October 20 Letters To The Editor – The Big Bend Sentinel – The Big Bend Sentinel https://collincountynewsonline.com/october-20-letters-to-the-editor-the-big-bend-sentinel-the-big-bend-sentinel/ Editor, Is it possible for all the local Marfa restaurants to consider uploading their change of hours on yelp.com rather than post a paper notice that only those in town see?  I drive an hour to come into town and am all excited to enjoy a meal somewhere only to discover the owners have decided they’re going on vacation or whatever they’re doing when they close abruptly.  It’s very disappointing to drive so far only to have to scramble to find anyone open. Choices are so limited as it is, to have such random hours without a way to know ahead of time is rather frustrating. Think of all the visitors you might be missing too. Just a suggestion from a foodie who enjoys coming to Marfa for a meal, but is becoming less interested the more this happens. It’s not worth the gas or the frustration because invariably second choices aren’t as good. Thanks, Joy Kennelly  Valentine ____________ Dear Editor, I would like to comment on an article in The Big Bend Sentinel, 13 October, 2022 issue, written by Allegra Hobbs, entitled “After pushback from locals, Alpine City Council stalls approval of new Dollar Store.” On 26 September, 2022, an action item came before the Planning & Zoning Commission (P&Z) to approve a replat application for consolidating lots for commercial retail development. The action to approve the application died for lack of motion and our recommendation to the Council of the City of Alpine was to deny it. I was surprised to read in the article that at some time in the recent past the City Council took up this issue — namely a request by Dollar Store to annex the land it bought — and voted to approve its annexation. I wish this request had been forwarded to P&Z first. If it had, the citizens surrounding the proposed site would have been properly notified and invited to attend our meeting, where they could express their feelings on the issue. Their feedback and our recommendation would have been forwarded on to the City Council, where it could have been further discussed in public. By having multiple public discussions early in the process, citizens would have been fully informed of all the issues at hand, been able to express their feelings in multiple forums, and know that their city was being informative, transparent and receptive to community concerns. I do agree with City Attorney Rod Ponton’s explanation that for the city to enforce its building codes and receive sales and property taxes from the business, the land had to be annexed. Researching Texas municipal annexations and their related extraterritorial jurisdictions (ETJ), it wasn’t difficult to find a recent case (holding) supporting what Ponton said. Citing the Third Court of Appeals in Dallas, in its published opinion on May 10, 2018, in Collin County, Texas v. The City of McKinney, Texas v. Custer Storage Center, LLC: “The case arose from a dispute after Custer developed a self-storage facility in McKinney’s ETJ, acquiring building permits from the county but not from the city. Collin County and McKinney were operating under a so-called ‘1445 Agreement,’ which specified that the city had exclusive authority to regulate the subdivision plats and approve related permits in the city’s ETJ.  … The Court ruled that no city may enforce building codes or collect building permits in its ETJ. The court specifically cited Town of Lakewood Village v. Bizios, a 2016 Texas Supreme Court decision, where the court had held that general law municipalities could not extend building codes or permits to the ETJ.  The Dallas appeals court ruled that the Bizios decision also applies to home rule cities; therefore, every city is prohibited from enforcing building codes or permits in its ETJ.  The opinion states that the city ‘lacks authority to require a landowner developing property in its [ETJ] to obtain City building permits, inspections and approvals, and pay related fees.’“ I don’t know the final outcome of this case, if it was appealed to the Texas Supreme Court, but I think it’s most likely the holding Ponton relied on when he recommended the annexation to the Alpine City Council. The only thing I would take issue with would be what Mr. Ponton was reported to have said in the article regarding the annexation that, “The city can only annex land at the request of the owner.” In the Home Rule Charter of the City of Alpine, TX, amended May 7, 2005, Section 2.03 : “The City shall have the power … to annex … (B) by action of the City Council, with or without the consent of the inhabitants or owners of the territory to be annexed.” I would ask, if you live in Alpine, to call your ward council person and ask them to make it a city policy to send all applications for annexations and related issues to Planning & Zoning first so that these issues don’t become unnecessary controversies. The things my family has gained over the past year from architects, consultants, city officials, and Alpine citizens have led to significant changes in the initial design of the Chisos Brewing Co. As a soon-to-be local employer, we hope our neighbors feel they have a stake in Chisos, and we’re happy to update them on some of the most important changes. Our plans have always included environmentally-conscious elements: State-of-the-art, water-saving brewing equipment A large water-saving, park-like native garden Design elements that highlight Alpine’s unique social and geological histories Hiring local and buying local whenever possible Turning locally-grown and locally-produced ingredients into authentically-local beers Whereas the Big Bend Brewery produced approximately 30,000 barrels (930,000 gallons) of beer per year, Chisos will initially produce only 1/30 of that amount, or about 1,040 barrels per year. Even if we someday become very successful, our maximum capacity (brewing twice a day, five days/week), won’t exceed 5,500 barrels/year. Too small to meet the 15,000 barrel/year industry definition of “microbrewery” (as established by the Brewers Association), Chisos Brewing will be classified a “taproom brewery.”  More important for a business in our beautiful desert: even at maximum capacity (if we ever reach it), Chisos’ total operation will consume less water every month than two average American families. And, by recycling brewery wastewater for agricultural use, we’ll put less water back into Alpine’s sanitary sewer system than the average Alpine family already does. Since initial building designs were presented in December 2021, we’ve made some important changes: Reduced the size of Chisos’ taproom building by almost 25%, from 6,630 to 5,118 square feet over two floors Purchased 22,651 square feet from Union Pacific for parking and leased a second nearby property for overflow parking if needed Worked with a brewery waste consultant to create an environment-friendly method for disposing of waste brewing water, spent grain and yeast, and neutralized cleaning products by giving them to local farmers and ranchers for agricultural use. We’ve already received multiple requests for these nutrient-rich brewing byproducts. Purchased a pickup and trailer to haul brewery waste twice a week  Purchased a retired ambulance to repurpose as a mobile “Beerbulance” to provide beverages for local events  In response to the city’s concern about noise pollution, Chisos will offer acoustic-only music outdoors, except for occasional special events and/or festival weekends. We also erected an 8-foot sound-reducing fence along the south boundary of the brewery property and, at the request of a neighbor, ensured the “good” side of the fence faces his property instead of ours. Changed the exterior of the downsized taproom building from stark white to soft gray, to blend more comfortably into the neighborhood Our family has poured time, resources, and our hearts into creating a welcoming place for all of Alpine’s citizens to meet, relax, and build community — a place everyone can be proud to visit with friends and family. I want my little boys to see where I grew up, so we recently bought a historical Alpine home and we are having it designed and renovated by awesome professionals who live right here.  I was an Alpine High School cheerleader, and I feel now, as an adult within my heart, there’s a cheerleader with a megaphone cheering loudly for my hometown.  I proudly say I’m from Alpine, and people not familiar with Far West Texas say, “Is that near Marfa?”   I politely correct them and say Marfa is near Alpine. Alpine is the largest town in the largest county in Texas!   Oftentimes, I’m encouraging professionals such as physicians, teachers, caregivers, business owners, and entrepreneurs to move and start a business in my hometown so they can help “mis amigos” in the Big Bend region.   I believe the Chisos Taproom will help the local economy and provide employment for people in Alpine. Murphy Street is looking good but will look even better than it’s ever been with Chisos Taproom.  All of our close friends and longtime residents are supportive of Chisos Taproom being built. Australia’s first university cloud supercomputing facility allows researchers to test new ideas and solutions up to 80 times faster than existing on-premises servers offically opened to industry partners on Wednesday night RACE provides fast, secure, and private connections, powered by Amazon Web Services and AARNet—ideal for higher-speed workloads that require fewer delays than the internet. RACE Director Dr Robert Shen says researchers, students, and industry partners will be able to fast-track the time it takes to turn initial ideas into products, thanks to the increased bandwidth. ­­“RACE will enable researchers to test out ideas and solutions up to 80 times faster compared to the existing on-premises servers”  “Research typically involves many failures before success: this facility lets researchers fail quickly so they can fine-tune their solutions and improve them,” says Shen AWS Chief Technologist for Australia and New Zealand, Simon Elisha says high performance computing is key to solving complex problems across many industries. “Using AWS, RMIT can securely deliver advanced computer performance, memory capacity, and scalability.”  “AWS’s portfolio of cloud services allows researchers at RMIT to focus on ground-breaking research, across a broad range of sectors, and innovate faster,” says Elisha. AARNet CEO Chris Hancock says the high-speed internet and communication services provided for RACE were designed to service both current and future demand. “AARNet has deployed a high-capacity network for RACE that scales up to 400Gbps to provide RMIT researchers with enough headroom to transfer massive amounts of data to AWS on demand now and in the future,” says Hancock New service makes a difference for the RMIT research groups  A team led by Professor Matt Duckham is applying computing power to design automated methods to locate a person based on a verbal description of their surroundings. This approach may be particularly valuable in emergencies if satellite positioning is unavailable. Duckham say his team now has the ability to process massive information streams including drone imagery, satellite data, data from sensor networks and crowd-sourced data that could overwhelm conventional computing facilities. “Enabling us to analyse these huge volumes of data from new sources can help better inform evidence-based policy decisions to improve public transport, traffic, infrastructure and many other aspects of quality of life,” says Duckham. Professor Michelle Spencer has used it to analyse data and communicate a new ultra-fast screening method for hundreds of potential electrolytes for lithium-metal batteries, which could potentially increase storage capacity by 10-fold, for lithium-metal batteries. “We are using RACE to analyse our data and produce high-resolution animations that help us to interpret our data and communicate our research findings,” says Spencer Associate Professor Thach Nguyen and the team at the Integrated Photonics and Applications Centre rely heavily on high performance computing to design fingernail-sized photonic chips that can be plugged into optical fibre networks to make the internet faster or medical diagnostic tools to track cancer cell spread in real time. “Direct access to RACE means that when designing and simulating brain-like chips or creating a chip which could break the record for the world’s fastest internet, the team can run multiple processes at once with computing capability that expands and scales as needed.” “RACE has provided our team with on-demand computing power anywhere, anytime to simulate our photonic chips at 10 times faster than was previously possible.” says Nguyen The research opens the doors to new opportunities including: The design of chips that could make internet faster,  Help drones more accurately inspect railway infrastructure Build handheld devices to detect ovarian cancer more accurately.  The Victorian Government has provided financial backing for RACE through the Victorian Higher Education State Investment Fund, establishing it as a critical resource for advanced data processing in universities and industry. Per the announcement, the firm says it will be “recruiting a wide range of talent for system construction and service development to provide new experiences such as Web 3 and the metaverse.” The available roles cut across areas of Business Development, Project Management, Legal, and Accounting, with new hires facing the possibility of being transferred to one of Konami Group’s corporations. Konami revealed that it had been researching blockchain technology and its role in gaming. Under the research, the gaming firm decided to create a non-fungible token (NFT) trading platform to allow players to trade their in-game digital collectibles for money. “NFTs can be used in-game as items, as well as participate in fan communities and events, and interact with other series and communities to further expand the user experience,” read Konami’s report. Applicants that scale through the hiring process will join the team in developing a “unique digital item distribution platform” in line with the Japanese regulatory framework. Konami is the name behind titles like the Metal Gear Solid franchise, Castlevania, Pro Evolution Soccer, and Froggy. Konami is no stranger to NFTs, having made an incursion into the niche back in January by launching digital collectibles to mark the 36th year anniversary of the Castlevania franchise. The collection was made up of GIFs of portions of the gameplay, while the rest was made of the game’s maps. The dip in NFT activity is worrying Konami’s push into NFTs is coming at a precarious time for the asset class, given the decline in transaction volumes. At the start of the year, NFT trading volumes were at 17 billion, and the figure fell to $466 million in October, which represents a 90% fall in activity. “The fading NFT mania is part of a wider, $2 trillion wipeout in the crypto sector as rapidly tightening monetary policy starves speculative assets of investment flows,” Bloomberg said. The decision by some large gaming companies to launch digital collectibles has been met with deafening criticisms. Ubisoft’s attempt at NFTs Quartz received backlash from the gaming community, while Nicolas Pouard, VP at the firm’s Strategic Innovation Labs, defended the offering by stating that “gamers don’t get what a digital secondary market can bring to them,” Despite the fall in NFT trading volumes and the lethargic start of Ubisoft’s foray, Konami can turn the tides in its favor by learning from the shortcomings of its predecessors. The honor came with a scholarship from the American Filtration Society. Global Environmental Science student Jacob Vasquez presented research he has been conducting for his senior thesis with Godwin Severa, assistant researcher at the Hawaiʻi Natural Energy Institute in the School of Ocean and Earth Science and Technology. They developed and tested specialized materials that capture atmospheric acidic gases that can pass through and impact the efficiency of fuel cells as they generate clean energy. To improve air purification technology, Vasquez analyzed the capacity for various materials to absorb gases such as carbon dioxide, hydrogen sulfide, nitrogen dioxide and sulfur dioxide. Jacob Vasquez talking with conference attendees about his research findings. “The entire experience developed my presentation and networking skills and was an absolutely beneficial experience for me made possible by my department, the Hawaiʻi Natural Energy Institute, and the UH Mānoa Undergraduate Research Opportunities Program (UROP),” said Vasquez. “It was rewarding to share our efforts to improve this promising clean energy technology.” The conference was an international opportunity for professionals and students to present their state-of-the-art research in filtration. It included presentations from 30 students representing seven different countries over the course of two days. Students were evaluated by a panel that included experts in the filtration industry. “We have exceptional students at UH doing cutting edge materials research that is critical for sustaining our future, including the full realization of fuel-cell based technologies,” said Severa. “It’s fulfilling to see our students participating in these efforts being rewarded. I encourage students to seek research experiences. It’s never too early to start. Educational entities OneonOne Limited, an online platform, and the Caribbean School of Data, with its implementing partner Mona School of Business, will provide the training.  “From a cost perspective we are sharing the partnership in terms of education fees and digital literacy fees,” said Price in the question-and-answer session.  Since the COVID-19 pandemic, the Government issued some 40,000 laptops to students as a means of allowing them to conduct classes remotely. It was aimed at stemming the spread of the virus.   The Flow project, called Jump, aims to hone in on vulnerable households that are likely to continue to fall behind in connectivity and education. Price said that overtime he expects it to increase graduation rates, jobs, financial inclusion and overall economic growth.  “Jump is our new programme to bridge the digital divide,” he said and later explained about measuring the uptake and usage of the devices. “We will be measuring success at every stage. So, we have a mark for three-months, six-months and so on, just to make sure we are collecting the data as we go,” said Price.  The launch was endorsed by Karl Samuda, Minister of Labour and Social Security, and Daryl Vaz, Minister of Science, Energy and Technology. The lounge offers a brand new menu, different from concessions elsewhere in the arena. “The focus here is approachable yet elevated sports bar food,” said O’Brien. Among the offerings are smoked gouda bacon dip, wagyu hot dogs, house-made pizza and spicy pork nachos. Beverages include signature, craft cocktails like the Straight up Spicy Margarita and the Even Money Espresso Martini. Local “We’ve been open already for about six nights for preseason and for some concerts. The atmosphere is electric,” said O’Brien. The FanDuel Sportsbook Lounge is open three hours prior to event time and one hour post on event days at the United Center. For now, there are no age restrictions.

And we hear you. The cost of Hawaii vacations has jumped tremendously. We just experienced this ourselves on last week’s visit to the Big Island. The price of the same accommodations rose about 300% over pre-Covid. Wow. At the same time, interisland airfare plummeted to $39 each way. The increases in the cost of Hawaii vacations are across the entire range of trip expenses. It includes transportation (and especially car rentals), hotels, food, and Hawaii activities. We’d go so far as to say that Hawaii vacations have become synonymous with being expensive and are best compared with international vacation costs rather than with domestic ones. It is said that Americans tend to budget about 2% of their annual budget on vacations. That is according to the latest federal government statistics. But Hawaii is in a league by itself, and those budgets are now out the window in most cases. How we saved on our Hawaii vacation on the Big Island. Instead of booking massages for $300 or more at the hotel spa, we both opted for the Hokulani Massage Academy in Waimea, where apprentice massage rates are $45 for an hour and a professional hour-long massage is $75. We also asked for a microwave at our hotel to enjoy lanai dining from the grocery store rather than an expensive eat-out meal every single night. With that said, we did splurge and ate at the Canoe House one night, which we enjoyed thoroughly and will perhaps review based on the food, location, ambiance, and creativity. Another savings was checking and rechecking the prices of car rentals before our trip. We wrote about that experience specifically in We Saved Extra 25% On Hawaii Car Rental. It Wasn’t Costco. We also had sticker shock trying to get an Uber at one point. The 12-mile trip was first priced at $179, and we’ll let you know what happened to that in another humorous yet telltale article. So while airfare and hotel prices may or may not fluctuate, you can save on activities and dining by being creative and doing online research. If you have any tips on how you saved on your Hawaii vacation, please share them with others in the comments below, since prices have soared to new records. What is today’s average cost of a moderate 7-night Hawaii vacation for two? Accommodations: $2,800 (that is at the economy end of the scale). Air transportation: $1,200 (may be more or less depending on location). Car rental: $800 (varies significantly by season and other factors). Food and beverages: $1,400 (with one moderate main meal out daily). Total estimated average cost: $6,200 per week. Due to the cost of airfare to travel from 2,500 to 5,000 miles and the highest accommodation cost in the U.S., Hawaii vacations are unlike most domestic trips. The total costs can vary greatly by how you travel, where you stay and eat, and what you do. Older Hawaii vacationers tend to spend more. We’ve seen estimates that those who are retired or near retirement spend up to 4x more on Hawaii vacations than those in their 20s for example. Will you now shun Hawaii for more affordable vacations? Hawaii vacation costs here have escalated more rapidly than we see elsewhere. Take even restaurants, for example. They have raised their prices due to food, supplies, shipping, insurance, and fuel costs. That is probably the truth, given what we see here at Costco and other stores here in Hawaii. Prices have risen more here than elsewhere. In part, that is due to the distance that everything needs to travel to get to Hawaii. How hard is it for Hawaii tourism businesses to attract and retain employees? Then there’s the cost of people. It is extremely hard to attract employees to the Hawaii travel industry after Covid. And that problem doesn’t seem to be improving. We still find businesses suddenly closed when adequate staffing doesn’t show up to work. Higher airfares are coming too, except for these specific routes. The cost of flights to Hawaii is on the rise. Economy airfares to Hawaii have risen less, whereas extra legroom and business class have risen far more. These premium offerings have risen in price by on average more than 100% since pre-Covid, based on our own checking. The exception to airfare increases is on those routes where extreme competition between Hawaiian and Southwest continues to suppress price increases. That includes Hawaii flights from California cities and interisland flights primarily. On those routes, it is still easy to find Hawaii airfares of about $300 RT, or less, including all taxes and fees. In that case, for two people, the average cost might be at or below $600. Start Hawaii trip planning with Hawaii hotels to find any value options. Since Hawaii hotel rates are the highest in the US, start looking for value options there before purchasing airfare. Revenge travel, post-pandemic, allowed those rates to rise to levels never seen before. In your editors’ visit to the Big Island this week, we found that hotel rates had risen multiple times since last being there pre-Covid. For example, we once wrote about staying at the oceanfront Kona Tiki Hotel on Big Island, when it was $69 a night. When checking rates today, that same room starts at $309 nightly for a two-star budget hotel. Up on the Kohala coast, oceanfront resorts have gone up in price by hundreds of percent. Hawaii hotels/vacation rentals are the number one expense. This can now cost at least five times more than Hawaii airfare. With the highest hotel accommodation rates in the U.S., accommodation for an average 7-night Hawaii vacation, including all taxes and fees, is likely to amount to $3,000 or more. And if you’re heading to Maui, keep in mind that Wailea hotels are still getting daily rates in the range of $1,000. So you can expect a 7-nighter with taxes and fees to run you $8,500 or more. Those estimates are conservative too. We recently checked rates at South Maui properties for January and found Andaz, and Four Seasons, for example, starting at nearly $2,000 per night. Lower-end properties, such as Aston Maui Hill, were asking $1,098 in January. Remember that Hawaii hotels have dynamic pricing and tend to adjust prices daily and seasonally. Ever considered the 7-night NCL Cruise visiting four islands? The current price starts at $1,449 per person and includes your room, dining, entertainment, Wi-Fi, and free ground excursions. Your editors have done this cruise twice and highly recommend it. When you add up the cost of a 7-night vacation for two, this is an attractive option to save money and visit Big Island, Oahu, Maui, and Kauai. Plus it’s just a lot of fun. Have you tried buying a lei in Hawaii lately? This is just another example of costs that have gone through the roof. The cost of flowers in Hawaii has become extreme. Once ubiquitous and cheap, flowers are hard to come by. Also likely due to the lack of labor for island flower farming. So if you want a cheap orchid lei, they’re still there to be found. If you want anything else, get ready for sticker shock. We also opted out of purchasing a beach towel at our Big Island hotel, which was $117 with tax. Seriously? Now it’s your turn to comment. According to the United Health Federation’s 2021 America’s Health Rankings Annual Report, Oklahoma ranks 45th in overall resident health. Lora Buechele, coordinator for Cherokee County TSET HLP, shared her thoughts on the importance of health literacy. “In a society of so much misinformation regarding health, it is imperative that we educate individuals on how to find and understand accurate health information and services available to them,” said Buechele. “As community organizations, health care providers, elected officials, and other health professionals, it is so important that we connect health literacy to health equity so all community members have the opportunity to live a healthy and quality life.” A record number of libraries are now part of that effort. Forty-one public libraries across the state recently received a total of $218,879 in grants from the Oklahoma Department of Libraries to support health literacy programs. “Many sites have applied for the grants over multiple years to further develop and continue their health literacy efforts,” said Leslie Gelders, administrator of ODL’s Office of Literacy Development, in a recent press release. “And we always have some new sites coming onboard each year.” In the Eastern Oklahoma Library System, six facilities — the Rieger Memorial Library and the Delaware County, Eufaula, Grove, Rieger, Muldrow, and Muskogee public libraries — were awarded grants totaling $20,537. Grantees will host a variety of programs and classes related to exercise, healthy cooking, and more. For example, the Muskogee Public Library will be encouraging physical activity with classes in music and movement and has planned biking safety sessions and a bike repair station. Both Buechele and Durant are staff on the Cherokee County Health Services Council, which runs several programs aimed at helping area residents stay on top of their health. “Through the Caring for Tahlequah program, we are currently offering a Self-Management Education workshop for people living with chronic diseases,” said Pamela Iron, executive director of CCHSC. “These workshops are free and led by certified lay leaders designed to help people gain self-confidence in their ability to control their symptoms, better manage their health problems, and lead fuller lives.” Through CCHSC’s AmeriCorps program, Office Services Specialist Rozlyn Locust said the council aids the Rural Health Foundation in decreasing poverty in Cherokee County. “The organization identifies and tracks health concerns and trends in Cherokee County by promoting innovative health-related programs and education for the best quality of life,” said Locust. CCHSC also offers training for Narcan administration and stigma reduction. Each includes an open discussion and conversation for individuals from Cherokee County with opioid-use and substance-use disorders. “We are educating the community on local treatment resources and ways to change our vocabulary to reduce stigma across Cherokee County,” said Locust. Locust and Iron both pointed to the the Tri-County Rural Health Network, which provides rural communities with HIV self-testing kits. “These kits promote self-confidence and sexual health awareness to any individual within our local communities,” said Iron.

At about 3:13 p.m., Chautauqua County sheriff’s deputies responded to Vineyard Drive for a reported motor vehicle accident with personal injury. Upon arrival patrols located three vehicles involved. An investigation at the scene alleged that 31-year-old Jonathan Gonzalez Colon of Dunkirk was traveling east and rear ended a vehicle that was stopped at a red light. This vehicle then struck another vehicle that was also stopped at the red light. Gonzalez Colon was found to be driving with a suspended license, following too closely and using speed not reasonable and prudent for the road conditions. A passenger in Gonzalez’s vehicle was transported to the hospital for minor injuries. Gonzalez Colon was issued traffic citations and will answer the charges in the town of Dunkirk court at a later date and time. Months after announcing it had raised $11.15 million, crypto asset manager Valkyrie Investments earlier this month revealed – quietly – that the biggest participant in the funding round reneged, leaving Valkyrie scrambling to find others to fill the gap. In a letter that went largely unnoticed until now, Valkyrie CEO Leah Wald wrote that an entity she called CSA Evolution VC Fund was no longer able to contribute $5 million toward the transaction. “We had a signed subscription doc in-hand, and their [limited partners] were blue chip firms that have impeccable reputations in the business,” she wrote in the letter dated Oct. 7. “In the months that have since passed, though, those LPs backed out and the investor was unable to meet its obligation.” She went on to say that Valkyrie was looking for other investors to step in. When reached Wednesday, a Valkyrie spokesperson said, “we of course are in advanced talks with a number of potential investors who have expressed interest in our firm, and hope to have positive news in the coming weeks.” Before the publication of this story, there was a single Google search result for CSA Evolution VC Fund: Wald’s letter. There are signs, however, that there is an association of some kind with Clear Sky Advisers, a Houston-based firm that describes itself as an investor in “environmental credits and companies focused on decarbonization, electrification and resource sustainability.” First, there’s the obvious: Clear Sky Advisers can logically be shortened to CSA. But far more significantly than that, Valkyrie’s June press release on the more than $11 million fundraising listed, among others, a participant it called “Clearsky.” There was no mention of CSA Evolution VC Fund. Furthermore, there’s a person who clearly connects Valkyrie and Clear Sky Advisers. The CEO of the latter, Shawn Singh, is mentioned in Valkyrie regulatory filings for its exchange-traded funds (ETFs). He is listed, for instance, as a trustee of the Valkyrie ETF Trust II. Clear Sky Advisers declined to comment. Singh did not respond to multiple requests for comment. In June, Valkyrie Chief Investment Officer Steven McClurg downplayed the importance of Valkyrie’s raise. He told CoinDesk that Valkyrie had even declined some offers, which were unsolicited. In the end, the decision to accept the investments was “less about the money and more about [forming] strategic partnerships” with key industry players, McClurg said. “We really weren’t anticipating raising any capital right now.” That message conflicts with Valkyrie’s own regulatory filings. In March, the company told the SEC it was seeking to raise $20 million and already had $5.1 million in fresh capital banked. (Valkyrie’s previous funding round was a $10 million Series A in June 2021). And Wald’s comments suggest Valkyrie is still hungry for capital. “Over the past few months, we explored a number of avenues and potential solutions to get the promised investment in the door,” she wrote. “In fact, the firm’s principal recently made an investment from his own personal funds.” And now Valkyrie has “decided for now to pursue alternative funding sources, including additional investors.” Valkyrie had hoped to use venture capital money to fund its staking and mining operations and ultimately court more institutional investors in the digital assets space. The firm currently runs several operations, including a decentralized finance (DeFi) hedge fund, three ETFs listed on Nasdaq, several protocol trusts and a protocol treasury management business. Some of the equipment was recovered on battlefields in Ukraine, the Justice Department said, and other nuclear proliferation technology was intercepted in Latvia before it could be shipped to Russia. The Justice Department charged nine people in separate cases in New York and Connecticut, as well as two oil brokers for Venezuela. The defendants are accused of acquiring the military technology from U.S. companies and then laundering tens of millions of dollars for wealthy Russian businessmen and other sanctioned entities. Some of the defendants are also accused of brokering illicit oil deals for the Venezuelan state-owned oil company. “As I have said, our investigators and prosecutors will be relentless in their efforts to identify, locate, and bring to justice those whose illegal acts undermine the rule of law and enable the Russian regime to continue its unprovoked invasion of Ukraine,” Attorney General Merrick Garland said in a statement. The five defendants charged in New York are all Russian nationals, and two have been arrested. All four defendants in the Connecticut case — three Latvians and one Ukrainian — were taken into custody months ago at the request of U.S. authorities. The criminal charges complement the latest round of Biden administration sanctions targeting Russia. The Treasury Department’s Office of Foreign Assets Control announced sanctions Wednesday against one of the men charged by the Justice Department, designating Yury Orekhov and two of his firms, Nord-Deutsche Industrieanlagenbau GmbH and Opus Energy Trading LLC, for procuring advanced semiconductors and microprocessors used in fighter aircraft and ballistic and hypersonic missile systems among other military uses. Orekhov and the firms ultimately sent the materials to Russian end-users, including companies designated by various federal agencies, in violation of U.S. export controls. The Justice Department, Federal Bureau of Investigation, and Treasury’s Office of Foreign Assets Control worked in coordination to identify the Russian network. Along with sanctions on members of Russian President Vladimir Putin’s inner-circle, the U.S. has frozen Russian Central Bank funds and imposed aggressive export controls. The latest effort is dedicated to preventing Russia from procuring military technologies. Deputy Treasury Secretary Wally Adeyemo said in a statement Wednesday that Russia has increasingly struggled to get the technologies it needs to sustain the war “thanks to the unprecedented sanctions and export controls imposed by our broad coalition of partners and allies.” “We know these efforts are having a direct effect on the battlefield,” he said, “as Russia’s desperation has led them to turn to inferior suppliers and outdated equipment.” Information from the Office of the Director of National Intelligence, presented Friday at the Treasury Department, said Russia has lost more than 6,000 pieces of equipment since the beginning of the war in late February and is turning to Iran and North Korea for supplies. The company doesn’t foresee cloud gaming will replace consoles or PC, and called it “a new and immature technology.” The CMA wrote on Sept. 1 that it would launch a full investigation into whether Microsoft buying Activision could hurt market competition in the U.K. The regulator argued that Microsoft could stifle its rivals by removing Call of Duty from PlayStation or by adding Activision’s games to its cloud gaming service. The deal faces scrutiny from multiple international regulators and the United States Federal Trade Commission. Microsoft has repeatedly presented cloud gaming as a way to enjoy its games and supplement console sales that trail behind Sony’s. At flagship industry trade show E3 in 2019, one of the industry’s last in-person conferences until events resumed in 2022 — Microsoft showed off its cloud gaming service Project xCloud in eye-catching demos to gamers, saying the service could play all 3,500 games in the Xbox catalogue, and an additional 1,900 games still in development. “We’re eager to see how this space continues to grow and look forward to supporting development studios, our partners and others in the industry who are investing into cloud gaming as it invites more people to experience games,” said Xbox Cloud Gaming vice president Catherine Gluckstein in an Oct. 6 statement to The Washington Post. Gluckstein’s comments came in response to questions about the state of gaming after the shutdown of a competing cloud platform, Google’s Stadia. Google announced Sept. 29 that Stadia would shut down by January 2023. Microsoft’s message in its response to the CMA Tuesday was more tempered, arguing that customers are likely to take a long time to switch over to cloud gaming, and are likely to stick to PC and console for most games. Despite the hype around cloud gaming, Microsoft wrote that gamers don’t care about whether their games are stored locally or in the cloud. Instead, the technology needs to win them over on game content and actual tech specs, such as graphics and latency. Even as the cloud gaming landscape has constricted with the shuttering of Stadia, brands like Logitech, Ubisoft and Razer are still optimistically promoting their cloud gaming services. The Microsoft filing also contained an assortment of other facts, some more recent than others, offering a rare peek into the notoriously tight-lipped games industry. Xbox has agreed to not bring Call of Duty to Game Pass “for a number of years” to honor Activision Blizzard’s ongoing deal with Sony giving early access to PlayStation users, which ends in 2024. Microsoft revealed in the filing it had offered to keep Call of Duty on PlayStation through 2027, but Sony ultimately rejected this offer. Microsoft’s response to concerns over Call of Duty has been to continue insisting it won’t remove the lucrative franchise from PlayStation, as Microsoft has repeatedly told gamers and regulators it would lose money on the franchise if Call of Duty left Sony’s platform. Microsoft also detailed in the filing its plans to build a mobile game store across devices, which the company first announced back in February. The mobile store would adapt the preexisting Xbox Store that consumers already know on PC and console to the more portable platform to challenge Google Play Store and Apple’s App Store. Microsoft’s filing is significantly more candid about the console wars than some of its blog posts and statements from executives over the years. It fully admits to the U.K. regulator that Sony and Nintendo have beaten the company on the number of consoles sold and number of monthly active users. Microsoft’s filing even contained criticism of Call of Duty, noting how 2021′s installment “Call of Duty: Vanguard” was panned by reviewers on release, and that the franchise could fail over time. In its bid to convince the U.K. regulator that the acquisition wouldn’t hurt competition, Microsoft laid bare several of its shortcomings in the filing. The company has never matched Sony’s advantage on gaming exclusives and console sales. It also said Sony has Xbox Game Pass blocked on PlayStation. All told, the filing shows Microsoft pleading it’s more like David than Goliath when it comes to gaming as it tries to gain regulatory approval.

Legacy Partners bought 11 acres in Melissa to build a luxury 133-unit single-family rental community in Melissa, the developer’s brokerage, Vanguard Real Estate Advisors, said Wednesday. The site is along State Highway 5, about 3 miles northeast of the intersection of Highway 75 and Highway 121. The parcel is directly south of the Melissa United Methodist Church at 3851 McKinney St. Doug Zadow, a prominent landowner in Melissa, was the seller. Jordan Cortez, managing principal of Vanguard Real Estate Advisors, said Legacy Partners and other developers are chasing projects in Melissa in response to the city’s rapid population growth, great schools and high incomes. “We’re seeing a tremendous amount of interest from both build to rent and multifamily developers in that market,” Cortez said. Melissa, a city in Collin County 40 miles north of Dallas, is a hotspot for construction of for-sale single-family homes. The city’s population has nearly doubled over the past five years to 22,000 in 2022, according to city estimates. Another builder, NexMetro Communities, has two single-family rental communities underway in Melissa, Avilla Stoneridge and Avilla Springs. Legacy Partners, based in Foster City, Calif., develops, manages and acquires multifamily and build-to-rent communities in cities across the U.S. It has three communities in North Texas: 880 Lyn in Irving, Merit in Lewisville and Ovation at Galatyn Park in Richardson. They wouldn’t, she said. The channel would stick with its usual prime-time lineup of Tucker Carlson, Sean Hannity and Laura Ingraham. Mr. Murdoch, the executive chairman of Fox Corporation, was fine with Ms. Scott’s decision, according to an executive with knowledge of their conversation. As a business move, Ms. Scott’s call was the right one for Fox News in the end. As many viewers tuned in as they would on a regular night. And Fox still managed to best CNN in the ratings. The decision was true to form, according to interviews with more than a dozen current and former colleagues. Since Ms. Scott took over the top job at Fox News in 2018, her colleagues said, she has managed from behind the scenes with a simple mantra: Respect Fox’s audience. Often, that involves sparing conservative viewers what they don’t want to hear — even when that means ignoring one of the biggest stories of the year. That strategy has helped Fox News succeed not just as the most-watched cable news network in the country but also as a multibillion-dollar consumer brand with a suite of businesses that, according to a recent company promo for one product, offers fans “The World According to Fox.” In addition to the Fox News and Fox Business cable channels, Ms. Scott has introduced Fox News Books, a publisher of meditations on Christianity; Fox Nation, a $5.99-per-month streaming service that produces a reboot of “Cops” and an original special from Mr. Carlson, “The End of Men,” that purports to explore a nationwide decline in testosterone rates; and Fox Weather, a new app and cable channel. Mr. Murdoch is the son of Rupert Murdoch, the chairman of News Corp and Fox.Credit…Drew Angerer/Getty Images But Ms. Scott’s Fox News — a sanctuary for conservatives where few unpleasant facts intrude and political misinformation has spread — also looms large in a case that threatens Fox’s business, and possibly Ms. Scott herself. She has emerged as one of the central figures in the $1.6 billion defamation lawsuit against Fox by Dominion Voting Systems, in which the voting company accuses Fox executives of juicing ratings and profits by repeatedly airing false information about Dominion machines siphoning votes away from former President Donald J. Trump. According to several people closely involved in the case, lawyers for Dominion are expected to depose her soon. A judge has granted Dominion access to her emails and text messages from the period after the 2020 election when Fox anchors and guests amplified some of the most outrageous falsehoods about Dominion and its supposed role in a plot to steal the election. So far, those messages contained at least one instance in which Ms. Scott expressed skepticism about the dubious claims of voter fraud that her network had been promoting, a recent court proceeding revealed. That kind of evidence is what Dominion hopes will ultimately convince a jury that Fox broadcast information it knew to be false, which would leave the company on the hook for significant damages. People who have heard Ms. Scott speak in meetings say she has been critical of Mr. Trump’s election denial claims, though she mostly keeps her personal politics private. (She is registered as unaffiliated.) One colleague recalled that in a meeting shortly after the 2020 election, Ms. Scott seemed in disbelief as she described how people she considered otherwise serious and rational thought there was any chance Mr. Trump could legitimately stop President Biden’s inauguration. And according to a message that Ms. Scott sent around the same time, which Dominion lawyers recently cited in court, she warned against “giving the crazies an inch,” referring to pro-Trump conspiracy theorists. NPR first reported on that message, but a transcript of the hearing in which it was disclosed has since been sealed by a judge at Fox’s request. Fox has suffered several setbacks in court lately as it has tried to narrow the scope of the case and limit what internal communications it is required to hand over to Dominion. In a statement, Fox News Media lauded Ms. Scott for expanding the company into numerous new businesses. “We are extremely proud of Suzanne rising through the ranks to become one of the most successful C.E.O.s in the media industry and her track record of incredible results speaks for itself.” Lawyers for Fox have said that its commentary on the 2020 election and Dominion was protected by the First Amendment and inherently newsworthy. “There is nothing more newsworthy than covering the president of the United States and his lawyers making allegations,” Fox News Media said in a statement. The Murdochs, however, have been forced to make hard choices about even their most favored chief executives when scandal overwhelms. In 2010, Rupert Murdoch, the chairman of Fox Corporation, reluctantly pushed out Rebekah Brooks, who ran his British newspapers and was a close protégé, amid a police investigation into phone hacking by journalists who worked for her. Her first big promotion was to a senior producer position on Greta Van Susteren’s show. She would go on to oversee network talent, and then programming. Colleagues say she pays careful attention to what’s on Fox, often watching from her office with the sound off and occasionally offering advice to producers and hosts on how sets could look better, outfits sharper and guests could be more compelling. Under her direction, Fox News has maintained not only one of the biggest audiences in cable but in all of television, occasionally drawing more viewers than traditional broadcast networks like ABC. And Fox News collects far higher ad rates than its competitors — an average of almost $9,000 for a 30-second commercial in prime time, compared with about $6,200 for CNN and $5,300 for MSNBC, according to the Standard Media Index, an independent research firm. As chief executive, Ms. Scott has adopted a mostly deferential view of dealing with talent, current and former hosts said. Mr. Ailes believed that no host should ever assume they were bigger than the network — or him. In 2010, for instance, after Mr. Hannity made plans to broadcast his show from a Tea Party rally in Cincinnati where organizers had billed him as the star attraction, Mr. Ailes ordered the host to scrap his plans and return to New York, threatening to “put a chimpanzee on the air” if he didn’t make it back in time, recalled one former Fox employee. Mr. Zuckerberg and other tech executives want us to buy these gadgets to live out their fantasy that the metaverse will be an immersive virtual world where we shop, socialize and work. But consumers shouldn’t necessarily follow the whims of business leaders. Gaming has been the most compelling use of these headsets since the Oculus Rift arrived in 2016. The introduction of that contraption, a clunky headset that plugged into a personal computer, marked the debut of mainstream virtual reality, and the early wave of applications was focused on this kind of entertainment. Based on extensive testing of that device, along with the myriad competitors that came after, and the new Meta Quest Pro set for release next week, it seems safe to conclude that the tech has found its sweet spot. The headsets are wearable, immersive video game consoles. People should buy them for the same reasons they get PlayStations and Nintendos: to be entertained and to find brief escapes from the real world. Not to live out the outlandish dreams of tech leaders. Meta envisions that high-resolution headsets, new business-focused software and superfast internet connections will transform the way we work, collaborate and create art. In the company’s own jargon, the Quest Pro could unlock “net new use cases.” Yet when asked, the product’s leaders couldn’t name a “killer app” for the fancy new headgear. What Is the Metaverse, and Why Does It Matter? Card 1 of 5 The origins. The word “metaverse” describes a fully realized digital world that exists beyond the one in which we live. It was coined by Neal Stephenson in his 1992 novel “Snow Crash,” and the concept was further explored by Ernest Cline in his novel “Ready Player One.” The future. Many people in tech believe the metaverse will herald an era in which our virtual lives will play as important a role as our physical realities. Some experts warn that it could still turn out to be a fad or even dangerous. “We’ll learn with developers once the device is in the market,” said Anand Dass, a director of metaverse content at Meta, at a product briefing this month. In other words, Meta’s sales pitch for the Quest Pro is the potential for it to be life-changing by enabling tasks that couldn’t be done before. That is a mighty compelling narrative, but it is a vision that has yet to be realized. There’s a valuable lesson amid all the hype surrounding virtual (augmented, mixed, whatever-you-want-to-call-dorky-looking) goggles: We shouldn’t spend our dollars on a company’s hopes and promises for what a technology could become. We should buy these headsets for what they currently do. And based on what I saw, for the foreseeable future, the Meta Quest Pro will primarily be a gaming device. (I predict the same outcome for the Apple headset expected for an unveiling next year.) Meta highlighted three features: the headset’s higher-definition picture, which is receiving quadruple the number of pixels of its predecessor, the $400 Quest 2; the array of cameras embedded into the headset, which can now create a real-time rendering of your facial expressions and eye movements; and new motion controllers with improved pressure sensitivity so you can squeeze a virtual object gently or grab it aggressively. Meta employees and app developers gave me an hourlong tour through software tailored for the headset. I created a digital avatar of my face that mimicked my grins and frowns as I raised a curious brow. I made 3-D drawings and tossed virtual darts. I found the improved graphics and controllers impressive (and my animated avatar a bit creepy), but after I removed the headset and returned to reality-reality, I could only imagine wanting to use these new features to play games. My favorite virtual-reality game, Blaston, which was released in 2020 and involves players shooting one another in a virtual arena, would probably benefit from the improved motion controllers to make trigger squeezes for the different guns more realistic. PokerStars VR, where gamers gather around a virtual card table to play Texas hold ’em, would be more fun if we could pick up tells through each player’s facial expressions. By the end of the demo, I was also doubtful that I would get any work done with this headset. In a promotional video for the product, Meta suggested that the Quest Pro could be a multitasking tool for workers juggling meetings while scrolling through emails and other tasks. But the device’s battery lasts only one to two hours, according to Meta. (The headset can still be used while plugged in, but using a computer is less complicated.) This is the reality on which we should base our buying decisions. Not even Meta seems to believe many people will buy the Quest Pro. It said the device’s target audience would be early adopters, designers and businesses. If you fall into any of those camps, I recommend a wait-and-see approach to gauge whether useful virtual-reality applications become available for your profession. The company left a more obvious niche off its target list: hard-core gamers willing to spend lots of money on every piece of new gaming hardware. They are in for a treat. In addition to providing access to high-resolution virtual reality games made for the Quest Pro, the headset will work with hundreds of games already made for the Quest 2. Many of those older Quest 2 titles are quite good. Games that get your heart pumping and make you break a sweat, like Beat Saber and FitXR, which both involve swinging your arms around to hit objects, are a boon in an era when people need to wear smartwatches to remind them to stand up. None of this — a first impression that the Quest Pro will be great for playing games and primarily be used for entertainment — is a bad thing. The fact that we can get visually stunning, immersive gaming in a lightweight, wireless headset means virtual reality has come a long way in less than a decade. For now, that’s the only reason to buy one of these.
