Obituary For Karen Anne Herstedt | Davenport Family Funeral Homes And Crematory https://digitalarizonanews.com/obituary-for-karen-anne-herstedt-davenport-family-funeral-homes-and-crematory/ Obituary Karen Anne Herstedt, age 82, of Surprise, AZ, passed away unexpectedly on September 9, 2022, in Lake Barrington, IL, while visiting family for the summer with her husband, Arvid. On December 29, 1939, Karen Anne Rhodenbaugh was born in Moline, IL to Ray and Wynona Rhodenbaugh of Orion, IL. She had an idyllic childhood, living in a small farming town with her three brothers and extended family. Everyone there knew all their neighbors; and whatever you didn’t already know, you could learn by picking up the telephone and listening in on the party line. Her family were all members of St. Paul Lutheran Church in Orion, IL. Karen played piano, participated in the high school marching band, and was a popular cheerleader, as well. She graduated from Orion High School in 1958, and then spent a year in nursing training at Moline Public Hospital. Karen met Arvid Joel Herstedt, of East Moline, at The Wells Fargo Lounge in Moline, IL. Arv says he had to leave his home to find a telephone somewhere, so he could pursue her afterward without being under his parents’ watchful eyes and ears. There was only one phone in the house, after all! Arvid knew Karen was “the one” immediately, and they were inseparable ever after. Karen and Arvid married on December 22, 1962 at St. Paul Lutheran Church in Orion, and honeymooned in Lake Delavan, WI. They moved to Palatine, IL where Arv had been offered a teaching and coaching position at Palatine High School. She and Arv had three children; Laurie, Lynelle and Daniel, who were lucky to grow up with a close network of teaching and coaching friends and their families. All the kids grew up together! You all know who you are, and you mean so much to us! The parties were legendary. One such long-standing friendship was with Joyce and Dennis Keppen. Arv and Dennis launched K&H Roofing as an additional enterprise after their work at PHS as Industrial Ed teachers. Karen and Joyce managed their other joint venture, Waist-Up, a T-shirt and silkscreen business, for more than 15 years. The Keppens have continued to be a source of great solace for our family. Karen and Arvid also enjoyed wonderful friendships throughout the years with neighbors in Palatine, Rolling Meadows and in later years, Surprise, AZ. Karen was a homemaker in the true sense of the word; serving her family exceptionally well. She not only prepared beautiful, nutritious meals three times a day, year round; (liver is good for you) but carried out meticulous cleaning, bountiful gardening and copious yard work. She was an all-around cheerleader, caretaker, and nurse extraordinaire for her entire family, including her parents as they grew older. No one could make you feel as safe and cared for than our mother. Karen loved making our holidays memorable. She was a marvelous cook and mixologist, and an ever-effervescent party hostess who loved having fun. Who will make the annual Oostakaka or the infamous Liver Ball with as much aplomb now? She loved singing, playing the piano, dancing, golfing, and entertaining friends. She planned our summer vacations with grandparents, aunts, uncles, cousins and friends. She was a doting wife, mother, and then grandmother; serving up love daily. She had a new lease on life with the advent of her newest grandchildren. She was stunningly beautiful, even into her 80s. Her beauty never dimmed. Karen was predeceased by her parents, Ray and Wynona Rhodenbaugh. She is survived by her husband, Arvid Herstedt, her children; Laurie Schaefer (Mark), Lynelle Herstedt, and Daniel Herstedt (Tabitha); her grandchildren, Chelsea Shaw (Max), Sam, Caroline and Joseph Roseri, Kaleb, Ava and Owen Crawford, Hailey and Hudson Herstedt; her brothers Bill (Judy), Roger (Kathy) and Steve Rhodenbaugh, in-laws David (Susan) Herstedt and Linnea (Eli) Pyevich; as well as many nieces, nephews, cousins and friends too numerous to list. May her abundant energy and joy for life live on in all who knew her and loved her. A Celebration of Life for Karen will be held Saturday, October 15 from 11:00 am to 3:00 pm at the home of her son Daniel, 5612 Meadowbrook Lane, Crystal Lake, IL, 60014. The draft recommendations, from the U.S. Preventive Services Task Force, are designed to help primary care clinicians identify early signs of anxiety during routine care, using questionnaires and other screening tools. Anxiety disorders are often unrecognized and underdetected in primary care: One study cited by the task force found the median time for initiating treatment for anxiety is a staggering 23 years. While the task force’s initial deliberations on anxiety screening predated the coronavirus pandemic, the new guidance comes at a critical time, said task force member Lori Pbert, a clinical psychologist and professor at the University of Massachusetts Chan Medical School in Worcester, Mass. “Covid has taken a tremendous toll on the mental health of Americans,” Pbert said. “This is a topic prioritized for its public health importance, but clearly there’s an increased focus on mental health in this country over the past few years.” In April, the task force made similar recommendations to begin anxiety screening in children and teens, ages 8 to 18. The proposal announced Tuesday focuses on young and middle-aged adults, including those who are pregnant or postpartum, citing research showing that screening and treatment can improve anxiety symptoms in those younger than 65. But the guidance, somewhat surprisingly, stops short of recommending anxiety screening for people 65 and older. One reason: many common symptoms of aging, such as trouble sleeping, pain and fatigue, can also be symptoms of anxiety. The task force said there wasn’t enough evidence to determine the accuracy of screening tools in older adults, which may not be sensitive enough to distinguish between anxiety symptoms and conditions of aging. The task force advised clinicians to use their judgment in discussing anxiety with older patients. The task force also reiterated an earlier recommendation that adults of all ages undergo routine screening for depression. The task force, an independent panel of experts appointed by the Agency for Healthcare Research and Quality, wields enormous influence, and while its advice isn’t mandatory, the panel’s recommendations often change the way doctors practice medicine in the United States. Some doctors questioned how the recommendations would play out in the real world, where mental health providers say they already can’t meet patient demand, and patients complain of waiting months for an appointment with a therapist. “Screening is great, but with a dire shortage in the workforce, it’s perplexing unless there are plans for increased funding of clinicians,” said Eugene Beresin, a psychiatrist at Massachusetts General Hospital and executive director of the Clay Center for Young Healthy Minds. Global prevalence of anxiety and depression increased by 25 percent during the first year of the pandemic, the World Health Organization reported earlier this year. By the end of 2021, the WHO said, “the situation had somewhat improved but today too many people remain unable to get the care and support they need for both pre-existing and newly developed mental health conditions.” Anxiety, with its telltale dread and gut-wrenching, heart-pounding, palm-sweating physical signs, can manifest in a number of distinct diagnoses, including generalized anxiety disorder, social anxiety disorder, panic disorder and others. Together, these make up the most common mental illnesses in the United States, afflicting 40 million adults each year, according to the Anxiety and Depression Association of America. Treatment can include psychotherapy, notably cognitive behavioral therapy; antidepressant or anti-anxiety medications; as well as various relaxation, mindfulness and desensitization therapies, physicians said. The panel also considered the benefits of screening patients for suicide risk but concluded that even though suicide is a leading cause of death among adults, there is “not enough evidence on whether screening people without signs or symptoms will ultimately help prevent suicide.” Still, the panel urged providers to use their own clinical judgment to determine whether individual patients should be screened for suicide risk. For primary care physicians, already in the throes of a “crisis” of burnout, pandemic-driven stress and their own mental health challenges, adding yet another screening test to a long list of clinical tasks may feel burdensome. “If primary care providers are asked to screen for one more thing, we are going to break without more resources,” said a nurse practitioner in Northern California, who asked not to be named because she didn’t have permission from her clinic to speak about the issue. Ticking off current requirements, like verifying up-to-date screenings for cervical, colon and breast cancer, as well as food insecurity, domestic violence, alcohol and tobacco use, she said everything must be packed into a 15-minute appointment, while also treating patients with complex, chronic conditions. “It just feels wrong if people are positive for depression or anxiety, and we don’t have the mental health support to help them,” said the practitioner. But Mahmooda Qureshi, an internal medicine physician at Massachusetts General Hospital, said that additional support for patients suffering from depression or anxiety will help. “After 2020, it’s the rare patient who is not anxious,” said Qureshi, who noted that she now routinely asks patients, “How’s your stress?” “We have found that when it comes to mental health, if we don’t ask, often we don’t know.” The task force acknowledged the challenges of delivering mental health care to all those in need, adding that fewer than “half of individuals who experience a mental illness will receive mental health care.” The panel also cited “racism and structural policies” that disproportionately affect people of color. The panel noted that Black patients are less likely to receive mental health services compared to other groups, and that misdiagnosis of mental health conditions occurs more often in Black and Hispanic patients. Pbert said the latest guidance is just one step in addressing the urgent mental health needs of patients. “Our hope is that this set of recommendations can bring awareness of the need to create greater access to mental health care throughout the country,” she said, as well as highlight “gaps in the evidence so funders can support critically needed research in these areas.” The proposed recommendations are open for public comment through Oct. 17, after which the task force will consider them for final approval. Officials in the self-declared statelets of Luhansk and Donetsk and in the occupied region of Kherson in south Ukraine announced “referendums” to be held from Friday to Tuesday. Such votes, which are illegal under Ukrainian and international law, have been widely derided in advance by Western officials as a sham, and merely a precursor to the violation of Ukraine’s territorial sovereignty. After annexing the territories, Moscow would likely declare Ukrainian attacks on those areas to be assaults on Russia itself, analysts warned, a potential trigger for a general military mobilization or a dangerous escalation such as the use of a nuclear weapon against Ukraine. Russia officials and pundits on state television have asserted for months that Russia, in the war it initiated, is fighting against NATO, not just Ukraine. The head of the Russian-appointed occupying administration of Zaporizhzhia region, Yevgeny Balitsky, said a staged referendum would be held on the same dates in the parts of that region controlled by Russian forces, which includes Enerhodar, where Ukraine’s largest nuclear power plant is located. Balitsky said there was “no point in postponing the procedure.” Moscow’s proxy leader in Kherson, Vladimir Saldo, appealed to Russia for help organizing the staged referendum, highlighting the thin veneer of Moscow’s pretense that local officials were in control. Militarily, Russia does not have a firm grip on any of the regions it could move to annex, and the quick staging of votes suggested Russian President Vladimir Putin now aims to accomplish by political fiat what he failed to achieve on the battlefield. But seizing Ukrainian sovereign territory in flagrant violation of international law, during the very week when world leaders are gathered at the United Nations for the annual General Assembly meetings would be a remarkably brazen step, even for Putin, who has shown little regard for global public opinion as he launched the largest land war in Europe since World War II. The push toward annexation also shows how Putin’s options have been shrinking, following recent military setbacks and rising criticism of the war internationally and at home, including a remarkable public rebuke of Russian President Vladimir Putin by Indian Prime Minister Narendra Modi, at a meeting of the Shanghai Cooperation Organization in Uzbekistan last week. In recent days, a successful Ukrainian counteroffensive forced to a major Russian retreat in the northeastern region, as Russian troops fled cities and villages they had occupied since the early days of the war without much of a fight, and abandoned large amounts of military equipment. Ukraine’s sweeping counteroffensive left Russia weakened on the battlefield, and has left Russia’s hold on the occupied parts of the Donetsk and Luhansk regions tenuous after Moscow devoted months and significant manpower merely to capture most — but not all — of the Luhansk region this summer. In Ukraine’s south, Kyiv’s forces have made slower-moving but steady gains in a separate counteroffensive across the Kherson region. Strikes on weapons depots, command posts and supply routes using U.S. provided long-range rocket launcher HIMARS have strained Russian logistics, reducing Russia’s ability to bombard Ukrainian soldiers across the front line. In Russia, pro-war hard-liners, furious at the setbacks on the battlefield as life for most Russians goes on essentially as normal, have called for a harsh escalation, with some even advocating the use of nuclear weapons, to crush Ukrainian resistance. The use of a nuclear weapon would cross a bright red line. President Biden over the weekend warned Putin not to use an atomic weapon. Asked by a reporter on the CBS news show “60 Minutes” what he would say to Putin if he were contemplating such a move, Biden said: ““Don’t. Don’t. Don’t. It would change the face of war unlike anything since World War II.” Prominent Russian propagandist Margarita Simonyan, editor in chief of RT, who is among the hawks cheerleading for a tougher approach to Ukraine, tweeted Tuesday that the moves underway could lead to Russia’s victory or nuclear war, hinting that Russia is about to ramp up its actions. “Judging by what is happening and what is about to happen, this week marks either the eve of our imminent victory or the eve of nuclear war,” Simonyan wrote. “I can’t see any third option.” Simonyan, like other pundits and propagandists on state television, has argued for months that Russia is facing an existential fight for survival against NATO. Former Russian president Dmitry Medvedev, who is now deputy head of the country’s Security Council, said annexing the regions would change Russia’s development for decades to come and “the geopolitical transformation in the world will become irreversible.” In a veiled threat of nuclear escalation, he warned of severe consequences if Ukraine continued to attack the regions after Russia absorbed them.“An invasion into Russian territory is a crime, the execution of which will enable our use of all powers of self-defense,” he said. Ukrainian Foreign Minister Dmitro Kuleba, however, said in a tweet that the “sham referendums” would not change anything. “Russia has been and remains an aggressor illegally occupying parts of Ukrainian land,” Kuleba tweeted. “Ukraine has every right to liberate its territories and will keep liberating them whatever Russia has to say.” Western officials have warned Russian President Vladimir Putin against annexing the parts of eastern Ukraine that it controls. The Kremlin’s typical response is that the moves are not imposed from Moscow, and that it is up to the populations to decide. Russia, however, has a history of flawed elections and downright electoral fraud. NATO Secretary General Jens Stoltenberg said sham referendums would have no legitimacy and would not change the nature of Russia’s war of aggression against Ukraine.“This is a further escalation in Putin’s war. The international community must condemn this blatant violation of international law (and) step up support for Ukraine,” he said on Twitter. Analyst Tatiana Stanovaya, of R. Politik political consultancy, said the move toward immediate “referendums” was a sign that Putin had changed course dramatically, taking a dangerous new escalatory path. Posting on Telegram, Stanovaya said that the immediate sham votes amounted to “preparation for full-scale war. This is a serious reversal of Putin’s logic regarding Ukraine.” Previously, Putin’s view seemed to be that it was only a matter of time before Western support for Ukraine folded and Russia could claim victory. Stanovaya described the move toward annexation as “an unequivocal ultimatum from Russia to Ukraine and the West: either Ukraine retreats or nuclear war.” “To guarantee ‘victory,’ Putin is ready to hold immediate referendums to gain the right (in his mind) to use nuclear weapons to defend Russian territory,’” she wrote, adding: “Putin does not want to win this war on the battlefield. Putin wants to force Kyiv to surrender without a fight.” If Ukraine refuses to back down, Putin would likely declare a mandatory military mobilization, Stanovaya added. So far, Putin has resisted such a move knowing that a national draft would be deeply unpopular. With Russia faces facing a serious manpower problem in its war against Ukraine, the State Duma, Russia’s lower house of parliament, adopted amendments Tuesday toughening punishments for soldiers who desert or refuse to fight. Under the amendments, deserters who are away from the posts for more than a month would face a maximum 10-year sentence, compared with the current maximum five-year term. Soldiers who refused orders to fight or to deploy could be jailed for up to three years. Voluntary surrender could be punished by up to 10 years in prison while looters could be given a penalty of up to 15 years. The amendments are almost certain to be approved by the Federation Assembly, the upper house, on Wednesday and could be signed by Putin the same day. Pro-war hard-liners have been demanding a tougher approach to the “special military operation” in Ukraine, even as the Kremlin has insisted that all is going to plan. The amendments immediately increased speculation that Putin may opt for a national military mobilization, Russia’s military staffing problem has been worsened by soldiers repudiating contracts and surrendering or deserting. Even a major recruitment effort, including enlisting prisoners and sending volunteers to the front line with little training, has not helped Russia regain its lost military momentum. Before launching his full-scale invasion of Ukraine in February, Putin recognized the two eastern Ukraine Moscow proxy regions of Luhansk and Donetsk as independent. Meanwhile on Tuesday, members of the far-right Alternative for Germany party said they were traveling to Russian occupied-areas of eastern Ukraine, providing fodder for pro-Kremlin propaganda. The visit by the AfD lawmakers stands to legitimize the Kremlin’s claims that the regions need Russian protection. SISAK WASHINGTON — Donald Trump’s legal team has told a newly appointed independent arbiter that it does not want to answer his questions about the declassification status of the documents seized last month from the former president’s Palm Beach home, saying that issue could be part of Trump’s defense if he’s indicted. Lawyers for Trump and for the Justice Department are to appear in federal court in Brooklyn on Tuesday before a veteran judge named last week as special master to review the roughly 11,000 documents — including about 100 marked as classified — taken during the FBI’s Aug. 8 search of Mar-a-Lago. Ahead of the status conference, Raymond Dearie, the special master, requested the two sides to submit a proposed agenda and also provided a draft plan for how he envisions the process moving forward over the next two months. READ: Letter by Trump’s team to special master Trump’s lawyers signaled in a Monday evening letter their objection to several aspects of that draft plan, including a request from Dearie that they disclose to him and to the Justice Department information about the classification status of the seized documents. The resistance to the judge’s request was notable because it was Trump’s lawyers, not the Justice Department, that had requested the appointment of a special master to conduct an independent review of the documents so that any material covered by claims of legal privilege could be segregated from the investigation — and because the former president’s team’s recalcitrance included an acknowledgment that the probe could be building toward an indictment. Trump has maintained without evidence that all of the records were declassified; his lawyers have not echoed that claim, though they have asserted that a president has absolute authority to declassify information. In the letter, Trump’s lawyers say the time for addressing that question would be if they file a motion seeking the return by the Justice Department of some of the property taken from Mar-a-Lago. “Otherwise, the Special Master process will have forced the Plaintiff to fully and specifically disclose a defense to the merits of any subsequent indictment,” the lawyers wrote. On Monday, Tucker Carlson of Fox News used his massive cable news audience — an average of over 3 million viewers a night — to spread a QAnon-style conspiracy theory and encourage people to commit violence against teachers and health care providers. Media Matters collected the clip. It’s hard to follow for those who aren’t already well-versed in the right’s mythology accusing LGBTQ people and their allies of “grooming” children to be victims of sexual abuse. But what is undeniable is that Carlson is calling for violent vigilantism in response to his false accusations against doctors and teachers.  Carlson is light on examples of this alleged grooming but heavy on hyperbole and accusations implying that every child who sees a doctor or enters a classroom is in danger of being sexually abused by some liberal cabal. Yes, schools have sex education and children’s hospitals offer affirming care for LGBTQ kids. But the fantasy that Carlson spins out has nothing to do with these banal realities. He claims hospitals are “castrating” children, a claim that has no relationship to painstakingly slow care protocols for gender non-conforming minors, care which is mostly focused on mental health approaches and sometimes hormonal treatment. (Surgery is generally reserved for adults.) We see this in Carlson’s accusation that sex education is offered to puberty-age children in order to sexually stimulate teachers. But what’s especially disconcerting is how Carlson has grown so cavalier about using these conspiracy theories to push violence as a tool against educators and health care workers. During this clip, he calls for “neighborhood dads” to dish out “instant justice” to sex education teachers. He claims doctors and teachers are “weirdos getting creepy with other people’s children” and that they are committing “sex crimes.” He implies doctors are somehow facilitating gender transition for kids without consulting parents. And he flat-out calls it a “moral duty” to “hurt” people who are supposedly doing these things.  Carlson doesn’t say the word “QAnon,” because he’s clever enough to build plausible deniability around his rhetoric. But he appears to be pandering to and legitimizing this conspiracy theory, which holds that Democrats are leading an international cabal of cannibalistic pedophiles. He even baselessly insinuates that President Joe Biden molested his own daughter, and suggests this is why Biden supports trans rights. That rhetoric doesn’t just encourage people to go online to “research” on their own, sending them directly to QAnon. It trains audiences to be more accepting of illogical conspiracy theories by legitimatizing wild leaps of logic.  Also, crucially, Carlson is valorizing violence. Ultimately, this is what QAnon and all adjacent “groomer” conspiracy theories are about: Building the cultural architecture to justify political violence. It recasts violence against Democrats and LGBTQ people as “defending children.” And, by running segments like this, Carlson removes the wiggle room to pretend that these outrageous conspiracy theories aren’t inherently violent.  The link between political violence and the QAnon “groomer” talk is also evident in Donald Trump’s escalatingly open dalliance with QAnon. Last week, Trump posted a bit of QAnon fan art showing him in what is supposed to be a majestic pose, sporting a QAnon pin and captioned with QAnon slogans.  A few days later, at a rally in Ohio that was supposed to support Republican senatorial candidate J.D. Vance, the Trump team played a tune that was almost identical to a QAnon song as the crowd raised their fingers in the QAnon salute.  Want more Amanda Marcotte on politics? Subscribe to her newsletter Standing Room Only. The timing of this more overt QAnon support happens to coincide with Trump’s increasingly open winking at violence. In response to the FBI raid at Mar-a-Lago in August, which targeted classified materials Trump is illegal possession of, Trump has made unsubtle threats of violence against law enforcement. He sent a message to the Department of Justice reminding them that his supporters are generating a lot of “heat” but that he could call them off, implying that the price would be the DOJ dropping the investigation. Trump has continued to issue these implied threats through right wing media, assisted by Sen. Lindsey Graham, R-S.C., who offered his own threat disguised as a warning of “riots in the streets” if Trump is indicted.  Trump and Carlson are speaking to two audiences — their own devoted supporters and worried liberals. As David Graham at the Atlantic argued, “If there was a time when Trump didn’t know how people would respond when he makes these veiled threats, it has passed. He understands now, and does it anyway.” Plausible denials that this rhetoric is anything but purposeful should have dissipated after January 6. Recently, a Trump supporter died in Cincinnati after attacking an FBI office in direct response to Trump’s threatening noises about the raid.  All this led to Biden giving his speech at Independence Hall in Philadelphia, reminding Americans that “history tells us that blind loyalty to a single leader and a willingness to engage in political violence is fatal to democracy.” Biden’s speech was well received, with 58% of Americans agreeing with him that Trump leads a violent movement that threatens democracy.  Trump’s reaction has clearly not been to scale back but to double down. Carlson’s segment is also emphatic in its endorsement of violence. The overtly violent rhetoric and unsubtle nods to QAnon all point to a strategy of scaring political opponents into backing down, and it’s spreading. Across the country, far-right sheriffs are promising campaigns of intimidation at the polls. Reports show that Republican candidates across the country are flirting with pushing their own Big Lies if they lose their elections, seeding the possibility that they could attempt to rile up their own voters to “do something,” much like Trump incited the January 6 insurrection.  Trump and Carlson are speaking to two audiences — their own devoted supporters and worried liberals who see clips of these messages encouraging violence. But radicalism can also breed backlash. As the largely positive response to Biden’s speech shows, Americans may not be keen on either extremism or political violence. Conspiracy theories like QAnon turn off exponentially more people than they lure in. Far-right bets on the politics of violence and intimidation have not yet proven to be successful in intimidating their opponents. This strategy may even anger more voters, making them more likely to turn out for Democrats in November.  Read More Here

Analysis | The Holes In Trump’s Latest Delay Tactic https://digitalarizonanews.com/analysis-the-holes-in-trumps-latest-delay-tactic/ For weeks, Donald Trump has benefited from the orders of a judge who has proven conspicuously incurious about his public claims that he declassified the documents labeled confidential, secret or top-secret seized from his residence at Mar-a-Lago last month. That appears to be coming to an end. And Trump’s legal team is continuing with a tried and true public relations and legal strategy: delay, delay, delay. In a new filing to the special master now charged with reviewing the documents, Raymond J. Dearie, Trump’s legal team attempts to beg off Dearie’s request for it to finally, at long lost, address in court what Trump has claimed publicly about declassifying the documents. The filing makes two main arguments on that front. One is that taking a position on the classification status of approximately 100 documents marked classified that were seized on Aug. 8 could jeopardize Trump’s potential criminal defense. The other is that Judge Aileen M. Cannon didn’t require Dearie to determine whether the documents are classified. The latter, in particular, is a stretch. Cannon’s original order didn’t dwell on whether the documents might have been declassified, but she did charge the special master “to review the seized property, manage assertions of privilege and make recommendations thereon, and evaluate claims for return of property.” The Justice Department then asked that it be allowed to continue reviewing only the documents marked classified and that such documents be excluded from the special master’s review, which drew the Trump legal team into actually addressing the matter. In its filing, though, Trump’s lawyers skirted the issue, calling the documents’ classification status into question but not actually disputing that they remained classified — and accordingly, not echoing Trump’s public claims. That was good enough for Cannon, who denied the DOJ’s request while accepting the Trump team’s argument that this fact is in dispute. But in rejecting the request and naming Dearie as special master, Cannon again charged him with parsing the status of documents. She listed among his duties: “Identifying personal items/documents and Presidential Records in the Seized Materials and making recommendations to the Court as to any categorization disputes between the parties.” Again, Cannon didn’t dwell much upon the classification issue. And that listed duty specifically addresses “personal items” and “Presidential Records” rather than whether documents are classified. But it also says he must make “recommendations to the Court as to any categorization disputes between the parties” (emphasis added). Cannon elsewhere explicitly described the classification status as a disputed fact, meaning Dearie would sure seem to be charged with resolving it. And that would seem to involve establishing the two sides’ views on their status. Cannon also charged Dearie with reviewing the documents marked classified first, meaning Dearie could determine there is particular urgency in resolving their actual status. Dearie is set to meet with the Justice Department and Trump’s lawyers Tuesday afternoon. The Trump team’s other argument — that it can’t disclose its position because it could jeopardize Trump’s criminal defense — would also seem to be undercut by the fact that Trump keeps claiming publicly that he declassified all the documents. That includes as recently as Friday. How that might play in a criminal case remains to be seen, but it’s not like he’s played this claim close to the vest. And all of this should be viewed in the appropriate context, which is that Trump’s legal team is trying to prolong this matter. That could be because his lawyers fear Trump’s declassification claim is false — opening themselves up to legal repercussions — or because they don’t think they can prove it. It could also be because they want Cannon, a Trump-nominated judge who has sided with them in controversial ways, to weigh in as much as possible as Dearie’s review progresses. Another reason, of course, is that they see value in prolonging these matters as much as possible. Getting a special master in the first place was a way to draw things out and delay the Justice Department’s criminal investigation. That’s because one of the lessons of Trump’s political career is that the lengthier the proceedings, the better it augurs for Trump. The Russia investigation played out over years, and by the time a bipartisan Senate report bolstered claims that Trump’s campaign might have coordinated with Russia in a way the Mueller report hadn’t, those findings were received as old news. People had tuned out. In the case of the documents at Mar-a-Lago, more Americans believe Trump broke the law than have in just about all of his previous controversies, including the Russia probe. Dearie — whom the Trump legal team recommended for the special master position, and the Justice Department deemed acceptable — has a reputation as being particularly slow and deliberate. But he’s now proposed a rather aggressive timetable, aiming for the completion of the inspection and labeling process by Oct. 7, according to the Trump filing. Trump’s team is also pushing for a more delayed timetable in general, which includes waiting to assert whether the documents were declassified until a hearing in late November — at the tail end of the timetable Cannon set for Dearie’s review, which concludes Nov. 30. That doesn’t appear to be any coincidence. If Monday night’s filing is any indication, the Trump legal team will try to gum up the works, even with the special master they themselves recommended. In a court filing ahead of the hearing, Trump’s lawyers acknowledged that the investigation into the documents found at Mar-a-Lago could lead to an indictment. The newly appointed special master, federal judge Raymond J. Dearie, is weighing the mechanics of how to review about 11,000 documents, roughly 100 of which are classified, that were taken Aug. 8 when FBI agents executed a court-authorized search of Trump’s residence and private club. Prosecutors say the search was necessary to recover highly sensitive national security papers, following months of prevaricating by Trump’s legal team about what classified documents he had after leaving the White House and whether he had given them all back to the government. Officials say they are investigating several potential crimes, including mishandling of national defense information and hiding or destroying government records. Trump’s lawyers accuse the Justice Department of trying to turn a records-keeping dispute with the National Archives and Records Administration into a criminal case. U.S. District Court Judge Aileen M. Cannon, a Trump appointee, granted Trump’s request for a special master — a neutral third-party legal expert — to review the seized documents to determine which may be covered by claims of attorney-client privilege or the far more vague and disputed assertion of executive privilege. After Cannon appointed Dearie to serve as special master, Dearie ordered both sides to appear in his courtroom Tuesday to talk over the mechanics of reviewing the documents — even as the Justice Department is appealing parts of Cannon’s order. Prosecutors have asked a higher court to stay Cannon’s decision that Dearie should review the classified as well as the nonclassified documents, and that the FBI and Justice Department cannot use the classified documents as part of their criminal investigation while the special master review is ongoing. In a filing ahead of Tuesday’s hearing, lawyers for Trump expressed concern that Dearie has posed questions to them that Cannon left unasked, including about whether the documents that bore classification markings were in fact classified. The lawyers argued that Trump — who had broad declassification powers when he was president — might be at a legal disadvantage if he answered those questions at this stage of the process. Explaining whether Trump declassified the documents, the lawyers wrote, would force Trump to “fully and specifically disclose a defense to the merits of any subsequent indictment without such a requirement being evident in the District Court’s order.” By raising that concern, the lawyers acknowledged at least the possibility that the former president or his aides could be criminally charged in the case. Trump’s lawyers have repeatedly suggested in court filings that the former president could have declassified the documents — but they have not actually asserted that he did so. The Washington Post has reported that among the classified material the FBI took from Mar-a-Lago was a document describing a foreign government’s military defenses, including its nuclear capabilities, according to people familiar with the search, who spoke on the condition of anonymity to describe sensitive details of an ongoing investigation. Some of the seized documents detail top-secret U.S. operations so closely guarded that only the president, some members of his Cabinet or a near-Cabinet-level official could authorize other government officials to know details about them, these people said. Records that deal with such programs are kept under lock and key, almost always in a secure compartmented information facility, with a designated control officer to keep careful tabs on their location. Patti was born January 4, 1931 in Quinter, Kansas to Howard Charles Reed and Irene Bower. She was the oldest of 3 children. She met her husband, David Hallstrom in 1950 at the University of Nebraska and they celebrated 56 years of wonderful marriage until he passed away in 2006. She shared David’s passion and heart for the City of Scottsdale. Patti and David moved to Scottsdale in 1958. Patti became a Welcome Wagon Hostess, Teaching Leader for Bible Study Fellowship-Phoenix as well as serving in various groups at Ascension Lutheran Church and Scottsdale Bible Church. She was also extremely proud of the United States of America, The Declaration of Independence, The Constitution, and our Founding Fathers and served in various roles supporting the Arizona Republican Party including volunteering with Barry Goldwater’s Presidential Campaign and the experience of being an alternate at the 1996 Republican National Convention in San Diego. She was very involved with Newt Gingrich and promoting the Renewing American Civilization course and making it available in Arizona. In the 1990’s, she was a founder and driving force for the City of Scottsdale’s Constitution Day Contest bringing an awareness and deeper understanding of the Constitution to school age children and the community. She enjoyed supporting her children and grandchildren with their various activities and sporting events and was well known for always attending Billy’s baseball games and bringing her well-loved Texas Sheet Cake. Patti is survived by her brother Jerome Reed of Greenwood Village CO, son Billy (Vicky) Scottsdale AZ, daughter Melissa Lane (Cecil) Ramah NM, 5 grandchildren Mitch (Natasha) Las Vegas NV, Laura, Florence AZ, Katherine Lane, Parrish FL, Christina Jones (Aaron) Puyallup WA, Cooper, New York NY, and 4 great grandchildren. Baltimore City Circuit Judge Melissa Phinn vacated the 41-year-old’s conviction and granted him a new trial on Monday. The quashing of his conviction came after prosecutors said that an almost year-long investigation had cast doubts about the validity of cellphone tower data and uncovered new information about the possible involvement of two alternate unnamed suspects. Officials now have 30 days to decide whether they will fully drop the charges against Mr Syed. There’s reason to believe they will. In the meantime, Mr Syed will remain on home detention with a GPS bracelet monitoring his movements. Mr Syed was convicted in 2000 of first-degree murder, robbery, kidnapping and imprisonment of his ex-girlfriend Hae Min Lee. Lee, 18, vanished after leaving her high school on 13 January 1999. Her strangled body was found in a shallow grave in a Baltimore park around a month later. Mr Syed has always maintained his innocence. It’s the first time the U.S. Preventive Services Task Force has recommended anxiety screening in primary care for adults without symptoms. The proposal is open for public comment until Oct. 17, but the group usually affirms its draft guidance. The recommendations are based on a review that began before the COVID-19 pandemic, evaluating studies showing potential benefits and risks from screening. Given reports of a surge in mental health problems linked with pandemic isolation and stress, the guidance is “very timely,” said Lori Pbert, a task force member and co-author. Pbert is a psychologist-researcher at the University of Massachusetts’ Chan Medical School. The task force said evidence for benefits, including effective treatments, outweighs any risks, which include inaccurate screening results that could lead to unnecessary follow-up care. Anxiety disorders are among the most common mental health complaints, affecting about 40% of U.S. women at some point in their lives and more than 1 in 4 men, Pbert noted. Black people, those living in poverty, people who have lost partners and those who have other mental health issues are among adults who face higher risks for developing anxiety, which can manifest as panic attacks, phobias or feeling always on edge. Also, about 1 in 10 pregnant and postpartum women experience anxiety. Common screening tools include brief questionnaires about symptoms such as fears and worries that interfere with usual activities. These can easily be given in a primary care setting, the task force said, although it didn’t specify how often patients should be screened. “The most important thing to recognize is that a screening test alone is not sufficient to diagnose anxiety,” Pbert said. The next step is a more thorough evaluation by a mental health professional, though Pbert acknowledged that finding mental health care can be difficult given shortages of specialists. Megan Whalen, a 31-year-old marketing specialist who was diagnosed with anxiety in 2013, says regular doctors should screen for mental health issues as commonly as they do for physical problems. “Health is health, whether the problem is visible or not,” said Whalen, of Hoboken, New Jersey. She has gotten help from medicine and talk therapy, but her symptoms worsened during the pandemic and she temporarily moved back home. “The pandemic made me afraid to leave home, my anxiety telling me anywhere outside of my childhood house was unsafe,” Whelan said. “I absolutely still struggle with feelings of dread and fear sometimes. It’s just a part of my life at this point, and I try to manage it as best as I can.” The task force said there isn’t enough solid research in older adults to recommend for or against anxiety screening in those aged 65 and up. The group continues to recommend depression screening for adults and children, but said there isn’t enough evidence to evaluate potential benefits and harms of suicide screening in adults who show no worrisome symptoms. In April, the group issued similar draft guidance for children and teens, recommending anxiety screening but stating that more research is needed on potential benefits and harms of suicide screening kids with no obvious signs. Guidelines from the task force often determine insurance coverage, but anxiety is already on the radar of many primary care doctors. In 2020, a group affiliated with the American College of Obstetricians and Gynecologists recommended routine primary care anxiety screening for women and girls starting at age 13. Melissa Lewis-Duarte, a wellness coach in Scottsdale, Arizona, says rhythmic breathing, meditation and making a daily list of three things for which she is grateful have all helped with her anxiety. “Doctors say, ‘Make sure you’re sleeping, control your stress.’ Yeah, I get that,” but not everyone knows how, said the 42-year-old mother of three. “It’s difficult to prioritize self-care, but that’s what’s necessary.” Follow AP Medical Writer Lindsey Tanner at @LindseyTanner. One of the victims died after being crushed by the facade of a department store in the Pacific port of Manzanillo, while another was found dead at a mall. The tremor passed without that level of tragedy, despite heightened nerves from a nationwide annual earthquake drill that occurred less than an hour before. The tsunami alert, which was issued immediately after the quake, was revised later in the day. No one has cast a vote in the 2022 general election, but lawsuits are already coming in. Four Chester County residents — James Romine, Daryl Campbell, Sandra Bowman, and William Borton — have asked the Chester County Court of Common Pleas to prohibit the county from using drop boxes to receive mail and absentee ballots unless the boxes are physically monitored to ensure that people deliver only their own ballot. The group of residents also wants the court to prohibit the county from accepting and counting any ballots delivered by someone other than the voter. Included in the legal complaint are screenshots from surveillance footage of an unmanned ballot drop box in West Chester purporting to show more than 300 people delivering more than just one ballot for the 2022 primary election in May. In Pennsylvania, a voter who qualifies for an emergency absentee ballot may allow a representative to submit their ballot on their behalf; for everyone else, delivering more than one ballot is against the law. “Plaintiffs will suffer irreparable harm in that the void or invalid ballots will dilute their validly cast ballots — and the validly cast ballots of other voters — thereby impinging on their fundamental right to vote under the United States Constitution and their right to a free and fair election under the Pennsylvania Constitution,” the legal complaint said. The residents filed the complaint with the help of Wayne-based conservative firm Zimolong Law and Washington D.C.-based America First Legal Foundation, which was founded by Stephen Miller, former President Donald Trump’s senior adviser. Mark Meadows, Trump’s former White House Chief of Staff serves on its board of directors. In a written statement announcing the lawsuit, Miller describes the organization’s interest in the case as a “civil rights crusade.” “This is our second lawsuit in 15 days in Pennsylvania, suing election officials for their lawless conduct and egregious violation of Americans’ sacred right to ensure their vote is not canceled out by fraud and criminal activity,” Miller said. America First Legal Foundation recently engaged in a similar action against Lehigh County on Sept. 1. In a written statement to WHYY News, a Chester County spokesperson said that they couldn’t comment directly on the litigation. However, the spokesperson provided an update on how the county has been in the process of reviewing and refining the ways in which mail ballots are cast. “The County has produced, posted, and publicized informational videos on many aspects of the election process, including voting by the legislature’s newly authorized mail-in ballot. Prior to the May 2022 Primary, the County also held an in-person information session on the full voting process,” the statement read. “We also posted clear signage on every mail-in ballot drop box throughout the county which noted the rules for returning a mail-in ballot.” Last Monday, Chester County Voter Services also finalized details to implement additional efforts for the November 2022 election that will further educate voters on the rules for returning mail ballots. This includes using “brightly colored notices inserted with all mail-in ballots” to explain the rules for returning a mail ballot as well as staffing all drop boxes. Neighboring Delaware County is also still fighting a baseless election lawsuit from 2020. The Pennsylvania Department of State is already preparing to defend the state from the next wave of election-related lawsuits. Interior security camera video from the Coffee County elections office shows Cathy Latham, the county Republican Party chair at the time, welcomed a computer forensics team when it arrived on Jan. 7, 2021, introduced the team to local election officials and spent nearly all day there. She also instructed the team what to copy, which turned out to be “virtually every component of the voting system,” the filing says. The video directly refutes Latham’s testimony in a sworn deposition and her representations in filings with the court, the document states. The filing comes in response to Latham’s attorneys’ attempt to quash subpoenas for her personal electronic devices, including any cellphones, computers and storage devices. Robert Cheeley, an attorney for Latham, did not respond to an email seeking comment. He previously said his client doesn’t remember all the details of that day. But he said she “would not and has not knowingly been involved in any impropriety in any election” and “has not acted improperly or illegally.” Latham said in a deposition last month that she moved to Texas over the summer. In January 2021, she was chair of the Coffee County Republican Party and was the state party caucus chair for more than 125 of Georgia’s smaller counties. Latham also was one of 16 Georgia Republicans who signed a certificate in December 2020 falsely stating that Trump had won the state and declaring that they were the state’s “duly elected and qualified” electors. Trump in fact lost Georgia by nearly 12,000 votes to Democrat Joe Biden. The investigation into Trump’s efforts to change the results includes a phone call he made to the Georgia secretary of state, a fellow Republican, suggesting he could “find” just enough votes to make Trump the winner. Fulton County District Attorney Fani Willis, a Democrat who’s leading that investigation, has notified Latham and the other fake electors that they could face criminal charges. The Georgia secretary of state’s office has described the copying of data from Coffee County’s election system as an “alleged unauthorized access” and last month asked the Georgia Bureau of Investigation to get involved. It’s the latest of several suspected breaches of voting system data around the country tied to Trump allies since his election loss. Attorney Sidney Powell and other Trump allies were involved in arranging for the copying of the election equipment in Coffee County — which is home to 43,000 people and voted overwhelmingly for Trump — as part of a wider effort to access voting equipment in several states, according to documents produced in response to subpoenas in the long-running lawsuit over Georgia’s voting machines. Latham’s “data likely will reveal additional details about the work performed and information obtained in the breach, what was done with the compromised software and data, and the people involved in planning and orchestrating the breach, which puts voters and future elections at enormous risk,” the filing says. An exhibit attached to the Monday filing juxtaposes quotes from Latham’s deposition with images pulled from security camera footage that appear to directly contradict her statements. Latham said that she went to her job as a high school teacher and stopped by the election office briefly that afternoon. But the video image shows her arriving at 11:37 a.m., and time stamps on other images show her there throughout much of the day. She also said she didn’t see specific people and saw others only briefly, but the video images show otherwise. The lawsuit that includes the fight over Latham’s personal electronic devices was originally filed several years before the 2020 election by individual voters and the Coalition for Good Governance, an election security advocacy group. It alleges that Georgia’s touchscreen voting machines are not secure and seeks to have them replaced by hand-marked paper ballots. The Monday filing said the plaintiffs have identified multiple documents that Latham failed to produce in response to a previous subpoena. Additionally, information collected indicates your products fit within the definition of a biological product in the Public Health Service Act (PHS Act) [42 U.S.C. 262(i)]. Therefore, your products are drugs as defined in section 201(g) of the Federal Food, Drug, and Cosmetic Act (the FD&C Act) [21 U.S.C. 321(g)] and biological products as defined in section 351(i) of the PHS Act. MyOwnSkin and MySkinRestore are also human cells, tissues, or cellular or tissue-based products (HCT/Ps) as defined in 21 CFR 1271.3(d) and are subject to regulation under 21 CFR Part 1271, issued under the authority of section 361 of the PHS Act [42 U.S.C. 264]. HCT/Ps that do not meet all the criteria in 21 CFR 1271.10(a), and when no exception in 21 CFR 1271.15 applies, are not regulated solely under section 361 of the PHS Act [42 U.S.C. 264] and the regulations in 21 CFR Part 1271. Such products are regulated as drugs, devices, and/or biological products under the FD&C Act and/or the PHS Act, and are subject to additional regulation, including appropriate premarket review. 21 CFR 1271.20. Based on a review of materials described above, BioLab Sciences does not qualify for any exception in 21 CFR 1271.15, and MyOwnSkin and MySkinRestore fail to meet all the criteria in 21 CFR 1271.10(a). Specifically, MyOwnSkin and MySkinRestore fail to meet the criterion set forth in 21 CFR 1271.10(a)(1) that they not be more than minimally manipulated as such term is defined for structural tissue in 21 CFR 1271.3(f)(1). Because your processing alters the original relevant characteristics of the skin related to its utility for reconstruction, repair, or replacement, MyOwnSkin and MySkinRestore are more than minimally manipulated. MyOwnSkin and MySkinRestore also fail to meet other criteria set forth in 21 CFR 1271.10(a). An HCT/P meets the criterion in 21 CFR 1271.10(a)(2) if the HCT/P is “intended for homologous use only, as reflected by the labeling, advertising, or other indications of the manufacturer’s objective intent.” MyOwnSkin and MySkinRestore are not intended to perform the same basic function or functions of skin in the recipient as in the donor, such as serving as a protective covering. Rather, these products are intended as advanced wound care therapies, including to regenerate skin in various wounds. Such use is not homologous use as defined in 21 CFR 1271.3(c). An HCT/P meets the criterion in 21 CFR 1271.10(a)(3) if “the manufacture of the HCT/P does not involve the combination with another article, except for water, crystalloids, or a sterilizing, preserving, or storage agent, provided that the addition of water, crystalloids, or the sterilizing, preserving, or storage agent does not raise new clinical safety concerns with respect to the HCT/P.” Based on the processing and product information available for MyOwnSkin and MySkinRestore, skin cells from a patient’s skin are (b)(4) prior to shipment and implantation in the same individual. Therefore, this criterion is also not met. Because Biolab Sciences does not qualify for any exception in 21 CFR 1271.15, and because MyOwnSkin and MySkinRestore do not meet all the criteria in 21 CFR 1271.10(a), these products are not regulated solely under section 361 of the PHS Act and the regulations in 21 CFR Part 1271. MyOwnSkin and MySkinRestore appear to be combination products and would be regulated under the statutory authorities applicable to drugs as defined in section 201(g) of the FD&C Act [21 U.S.C. 321(g)] and biological products as defined in section 351(i) of the PHS Act [42 U.S.C. 262(i)].3 Please be advised that the definition of HCT/Ps in 21 CFR 1271.3(d) excludes secreted or extracted human products. Accordingly, secreted bodily fluids, such as amniotic fluid, are generally not considered HCT/Ps subject to regulation under 21 CFR Part 1271. Amniotic fluid intended to treat diseases or conditions in humans is generally regulated as a drug under the FD&C Act and a biological product under the PHS Act and requires premarket review and approval. As such, your products derived from amniotic fluid, Fluid GF, Restore GF, Fluid Flow, Amnio Retore, Stimuleyes, and (b)(4), are also regulated as drugs and biological products under section 351 of the PHS Act and the FD&C Act. In order to lawfully market a drug that is a biological product, a valid biologics license must be in effect [42 U.S.C. 262(a)]. Such licenses are issued only after showing that the product is safe, pure, and potent. While in the development stage, such products may be distributed for clinical use in humans only if the sponsor has an investigational new drug application (IND) in effect as specified by FDA regulations [21 U.S.C. 355(i); 42 U.S.C. 262(a)(3); 21 CFR Part 312]. None of your products are the subject of an approved biologics license application (BLA), nor is there an IND in effect for any of them. Based on this information, we have determined that your actions have violated the FD&C Act and the PHS Act. Additionally, during the inspection, FDA investigators documented evidence of significant deviations from current good manufacturing practice (CGMP) requirements, including deviations from section 501(a)(2)(B) of the FD&C Act and 21 CFR Parts 210 and 211. At the close of the inspection, the FDA investigators issued a Form FDA-483, List of Inspectional Observations, which described a number of significant CGMP deviations applicable to your products. FDA identified additional significant deviations upon further review of the information collected during the inspection, as described below. Additionally, we have received a safety concern about one of your products. Your CGMP deficiencies, involving over (b)(4) units of products manufactured between March 2019 and the present, include, but are not limited to, the following: 1. Failure to establish appropriate written procedures designed to prevent microbiological contamination of drug products purporting to be sterile, including procedures for validation of all aseptic and sterilization processes [21 CFR 211.113(b)]. For example: a. You failed to validate the aseptic processes used to manufacture over (b)(4) units of Fluid Flow, Amnio Restore,(b)(4), Stimuleyes, Fluid GF, and Restore GF (i.e., by performing media fill simulations) since your manufacturing operations began in March 2019. Based on your product labeling, these products purport to be sterile and are expected to be sterile. b. Your firm failed to validate the sterilization process for Fluid GF and Restore GF. You have manufactured and distributed over (b)(4) units of these products since June 22, 2021. c. Your Fluid Flow (b)(4) sterilization validation, entitled “(b)(4) Sterilization Validation Report,” RST-1052, dated May 20, 2019, is inadequate. For example:   i. You have had failures during your dose verification audit where it was noted that the established dose to achieve sterility was not adequate and for which you made no changes to your process.   ii. You did not assess the impact of the (b)(4) sterilization on the integrity of the amniotic fluid product’s container-closure system to assure that sterility is maintained. d. The frequency of monitoring conducted in the critical aseptic areas is insufficient to detect problems and demonstrate control. For example:   i. Surface samples for microbiological monitoring are not collected in the Biological Safety Cabinets (BSCs) directly after processing of your amniotic fluid products. Environmental monitoring should be conducted directly after processing, before cleaning is performed, in order to monitor processing conditions and demonstrate control of the critical area during aseptic processing.   ii. Personnel monitoring is required only every (b)(4) for personnel who process your amniotic fluid products. e. In accordance with your cleanroom gowning procedure, personnel performing aseptic processing wear non-sterile personal protective equipment (PPE), such as hair covers, beard covers, and shoe covers, that does not adequately protect against microbiological contamination of your products. f. During the inspection, FDA investigators observed personnel practices that do not adequately protect against microbiological contamination of your products. This time taking on Big Sky Conference foe UC Davis, Arizona returned home to the friendly confines of Murphey Field at Mulcahy Soccer Stadium, hoping to get things back on track after a tough loss to then No. 10 ranked Pepperdine. And as the Wildcats returned to the pitch, it was once again another competitive matchup for Arizona. Despite a fairly slow start, Arizona Soccer was able to score an acrobatic goal near the end of the first half. Unlike its previous games, this one would be a bit of a back-and-forth match to start; however, Arizona was able to strike first in the first half. Scoring in the 36th minute, Arizona would break the 0-0 tie, after freshman midfielder, Sami Baytosh would field a pass from Angela Baron across midfield. Juggling the ball in the air while falling, Baytosh volleyed the ball to herself before bicycle kicking the ball while on the ground that soared over the UC Davis keeper’s head and into the back of the net. The goal was so impressive, that Bleacher Report even picked up and shared the highlight! UC Davis would stay aggressive in this one, still putting shots on the goal, but luckily, the Wildcats’ defense was able to hang tough, holding on to win 1-0. With the win, the Wildcats improve their record to 3-2-2 and will return to action on Friday when they travel to Salt Lake City to take on Pac-12 foe, Utah. Now the two will square off in the general election.  Spence is a retired Naval lieutenant commander and nuclear engineering officer and Buchli is a real estate broker.  Gilbert voters must be registered to vote by Oct. 11 to participate in the Nov. 8 election. Residents can register or check their status at the Maricopa County Election Department’s website.  2022 ballot measures: Here are propositions Arizona voters can decide on in November Early ballots will be mailed starting Oct. 12 for those who choose to vote by mail. Early voters should return their ballot in the mail by Nov. 1 or place it in a ballot drop-off location or voting location by 7 p.m. Nov. 8.  The Arizona Republic asked candidates about key local issues ahead of the August election. The two runoff candidates responded to another round of questions.  Some responses were edited to meet the 150 word limit.  Top 2 issues in Gilbert What do you see as the town’s two most critical challenges and how would you help solve them? Buchli: “The explosive apartment growth by adding too many, too fast and not properly managing the growth. This will cause traffic issues, additional needs for water and services, backlog of park services for children, parking issues and more. … Proper growth can be managed by adding affordable single-family homes, which adds good tax revenue … and less apartments (for) more controlled and managed growth to maintain the quality of life in Gilbert.  “The town must also be mindful of what will bring in the most revenue to sustain the town once buildout happens, which could come sooner than later if we continue the current level of growth. The town must be forward planning, updating, and looking to add businesses, large corporations and … companies that will bring in good revenue for the town once built out. I would like to see ‘no more down zoning’ of commercial property to multifamily.” Spence: “One critical challenge is to find value engineering solutions that will mitigate the impact of construction inflation on capital improvement and infrastructure projects. Soaring material costs and supply chain issues will require the town to prioritize work and revisit production timelines. However, there are several items that cannot wait; the work on the northern water treatment plant is critical to our town, as are the traffic mitigation and roadway improvement projects. Every effort must be made to ensure that the town gets a quality product, completed on-time and at the best price. “Another challenge is the recruitment, training, and retention of our Gilbert workforce. Employee shortages are affecting every facet of our town. Police, fire, schools and businesses throughout Gilbert are struggling to meet staffing requirements. We must find ways to collaborate with local businesses and business organizations to develop and entice skilled workers to seek employment opportunities in Gilbert.” Gilbert by rail  Residents have been vocal over light rail and commuter rail. Should either of those projects come to Gilbert? Why or why not? Buchli: “The residents of Gilbert have overwhelmingly expressed their opinions of “not” wanting any type of transit rail or stop/drop stations in Gilbert and especially not in the Heritage District area and I am with them. “Looking at the history of transit rail in other cities shows it brings an aftermath of crime, panhandling and homelessness, with rare exceptions. “It is a massive cost to build and to maintain and operate upwards of $90,000 a month, ridership is very low and it will increase residents’ taxes. Even the ridership on buses is low and does not cover the cost of maintenance and operation.” Spence: “I am opposed to light rail and commuter rail in Gilbert. Additionally, I am opposed to taxpayer funds being used to perform a feasibility study for rail stations in Cooley Station or downtown Gilbert. “I have read numerous regional transportation studies and fully understand the information that was referenced by opponents of rail systems in Gilbert. While crime and vagrancy are reasons to oppose light rail, my opposition is based on the excessively high construction cost and possibility of subsidies that may be required to sustain operation. “Additionally, I don’t believe that we will have the population density to make it a viable transportation option for Gilbert. While commuter rail may pass through Gilbert, with or without support from our town, I do not believe that it is in the best interest of our town to pursue having a commuter rail stop in Gilbert.” Managing Gilbert’s water  The federal government recently announced cuts to Arizona’s water supply from the Colorado River. What does Gilbert need to do to manage the town’s water supply in the ongoing drought that could lead to steeper cuts? New Jersey-based Shattered Realm was scheduled to perform just after 6 p.m. but the show was abruptly canceled before the performance. Around 7 p.m., the Nile posted on Instagram that there was an “online threat” that potentially put “patrons, staff and the bands in danger.” No other information was immediately released. It’s got 33 songs, which Billy Corgan will gradually roll out on his new podcast Thirty-Three With William Patrick Corgan, and as the album title implies, the album is split up into three acts. Act 1 comes out November 15, Act 2 on January 3, Act 3 on April 21, and there will also be a special edition box set due on April 21 that includes 10 bonus tracks. The first single is “Beguiled,” and you can hear that below. The Smashing Pumpkins are also gearing up for an arena tour with Jane’s Addiction that hits the NYC-area on October 14 at UBS Arena and October 19 at Madison Square Garden (tickets). Donald Trump’s Legal Team Baulks At Judge’s Document Declassification Questions https://digitalarizonanews.com/donald-trumps-legal-team-baulks-at-judges-document-declassification-questions/ Donald Trump’s legal team has told a newly appointed independent arbiter that it does not want to answer his questions about the declassification status of documents seized last month from the former president’s Florida home, saying the issue could be part of the former president’s defence if he is indicted. Lawyers for Mr Trump and for the Justice Department are to appear in federal court in Brooklyn on Tuesday before a veteran judge named last week as special master to review about 11,000 documents — including 100 marked as classified — taken during the FBI’s search of Mar-a-Lago on August 8. Ahead of the status conference, Raymond Dearie, the special master, requested the two sides to submit a proposed agenda and also provided a draft plan for how he envisions the process moving forward over the next two months. Mr Trump’s lawyers signalled in a Monday evening letter their objection to several aspects of the draft plan, including a request from Mr Dearie that they disclose to him and to the Justice Department information about the classification status of the seized documents. Donald Trump’s Mar-a-Lago club in Palm Beach (Steve Helber/AP) The resistance to the judge’s request was notable because it was the Trump team, not the Justice Department, that requested the appointment of a special master to conduct an independent review of the documents so that any material covered by claims of legal privilege could be segregated from the investigation — and because the Trump team’s recalcitrance included an acknowledgment that the investigation could be building toward an indictment. Mr Trump has maintained without evidence that all of the records were declassified. His lawyers have not echoed that claim, though they have asserted that a president has absolute authority to declassify information. In the letter, his lawyers say the time for addressing that question would be if they file a motion seeking the return by the Justice Department of some of the property taken from Mar-a-Lago. “Otherwise, the special master process will have forced the plaintiff to fully and specifically disclose a defence to the merits of any subsequent indictment,” the lawyers wrote. The Trump team also asked the judge to consider pushing back all the deadlines for his review. Also on Tuesday, Mr Trump’s lawyers are to respond to a Justice Department’s appeal against a different judge’s order barring the department at least temporarily from using the classified documents it seized as part of its criminal investigation. In Season 7, Adkins competed to raise money for the Food Allergy & Anaphylaxis Network, a cause personal to him because his daughter, Brianna, suffers from a severe food allergy. In Season 13, Adkins competed for the American Red Cross. Both causes are what compelled him to compete, even though he admits now he didn’t enjoy being on the TV show. “It was the most stressful thing I’ve ever done,” Adkins admitted on HBO‘s Real Time with Bill Maher (via The Hill). ““If you go on there and try to win, which I wanted to win for my charities.” Although the show was hosted by Donald Trump, Adkins says he never became super close to the man who would become the President of the United States. “He was always good to me … I met him a few times,” Adkins shared. “He was very charming and personable in person. … He wants everyone to like him. That’s his big thing,” Adkins, who voted for Trump in both elections, said that the divisiveness in the country over the last several years weren’t as much with Trump as the political parties “Once each side is pointing at the other and calling them evil, once you get to that point, if you truly believe that, then compromise is off the table,” Adkins maintained. Adkins is back on TV, but not for another reality TV show. Instead, the Grand Ole Opry member is starring as Albie Roman in the FOX TV show, Monarch, opposite award-winning actress, Susan Sarandon. Although his role is fictitious, Adkins finds a lot of similarities between who he is and who he portrays on the TV drama. “He’s a no-nonsense kind of guy, and I’m kind of that way too,” Adkins told Fox News. “He’s not very animated, and neither am I.
