story, multiuse complex, the development never got off the ground due to financing issues. The project might have been doomed in any case by legal issues. Early on, the proposal to transform the downtown area and reconnect St Paul and Pine streets faced a blur of opposition and lawsuits. But it appears there is finally some progress involving the gaping hole in downtown Burlington. The central portion of what previously was Burlington Town Center was demolished in 2018, leaving only the front portion of the old mall and the former Macy’s department store standing. As first reported by Seven Days on September 16, a legal notice in the weekly newspaper indicated that a $26.32 million affordable housing project using some federal grant funds has been presented to the city. According to the Seven Days story, CEDO Director Brian Pine said this is a “positive” action that “bodes well for the whole project.” He told the newspaper that because it alters the previously approved plan, the developers will have to modify their permit. The legal notice reads: On or about September 30, 2022 the City of Burlington will submit a request to HUD for the release of HOME Investment Partnership Program funds under Title II of the Cranston-Gonzalez National Affordable Housing Act, as amended to undertake a project known as Burlington City Place Affordable Housing. The project is located at 130 Bank Street, Burlington, Vermont and includes new construction of an 8-story affordable housing building. The project is in the location of the former Burlington Mall building, which was demolished in 2018. The scope of work includes the following. Prior to the construction of the affordable housing project, a master podium structure will be constructed over most of the 2.53 acre parcel, which will support multiple mixed-use buildings, including the proposed 8-story 80-88 unit affordable housing building, and will accommodate parking under the buildings. The master project also proposes reconnection of both Pine and St. Paul Street between Bank and Cherry Streets. This environmental review includes the entire land area of the parcel, the parking and podium structures, reconnection of the two streets, and the affordable housing building itself. Mitigation measures include adherence to a Vermont Department of Environmental Conservation approved Corrective Action Plan, which requires the installation of a sub-slab depressurization system (SSDS) to mitigate impacts from off-site vapor migration, monitoring of the SSDS, and additional soil testing, if required, for the purposes of assessing potential urban soils if any are encountered, and management of such soils. The SSDS will double as a radon mitigation system. Mitigation measures also include that the project shall acquire all necessary permits before the project can be completed. The estimated total cost of the project is approximately $26,320,000 including $275,000 in HOME funds from the City of Burlington. The project also anticipates pursuing Section 8 Project-Based Vouchers. Other Federal funding sources include various funds provided by and through the State of Vermont. A separate combined notice will be completed for such funds by the State of Vermont. FINDING OF NO SIGNIFICANT IMPACT The City of Burlington has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Majority ownership for the entire project has changed hands a few times over the years, and now two related groups are vying to rebuild the old mall and parking garage into a modern complex, in three phases. The timeline for this work is still uncertain, but CityPlace developer Don Sinex told VermontBiz in mid-March that construction could begin as early as this fall, with completion expected 24 to 30 months after that. While his partners have been mostly quiet since they took control of the central section last May, Sinex now anticipates he will demolish all remaining structures in Phase 2 (including the former LL Bean and old mall as well as the Church Street facade) before eventually razing the Phase 3 Macy’s after July 2025, when the Burlington High School lease expires. Sinex said Phase 2 would include a 175- to 200-room hotel with one retail store on the new St Paul Street; two new retail spaces facing Church Street, with about 15 apartments above; and an arcade running from Church to St Paul. He estimated the cost at $60 million. Permitting has not been fully resolved as of late August, and financing is still uncertain. The company was a federal contractor that provided plastic sheeting to the U.S. Agency for International Aid. A review by the department’s Office of Federal Contract Compliance Programs alleged that from March 30, 2018 through Sept. 30, 2019 the company discriminated against Black, Asian and white applicants for laborer positions. The agency found Midwest Canvas’ actions violated Executive Order 11246, which prohibits federal contractors from discriminating in employment based on race, color, religion, sex, sexual orientation, gender identity or national origin. To resolve the allegations, Midwest Canvas agreed to pay $230,204 in back pay and interest to the affected applicants who applied for the laborer positions. In addition, the company will make employment offers to 41 identified class members. You’ll need an iPhone 8 or more recent iPhone to do it. We’ll walk through the download process and then turn to the new operating system’s most useful features. Before you start the download, make sure your phone’s backup feature is enabled so that in the unlikely event something goes wrong, you won’t lose anything on your phone. Check by going to “Settings,” tap on your name, “iCloud,” “iCloud Backup” and “Back Up Now.” Keep this feature on by default. Are you ready to download? Almost. Make sure your iPhone is connected to power and your battery is at 50% or greater. Connect to Wi-Fi. You’ll need at least 5 gigabytes of free storage space. If not, move off photos and videos to the cloud or an external device. You can also delete large files and unused apps by going to “Settings,” “General” and then “iPhone Storage,” where you’ll see a list of large files to select from. To download iOS 16, go to “Settings,” scroll down and tap “General” and then “Software Update.” If you don’t see iOS 16 at the top of your screen, that means you’re behind in updates. Scroll down to see “Upgrade to iOS 16” and tap it. The installation should only take a few minutes. Now it’s time for the good stuff. The customizable lock screen seems to be the favorite new feature, but here are additional ones I find most useful. iOS 16 brings you the ability to edit messages after you’ve sent them. Whether it’s autocorrect gone wrong or an ordinary typo, you can now fix your text maybe even before it’s read. Once edited, there will be a tiny “edited” notation below the message, a standard practice in social media. The recipient will be able to see previous versions if they hold down the notation. You will also be able to recall a message. But the clock will be ticking: you have 15 minutes to edit what your message says and two minutes to unsend it. You can also mark messages as unread after you’ve read them, which is useful when you don’t have time to respond immediately. Improvements continue in the Messages app with the ability to restore previously deleted messages. There’s now a Recently Deleted folder in Messages. Go to your message list and tap “Edit” in the upper left corner, which opens a dropdown menu. Select “Show Recently Deleted.” You’ll then see a list of the messages you’ve deleted and the number of days until they’re permanently deleted. Check the ones you’d like to recover or easily select all to recover or delete. Apple Mail now lets you schedule your emails to be sent in the future. After composing an email, press down on the send arrow to see your options, including a time tonight, tomorrow or set your own time by using the calendar and the clock feature. Here is one of my favorite features that represents new functionality within the Photos app. There’s no official name for this, but it is essentially a quick way to remove the background from a photo and use the cut-out in another app. There are entire apps devoted to doing this and of course Photoshop, but iOS 16’s built-in feature makes it simple and faster than relying on another app. Just open an image in the Photos app and hold down on it. You’ll see a faint outline drawn around the main object or objects. You copy and paste it into an Instagram post, a text message or any other app that uses a photo. You could also send the clip to your email for even more applications. My daughter, a special education Ph.D. student, was especially excited about this one as a quick way to simplify pictures for the visually impaired. Photos now gives you the ability to delete or merge duplicate photos, a great resource for those running out of storage space. Give it a try by opening the Photos app, tap “Albums” at the bottom of the screen and then scroll down to “Utilities.” Select “Duplicates” and you’ll see duplicate matches with the option to merge. Tap “Merge” to delete the duplicates. Behind the scenes, the software combines relevant data like captions, keywords, and favorites into one photo with the highest quality. Kansas State has embraced the image of a physical, defense-first team that can barely score. The rest of the Big 12 is also trying to find its identity as six teams play their first league games Saturday — Iowa State with the eighth-ranked defense in the nation, TCU with the ninth-ranked offense or top-10 teams Oklahoma and Oklahoma State that have been brilliant on offense and shown some defensive chops as well. “Tough. Resilient. Edgy. Hungry. Never satisfied. I think those would be the best,” said first-year Sooners coach Brett Venables, when asked to describe his team. “I love the way we are developing. Our leadership and our mindset. These guys are super hungry, and they want you to coach them hard. When I say they are literally sitting on the edge of their seats in every meeting, I can’t say it any more clearly and truthful. And when we go to practice it is the same thing.” Venables, a longtime defensive guru who arrived from Clemson added: “We are still have a long way to go, but we are making steady improvement” The biggest surprise in the Big 12 through the nonconference portion of the season is undoubtedly the Jayhawks, and it’s not only because they’re 3-0 for the first time in more than a decade. They’ve been dynamic on offense behind Jalon Daniels, who may be the impressive quarterback in the league so far. The league’s offensive player of the week following another big performance in a win at Houston, Daniels is doing what would get a player on a national title contender in the Heisman Trophy conversation. He accounted for 281 yards and five touchdowns in the 48-30 win over the Cougars, pushing his TD total to 10 through the first three games. He is both the Jayhawks’ leading rusher with 244 yards and passer with 566 yards. “We have a lot of people who are able to make plays with the ball in their hands in our offense,” said Daniels, who was fighting for playing time a year ago but seized the starting job in fall camp. “I feel like (coordinator Andy Kotelnicki) realizes that, so I feel like he does a great job of being able to put guys in situations to be able to get the ball.” It’s not as if the Jayhawks have beaten up on soft competition to reach this point: They’re sitting atop the Big 12 by virtue of their overtime win at West Virginia and knocking down future conference foe Houston, which was expected to be a Top 25 contender. “It’s nice to see that our early start’s being recognized,” said Kansas coach Lance Leipold, whose team plays another 3-0 opponent in Duke on Saturday. “But shortly after that happens, you have to just keep your head down and focus on what you’ve got to get done and get better at.” There’s plenty for the Jayhawks’ rivals along Interstate 70 to get better at on offense. Turns out establishing an identity doesn’t mean much if you don’t win. “Adversity has struck and how are we going to respond to that adversity — all of us, players, coaches — because we knew it was going to be a tough game,” Wildcats coach Chris Klieman said. “We knew that they were a good football team and we knew we had to play really well to beat these guys. The Vancouver-based miner says it now expects its third-quarter steelmaking coal sales to be between 5.5 million and 5.9 million tonnes compared with earlier guidance for between 5.8 million and 6.2 million tonnes. The company says there was a “structural failure” of the plant feed conveyor belt. Initial estimates are that production at Elkview operations will be interrupted for one to two months while the repairs are made. Teck estimated that if the suspension lasts two months that the impact on 2022 steelmaking coal production will be in the range of 1.5 million tonnes. The company say Elkview will reschedule planned plant maintenance to take advantage of plant downtime and mine operations will focus on pre-stripping during the outage.
