(AP) — Railroad workers secured a deal Thursday that will deliver 24% raises and $5,000 bonuses over five years and it will also address some of their concerns about strict attendance rules and time off. The deal that’s retroactive to 2020 will give rail workers the biggest raises they’ve seen in more than four decades. But the concessions related to working conditions may prove to be more important to them. The nation’s biggest railroads, including Norfolk Southern, CSX, BNSF, Union Pacific and Kansas City Southern all negotiated jointly with 12 unions. Railroad workers will now be able to take unpaid days off for doctor’s appointments without being penalized under railroad attendance rules. Previously, workers would lose points under the attendance systems that BNSF and Union Pacific had adopted and be disciplined. The last three unions that remained at the bargaining table — the Brotherhood of Locomotive Engineers and Trainmen Division of the International Brotherhood of Teamsters; the International Association of Sheet Metal, Air, Rail and Transportation Workers – Transportation Division; and the Brotherhood of Railroad Signalmen. — together represent about 60,000 of the 115,000 railroad workers at the 12 unions involved in the talks. Like with the other unions that agreed to a deal with the railroads, the financial terms closely follow the recommendations the Presidential Emergency Board that President Joe Biden created last month. The other nine unions that had reached agreements all had a provision in their deals that will allow them to receive additional benefits equal to what the remaining unions earned through negotiations. So they will likely be able to also benefit from the concessions the unions representing engineers and conductors secured. The unions that represent the conductors and engineers who drive the trains had pressed hard for changes in the attendance rules because they said the policies made it hard to take any time off. The unions said this deal sets a precedent that they will be able to negotiate over those kind of rules in the future. But workers will still have to vote whether those changes are enough to approve the deal. Victor Chen, a sociologist at Virginia Commonwealth University who studies labor, said addressing concerns about working conditions have increasingly become a priority for unions and the workers they represent. The railroad unions pointed to workload and attendance rules after the major railroads cut nearly one-third of their workforce — some 45,000 jobs — over the past six years. The railroad industry has aggressively cut costs everywhere and shifted its operations to rely more on fewer, longer trains, which allowed to to use fewer locomotives and fewer employees. The unions said the remaining workers, particularly engineers and conductors, were on call 24-7 because of jobs cuts and could hardly take any time off under strict attendance rules. “At a certain point, good wages just aren’t enough to make up for the toll these sorts of working conditions impose on workers,” Chen said. “The companies need to treat workers like human beings, rather than just inputs in a business process.” Unions had an advantage at the bargaining table because of the tight labor market and ongoing service problems on the railroads, Chen said. Shippers have complained loudly this year about delays and poor service as railroads struggled to quickly hire enough workers to handle a surge in demand as the economy emerged from the pandemic. Worker shortages have prompted a number of other unions to strike over the past two years, and union organizing efforts are up with prominent campaigns to establish unions at Starbucks, Amazon and other companies. But Chen said the railroad unions had additional leverage because of the persistent supply-chain problems. In one of the biggest strikes last year over 10,000 Deere workers secured 10% raises and improved benefits but those gains came after the workers remained on strike for a month and rejected two offers from the company. But it likely won’t be clear for several weeks whether railroad workers will support these deals. Already, one labor union voted Wednesday to reject a deal based closely on the Presidential Emergency Board’s recommendations, but the members of that International Association of Machinists union agreed to delay any strike action until Sept. 29 to allow for additional negotiations. Two other rail unions voted to approve deals Wednesday. Rutgers University professor Todd Vachon, who teaches classes about labor relations, said that since the pandemic, working conditions have increasingly been a key part of labor disputes — sometimes rivaling wages and benefits. Railroad workers were particularly attuned to work-life balance and the ability to take time off for health reasons. That has led to a “real resurgence in the labor movement that goes beyond merely reacting to inflation,” Vachon said. The Presidential Emergency Board recommended significant raises, but told the unions to address their concerns about working conditions through arbitration that can drag on for years or additional negotiations at each railroad. C.A.M.P. stands for Child Attitude Motivation Program. “The intent behind the camp, it’s a pretty personal thing to me,” said Judge Terry Stevens, Roane County General Sessions Court, Part I. “My dad grew up under hard, rough circumstances. He was one of 12, and, out of the eight friends he grew up with, he was the only one who didn’t ever go to jail or prison and one of only two that were alive in adulthood. After I was appointed, we talked about ways to motivate some of our local youth who grow up in bad circumstances or who were making their circumstances worse. What made it work better for my dad was meeting the gentleman I knew as my grandfather, who had expectations and showed him what opportunities were available. That’s the goal of our camp, to help the kids with some of the things they’re dealing with and also show them what opportunities are out there. We also let them know people in the community have expectations of them for the better. That’s what we try to convey through camp.” “I learned to stop and think before I act,” said a 14-year-old male participant, who was in the program for unruly behavior at home. “We need to respect ourselves, so we can learn how to treat other people.” C.A.M.P. works with community partners to teach students by simply sharing stories of hardship and success, to teaching valuable life skills. Throughout this 8-week summer program, students received classroom-based presentations and prevention education, which covered alcohol, stimulants, marijuana, tobacco/nicotine, prescription medication misuse, as well as suicide prevention, the importance of teen mental health, strengths and character building. The students were given time to express themselves through learning how to play the guitar, building bird houses, painting and crafts. Students attended horse equine therapy sessions, learning how horses aid in grief counseling. They also participated in team building exercises and attended Ridgeview Behavioral Health’s obstacle course in Oak Ridge. “Roane County Anti-Drug Coalition comes in and teaches independent living skills,” said Leonora Spangler, Youth Services Officer with the Juvenile Court. “We work with our local health department and they teach everything from how to wash your hands appropriately to how to make a doctor’s appointment. We were able to work with the health educator on a lot of different things this year, including making their own lunch one day. They made the menu, they made the salad, they made the spaghetti, they made a dessert and it was a good, healthy meal.” “I enjoyed the food that was brought in and learning about nutrition,” said the male participant. “Learning how to cook and knowing about nutrition to stay healthy is important.” In addition, C.A.M.P. participants learned about a variety of topics such as healthy living, healthy relationships and budgeting through the University of Tennessee Extension Office.  A local realtor also discussed the importance of good credit scores, paying bills on time, and how these things can impact lease agreements or home loans. “We’ve had doctors, dentists, pharmacists, trades folks and financial planners come and just kind of say here’s how you do it to try and take the stigma away and take the impossible out of their minds,” said Judge Stevens. “There’s a lot of them who don’t know how to achieve certain things and think that it’s not possible, so we have a lot of people come in from pretty diverse backgrounds to say anything’s possible.” Judge Stevens said C.A.M.P. is a program of trial and error, where new lessons are added each year. “This year it was a stock market category, because so many people have the opportunity to have 401ks or IRAs with employers,” said Judge Stevens. “It’s important that they know what their money is doing and also that there’s a benefit to saving money. A lot of them don’t understand it. We do the budget part, but then what do you do after the budget? It’s very interesting to see. They bring up different companies that they like and then we say there’s a stock for that. They were very interested in learning about it.” C.A.M.P.’s predecessor was known as a boot camp and ran from 2005 to 2011. When Judge Stevens was appointed to the bench in 2016, he wanted to start a camp that focused on attitude and motivation. Despite a year off during the Covid-19 pandemic, it’s been up and running ever since. “Our first graduating class is somewhere between 20 to 22 and they navigated those early developmental, often poor decision-making years without coming back,” said Judge Stevens. “We’re very thankful and very excited about the long-term success that we’ve had with them.” To date, only one student was ordered to return to the program for a second summer. “We tell the kids part of our expectation for them is to follow in the footsteps of the ones who have come before them because they’ve all done very well, as far as not having any future contact with the justice system,” said Judge Stevens. “We don’t want them to come back, only If they want to come back to say hi or if we can help them with something positive. We have had some come back for letters of recommendation or some guidance.” “I had one who asked my opinion about a sewing machine,” said Spangler. “It’s those little things that you don’t really pick up on. She thought I would be honest with her. I thought that was an odd little interesting thing that she reached out about. You become one of their adults and that’s a good thing. I’m thankful for that opportunity. They grow up and you get to see it. As they mature, they will stop by just when you need them to tell you what they are up to.” C.A.M.P. does not receive any extra funding from Roane County. However, the Roane County Sheriff’s Office does provide a school resource officer for the rare occasions when behavioral issues arise. “Our school system will provide some food for them and transportation, via the bus, but all of these things are already included in their budget,” said Judge Stevens. “We have our anti-drug coalitions that will help fund some things and get resources. The rest is all just community support and quite a few folks who will help cover meals and will help with their time to come speak. We’re very fortunate in that we’ve never had to ask for money. Most of the time, we get more offers than we can accommodate.” Ahead of graduation, students created action plans for the upcoming school year to address truancy, disciplinary issues, grades, and how to overcome peer pressure. They also learned how to make lifestyle changes that will put them on paths to success, including re-evaluating friendships and relationships. In addition, the students completed many hours of community service, both on-site at locations such as Roane County Parks and Roane State Community College, and at mandated off-site locations. On graduation day, students received a certificate of attendance, rewards from C.A.M.P. community partners, and a cookout celebration. “It’s the first time some of these kids have completed something because they struggled academically, or because of poor attendance or other issues with school,” said Judge Stevens. “It’s just to let them know whenever you do succeed and you do try hard, there is a benefit. We explain to them that it’s not always a monetary benefit, but there’s always someone watching how they perform and there’s a benefit if they do it the right way. That’s what we’re trying to convey. Some of these kids wonder why does it matter if I do this? It does matter. There is a better way. Whether it’s not coming back to court, pursuing a career or, sometimes, just the dynamic in their household benefitting from them doing their best.” Children’s Attitude Motivational Program (C.A.M.P) is a partnership with Roane County Anti-Drug Coalition (RCADC), and Roane County Juvenile Courts and Probation. Student participants are required to attend C.A.M.P. Monday – Friday, 8 a.m. to 3 p.m., similar to a school day.

Roguelikes have dominated the indie scene for a while now, but it has become so popular that it has begun to permeate flashy triple-A blockbusters too. With Sony’s PS Plus service’s growing list of games, there are quite a few options for you to experience the deeply compelling gameplay loop of the roguelike genre. There are plenty of roguelikes on PS Plus Extra, but which are worth your time? 8 Fury Unleashed Fury Unleashed takes the gameplay elements from the frenetic side-scrolling bullet-hell platformers of old and chucks them straight into a procedurally generated comic-book-inspired world, with all the meta-progression upgrades you can imagine. The game is like a fun mix between Contra and Dead Cells, and includes an intriguing combo system that offers rewards for unbroken chains of kills. It all helps to keep the action flowing while increasing your score. The moment-to-moment gameplay feels great as you have access to an impressive arsenal, with plenty of dashes and double jumps to keep the combo going. The game also allows you to bring a buddy along for co-op, which makes for twice the bombastic fun. 7 Everspace Most games set in space tend to go for a slower-paced and more explorative type of experience as you delve into the vast lonely depths of the unknown. Everspace does away with all that tranquil nonsense and looks to emulate the action-packed space shooters of old, in addition to introducing a cool story and some interesting roguelike elements. It is a solitary experience that has you engaging in run after run of hair-raising combat, which can change quite dramatically based on the type of ship and upgrades you’ve opted for. The story is told in quite a simplistic way, but the fact that it’s there at all is a welcome surprise as it will keep you engaged enough to see it through. 6 Moonlighter Has it ever crossed the minds of all those warriors committing heroic deeds what the humble town merchant gets up to when they’re off on their world-saving adventures? Moonlighter looks to answer that very pertinent question and will broaden your understanding of what it means to be an unsuspecting merchant. After inheriting a modest shop as part of the family business, you must delve into dark dungeons to find various trinkets and treasures to sell in order to maintain a healthy profit. Moonlighter is part shop-management sim and part roguelike dungeon crawler, which echoes the likes of The Legend of Zelda and The Binding of Isaac. What follows is an engaging loop of heading into the dungeons to find loot at night, then returning home to sell your plunder during the day. These two genres feed into each other in such a complimentary fashion, that it’s hard to believe it hasn’t been done before. 5 Children Of Morta Children of Morta bucks the ever-pervasive trend of roguelikes having a barely non-existent story by including a very well-thought-out narrative with a cast of lovably unforgettable characters. You take control of the noble Bergson family as they fight to uncover the mystery of the growing Corruption that is taking over the land. In addition to having distinct personalities with their own backstories and character arcs, each family member has unique abilities that can be boosted between runs. You have the option to permanently upgrade damage and armor, but there’s also a huge variety of other boons and pickups that will help you along the way. After dying, you’ll be rewarded with some deeper narrative insights, giving further detail into the background of each character and their relationships with each other. It’s a refreshingly unique take on the genre, and the delightfully colorful pixel-art graphics are a treat for the eyes. 4 Deathloop Arkane Studios pulled another one out of the bag when it released Deathloop, a stylish high-octane first-person shooter that has you vying to assassinate a variety of nasty baddies in a continual time loop. Arkane has definitely taken inspiration from their popular Dishonored series, as the combat is just as polished and slick. Admittedly, this isn’t a traditional roguelike game, as it incorporates mechanics from a variety of different genres. Where it does share its similarities is with its continual repetition of the same levels, where you will learn to improve your skills to better tackle each run. The environments vary depending on the time of day, allowing you to plan the best route possible for the most stylishly effective form of assassination, sort of like the Hitman series. Although not the most traditional of roguelike experiences, it shares enough with the genre to give its fans a good time, and the game is a fantastic experience in its own right. 3 Enter The Gungeon The tremendous success of Dodge Roll’s Enter The Gungeon is very well deserved as it’s one of the very best roguelike twin-stick shooters ever made. The number of guns you have at your disposal is tantalizingly overwhelming, with each weapon having its own unique abilities and distinct gameplay quirks, including a gun that shoots literal black holes. At its heart, the game is its dungeon (or gungeon) crawling, with each procedurally-generated level spawning a variety of bullet-themed enemies, items, and lore to discover. Each of the eight playable characters feels distinct and have their own perks and abilities, which helps to keep runs fresh. The game is very tough and will likely take you many playthroughs to get to the end bosses – although it’s such a joy to play, you probably won’t even notice. 2 Dead Cells With a slew of free updates, four sizable chunks of paid DLC, and a variety of continually added levels, bosses, and enemy types, there really is no end in sight for Dead Cells’ reign as king of the 2D roguelike. It is so much more than a simple action platformer by cleverly borrowing from Soulslikes and Metroidvanias. While navigating the procedurally generated levels, you’ll jump and dodge-roll your way through the game’s punishing combat. During each run, you are given the option to spec your character according to your chosen play style. You have access to a huge assortment of weapons and gadgets, making each play-through feel unmistakably different from the last. This is a roguelike experience that will likely be enjoyed by gamers for years to come, and if you’ve yet to get your hands on it, picking it up on PS Plus is a no-brainer. 1 Returnal Returnal was the first game that truly showcased what the PS5 is capable of, by flaunting its impressive 3D audio and the DualSense’s impressive adaptive triggers and haptic feedback. By drawing on its experience with frantic twin-stick indie shooters, developer, Housemarque’s, first foray into the triple-A space is a thrilling, bullet-dodging ascent into hell. With every death, you start again at your crashed ship to face the challenge anew, with access to a whole host of weapons and upgrades to aid you in your journey. In true Housemarque style, the shooting feels phenomenal, and the snappy traversal feels great when weaving in and out of the constant onslaught of bullets. It’s one of the most polished roguelike games out there, with a rich and engaging story that will have you happily die again and again to solve the mystery contained within. According to data compiled by Bloomberg, the three worst-performing non-leveraged ETFs listed in the US this year were all crypto-related funds. The top spot on the list of the worst ETFs was held by Viridi Bitcoin Miners ETF (RIGZ), which has fallen 69% this year. The fund was followed by Global X Blockchain ETF (BKCH) and VanEck Digital Transformation ETF (DAPP), which have both seen year-to-date losses of 68%. The heavy losses for crypto-themed ETFs have come as the Federal Reserve (Fed) has tightened monetary policy and increased interest rates in an effort to tame soaring inflation in the US. The situation has, in other words, been the opposite of last year, when the Fed eased monetary policy and resorted to massive “money printing” to keep the economy afloat during Covid lockdowns. “These areas were clearly prime beneficiaries of plentiful monetary and fiscal stimulus. Now, dry bulk freight futures and crypto are both suffering from the same malady – a highly aggressive Fed,” Nate Geraci, president of financial advisory firm The ETF Store, commented in the article. “The easy money party is over and both of these areas are now in the midst of brutal drawdowns,” he added. And although crypto funds have already seen the sharpest losses of all sectors, more pain could still be ahead. The first sign of this came this past Tuesday, when US inflation data revealed that inflation in August had been slightly higher than expected, coming in at 8.3%. The fear among market players now is that the Fed will respond to the higher-than-expected inflation by raising rates by 100 basis points at its next meeting, something the Fed hasn’t done since 1984. According to the derivatives exchange CME’s FedWatch Tool, the likelihood of a 100-basis point hike now stands at 20%, while there is an 80% chance the Fed will hike by 75 basis points.

LaPlante said. “As we use various authorities to replenish our own stocks, industry can expect a strong, persistent demand signal.” This procurement is part of the Ukraine Supplemental appropriation. The contract includes Army Ukraine replenishment, Army FY22 procurement, and international partner missiles. “This award demonstrates the Army’s ability to use the new authorities given to us by Congress to acquire critical capabilities for our Soldiers, allies, and partners rapidly and responsibly,” said Douglas R. Bush, the Army’s assistant secretary for acquisition, logistics and technology. To date, the Javelin Joint Venture has produced more than 50,000 Javelin missiles and more than 12,000 reusable Command Launch Units. Javelin is expected to remain in the U.S. weapon arsenal until 2050 and is subject to continual upgrades to support evolving operational needs. The committee, known as CFIUS, is made up of members of the departments of State, Defense, Justice, Commerce, Energy and Homeland Security and is led by the Treasury secretary. It sends its findings and a recommendation to the president, who has the power to suspend or prohibit a deal. While the White House said the new order is not targeted toward any particular country, it comes amid growing concern among U.S. officials about China’s investments in the U.S. technology sector and other industries. The order calls for CFIUS to weigh whether a foreign investment or sale could affect the resilience of critical U.S. supply chains and the impact it could have on U.S. technological leadership in areas affecting U.S. national security and on broader investment trends. It also calls on CFIUS to consider cybersecurity risks that could stem from a transaction and stipulates that the risks to U.S. residents’ sensitive data should also be considered. “President Biden’s executive order highlights CFIUS’s increasing attention to national security risks in several key areas and sharpens the committee’s focus on protecting America’s national security, while maintaining the U.S. open investment policy,” Treasury Secretary Janet Yellen said in a statement. “Strengthening our supply chains and protecting against foreign threats enhances our national security, and this executive order highlights CFIUS’s important role in that work.” Biden’s executive order comes after CFIUS’ oversight role of foreign investment was significantly expanded by 2018 legislation passed by Congress. CFIUS already has been considering many of the criteria laid out in Biden’s executive order, according to senior administration officials, who briefed reporters on the condition of anonymity under ground rules set by the White House. But the officials added that the administration hopes by publicly highlighting and sharpening the committee’s focus on what the administration sees as emerging risks, it will give greater clarity to businesses and investors as they look at national security risks that may arise from a potential transaction. Before the 2018 legislation, CFIUS investigated cases in which a foreign company’s attempt to acquire or merge with an American company could pose a national security risk. The 2018 legislation expanded CFIUS’ oversight to review certain joint ventures, minority stakes and real estate deals near military bases or other sensitive national security facilities. The legislation was prompted by complaints Chinese companies were taking advantage of gaps in U.S. law and improperly obtaining technology and possibly sensitive information. U.S. lawmakers also have expressed concern that Chinese companies were using joint ventures with foreign companies or minority stakes in ventures to gain access to sensitive technology. An annual Treasury Department report released in August showed Chinese investors more than doubled the number of applications they filed in 2021 seeking U.S. regulatory clearance for proposed deals.

Second Life, which was brought to virtual life by Linden Lab in 2003, is widely acknowledged as the first “metaverse” in which individuals could acquire, build on and, if they wished, sell virtual land. Coming to life long before the advent of cryptocurrency, the coin of the realm was the U.S. dollar, and land could be acquired through auctions held by Second Life. In 2006, Second Life concluded that an avatar named Marc Woebegone had found a way to hack into an auction and acquire a property below market value. Second Life took back the land, and all other virtual land owned by Woebegone, with the flip of a switch, effectively accomplishing the first ever non-judicial virtual foreclosure. Bragg v. Linden Lab, 487 F. Supp. 2d 593 (E.D. Pa. 2007). The matter eventually settled. Almost 20 years later since Second Life welcomed its first avatar residents, it seems inevitable that if the metaverses succeed to the degree that J.P. Morgan and many others hope, virtual land disputes will only become more common. For example, TerraZero Technologies, founded in 2021, promotes that it “owns, acquires, leases and develops real estate within multiple Metaverses” (including Decentraland, where there currently are roughly 200 properties), while also providing “a full service real estate experience, including buying, leasing, construction, tenant representation and white-glove brokerage services.” TerraZero rents and sells its land to individual consumers and businesses alike. Interestingly, TerraZero deliberately attributes its properties with many of the characteristics of traditional real estate, i.e., “LAND is a non-fungible digital asset maintained in an Ethereum smart contract . divided into parties are referenced using unique x,y Cartesian coordinates,” and “each LAND token includes a record of its coordinates, its owner and a reference to a content description file or parcel manifest that describes and encodes the content the owner wishes to serve on his or her land.” In other words, just as in real life, the land purports to be unique and has a title resembling that found in a traditional deed. Unlike Second Life’s owner, which claimed, “You have to remember this stuff isn’t real. It’s a game on a computer,” TerraZero and others consider their land as more than just a game. Evans v. Linden Research, 2012 WL 5877579, at *2 (N.D. Cal. Nov. 20, 2012). Indeed, TerraZero will loan U.S. dollars to individuals and businesses to allow them to buy property. To secure these loans, NFTs are given by the borrower as collateral. Once the debt is paid, TerraZero returns the NFTs to the borrower. It is unclear clear from the website whether an owner can sell the land subject to a mortgage or whether the owner can borrow against the property further and grant a security interest to a third party, which potentially would have its own remedies rights in event of default. Not the Same Presumably, there will come a time when a TerraZero borrower defaults and disputes the forfeiture of its collateral and the loss of its rights to the property. Despite “land” being given the attributes of traditional real estate, it is difficult to believe that a court will deem the land so similar to virtual real estate as to require TerraZero to initiate the notice and other procedures associated with either judicial or non-judicial foreclosures, given that there the property does not exist in particular state and that the rules behind traditional foreclosure would be hard to bend to sensible application in the virtual world. But it is a much closer call as to whether the requirements of Uniform Commercial Code (UCC or Code) Article 9 should be followed if TerraZero flips the switch, extinguishes its borrower’s rights and declares ownership of the NFTs it holds as collateral. Do any of the Code’s notice requirements (which differ depending on whether the borrower is a consumer or a business), redemption requirements and collateral sale rules apply? It is only a matter of time before these arguments are made, and although in traditional contracts some elements of the UCC can be waived by agreement, the applicable statutes are generally non-waivable under state law. Equally certain is the possibility of a dispute if TerraZero decides that a tenant has breached its lease and “evicts” (again, by a flip of a switch) its tenant. Would the higher protections, such as laws barring debt acceleration, offered by many states to individual tenants in the real world apply? Would a persistent coding error violate a virtual implied covenant of habitability? And at an even more basic level, will leases be subject to the numerous requirements (font size, etc.) that apply in the real world? It seems likely that virtual property owners, landlords and brokers will argue that despite the nomenclature resembling real estate in the non-virtual world, their arrangements are subject to their Terms of Service, and the state laws that govern selling and renting real estate simply do not apply. However, numerous questions remain unanswered, including whether terms of service need to distinguish between consumer and commercial entities in the manner often required by Article 9. But as the housing market in Decentraland and other metaverses similar to it heats up, it likely will not be long before a brick-and-mortar court weighs in. Which seemed a touch extreme. Now the company may have calmed its own heart in order to win yours. It’s just released an ad that tries to persuade you that Intel is inside so very many things. The four bongs that used to tell you instantly that Intel was inside your gadget. Oh, perhaps it wasn’t as much of a bong for you as a bum bum bum-bum. At the same time, it’s down by a very modest 0.3% in a week, up by 2.5% in a fortnight, and down by 10% in the last 30 days. These are hardly awe-inspiring movements for a cryptocurrency that happens to be the seventh-biggest by market cap, yet crypto also happens to find itself in hardly awe-inspiring macroeconomic conditions at the moment. Global stock markets have fallen in the face of negative inflation data, while Ripple continues to fight a nearly two-year-long legal battle with the Securities and Exchange Commission in the US, something which conspires to keep XRP’s price suppressed. Nonetheless, hope for a long-awaited end to this legal case has increased in the past 24 hours, after the presiding US court approved joint scheduling proposals concerning the redaction of parts of key SEC documents. When combined with other positive developments and rulings for Ripple over the past year, this suggests that a positive end to this legal tussle may be near, and that XRP could explode as a result. XRP Barely Budges Following Judge Torres Judgment The latest judgment in the Ripple-SEC case has come from Judge Torres, who has delivered several other rulings viewed favorably by people in the Ripple camp in previous months. In this particular instance, she simply approved a plan that had been jointly agreed by Ripple and the SEC, setting out a schedule for summary judgments on key parts of the case. As illustrated in the tweet below from attorney James K. Filan, this schedule runs from now to the end of December. This likely means that the case will not end until the beginning of 2023 at the very earliest. However, crypto-specialized lawyer Jeremy Hogan expressed approval at the fact this plan will speed up the resolution of the case, given that it sets a clear timeline for the delivery important documents and decisions. It shows that both parties now want to bring things to a head, with Judge Torres agreeing with their wishes. But while this is a positive development in the legal saga, it hasn’t really had a tangible effect on the price of XRP. The latter is still down across most timeframes, and also remains 70% down in the past 12 months.  Despite the lack of movement, XRP’s chart shows it hit a bottom some time ago and is now simply biding its time until another rally. Its RSI has been below 40 for much of the past week, while its 30-day moving average remains far below its 200-day. Of course, XRP needs to wait for the overall economic picture to improve before any real gains can happen. But when such improvements do occur, and when the case is finally resolved, its supporters are expecting it to post some fairly eye-watering returns. Will Ripple Win? The big question is whether Ripple will actually secure a positive judgment when the time for a final ruling comes. This is ultimately for the courts to decide, yet previous developments in the case suggest that Ripple has good prospects. In Jananury of this year, Ripple won the right to access important emails from 2018, concerning a speech delivered by the SEC’s William Hinman in which he declared that neither ETH nor BTC was a security. It then secured another favorable judgment in April, in which the court denied the SEC’s right to withhold some of the aforementioned important emails. On top of this, various legal experts have gone on record to say they expect a settlement — rather than a ruling against Ripple — to be the likeliest outcome. This is in addition to positive statements from more crypto-sympathetic lawyers, as well as from Ripple’s own executives.  The future therefore looks bright for Ripple, with the company actually planning to list publicly following the case’s close. Together with the ending of regulatory pressure, and with the relisting of XRP on exchanges such as Coinbase, this could result in the altcoin’s price surging dramatically. In this respect, it’s worth remembering that XRP was one of the few major cryptocurrencies that didn’t set a new record high in 2021, and that still has an ATH dating from 2018. So at the very least, the market could expect XRP to rally to this ATH — of USD 3.40 — in the event Ripple gets what it wants.

Established by the Department of Defense on September 18, 1947, the Air Force has played a critical role in our national defense and has also become integral to American air superiority with its fighter jets, bombers, and advanced technologies that will shape the battlefields to come. In honor of the Air Force’s anniversary, today’s WatchBlog post looks at how the Air Force maintains that air superiority, including incorporating leading technologies, and our work on the challenges it could face in these efforts. Equipment maintenance and modern aircraft challenges The Air Force spends tens of billions of dollars annually to maintain its weapon systems and ensure they are available to support today’s military operations and maintain the capability to meet future defense requirements. The Air Force is built around an aerial fleet of fighter jets, bombers, refueling tankers, command and control aircraft, among others. But in a June report, we found that the Air Force has struggled for years to maintain its aging fleet because of lack of parts, maintenance delays, and other problems. In fiscal year 2021, only two of 22 Air Force aircraft met internal mission readiness goals. To help the Air Force address these issues, which impact national defense, we have identified trends in costs and some of the cost drivers—such as the size of their fleets and particular challenges associated with each aircraft. We also found that the Air Force’s efforts to maintain its fleet could be aided by further development of plans to address maintenance needs, including the risks of delaying maintenance and challenges in addressing needs quickly. Moreover, having a plan would provide Congress with a better understanding of current sustainment challenges, and what the Air Force needs to do in an effort to prevent further complications. The F-35 fighter jet is here, but faces challenges To help replace older aircraft and provide advanced capabilities, the F-35 was introduced as the newest fighter jet for the Air Force, Navy, and Marines Corps. It is one of the most modern weapons systems in the world, with stealth capabilities, advanced sensors, and computer network technologies, such as its Autonomic Logistics Information System. But this technology comes with a hefty price tag. The F-35 is one of the most expensive aircraft for the Department of Defense (DOD) to sustain. We found that the estimated F-35 life-cycle sustainment costs since 2012 have increased steadily from $1.11 trillion to $1.27 trillion, despite current efforts to reduce existing sustainment costs. The military services collectively face tens of billions of dollars in sustainment costs that they project will be unaffordable. For example, the Air Force needs to reduce estimated annual per-plane costs by $3.7 million (47%) by 2036, or costs in that year alone will be $4.4 billion more than it can afford. GAO suggested that Congress, among other things, consider making future F-35 aircraft procurement decisions contingent on DOD’s progress in making the F-35 more affordable. In the National Defense Authorization Act for Fiscal Year 2022, Congress took steps to limit the quantity of F-35s procured by the military services beginning in fiscal year 2029 based on their ability to achieve affordability cost targets. In April, we testified before Congress that the F-35 fleet’s average mission capable rate—the percentage of time during which the F-35s can fly and perform at least one mission—were well below program goals. One major reason is that an increasing number of F-35s have not been able to fly because they don’t have a working engine. We recommended that DOD should make changes to its F-35 engine sustainment strategy. In addition, we identified numerous uncertainties facing the future of F-35 sustainment that DOD must grapple with in the coming years. The flight path forward The Air Force faces difficult decisions regarding how best to address continuing operational demands while preparing for future challenges. An important aspect of this is determining an appropriate balance between maintaining and upgrading and procuring weapon system platforms. As it plans for the future, the Air Force will need to balance sustaining its existing force with its desire to grow and modernize. We have made recommendations related to readiness, force structure, sustainment and weapon system development, and procurement to the Air Force. DOD and the Air Force have agreed with and implemented some of these recommendations. My own sister couldn’t believe I was taking the job. I mean, I even asked myself that when I applied. That’s not meant to be a slight or disrespect to anyone (at South Davidson). But you just have to look at the recent history.” And that history is painful. 2022 FOOTBALLDavidson County 2022 high school football schedules LEXINGTON SENIORFootball hopes new field is part of revival for once-proud program The Wildcats have won exactly 10 games in the past 10 seasons, had six head coaches during that time − not counting two who were hired in the offseason but left before ever coaching a game − and fought to have enough players at times to finish some of those seasons. Yet Honeycutt left as assistant coach at highly-successful North Davidson to take on the challenge for his first head coaching job. And, boy, is he and his staff doing the unthinkable. South has a 3-1 record heading into this week’s Central Carolina Conference opener against North Rowan. The last time the program won three games in a season was 2011, when the late Mike Crowell was head coach.  And those three wins that season didn’t come in the first four weeks. “I wanted to be a head coach by the time I was 30,” said Honeycutt, who will depart his 20s with his birthday next week. “And I was wanting a challenge. And I knew this would be a challenge. Taking this job was kind of like a perfect storm. David House (South’s assistant football and head wrestling coach) was at Glenn when I was teaching and coaching there. He is here now, so I know him. I did my student teaching several years back at Ledford under Chris Adams (South’s new principal). And I am obviously familiar with the Davidson County school system. “I just thought it was a perfect fit,” he said. Honeycutt, who starred on the gridiron at North and later at Greensboro College, has been successful doing what others have tried. “Trying to get these kids to fully believe they can play with and beat anybody,” said Honeycutt. “Now, that is a process. But our staff … we’ve been teaching it and coaching it since the start of preseason. And to have us win our first two games, and come back and win after trailing late in the first game (vs. North Stokes), I was so glad that happened.” The Wildcats have been getting solid play from junior quarterback Tanner Delattre and seniors Jesse Pope, Jaden Shively and Haiden Ireland, who leads the team with five touchdowns this season. South also has just enough numbers to field a junior varsity team, meaning freshmen and sophomores get a chance to play on Thursdays instead of standing on the sidelines on Friday nights. “We have right at 45 kids in the program now,” said Honeycutt. “Last year, I believe it was something like 20 kids. That’s huge to have a JV team. We are trying to get as many kids as possible to play. We have roughly 400 students in our school and only 150 of those are boys.” South’s pinnacle in football came in the early 2000s, when John Shelton led the program to three consecutive six-win seasons. Shelton is now serving as an assistant to Honeycutt. And Adams, for one, is proud of the entire program. “Coach Honeycutt has made an immediate impact on our kids and in our community since his first day on campus,” said Adams, the former Ledford football and baseball coach. “I could not be more proud of the job he and his coaching staff have done so far. There is a lot of work left to do, but I certainly have a lot of confidence in the direction we are going.”

An NFT – according to the definition provided in a proposed regulation on markets in crypto-assets by the European Parliament and the Council ― is a digital representation of a value or a right that uses cryptography for security and is in the form of a coin or a token or any other digital medium, which may be transferred and stored electronically using distributed-ledger technology or similar technology. That definition is slightly different to that recently presented by the EUIPO, which is narrower and more strict. This claims that NFTs should be treated as unique digital certificates registered in a blockchain, which authenticate digital items but are distinct from those digital items. The EUIPO has presented its guidance on trademark applications for metaverse and NFT-related goods and services, and indicated that virtual goods are proper to Class 9 because they are treated as digital content or images. However, the term ‘virtual goods’ lacks clarity and precision, so must be further specified by stating the content to which the virtual goods relate (eg, downloadable virtual goods, namely, virtual clothing). For the office, the term NFT alone is not acceptable – the type of digital item authenticated by the NFT must be specified. So far, there has been no equivalent communication from the Polish Patent Office, so it is reasonable to assume that it will follow the EUIPO’s guidelines. Polish IP practitioners can look to applications filed with the EUIPO or USPTO as there have only been a few filed with the Polish IP office. However, even in these few applications interesting patterns are beginning to emerge. Four trademark applications have been filed for Louis Vuitton Malletier (applications: Z.544393, Z.544399, Z.544392 and Z.544395) and one for Off-White LLC (Z.541790) related to the metaverse. The four applications of the French fashion brand were filed in Classes 9, 35, 36, 41 and 42. In each class, there are examples of virtual goods or services. Some terms from the list of goods and services relating to Louis Vuitton’s marks are particularly intriguing. For example, in Class 35 the company has registered under: rental services of virtual goods, characters or places, digital collectibles or non-exchangeable tokens, online in virtual, augmented or mixed reality environments. The applicant is known for selling goods, but as we understand, in the metaverse it will also provide rental services and these will not only relate to goods, but also to virtual characters and places. The trademark application owned by Off-White LLC was filed in Classes 9, 35, 41 and 42. There are also animated and non-animated characters but these appear in Classes 9 and 42 as part of downloadable computer software for creating, producing and modifying digital, animated and non-animated designs and characters, as well as servicing non-downloadable computer software for creating, producing and modifying digital animated and non-animated designs and characters. If we look for trademarks related to NFTs filed with the Polish Patent Office, we see the five applications mentioned above, as well as two other marks. The first is a word sign FREEVERSE filed by Freeverse SL (application: Z.542966) and the other, purely figurative, was filed by Visa International Service Association (Z.535643). However, in these two applications, there are not many NFT-related goods or services. The only service related to NFTs in the latter application concerns the financial exchange of virtual currency, in terms of NFTs in Class 36. Freeverse SL has two services in Class 42: non-transferable token design; development of NFTs. In the list of goods and services of the four Louis Vuitton applications, NFT is listed alone. Following the latest EUIPO communication, it shall not be accepted as such. We are curious as to whether the Polish Patent Office will follow the EUIPO’s communication and will request that lists of goods and services be amended. So far, out of all the applications discussed, only one has been registered – that of Visa International Service Association. We will monitor the Polish Patent Office’s register carefully to see if other applications are registered and if any new applications related to the metaverse and NFTs arise. We hope that brands will soon decide to file marks related to virtual reality, and we will have the opportunity to create a list of virtual goods and services. In his second column on his recent expedition to the remote Scottish Islands, Vitali tries to break that stereotype. Modern technology is always one step ahead of me. Before sitting down to write this second column about my recent journey to the Scottish Islands on board MV Greg Mortimer, I thought it would be good to know which seas the hardworking small ship was surfing at that particular moment. I was about to phone Aurora Cruises, the vessel’s owner, when an IT-savvy friend referred me to the website www.vesselfinder.com. From there I gleaned that: “The current position of Greg Mortimer is at North East Atlantic Ocean (coordinates 65.5679 N / 24.6406 W) reported 11 days ago by AIS. The vessel is en route to the port of Sisimiut, Greenland, sailing at a speed of 10.6 knots… Current draught: 5.2m…” I could almost feel a cool Arctic whiff of the “5.2m draught” on my face, the draught that would ruffle my hair all the way to the mysterious Greenland port of Sisimiut. In my previous Greg Mortimer column, I focused primarily on the ship herself – brand-new and stuffed with state-of-the-art bang-up-to-date technologies – from the inverted Ulstein X-Bow and Rolls-Royce dynamic stabilisers to variable-pitch propellers, semi-balanced rudders and (my favourite gadgets) two upper-deck Jacuzzi baths, sticking out of the ship’s perimeter and giving the bathers an illusion of flying high above the sea, like guillemots or albatrosses. Today, I want to talk about my technology-related experiences on the islands themselves. “Wait a moment,” I can hear you saying. “What kind of technologies can you possibly find on those remote and barren rocks?” Well, you will be surprised. Let’s start with the island of Eigg, which became the first community in the world to achieve complete renewable energy self-sufficiency. During the expedition, I found out that several other Scottish islands are now following closely in Eigg’s environmentally friendly footsteps (Rum, Ulva, Gigha etc). Recently, they were joined by the whole of the Orkney archipelago, which became fully self-sufficient and now produces 120 per cent of the energy it requires, mostly due to 650 (!) wind turbines and “the world’s most powerful tidal turbine” – Orbital Marine Power’s 2MV O2 – in its waters since 2021. Strolling through the semi-deserted streets of the Orkney capital Kirkwall on a Sunday morning, I picked up a copy of the ‘Islander’ magazine, from which I learned that little Orkney has also pioneered the first hybrid-electric aircraft in Scotland and the world’s first floating wave energy device to generate electricity to the national grid. In the main street of Kirkwall, I accidentally stumbled upon the family home of one of my favourite travel writers, Samuel Laing, Esq. He crossed the Channel to France on one of the first paddle steamers and wrote euphorically about “the great democratic power of steam” in his book ‘Observations on the Social and Political State of the European People’, published in London 1850 – the pride of my ever-growing old book collection. Samuel Laing (1780–1868) travelled extensively in Europe, including Norway and northern Germany, and published beautiful descriptions of these countries. I had no idea he was a native Orcadian. So, it was there, in the Scottish Islands, that I discovered the seemingly flimsy, and yet historically logical, connection between an early steamer and the super-modern explorer ship MV Greg Mortimer. I was excited to visit the officially remotest British island of Foula (area 4.88 square miles, population 38) which recently made history by becoming the last properly mapped area of Britain’s territory. Foula lies on the same latitude as Saint Petersburg, but has just one road. Since the 1990s, growing numbers of tourists, mostly bird watchers, have been making their way to Foula from around the world to see its puffins, skuas, razorbills, gannets and more. That was probably why Ordnance Survey mapmakers finally put the island on a separate custom-made OS Explore 1:7500 scale map. The map was published in 2017 and immediately became a collector’s item, alongside the recently released OS maps of Mars and the Moon. As a map addict myself, I can boast of being a proud owner of all three. While on Foula, I was shown around by Sheila Gear, an islander and a writer, who authored the book ‘Island West of the Sun’. She first took me to a peat moorland past the island’s school, with just five students at the moment. Peat is still harvested for fuel in the traditional fashion here – cut with a long hand-held blade, known as a ‘tusker’. The ingenuity of the islanders has no limits. Sheila pointed out several old cars, parked near houses and serving as wardrobes, storage closets and even rubbish bins. She explained that since it is very hard to get rid of old cars in Foula due to its isolation from the mainland, the islanders find other uses for them. Sheila also introduced me to the island’s unique technology of water supply via an underground pipe network, which the islanders had themselves invented and built. The water is collected at a spring and processed at a water treatment facility in the centre of the isle. The treated water is then pumped daily to two holding tanks, one at each end of the island, from where gravity feeds the flow into each property. Of course, that was a fairly simple achievement on the global scale, but for the tiny island it was as important as the first water channels built by the Romans over 1,000 years ago – on par with the discovery of electricity or the world’s first space flight. Following this line of thinking, I wasn’t particularly surprised to read in the ‘i’ newspaper on returning home about a new space port they are planning to build on the faraway Shetland Island of Unst. And why not? To paraphrase an old Latin saying, per insulae ad adstra! Through islands to the stars! A total of 37 projects will develop new technologies that engineer plants and microbes into bioenergy and improve carbon storage. The funding will support research into renewable bioenergy and biomaterials production, quantum-enabled bio-imaging and sensing for bioenergy, research to characterise gene function in bioenergy crop plants and understanding the role of microbiomes. Energy Secretary Jennifer M.
