Tucson, AZ, Oct 4, 2021–The Tucson Jewish Community Center (the J or the Tucson J) presents “A Celebration of Sculpture,” Sunday, October 23 from 10 a.m.-1 p.m. The free, all-ages annual showcase features a juried outdoor exhibition with eight new sculptures joining the SculptureGarden’s existing collection of over 40 works by local, national and international sculptors, an indoor Fine Art Gallery opening with more than 20 sculptures from 12 local artists, artist talks and live music throughout the duration of the event, dance performances from ZUZU! DanceGroup and Esperanza Dance, activities by Ben’s Bells and Arts for All (a Tucson J program) for all ages and abilities, and delicious kosher pizza for sale from the Kosher Pizza Truck.
Jurors Darlene Kryza, Donna Isaac, and Hirotsune Tashima selected the works for the juried exhibition, which includes sculptures by Pamela Ambrosio, Curt Brill, Gedion Nyanhongo, Hector Ortego, Joan Waters, and Nan Wollman. Artists exhibiting in the Fine Art Gallery show include Pamela Ambrosio, Jesse Berlin, Steve Grater, Candace Greenburg, Jerry W. Harris, Ronald Kalinoski, David Knorr, Andree Richmond, Gerald Rockwell, Ellen Sidor, Ted WadeSpringer, and Nan Wollman.
The three-hour event features live music indoors and outdoors by harpist Rebecca Foreman, pianist Sarah Tolar, guitarists Leila Lopez and Nathaniel Burnside, the Christine Harper FluteDuet, and Stu Mellan and the Birks Works Jazz Quintet.
In 2009, the J established its Sculpture Garden with a four-fold purpose in mind: to craft a public space that celebrates the appreciation of sculpture; to create an atmosphere of tranquility; to promote educational opportunities; and to enhance community fellowship. The convergence of art and audience in the Sonoran Desert region encourages visitors to relax, converse, meditate, and contemplate. The landscaped garden showcases outdoor sculpture, offers views of the surrounding mountain ranges and provides a meditative environment within the city limits.
A dedicated team of volunteers and lay leaders make up the J’s Sculpture Garden Committee, working in tandem with Jennifer Selco, the Director of Jewish Life and Learning, to oversee the planning and logistics of both the space and the annual event.

The Tucson J believes that arts and culture are critical means by which its community understands and appreciates itself more deeply and truly, offering experiences through a variety of mediums including visual art to foster conversations rooted in shared understanding, give new perspective to the most important questions of the world today, and promote creativity across the ages.
“I believe the J’s Sculpture Garden is on the cusp of becoming one of the most important cultural destinations in Tucson,” added Claire West, Sculpture Garden Committee member.
“I have shown work in galleries for many years. The work I display outside has the same sense of intimacy as my ‘inside’ work; it can feel vulnerable to exhibit in the grand scale of a public garden. I am grateful for the opportunity the J is giving me to make this step with my sculpture, The Green Splitting Tree. I think the placement shows the piece well, giving it scale, and intimacy,” says Nan Wollman, who is exhibiting work in both the Sculpture Garden and Fine ArtGallery.

WASHINGTON (AP) — Former Vice President Mike Pence on Wednesday warned against the growing populist tide in the Republican Party as he admonished “Putin apologists” unwilling to stand up to the Russian leader over his assault on Ukraine.
Speaking at the conservative Heritage Foundation in Washington less than a month before November’s midterm elections, Pence addressed the growing gulf between traditional conservatives and a new generation of populist candidates inspired, in part, by former President Donald Trump, who has transformed a large swath of the party.
“Today, on the cusp of a new era of Republican leadership … I think we need to chart a course that doesn’t veer off too far in either direction,” Pence told the think tank audience.
“Our movement cannot forsake the foundational commitment that we have to security, to limited government, to liberty and to life. But nor can we allow our movement to be led astray by the siren song of unprincipled populism that’s unmoored from our oldest traditions and most cherished values,” he said. “Let me say: This movement and the party that it animates must remain the movement of a strong national defense, limited government and traditional moral values and life.”
To that end, Pence criticized those in the party who have pushed a more isolationist foreign policy, particularly when it comes to Russian aggression. Earlier Wednesday, Russian President Vladimir Putin declared martial law for four illegally annexed Ukrainian regions as his forces have suffered stinging battlefield defeats and renewed attacks on Ukrainian cities and vital infrastructure.

“Now, I know there is a rising chorus in our party, including some new voices to our movement, who would have us disengaged with the wider world,” Pence said. “But appeasement has never worked, ever, in history. And now more than ever, we need a conservative movement committed to America’s role as leader of the free world and as a vanguard of American values.”
“As Russia continues its unconscionable war of aggression to Ukraine, I believe that conservatives must make it clear that Putin must stop and Putin will pay,” he added. “There can be no room in the conservative movement for apologists to Putin. There is only room in this movement for champions of freedom.”
Pence has been traveling the country, campaigning on behalf of Republican midterm candidates as he lays the groundwork for a potential 2024 presidential campaign. Some of the candidates he has endorsed have espoused the kinds of populist and isolationist views he seemed to take issue with Wednesday. Arizona’s Republican Senate candidate Blake Masters, for instance, has labeled the Russia-Ukraine conflict a “European problem” and has criticized federal spending on Ukraine.
Pence’s speech largely focused on the conservative “Freedom Agenda,” which he released earlier this year. It serves as both a concrete policy plan for Republicans as well as an implicit criticism of Trump, who has spent much of his time since leaving office obsessing about the 2020 election instead of looking forward.
Pence, who again argued in his remarks that in order to win “we must do more than simply criticize and complain,” has been a target of Trump’s ire since he refused to go along with the former president’s unconstitutional plot to try to overturn the will of voters in January 2021.
Pence once again stressed the importance of the oath he took when he was sworn in as vice president, adding that, “The American people must know that conservatives will not simply pay lip service to keeping faith with the Constitution, but that we will always keep our oath — that we will keep our oath, as the Bible says, even when it hurts” and “stand for the Constitution … even when it would be politically expedient to do otherwise.”

The deposition scheduled for Wednesday will give lawyers for E. Jean Carroll a chance to interrogate Trump about the assault allegations and statements he made.
NEW YORK — Former President Donald Trump is scheduled to answer questions under oath Wednesday in a lawsuit filed by E. Jean Carroll, a magazine columnist who says the Republican raped her in the mid-1990s in a department store dressing room.
The deposition — if it takes place as planned — will give Carroll’s lawyers a chance to interrogate Trump about the assault allegations as well as statements he made in 2019 when she told her story publicly for the first time.
Trump says Carroll’s rape allegation is “a hoax and a lie.”
His legal team worked for years to delay his deposition in the lawsuit, which was filed when he was still president. A federal judge last week rejected Trump’s request for another delay, saying he couldn’t “run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong.”
Details of where, when and how Trump was to be questioned haven’t been revealed by either his lawyers or Carroll’s. Only the date has been revealed in court filings.
Trump still appeared to be in Florida as of Wednesday morning.
Carroll was to have been questioned by Trump’s lawyers last Friday. Neither her attorneys and nor Trump’s have responded to questions about how that deposition went.
Anything Trump says during his deposition could potentially be used as evidence in an upcoming civil trial. He hasn’t faced any criminal charges related to Carroll’s allegations and any prosecution is unlikely. The deadline for criminal charges over sexual assaults that occurred in the 1990s has long expired.
Similar legal deadlines also applied to civil lawsuits over sexual assault. As a result, Carroll chose to sue Trump for defamation over comments he made in 2019 when he denied any wrongdoing. She maintains his denials and attacks on her credibility and character damaged her reputation.
However, New York lawmakers recently gave survivors of sexual violence a one-year window to sue their attackers over old assaults. Carroll’s lawyer has told the court she intends to file such a suit against Trump after that window opens in late November.
According to Carroll’s account, she bumped into Trump as the two were shopping at the Bergdorf Goodman store across Fifth Avenue from Trump Tower. At the time, Carroll was on television as the host of an advice program, “Ask E. Jean.”
She said the two engaged in friendly banter as she tried to help him pick out a gift. But when they were briefly alone in a dressing room, she said he pulled down her tights and raped her.
In a recent statement, Trump called that story “a complete con job.”
“I don’t know this woman, have no idea who she is, other than it seems she got a picture of me many years ago, with her husband, shaking my hand on a reception line at a celebrity charity event,” Trump said.

Former President Donald Trump may have undercut his legal defense in a defamation lawsuit after lashing out on Truth Social against rape accuser E. Jean Carroll.
Carroll, a longtime Elle Magazine columnist, accused Trump of rape in a 2019 book, alleging that he raped her in a Bergdorf Goodman dressing room in the mid-1990s. Carroll claimed Trump pushed her against the wall, pulled down her tights and forced himself on her.
Trump at the time claimed that he and Carroll had never met and that she was “totally lying,” arguing that she was “not my type.” Carroll filed a defamation suit against the former president, claiming that his attacks harmed her reputation.
Trump this week on Truth Social claimed that the “‘Ms. Bergdorf Goodman’ case is a complete con job,” and repeated that Carroll was not his “type.”
“It is a Hoax and a lie, just like all the other Hoaxes that have been played on me for the past seven years,” Trump wrote. “And, while I am not supposed to say it, I will.”
Carroll’s legal team declined to comment on the matter. “The latest statement from Donald Trump obviously does not merit a response,” a spokesperson for Carroll’s legal team said in a statement.
The tirade may have blown a hole in Trump’s defense in the case. His lawyers have long argued that he couldn’t be held personally responsible in the suit because any denials of the allegations came during his term and thus were a part of his official duties as president.
However, his latest denial and online harassment of Carroll were made as a private citizen, at a time when he is no longer protected by the presidency.
Barbara McQuade, a former federal prosecutor for Detroit, said Carroll would benefit from amending her complaint to include an additional count based on the Truth Social post. “Because Trump is no longer president, this statement was most certainly not made in the scope of his federal employment,” McQuade told VICE News.
Harvard Law Professor Laurence Tribe agreed that “Trump just blasted his own defense apart in the defamation suit brought by E. Jean Carroll.”

A Washington D.C. court is now deciding whether Trump was an official federal employee when he made his statement of denial in 2019 — if so, the United States could be listed as the defendant in the case, essentially nulling the suit as the federal government cannot be sued for defamation.
Manhattan Federal Judge Lewis Kaplan in 2020 rejected the notion that Trump was performing official duties when he made his first statements about Carroll. Kaplan wrote that “the allegations have no relationship to the official business of the United States.” He said this month that Trump “should not be permitted to run the clock out.”
The judge ordered Trump to sit for a deposition on Wednesday.
Trump’s team is sticking by the claim.
“We are confident that the D.C. Court of Appeals will find that our client was acting within the scope of his employment when properly repudiating Ms. Carroll’s allegations,” Trump attorney Alina Habba said in a recent statement to the New York Times.
The announcement comes just weeks after Habba asked Kaplan to delay the deposition until the D.C. appeal was decided, arguing that if her client won, the case would disappear. The request was denied on Oct. 12, as Kaplan found that Trump had brought the case to Washington “with the effect and probably the purpose of delaying it.” A trial date has been set for Feb. 6, 2023.
Carroll’s lawyers have also said that she plans to file another case against Trump in November under a new state law allowing victims of sexual assault a one-time opportunity to sue, even if, as in this case, the statute of limitations has expired.
“The question whether Mr. Trump in fact raped Ms. Carroll is central to this case,” Judge Kaplan explained. “It will be central also to the new case.”
CNN legal analyst Paul Callan warned that the case could be “dangerous” for Trump as his legal problems mount.
“He is being charged, essentially in a defamation case, with rape,” Callan explained. “[Carroll] brings the case not as a rape case but as a defamation case because the statute of limitations was gone on the rape case. However, when he gives this press conference saying, ‘She’s a liar, I never raped her, she’s not my type, she’s just doing it to amp up book sales,’ she says he defamed her and that gets the rape case in.”
“There’s one sleeper fact in this case that I think is very dangerous for Trump,” Callan added. “She claims she still has an article of clothing that she was wearing 23 years ago when the former president allegedly raped her and she wants to be able to have DNA sample testing done with respect to that in connection with this case. So we will see how that plays out.”
Conservative attorney George Conway, a frequent Trump critic, wrote on Twitter that Trump had a chance of winning the defamation case if he had not issued “a BRAND NEW statement REPEATING all the earlier defamatory statements, but since you’re no longer POTUS, you NO LONGER HAVE THAT DEFENSE you’ve been pushing for years that you made the statements while you were president!!!”

In 2018, Democrat Katie Hobbs spent $1 million in campaign funds running to become Arizona’s secretary of state, narrowly besting Republican Steve Gaynor, who spent $3.2 million in what was the most expensive race in state history for the post that oversees elections.
The record stood for less than four years. This year’s candidates for the state’s top election position have already matched that total and will certainly eclipse it by Election Day on Nov. 8.
Arizona is hardly an exception. It’s just a dramatic example of how races for secretary of state, once sleepy affairs that attracted relatively little attention or campaign money, have become high-priced, partisan battles.
In most states, the secretary of state is the official who oversees voting — an increasingly critical position after former President Donald Trump and his backers began spreading election falsehoods and targeting the offices by encouraging sympathetic candidates to run.
GOP candidates running for secretary of state in Arizona, Michigan, Minnesota, New Mexico and Nevada have reported raising a total of at least $3.3 million. The Democrats who oppose them have reported raising more — in excess of $10 million — and are being bolstered by additional millions in outside spending by allied groups.
Nationwide, spending on secretary of state races has set a historical record, said Michael Beckel, research director of Issue One, which is tracking races in which people who embrace Trump’s election lies are trying to gain control of the state offices that oversee elections.
“Clearly, people across the political spectrum are taking a new interest in secretary of state races in light of what happened in 2020, and both sides see these positions as critical,” Beckel said.
In Arizona, with Republican Hobbs now running for governor, Democrat Adrian Fontes has reported raising more than $2.4 million so far for the election to replace her as secretary of state. Records show his Republican opponent, state Rep. Mark Finchem, has raised more than $1.8 million.
The Arizona tally doesn’t include millions in outside spending, mainly by Democrats. They are warning that Finchem was present at the Jan. 6, 2021, rally outside the U.S. Capitol, has repeated Trump’s lies about the 2020 election being stolen and said he wouldn’t have certified President Joe Biden’s victory in the state.
To some, the escalating interest in these posts highlights risks to the United States’ unique election system, which is overseen by politicians elected in partisan races.
“The increasing polarization has intensified the vulnerability of the system,” said Kevin Johnson of the Election Reformers Network, which advocates for less partisan elections. “You used to be able to rely on a structure that didn’t require high ethics from officials, but managed to produce that anyway.”
Now, Johnson warned, Trump supporters believe there are few explicit restraints on secretaries of state. He said that’s in contrast to most other democratic countries, where nonpartisan institutions such as appointed panels rather than elected politicians oversee voting.
“No other democracy elects its election leaders,” Johnson said.
Nonpartisan administration of elections has become an applause line for underdog candidates in two Democratic-leaning states.
In Colorado, former county clerk Pam Anderson, a Republican, argues that her opponent, Democratic Secretary of State Jena Griswold, has acted in a way that is too partisan. In Washington state, Julie Anderson, an independent, is running against Democratic Secretary of State Steve Hobbs, arguing the position should be explicitly nonpartisan.
In contrast, in Wisconsin, many Republicans angry at Biden’s 2020 win in the state seek to dissolve the state’s bipartisan elections commission and vest election management in one or more partisan officials.
The nonpartisan stance also has been embraced by some Democratic secretaries of state, who are careful to draw a line between their party and their job. Michigan Secretary of State Jocelyn Benson said in an interview this summer that she has avoided involvement with the Democratic Association of Secretaries of State, a group chaired by Griswold that is spending to support the party’s statewide election officials.
“As I have seen my colleagues become more partisan, it’s something — that for me — I feel just goes beyond what is appropriate for a secretary of state to do,” Benson said.
Still, she has received at least $2.6 million from the Democratic group as she battles Republican Kristina Karamo, a community college instructor who spread false information about purported election fraud in November 2020 and beyond. Benson herself has reported raising more than $4 million for her re-election campaign, compared to more than $900,000 by Karamo.
Democrats say they don’t need to apologize for spending big, arguing that they’re defending the nation’s foundational principles by trying to keep candidates who spread false claims about elections from overseeing voting.
“We can’t take any risks when it comes to our democracy, and frankly our volunteers and donors have met the moment,” said Kim Rogers, executive director of the Democratic Association of Secretaries of State, which has pledged to spend at least $25 million on races this fall.
There’s no parallel Republican Party effort. The GOP’s group involved in secretary of state races, the Republican State Leadership Committee, said it’s spending little this year other than to support the reelection effort of Brad Raffensperger, the Georgia secretary of state who defied Trump’s demands that he be declared the winner of that swing state in 2020.
Andrew Romeo, a spokeswoman for the leadership committee, which also supports GOP state legislative candidates, contended in a statement that Democrats are the ones polarizing voting issues.
“Democrats – fueled by their liberal billionaire donors — are dumping unprecedented money into secretary of state races this year because they have given up on American democracy and an election system that has worked for 200 years and want to stack these offices with their far-left allies,” Romeo said.
Still, Democrats note that Republicans have spent heavily on non-campaign election infrastructure in the midterms. Conservative donors have funded operations to recruit and train poll watchers and to enlist activists to work at polling places in November.
Funders, whose identifies do not have to be disclosed, also have paid for slick documentaries promulgating election lies like the often-debunked “2000 Mules.” Patrick Byrne, the founder of Overstock.com, told The Associated Press in August that he’s spent $20 million investigating the 2020 election.
Byrne’s spending includes funding an organization called The America Project, which has donated $218,000 to a group called Conservatives for Election Integrity. That group was founded by Jim Marchant, the Republican nominee for secretary of state in Nevada. The organization is intended to support a coalition of secretary of state candidates like Marchant who question the result of the 2020 presidential election. The America Project’s spending accounts for roughly half the $429,000 the group has reported raising.
Byrne also has donated $5,000 to Marchant and $2,900 to Karamo in Michigan, according to the report from Issue One on the funding of election deniers’ campaigns. Other prominent funders include Trump’s own political group, Save America PAC, which donated $5,000 to Karamo and $5,000 to Finchem in Arizona. Also, Lewis Topper, who runs a network of fast-food restaurant franchises, donated more than $17,000 total to Finchem, Karamo and Marchant, according to the report.
Still, that’s small compared to the funding on the Democratic side. The Democratic group iVote, for example, announced on Monday $5 million in new spending against Finchem in Arizona, part of $11 million in spending against election denier secretary of state nominees.
Ellen Kurz, a veteran Democratic operative who runs iVote, said there is no comparison between her group and those that are funding election deniers.
“They are telling you that if their chosen candidate doesn’t win, they will disregard the will of the people,” she said. Democrats, she said, have “a nonpartisan idea — every registered voter, if they’re Democrat, Republican or Independent, should be able to cast a vote.”

WASHINGTON, Oct 19 (Reuters) – U.S. President Joe Biden announced a plan on Wednesday to sell 15 million barrels of crude oil from the nation’s emergency supply and begin refilling the reserve as he tries to dampen high gasoline prices ahead of midterm elections on Nov. 8.
The move came two weeks after the Saudi Arabia-led Organization of the Petroleum Exporting Countries rankled Biden by siding with Russia and agreeing to a production cut, raising fears of a new spike in U.S. pump prices.
“With my announcement today, we’re going to continue to stabilize markets and decrease the prices at a time when the actions of other countries have caused such volatility,” Biden said at a White House event.

Biden blamed Russian President Vladimir Putin’s invasion of Ukraine for higher crude and gasoline prices, while noting prices had fallen 30% from their peak earlier this year.
He also repeated a plea to U.S. energy companies, gasoline retailers and refiners, asking them to stop using record-breaking profits to buy back stock, and to invest in production instead.
Prices “are not falling fast enough,” he said.
“Families are hurting,” and gasoline prices are squeezing their budgets, he added.
Biden’s plan aims to add enough oil supply to the market to prevent price spikes that could hurt consumers and businesses, while also assuring the nation’s drillers the government will swoop into the market as a buyer if prices plunge too low.
The president, facing criticism from Republicans who charge he is tapping the Strategic Petroleum Reserve(SPR) for political reasons and not because there is an emergency, also said he would refill the nation’s stockpiles in the upcoming years.
Biden already announced the record release of 180 million barrels from the SPR earlier this year to combat a potential supply crisis brought about by sanctions on oil-rich Russia following its February invasion of Ukraine.
The SPR, which is now at its lowest levels since 1984, is more than half full with more than 400 million barrels of oil, Biden said, “more than enough for any emergency drawdown.”
He said his aim would be to replenish stocks when U.S. crude is around $70 a barrel, a level that would still allow companies to profit while still being a good deal for taxpayers. The U.S. benchmark was around $85 on Wednesday.

Biden’s efforts to use federal powers to balance the U.S. oil market underscores just how much the war in Ukraine, rampant inflation and OPEC’s cut have upended the plans of a president who came into office vowing to undo the oil industry and move the country swiftly to a fossil-fuel free future.
“We need to responsibly increase American oil production without delaying or deferring our transition to clean energy,” Biden said on Wednesday.
GASOLINE PRICES HURT
U.S. presidents have little control over petroleum prices, but the country’s massive gasoline consumption – the highest in the world – means high prices at the pump can be political poison. Retail gasoline prices have fallen from a high in June, but remain above historical averages, and are a major contributor to inflation.

The administration’s plan was to end the sale of the previously announced 180 million barrels that started in May, in November. However, purchases by companies, including Marathon Petroleum Corp (MPC.N), Exxon Mobil Corp (XOM.N) and Valero Energy Corp (VLO.N), were slower than expected over the summer and some 15 million barrels remain unsold.
Those will be put up for bidding for delivery in December, a senior administration official said. Extra oil could also be made available if needed, Biden said on Wednesday.
PUSHING ENERGY COMPANIES TO DO MORE
Biden said oil companies should feel more confident about investing in production with the new SPR repurchase pledge.
“So my message to all companies is this: You’re sitting on record profits and we’re giving you more certainty. So you can act now to increase oil production,” he said.
Companies “should not be using your profits to buy back stock or for dividends. Not now, not while a war is raging,” he said, asking them to bring down prices they charge at the pump.
In recent weeks, the oil industry has grown increasingly concerned the administration might take the drastic step of banning or limiting exports of gasoline or diesel to help build back sagging U.S. inventories. They have called on the administration to take the option off the table, a move officials are unwilling to do.
“We are keeping all tools on the table, you know, anything that could potentially help ensure stable domestic supply,” the official said.

MOSCOW (AP) — Russian President Vladimir Putin declared martial law Wednesday in the four regions of Ukraine that Moscow annexed and gave all regional governors in Russia emergency powers that open the door for sweeping new restrictions throughout the country.
Putin didn’t immediately spell out the steps that would be taken under martial law, but said his order was effective starting Thursday. His decree gave law enforcement agencies three days to submit specific proposals and orders the creation of territorial defense forces in the annexed regions.
The upper house of Russia’s parliament quickly endorsed Putin’s decision to impose martial law in the annexed Donetsk, Kherson, Luhansk and Zaporizhzhia regions. The approved legislation indicated the declaration may involve restrictions on travel and public gatherings, tighter censorship and broader authority for law enforcement agencies.
“We are working to solve very difficult large-scale tasks to ensure Russia’s security and safe future, to protect our people,” Putin said in televised remarks at the start of a Security Council meeting. “Those who are on the frontlines or undergoing training at firing ranges and training centers should feel our support and know that they have our big, great country and unified people behind their back.”
On Saturday, the Russian Defense Ministry said two men fired at soldiers on a military firing range near Ukraine, killing 11 and wounding 15. The ministry said two men from an unnamed former Soviet republic fired on volunteer soldiers during target practice before they were killed by return fire.
Putin didn’t provide details of the extra powers the heads of Russian regions will have under his decree. However, the order states that measures envisaged by martial law could be introduced anywhere in Russia “when necessary.”
According to the Russian legislation, martial law could require banning public gatherings, introducing travel bans and curfews, and conducting censorship, among other restrictions.
Kremlin spokesman Dmitry Peskov said Putin’s order doesn’t anticipate the closure of Russia’s borders, state news agency RIA-Novosti reported. In an apparent attempt to assuage a nervous public, regional authorities rushed to declare that no immediate curfews or restrictions on travel were planned.
Putin last month ordered a mobilization of army reservists, prompting hundreds of thousands of men to flee Russia.
The Russian leader on Wednesday also ordered the establishment of a Coordination Committee to increase interactions between government agencies in dealing with the fighting in Ukraine, which Putin continued to call a “special military operation.”
Prime Minister Mikhail Mishustin, who was named to lead the committee, said it would focus on boosting supplies of weapons and military equipment, conducting construction work and facilitating transportation.
In Russia’s regions bordering Ukraine, authorities plan to tighten security at key facilities and conduct checks of motorists, among other measures, according to Andrei Kartapolov, head of the defense committee of Russian lower house of parliament.

The announcement made on Wednesday, Oct. 19 detailed that the flight would be offered through Breeze Airways starting Feb. 10. Since the carrier began service in May 2021, it has steadily increased its offerings from Richmond, including nonstop flights to New York, Las Vegas, San Francisco, New Orleans and more.
As of now, the direct flight out of Richmond will be the only nonstop flight to Phoenix offered in the Commonwealth of Virginia.

A new poll from Monmouth University finds that 60% of Americans believe that former President Donald Trump should have to testify before the House Jan. 6 committee, while 34% say he shouldn’t have to testify.
By party, 89% of Democrats and 61% of independents say Trump should testify, versus 67% of Republican respondents who say he should not.
The poll — conducted Oct. 13-17 of 808 adults, and which has a margin of error of plus-minus 5.2 percentage points — comes after the House Jan. 6 committee voted to subpoena the former president. Trump responded to the committee, but his 14-page letter didn’t signal whether he’d testify or not.
The Monmouth poll also finds 36% of Americans saying Trump is directly responsible for the Jan. 6 attack on the U.S. Capitol; 27% saying he encouraged those involved; and 33% saying the former president did nothing wrong.
Those numbers are essentially unchanged from when Monmouth asked the same question a month ago.
And the poll finds Americans are divided about Trump’s continued presence in American political life — regardless of their views about his Jan. 6 involvement — with 47% saying his presence poses a danger, and with 50% disagreeing that he doesn’t pose a danger.

(Reuters) – Videos published by the Tampa Bay Times show Florida ex-convicts expressing bafflement and frustration as they were arrested for voting illegally, a result of the first investigations by Republican Governor Ron DeSantis’ new election police agency.
In one video, Romona Oliver reacted with shock when police arrived at her house early one morning and arrested her as she was headed to work.
“Voter fraud?” she asked. “I voted, but I ain’t commit no fraud.”
The videos from officers’ body cameras, which the newspaper obtained through public records requests, were taken on Aug. 18, hours before DeSantis held a news conference to announce the arrests of 20 people for voting illegally in the 2020 election.
DeSantis said all of those arrested had been convicted of murder or sex crimes, which excluded them from a 2018 Florida state constitutional amendment that restored voting rights to other felons who had finished their sentences. Oliver was convicted of second degree murder, the Tampa Bay Times reported.
“They do not have the right to vote,” DeSantis said. “Now they’re going to pay the price for it.”
The arrests marked the first cases brought by the Office of Election Crimes and Security, which was established earlier this year at the urging of DeSantis and includes sworn officers from the state Department of Law Enforcement.
The office’s creation was part of a broader push by Republicans around the country for more restrictive voting laws in the wake of former President Donald Trump’s baseless claims that the 2020 election was rigged.
DeSantis, widely seen as a presidential contender in 2024, has said the office will restore public trust in election integrity. His office did not immediately respond to a request for comment on Wednesday.
Democrats and civil rights groups have said the investigations could intimidate voters, particularly those of color, while perpetuating the false notion that voter fraud is a significant concern in U.S. elections.
The videos show at least some of the people arrested did not appear to have realized they were ineligible to cast a ballot.
“I thought…felons were able to vote,” said Tony Patterson, described by the newspaper as a registered sex offender, as he was placed in handcuffs. “Why would y’all let me vote if I wasn’t able to vote?”
Florida law requires that a defendant “willfully” commit voter fraud in order to be guilty of the crime.
In some cases, the defendants said they were not informed by local officials that they could not vote. Oliver, for instance, successfully registered to vote twice after her release from prison, the Tampa Bay Times reported.
Another defendant, Nathan Hart, also described as a registered sex offender, told officers an employee at the motor vehicle department told him to fill out a registration form after learning he was off probation, and assured him that he wouldn’t be allowed to vote if he were ineligible.

An expert panel convened by the Food and Drug Administration voted 14-1 on Wednesday to recommend withdrawing a preterm pregnancy treatment from the market, saying it does not work. The drugmaker and some patient groups had argued there is evidence to suggest it might work in a narrow population that includes Black women at high risk of giving birth too soon.
Peter Stein, director of the Office of New Drugs at the FDA’s Center for Drug Evaluation and Research, acknowledged in closing arguments clinicians’ arguments about the need for an effective drug to reduce the incidence of preterm birth — a leading cause of infant mortality in the United States. He said the agency agrees with clinicians who testified during three days of hearings on the urgent need for such a drug, but only if the data and science support it — and that is not the case for Makena.
“Hope is a reason to keep looking for options that are effective, whether we find them here or elsewhere,” he said. “Hope is not a reason to take a drug that is not shown to be effective. or keep it on the market.”
The recommendations of the panel of independent advisers are nonbinding, though the agency usually follows its advice. Withdrawing a drug from the market is a highly unusual step.
The three day hearing was emotional both for members of the public, as well as the panel members of the Obstetrics, Reproductive, and Urologic Drugs Advisory Committee.
Several health groups have supported keeping Makena on the market while further study is done, worried that pulling it could deepen health inequities. “We believe that removing access will have a detrimental impact on the health of women and birthing people at risk of recurrent preterm births and will not impact all women equally,” said Martha Nolan, senior policy adviser at HealthyWomen, nonprofit women’s health group focused on helping women making informed decisions about their care.
Members of the panel, which is made up of maternal health experts, neonatologists, statisticians, and other experts, related the difficulty of their decision.
“I’m so disappointed … I wish we weren’t sitting here today,” one member said. Another expressed “deep sadness” about the large trial of Makena that showed no benefit.
Esther Eisenberg, a reproductive endocrinologist, supported withdrawing the drug, “but I’m very conflicted. This is a very very difficult question.”
Cassandra Henderson, a maternal-fetal medicine specialist in New York City who was the sole panel member who argued the large clinical trial showed promise for some patient subgroups and who voted to keep the drug on the market, said she was concerned about the low representation of minority women in the trial, as “we do know race is sort of a surrogate for racism and all the structural inequities.”
Drugmaker Covis Pharma and its backers have argued that study may have missed its benefits in high-risk populations in the United States because participants were largely Eastern Europe and only 7 percent Black. In a filing with the FDA, the drug company called the latter trial “flawed,” not only because of its racial demographics, but also because the population was low-risk and the women had access to national health-care systems that differ greatly from the complex piecemeal system in the United States.
Raghav Chari, chief innovation officer for Covis, had testified the company was willing to work with the agency to limit Makena’s use to “a higher-risk target population” only and would also agree to stop active promotion of the drug.
He called this a “practical approach” that would enable individual physicians in consultation with their patients to make decisions about whether using the drug might be helpful.
Chari said Covis is committed to conducting additional studies to address questions about the drug’s potential risks and benefits, emphasizing that reducing preterm birth is a public health priority and an area of unmet need in drug development.
“We are not proposing that race biologically differentiates patients,” he said Wednesday. “At the same time, it is well-documented that preterm birth disproportionately impacts women who are Black and other minorities in the United States. These and other social determinants of risk are factors in defining the higher-risk population where Makena is most likely to be effective.”
But Joseph Alukal, a urologist who is director of men’s health at Columbia/NewYork-Presbyterian suggested the racial inequity argument “implies the drug is effective and implies the drug is safe” when we don’t actually have an answer on that.
Mark Hudak, a neonatologist the University of Florida College of Medicine, said he is “sensitive to the disparity issues that have been raised.” However, he said allowing Makena to remain on the market is not appropriate and would result in “complete regulatory chaos.”
Makena was approved by the FDA in 2011 under an accelerated approval program for drugs that treat serious conditions for which there are no treatments. The drugmakers are then required to conduct studies confirming the drug’s benefits to continue selling the medication. But the debate over Makena’s effectiveness more than a decade after its approval underscores the complexities of that program, highlighting how it can take the agency years to pull a drug from the market even if officials believe it’s ineffective.
In the case of Makena, the FDA’s Center for Drug Evaluation and Research proposed withdrawing it from the market in October 2020 — a move that followed an expert advisory panel’s 9-7 vote a year earlier to pull it from the market based on disappointing results from a large confirmatory study. But regulatory requirements, as well as the pandemic, have slowed the process.
The FDA’s Stein argued that leaving Makena on the market for a narrowed use would “upend the intention of the accelerated pathway.” He argued that “absent evidence of effectiveness, we are only left with risk. The benefit-risk balance for Makena is not favorable.”

Rep. Scott Perry (R-Pa.), the chair of the right-wing Freedom Caucus, floated to colleagues the idea of laying the groundwork for an investigation into the Biden administration’s approach to Russia-Ukraine peace talks, Axios has learned.
Why it matters: Republican criticism of President Biden’s approach to the conflict has splintered as the conflict has dragged on. While establishment GOP senators have urged Biden to speed up and diversify weapon sales to Ukraine, MAGA-aligned Republicans have demanded Kyiv enter negotiations to avert the risk of nuclear escalation.
Perry’s comments mirror the concerns of isolationists — on both the right and the left — who say the Western desire for an outright Ukrainian win could provoke a cornered Russian President Vladimir Putin to take drastic action, including a nuclear strike.
Ukrainians — and Biden — counter that Russia can end the war at any time by withdrawing its forces and that only the Ukrainian people have the right to determine the fate of their country.
Driving the news: In a text late last month to fellow Republican members of the House Foreign Affairs Committee, screenshots of which were obtained by Axios, Perry asked whether they had sent a records preservation request to the administration — the first step toward an investigation.
“Have we requested any Administration conversations with [Ukrainian President Volodymyr] Zelensky this spring that included the proposition of an end to Russian occupation in exchange for Ukraine not joining NATO?” he wrote.
Perry said he is “completely opposed to Russian actions regarding Ukraine,” but is “not in favor of war with Russia.”
“If these nitwits in this jackwagon Administration are blundering us or intentionally marching us to war with Russia, nuclear or otherwise, we’d better start to preserve the evidence so there can be accountability.”
Context: Early negotiations between Ukraine and Russia, which included proposals for Kyiv to formally abandon its NATO aspirations, collapsed as Vladimir Putin escalated his brutal assault on civilians.

The big picture: Republicans are planning a vast array of investigations into the administration, including into Hunter Biden’s business dealings in Ukraine and elsewhere, as well as the withdrawal of troops from Afghanistan last year.
Perry’s texts mark a rare instance of a proposed investigation into the administration’s response to the war in Ukraine, which has largely received the support of Congress in the form of aid packages.
Spokespeople for Perry and the White House did not respond to requests for comment.

GLENDALE, AZ — The Arizona Super Bowl Host Committee has announced Gilbert-based Footprint as the official “green” partner for Super Bowl LVII in Glendale.
Footprint, which has been on a mission to create a healthier planet by eliminating single-use plastics, will provide plant-based fiber products, such as plates, cups and utensils, as well as create educational opportunities to learn about the importance of eliminating single-use plastics at events in the months leading up to the Super Bowl.
“Partnering with the Arizona Super Bowl Host Committee will showcase the state as a hub for innovation and how events like the Super Bowl can be done with sustainability at the forefront,” Troy Swope, Footprint’s CEO and co-founder said in a statement. “The Super Bowl and adjacent events will put our company on the international stage to show what’s possible beyond single-use plastics and give fans the opportunity to experience Footprint’s eco-friendly, plant-based products — demonstrating that people don’t have to sacrifice the environment to enjoy sporting and entertainment events.”

Lou Malnati’s Pizzeria, based in Northbrook, IL, announced that it will officially make Tempe home to its eighth location in the Phoenix area. The famous deep dish pizzeria is slated to open its newest location in late fall 2022, currently under construction, at 27 South McClintock Drive in Tempe, AZ. The new space is located in Tempe Marketplace in a free standing retail building, adjacent to Barrio Queen and The Keg Steakhouse, near the corner of South McClintock Drive and East Rio Salado Pkwy. It’s located along the Salt River near the interchange of Loop 101 and 202 in the heart of the Valley.
Lou Malnati’s opened its first outpost in Phoenix in 2016, followed by locations in Arcadia, Scottsdale, Glendale, Mesa, Gilbert, and most recently in Chandler in April 2022. The 4,900 square foot space will be a full service restaurant featuring a great dining room, bar and outdoor patio. While the menu is highlighted by the legendary deep dish pizza, it also offers thin crust along with signature appetizers, salads, pastas and delicious desserts. The new store will offer dine-in, carryout, curbside pick-up, no-contact delivery, and drop off catering services for hungry fans in the Tempe area.

The company will hire approximately 110 local employees and is looking to fill various positions including bartenders, servers, delivery drivers, kitchen crew and team members. PHOENIX (3TV/CBS 5) – One in every eight children in the U.S. are experiencing food insecurity.
Schools lunches are a lifeline for many students but still, many of those same students struggle whenever they’re not in school. One special program is trying to change that, one kid at a time. Grab and Go meals are being donated on carts in Gilbert public schools in the Valley as part of the lead up to the Super Bowl in February.
The cars are called Fuel Up to Play 60 and is a partnership between Mission 57 hunger and the NFL. Kids will have access to a variety of vegetables, milk and orange juice, cereal, and other healthy breakfast alternatives. October Classic: For 28 years, the October Classic was the highlight of the season at the former Mesa Marin Raceway (CA) (1977 to 2005) on the eastside of Bakersfield. 2018, found the race returning to Kern County Raceway Park (CA) now on the westside of the oil town. This year’s edition will find the SPEARS SRL Southwest Tour Series joined by the SPEARS Modified Series, and the Spears Manufacturing Pro Late Models presented by Sigma Performance Services. The 34th Annual “October Classic 134” will be the penultimate event of the 9-race SRL Super Late Model schedule and will take place on October 22nd, paying $7,500 to the winner. $2,500 will go to second with $1,750, $1,500, and $1,300 to the top-five. For those on the Spears Manufacturing Frequent Flyer Program, it will pay $1,200 to start. The Pro Late Models will compete for $2,500 in the “Salute to the Oil and Gas Industry 80”. The Modifieds will race for $2,000 in the “Visit Bakersfield 60”.
History: 22 October Classics were run under the Southwest Tour Series banner. Mike Chase and Derek Thorn hold the most victories during those years with three each. Other notable winners since Gary Manlow, who won in 1988, include Kevin Harvick (1998), Kurt Busch (1999), David Gilliland (2004, 2005), Rick Carelli (1992), M.K. Kanke (1997), Steve Portenga (1993), Eric Holmes (2002), and Auggie Vidovich (2000). The last four events have been at Kern County Raceway Park (KCRP), where Linny White has been the only driver to beat Derek Thorn (2019). A new event champion will be crowned this weekend.
Field: 23 Super Late Models are currently entered for the “34th Annual October Classic 134” representing six states. Teams from Arizona, California, Idaho, Nevada, Oregon, and Texas are represented. Three drivers are scheduled to make their first starts of the season. Those drivers include John Dillon, Brandon Farrington, and Barrett Polhemus. There are five former SRL winners (Jacob Gomes, Buddy Shepherd, Dan Holtz, Jeremy Doss, and Blaine Rocha) on the entry. There are five Super Late Model Touring Series champions in the field. Those include John Dillon, Jacob Gomes, Chris Davidson, John Moore, and Jeremy Doss.
Championship Battle SLM: Jeremy Doss had closed the championship lead on Jacob Gomes to just 12 points, entering the last round at Irwindale Speedway (CA). But a season worst finish of sixth for Doss, gave Gomes a 32-point margin after his runner-up finish. The duo will renew their battle at the “October Classic 134”. In 2022, Gomes has first and third-place finishes at Kern, while Doss has come home fifth both times. Jace Hansen sits third, 159 points behind Doss. John Moore is fourth with Cale Kanke, Dustin Ash, Buddy Shepherd, Zach Telford, Scott Sanchez, and Trevor Huddleston the top-10. Blaine Rocha is only six points out of the top-10.
Rookie Battle SLM: Zach Telford holds a commanding lead in the Rookie-of-the-Year battle. Austin Herzog sits second in the standings followed by Dylan Zampa, Jake Bollman, and Sean Hingorani. Eight different rookies have scored points during the 2022 season. Telford, Herzog, Hingorani, Austin Thom, and Barrett Polhemus are entered as rookies this weekend.
Texas Two Step: The state of Texas will be represented by two teams this weekend. Veteran racer Chris Davidson will make the trip from Tayler Lake Village, TX, and teenager Barrett Polhemus will drive from Wimberley, TX to attend the October Classic. Davidson is a two-time Allen Turner Pro Late Model Series Champion at Five Flags Speedway (FL), as well as a two-time USRA Super Late Model Series Champion. Polhemus was the 2022 Tundra Series Rookie-of-the-Year, finishing eighth overall. He was third in the Jr Late Model Championship Standings at Madera Speedway in 2021.
Pro Late Models: 17 Spears Manufacturing Pro Late Models are currently entered for the “Salute to the Oil and Gas Industry 80”. Four series winners are entered including Sean Hingorani, Bradley Erickson, Seth Wise, and Dylan Zampa. Zampa leads the league with three 2022 victories, but Seth Wise leads the championship standings on the strength of one win, eight top-five and nine top-10 finishes. Tyler Reif is second in the standings followed by Dylan Zampa, Tanner Reif, and Christian Bazen. The Sigma Performance Services Young Gun standings mirror the championship standings.
Spears Modified Series: 18 Spears Manufacturing Modifieds are entered for the “Visit Bakersfield 60”. Jaron Giannini leads the championship standings, after winning the season opening event at Havasu 95 Speedway (AZ). Jimmy Sloan sits second in the standings, 89 points out of the lead. Travis Thirkettle is another 17 points back, on the strength of five victories, after missing the season opener. Sam Jacks is fourth with William Guevara rounding out the top-five. Jaron Giannini, Jimmy Sloan, Kyle Jacks, Kevin Vossen and Ray Mros are the top-five in the Rookie-of-the-Year battle. Thirkettle has won both previous events at Kern County Raceway in 2022.
Double Duty: Sean Hingorani and Holly Clark will pull double duty this weekend. Hingorani will compete in both the Super Late Model and Pro Late Model events with Nascimento Motorsports. Clark will compete in her families Modified as well as the Naake-Klauer Motorsports maintained Pro Late Model.
Farrington Returns: Brandon Farrington finished seventh in the championship standing and third in the rookie battle in 2021. He has been racing on the dirt tracks of the Southwest in 2022, but he will make his return to the series in a Garcia Racing Super Late Model this weekend. KCRP has been one of his favorite tracks, but he will be looking for better luck this weekend after his 2021 results. He would love to return to the form he exhibited in the 2020 October Classic, where he finished fourth.
“I’m super excited”, Farrington exclaimed about his return to the series! “I’ve missed this so much, not being in the seat this year. From the time we get to the track, to the time we leave, the SRL hospitality is unmatched in my opinion. And they make it a great experience. Kern is one of my favorite tracks. I always felt like we had good speed when I raced there. My last race in a “Super” was there, and it didn’t end well. I’m looking for some redemption from that last start there.”
Trick or Treat: The teams of the SPEARS SRL Southwest Tour, SPEARS Manufacturing Pro Late Models presented by Sigma Performance Services, and the SPEARS Modified Series will bring candy for kids in attendance at the October Classic. Cars will be parked on the front stretch for an autograph session, as well as an opportunity to pick up some Halloween goodies from the drivers and teams.
Schedule: Spectator Gates officially open at 4:00pm, with Qualifying for the Spears Pro Late Model Series, the Spears Modified Series, and the Spear SRL Southwest Tour Series beginning at 4:20pm. The autograph and on-track trick or treat sessions begin at 5:20pm. Feature events are scheduled for 6:00pm. The LiUNA Feel the Power Fireworks display will follow the feature events.
Live Broadcast: The Low Budget TV cast will be at Kern County Raceway Park to provide LIVE coverage of all three divisions. The PPV broadcast can be found at www.SpearsRacing.TV. The event will be tape delayed on MAVTV at a time and date to be announced later.
Looking Ahead: The season finale for all three series will take place on November 12th at Irwindale Speedway. The “2022 Spears Southwest Tour Series Finale – Prelude to the Showdown 100” will be shown LIVE on MAVTV, and will feature one of the biggest, if not the biggest field of the 2022 season. Champions will be crowned in the Spears SRL Southwest Tour Series, Spears Pro Late Model Series presented by Sigma Performance Services, and the Spears Modified Series.

These teams know eachother well, and I think it will be a competitive contest and the Doncic will probably put up a silly video game stat line like 26/11/10.
But that said, I think the Suns’ will be fueled by both a need to redeem themselves from last season and to put the league on notice that rumors of their demise amid the chaos of the offseason are greatly exaggerated.

Former President Donald Trump is scheduled to answer questions under oath Wednesday in a defamation lawsuit brought by a writer who alleges he raped her in the mid-1990s.
E. Jean Carroll, who was a longtime columnist for Elle magazine, sued Trump for defamation in 2019 after the then-president denied her allegations that he raped her in an upscale Manhattan department store’s dressing room. Carroll’s lawsuit claims the former president ruined her reputation when he denied the allegation.
A judge ruled last week that the former president must sit for a deposition in the case, rejecting a request by Trump’s lawyers to delay the testimony. Trump’s lawyers had tried to quash the suit by arguing that he was acting in his capacity as president when he denied the rape allegations — an argument that aimed to make the U.S. government the defendant and reduce Carroll’s chances of success given protections for federal employees who are sued for actions on the job.
U.S. District Judge Lewis A. Kaplan wrote that the lawsuit must proceed after being in legal limbo for three years, citing the “advanced age” of Carroll, 77, and Trump, 76, and potential witnesses.
“The defendant should not be permitted to run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong,” Kaplan wrote.
Kaplan noted with disapproval a series of attempts by Trump to delay the collection of evidence in the defamation lawsuit.
“Given his conduct so far in this case, Mr. Trump’s position regarding the burdens of discovery is inexcusable,” he wrote. “As this Court previously has observed, Mr. Trump has litigated this case since it began in 2019 with the effect and probably the purpose of delaying it.”
Trump took aim at Carroll in a post on his social media platform after the judge denied his request to delay the deposition.
“This ‘Ms. Bergdorf Goodman’ case is a complete con job,” Trump wrote.
Trump has repeatedly denied ever meeting Carroll, saying she was “totally lying” when she accused him of sexual assault.
“I’ll say it with great respect: Number one, she’s not my type. Number two, it never happened. It never happened, OK?” Trump told The Hill in 2019.
In a court filing last month, Carroll’s lawyers indicated she plans to sue Trump in November under a new New York statute that permits victims of sexual assault to sue years after the incident.

Donald Trump is set to appear for a deposition on Wednesday as part of a defamation lawsuit brought by E. Jean Carroll, a former magazine columnist who claims the ex-president raped her years ago.
Trump has long tried to delay the case and avoid testifying, ABC News reports. But Judge Lewis Kaplan last week rejected his attempt to again slow proceedings, ruling Trump “should not be permitted to run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong.”
Carroll sued Trump for defamation in 2019, after he denied “her claim that he raped her in a New York department store in the mid-1990s,” CNN writes. She now plans to sue Trump for the alleged assault under a new New York law set to take effect on Nov. 24. The law will “allow sexual assault victims to sue regardless of how old their allegations are,” ABC News summarizes.
Kaplan also said last week it “would make no sense” to further delay Trump’s deposition in the defamation case just because it might be used in Carroll’s future complaint. The claims in both suits are connected, he said.
But “the defamation lawsuit may go away on its own,” ABC News posits. The president’s team has pushed to substitute the Justice Department as the defendant in the case, since Trump was a federal employee at the time he denied Carroll’s allegations. The government cannot be sued for defamation, which would therefore end the lawsuit.
A federal appeals court recently ruled that Trump was in fact an employee of the federal government at the time, but has asked a Washington, D.C., appeals court to weigh in, as well, ABC News continues.

Russian President Vladimir Putin said martial law will be introduced across four regions of eastern and southern Ukraine, which Moscow illegally annexed after staged referendums last month despite not fully controlling these areas either politically or militarily. The move signals an intensifying effort to achieve his military objectives amid continuing airstrikes on infrastructure targets.
Military officials will take direct responsibility for civilian government functions in the Donetsk, Luhansk, Kherson and Zaporizhzhia regions, Putin said at a meeting of his security council. Putin did not elaborate on what exactly the introduction of martial law would change on the battlefield, as Russian forces are losing ground in the illegally annexed territories, including the southern Kherson region.

The fight for Kherson could begin in the “very near future,” a pro-Russian separatist official said. Residents were ordered to leave Wednesday morning in anticipation of a major Ukrainian push to retake the city; at least 50,000 inhabitants will be transported out in an operation that pro-Moscow authorities say will take about a week.

“ ‘Martial law’ implementation on the occupied territories by [Russian forces] should be considered only as a pseudo-legalization of looting of Ukrainians’ property by another ‘regrouping,’ ” Mykhailo Podolyak said on Twitter.

Ukrainian air defenses successfully shot down Russian missiles flying over the capital Wednesday, Kyiv Mayor Vitali Klitschko said on Telegram. He urged residents to stay in bomb shelters while air raid sirens continued to blare across the city.
One of those who heard the capital’s air defenses blast into action was the British ambassador to Ukraine, Melinda Simmons. She described the sound of explosions and the “total calm” with which the capital’s inhabitants rushed into bomb shelters.

Ally shares tumble after posting third-quarter earnings miss on impairment charge

Shares of Ally Financial fell 6% in morning trading after posting disappointing third-quarter results.
Ally’s third-quarter report, disclosed early Wednesday, included a 33-cent per share impairment charge tied to the firm’s mortgage unit, as well as a $438 million provision for credit losses. That led to a miss on both profit and revenue for the quarter, according to StreetAccount estimates.
Known primarily as an auto lender and online bank, analysts are watching how the company navigates weakening credit trends, particularly among subprime borrowers. Default rates on auto loans have begun to rise from historically low levels as Americans spend down balances fattened during the pandemic.
The bank also said Tuesday that its CFO was departing, a move that caught some off guard given its timing shortly ahead of Ally’s earnings release.
“This announcement, one day prior to the expected earnings release tomorrow morning, comes as a surprise and likely will cause some uncertainty in the market,” Piper Sandler analyst Kevin Barker wrote Tuesday in a note. “We have been concerned about Ally’s balance sheet position heading into the current economic cycle with deposit costs rising rapidly, default rates rising in auto loans and ALLY’s leverage at the higher end.”
Shares of the bank fell as much as 11% earlier in Wednesday’s trading session and have lost 42% this year.

JPMorgan lifts Robinhood’s price target, but stock is still expected to slide further
The online stock trading platform Robinhood had its price target slightly lifted by JPMorgan. But the firm still views the stock as underperforming and expects it to fall another 23% in 2023.
Analyst Kenneth Worthington said the stock’s short-term outlook was helped by better trading volume, especially among higher-revenue index options, in September. He also said the company was boosted by short-term tailwinds like higher rates that would increase earnings and better cash treatment.
Still, he said those near-term aids do not change the fact that long-term profitability of stock is “elusive.” Robinhood is part of a group of companies that went public through an initial public offering during the pandemic but are now struggling,
“While the founders have leveraged innovation, guts, and ideal market conditions to build a leading US retail broker, we do not see growth as sustainable,” he said in a note to clients. “We question the ability of the company to generate competitive margins over time given the focus on such small accounts that have limited room to be profitable.”
Robinhood is down 41.2% percent this year. The stock has plummeted more than 80% from its high of just over $55 seen in October 2021, which came a few months after it went public at a price of $38 that July.

Shares of Plug Power fall despite optimistic Street call
Jefferies initiated coverage on Plug Power with a buy rating, although the positive call wasn’t enough to counteract broad selling on Wednesday, and shares of the fuel-cell maker slid more than 6%.
Still, the firm said Plug Power should benefit from its leadership position within the hydrogen value chain.
“While the growth plan is capital intensive, we believe the current 2025 targets can be exceeded, aided by the new production tax credit (PTC),” the firm said in an Oct. 18 note to clients. “Execution will be crucial, but the order book and key customer relationships bolster our confidence,” analysts led by Sam Burwell added.
Jefferies has a $28 target on the stock, which is about 56% above where shares traded Wednesday. For the year the stock is down more than 30%.

Generac sliding after big guidance cut
Generac shares sank nearly 20% to a 52-week low after the power company cut its profit outlook in nearly half.
The company’s full-year revenue growth is now expected to come in at 22% to 24%, compared to a prior forecast of 36% to 40%. That means revenue growth is now more likely to fall below Wall Street expectations of 38%.
It follows similarly downtrodden third-quarter guidance as the company expects earnings per share at $1.75 compared to an estimate of $3.21. Revenue is also expected to be more than $200 million below estimates at $1.09 billion. Earnings for the quarter are expected to be released on Nov. 2.
Company leadership pointed to residential product demand slides and a partner’s bankruptcy that hurt shipments. Known for its generators, the company was expected to perform well following Hurricane Ian.

If you think Black Monday was bad, this year has been even worse
If you think things were bad when the stock market crashed on this day back in 1987, they’re actually worse now.
That’s because a day that saw a 22.6% collapse in the Dow Jones Industrial Average actually was part of a pretty good year otherwise.
“Moving to the present day, 2022 has actually been worse than 1987,” Bespoke Investment Group said in its morning note Wednesday.
A day after the Oct. 19, 1987 Black Monday crash, the S&P 500 was off less than 8% year to date. That compares to a 22% drop in the present day, more than twice the slide of 1987 even after the large-cap index has gained nearly 4% over the past week.
Also of note: The S&P 500 finished 1987 only slightly lower on a nominal basis and actually was positive in terms of total return, or with dividends reinvested. The market itself also recovered nicely from the crash and has offered investors solid returns since.
“Since the close on 10/19/87, the S&P 500 has had an annualized total return of 10.71%. Even more notable, though, is that had you invested in the S&P 500 on the Friday before the crash, [your] annualized total return over that span would have still been just short of 10% (9.99%),” Bespoke noted. “Not bad for the worst-timed trade of all time.”

Evercore ISI downgraded shares of Lowe’s on Wednesday as the home improvement industry shows signs of a demand slowdown.
“Lowe’s is above average in pricing power and is clearly benefiting from the housing shortage/home price improvements,” wrote analyst Greg Melich in a note to clients as he downgraded the stock to in line. “Our downgrade is based on the view that slower HI demand and disinflation could push comps lower in 2023, making margin gains muted.”

Morgan Stanley is standing by Apple heading into earnings season
Morgan Stanley is thinking positive heading into Apple’s third quarter earnings, due Oct. 27 after market close. While the bank doesn’t expect the report to answer all investor questions, it does anticipate some solid numbers.
“We believe the setup into Apple’s September quarter earnings report next week is constructive, as our September quarter revenue forecast of $90.1B implies 2% upside to Street forecasts, while our $133.7B December quarter revenue forecast implies 4% upside to consensus,” wrote analyst Erik Woodring in a Wednesday note.
Three key factors are driving his more constructive outlook – stable production of the iPhone, iPad and Mac, the record iPhone mix shift more than offsets currency headwinds and service and product growth should be solid and even above seasonality for the quarter.
“Combined, these factors create a compelling setup where Apple grows revenue HSD Y/Y in both the Sept and Dec quarters (despite a 5-6 pt. FX headwind) while revenue for the rest of our consumer hardware universe is expected to decline 13% Y/Y and 9% Y/Y on average in C3Q and C4Q, respectively,” he said.

Shares of United Airlines rose more than 5% in premarket trading after the travel company beat estimates on top and bottom lines for the third quarter and delivered upbeat guidance.
The company earned an adjusted $2.81 per share on $12.88 billion of revenue. Analysts surveyed by Refinitiv had penciled in $2.28 per share on $12.75 billion.
Total revenue per available seat mile was up 25.5% compared to the same period in 2019, United said. CEO Scott Kirby said that hybrid work appears to be boosting demand for flights.

Housing starts continue to slow
Housing starts fell more than expected in September, dropping 8.1% month over month to an annualized rate of 1.44 million. Economists surveyed by Dow Jones were expecting a 6.7% decline.
Building permits rose 1.4%, but that was below the 1.5% expected.
