Trump Angrily Lashes Out After His Deposition Is Ordered https://digitalarkansasnews.com/trump-angrily-lashes-out-after-his-deposition-is-ordered/ NEW YORK (AP) — Former President Donald Trump angrily lashed out Wednesday, calling the nation’s legal system a “broken disgrace” after a judge ruled he must answer questions under oath next week in a defamation lawsuit lodged by a writer who says he raped her in the mid-1990s. He also called the 2019 lawsuit by E. Jean Carroll, a longtime advice columnist for Elle magazine, “a hoax and a lie.” The outburst late in the day came hours after U.S. District Judge Lewis A. Kaplan in Manhattan rejected a request by his lawyers to delay a deposition scheduled for Oct. 19. Kaplan is presiding over the case in which Carroll said Trump raped her in the dressing room of a Manhattan Bergdorf Goodman store in the mid-1990s. He called the lawsuit “a complete con job.” “I don’t know this woman, have no idea who she is, other than it seems she got a picture of me many years ago, with her husband, shaking my hand on a reception line at a celebrity charity event,” Trump said. “She completely made up a story that I met her at the doors of this crowded New York City Department Store and, within minutes, ‘swooned’ her. It is a Hoax and a lie, just like all the other Hoaxes that have been played on me for the past seven years,” he said. Then he grumbled: “Now all I have to do is go through years more of legal nonsense in order to clear my name of her and her lawyer’s phony attacks on me. This can only happen to ‘Trump’!” Carroll is scheduled to be deposed on Friday. Roberta Kaplan, Carroll’s attorney, said she was pleased with the judge’s ruling and looked forward to filing new claims next month “and moving forward to trial with all dispatch” after New York state passed the Adult Survivors Act, allowing her to sue for damages for the alleged rape without the statute of limitations blocking it. After Trump’s statement was released, a spokesperson for Kaplan’s firm, Kaplan Hecker & Fink, said the “latest statement from Donald Trump obviously does not merit a response.” Trump’s legal team has tried various legal tactics to delay the lawsuit and prevent him from being questioned by Carroll’s attorneys. But Judge Kaplan wrote that it was time to move forward, especially given the “advanced age” of Carroll, 78, and Trump, 76, and perhaps other witnesses. “The defendant should not be permitted to run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong,” he wrote. Carroll’s lawsuit claims that Trump damaged her reputation in 2019 when he denied raping her. Trump’s legal team has been trying to quash the lawsuit by arguing that the Republican was just doing his job as president when he denied the allegations, including when he dismissed his accuser as “not my type.” Trump doubled down on the comment in his statement Wednesday, saying: “And, while I am not supposed to say it, I will. This woman is not my type! She has no idea what day, what week, what month, what year, or what decade this so-called ‘event’ supposedly took place. The reason she doesn’t know is because it never happened, and she doesn’t want to get caught up with details or facts that can be proven wrong.” Whether Trump will remain the defendant in the original lawsuit is a key question because if Trump was acting within the scope of his duties as a federal employee, the U.S. government would become the defendant in the case. The 2nd U.S. Circuit Court of Appeals said in a split decision last month that Trump was a federal employee when he commented on Carroll’s claims. But it asked another court in Washington to decide whether Trump’s public statements occurred during the scope of his employment. Kaplan, the judge, said Trump has repeatedly tried to delay the collection of evidence in the lawsuit. “Given his conduct so far in this case, Mr. Trump’s position regarding the burdens of discovery is inexcusable,” he wrote. “As this Court previously has observed, Mr. Trump has litigated this case since it began in 2019 with the effect and probably the purpose of delaying it.” The judge noted that the collection of evidence for the lawsuit to go to trial was virtually concluded, except for the depositions of Trump and Carroll. “Mr. Trump has conducted extensive discovery of the plaintiff, yet produced virtually none himself,” Kaplan said. “Completing these depositions — which already have been delayed for years — would impose no undue burden on Mr. Trump, let alone any irreparable injury.” The judge also said the deposition could be useful when Carroll’s lawyer next month files the new lawsuit. In what would amount to be the strongest evidence of obstruction of justice, Trump told at least one aide to take boxes from the storage to his personal residence last spring after he received the legal order to cough up all classified records, according to twin bombshell published reports on Thursday. The longtime Trump aide, named in one report as Walt Nauta, has spilled the beans about his boss in repeated interviews with the FBI and is considered a critical witness against the former president. The damning twin reports in the Washington Post and New York Times help to explain why prosecutors were so sure Trump had failed to fully comply with the subpoena and why a judge authorized the explosive Aug. 8 search of his waterfront home and club. [ Trump’s troubles worsen: 6 legal landmines facing the ex-president ] Trump has been locked in a dispute with the government for months over the documents, including highly classified materials, that he improperly took with him after leaving the White House in January 2021. The former president returned about 15 boxes of the records, but the feds correctly believed more documents remained at Mar-a-Lago or elsewhere. Prosecutors obtained a subpoena requiring Trump to return all the outstanding classified materials. He handed over dozens of documents and his lawyers submitted a statement claiming they a “diligent search” revealed no more were at the resort. (AP) But the feds had evidence that Trump was lying and defying the subpoena. When they initially questioned the aide, he denied ever moving the boxes, the reports said. But when confronted with evidence to the contrary, he opened up about Trump’s direct involvement in trying to move the documents, a big legal no-no after getting a subpoena. The aide has also told investigators about Trump’s other efforts to get subordinates to help him thwart efforts to get the documents back. Trump derides the probe as a partisan witch hunt and has told supporters that he believes the documents belong to him, which is not true. The move comes after Google added former President Donald Trump’s Truth Social platform to its Play Store. The app had previously been barred from the store for content moderation concerns. Shares of Digital World Acquisition Corp., the shell company set to take Trump Media and Technology Group public, rose significantly after former President Donald Trump’s Truth Social platform was allowed onto the Google Play Store Wednesday. Shares of DWAC were up more than 18% Thursday. The change means that the app is now available on the app store for the 44% of smartphone users in the United States who have an Android device. Android users could previously access the platform through their web browser or through “side-loading” the application through the Truth Social website. The app had previously been barred from the Google Play Store for violating Google’s guidelines for moderating user-generated content. “Apps may be distributed on Google Play provided they comply with our developer guidelines, including the requirement to effectively moderate user-generated content and remove objectionable posts such as those that incite violence,” a Google spokesman said Wednesday. Truth Social agreed to enforce content moderation and to remove and block users who publish posts that incite violence, according to Google. Money Report The platform was founded by Trump after he was banned from Twitter in January 2021 “due to the risk of further incitement of violence,” after hundreds of his supporters attacked the U.S. Capitol.  Shares of DWAC fell in early October when Elon Musk said he would buy Twitter. The billionaire has previously said that he would reinstate Trump’s account. The former president had over 80 million followers on Twitter, but he has only around 4 million on Truth Social. Investors have cited these anemic numbers among their reasons for pulling funding from the DWAC-Trump Media merger. The company lost $138 million of its $1 billion private investment after a key deadline passed in September. DWAC is currently pushing to extend the deadline for the merger, which is currently set for Dec. 8. The company needs 65% of shareholders to approve a yearlong extension, but it has thus far failed to get adequate support. Without the extension or the completion of the merger, DWAC would liquidate Dec. 8. The shareholder vote has been delayed until Nov. 3. The deal is also the subject of a Justice Department probe into possible securities violations relating to undisclosed discussions between the companies prior to the merger announcement. A whistleblower and founder of Trump Media and Technology Group, Wiliam Wilkerson, flagged the potential violations to the SEC. “One way or another, this company is going to go bankrupt,” Wilkerson recently told the Miami Herald. “I don’t think the company is going to be approved by the SEC.” Trump Media has said the company is exploring legal action against the SEC for delaying the deal. The New York Times’ Dealbook newsletter confirmed Owens’ claim on Thursday. West has been critical of several of his business partners recently including JPMorgan CEO Jamie Dimon and other senior executives Bill Grous and Jing Ulrich. The field of 27 teams in the men’s race includes four nationally ranked top 30 teams. Leading the group is host school Oklahoma State, who are ranked No. 4, followed by No. 21 Razorbacks, No. 25 Montana State, and No. 29 California Baptist. Other schools competing include Abilene Christian, Butler, Charleston Southern, DePaul, Iowa, Kansas, Kansas State, Liberty, Little Rock, Missouri, Nebraska, Oklahoma, Oral Roberts, Pittsburgh, Portland State, Purdue, St. Louis, South Dakota State, Southern Utah, UC Santa Barbara, UCLA, Washington State, and Wyoming. “There are two big meets this weekend, the one in Wisconsin and the national meet at Oklahoma State,” said Arkansas men’s head coach Chris Bucknam. “We chose the Oklahoma State course, where we opened on September 1 with a small group in a 5k race. This will be the first time we have our full squad on this course. This is our preview before the national championships. “We have two goals. The first is to run against some great competition. Number two is just to get on this course again – to preview it for the national meet and I like the toughness of the course. Truth Social app from former US President gains approval for release on Google Play Store Alphabet’s Google has approved Truth Social, the social media app from former US President Donald Trump, for its Play Store. Last month Google had continued to refuse to approve it, because the app violated the Play store’s standards due to its insufficient content moderation. Following that, Truth Social moved to implement stronger content moderation policies, leading to Google’s approval. Truth Social will now be downloadable to Android smartphones via Google’s Play Store. Truth Social The delayed arrival on the Play Store comes after the app was launched on the Apple App Store back in February this year. Android is the world’s largest mobile operating system, but in the United States Android phones only account for 40 percent of the smartphone market. And despite its delay appearance on the Google Play Store, Truth Social was available for download for Android users in the US from other sources. Those other sources where the Android version could be found included non-Google sources, such as the Samsung Galaxy store. On Wednesday, a Google spokesperson told CNN the content moderation standards for Truth Social had now been met. “Apps may be distributed on Google Play provided they comply with our developer guidelines,” the spokesperson said, “including the requirement to effectively moderate user-generated content and remove objectionable posts such as those that incite violence.” Under Truth Social’s policies, user content that encourages violence “may result in” that content, or the account creating that content, being removed from the platform. Truth Social has agreed to enforce its policies against incitement, Google added. Website launch, closure Truth Social was Trump’s latest effort to create an online presence for himself following his ban from most mainstream social media platforms after the deadly 6 January, 2021 attack on the US Capitol by his supporters. After leaving office and faced with an ongoing social media ban, Donald Trump launched his own website to publish content ‘straight from the desk’ of the former president. But after only one month of operation, Donald Trump closed down that website. Trump has lashed out repeatedly against the social networking bans and has previously asked a US judge to order Twitter to restore his account. Trump’s return? But Trump’s ban on social networking platforms could be nearing an end. Yesterday it was reported that Twitter was reviewing its policies around permanently banning users. However that review would unlikely pave the way for a return to Twitter for Donald Trump, as removing bans for breaching of its policy against inciting violence was not under consideration. Trump is banned on Facebook for two years, until 7 January 2023, after which the company will review his suspension. YouTube and Twitter also initially banned Trump for a limited period of time, but YouTube then also suspended Trump’s account for a two year period. Twitter however opted to permanently ban Trump from its platform. Facebook and YouTube’s bans are due to be reviewed in January 2023, and could be lifted if and when the risk of violence has decreased. And Twitter’s permanent ban on Trump could be reversed by Elon Musk, who calls himself a free speech absolutist, if he completes his $44 billion acquisition of Twitter. Its shares were up 2% early in the session, compared with a 1% drop in the S&P 500. —Leslie Josephs Average rate on 30-year fixed mortgages reaches highest level since April 2002 The average rate on a 30-year fixed mortgage leapt to 6.92%, reaching its highest level in about 20 years according to Freddie Mac. Just a year ago, the average rate on these home loans was 3.05%. Rates on 15-year fixed mortgages also ticked higher, averaging 6.09%, up from 2.30% a year ago. The leap in home loan costs comes as the Federal Reserve continues its aggressive rate-hiking campaign to cool inflation. Wages can’t come down until we have more layoffs and there haven’t been, there’ve been remarkably few of them,” he said on CNBC’s “Squawk on the Street” Thursday morning. “I’ve been looking at the 2-year [U.S. Treasury yield] and thinking: haven’t people seen the momentum to go to 5%?” he added. “I’m a little aghast that people are aghast. If they actually look at the numbers… they would’ve seen it was going to be really hot.” — Tanaya Macheel Stocks open lower following CPI report Stocks opened lower Thursday, continuing a slump that started after the September consumer price index report came in hotter than expected. The Dow Jones Industrial Average fell 500 points, or 1.73%. The S&P 500 slipped 2.10% and the Nasdaq Composite slumped 2.80%. The yield on the 10-year U.S. Treasury spiked above 4% as bonds sold off – yields are inverse to price. The report signaled that inflation remains persistent even as the Federal Reserve raised interest rates. Going forward, the central bank will likely continue its path of aggressive hikes. —Carmen Reinicke Traders bet Fed will get even more aggressive, market pricing in rate close to 5% Traders are betting the Federal Reserve will now drive interest rates close to 5% before stopping its rate hikes next spring. Fed funds futures showed rate expectations rising sharply after the September consumer price index showed inflation running at a hotter than expected 0.4% over August. The market now expects the fed funds rate to reach 4.9% by April, up from about 4.65% Wednesday. “We’re adding in a full hike to the terminal rate from yesterday,” said Bleakley Advisory Group’s Peter Boockvar. Futures for November priced in 100% expectations for a 75 basis rate hike in November, but futures also showed some traders were looking for a slightly higher 100 basis points hike. (A basis point equals 0.01 of a percentage point) Boockvar said a 100 basis points (or a full percentage point) is not likely, but that the Fed could raise by 75 basis points in November and now 50 basis points in December. The market is pricing in a fed funds rate of 4.25% to 4.50% by the end of this year, he said. “It’s not going to impact the next meeting, but it impacts the meetings after that. The futures going out a few months are just getting crunched,” said Wells Fargo’s Michael Schumacher. “I think the story is the Fed is going  to stay pretty aggressive for a longer period of time.” But because there are fears of a recession, the market is showing the Fed ends its rate hikes by the second quarter, he said. –Patti Domm 10-year Treasury yield races past the 4% level U.S. Treasury yields surged after the CPI report was released on Thursday morning, as traders feared that the Federal Reserve would have to hike rates even higher to combat inflation. The benchmark 10-year Treasury yield jumped 17 basis points to 4.07%. A basis point is equal to 0.01 percentage points. The 2-year Treasury yield, which is more sensitive to Fed rate hikes, spiked more than 22 basis points to 4.51%. Yields move opposite of bond prices. The dramatic rise in interest rates this year means there has been a big sell-off in bonds, making this year’s markets painful even for investors who invested heavily in fixed income. — Jesse Pound There’s a chance of two more 75bps rate hikes this year, Zaccarelli says Thursday’s higher than expected consumer price index report has opened up the possibility for two more 0.75 percentage point rate hike increases from the Federal Reserve this year, according to Chris Zaccarelli, chief investment officer for the Independent Advisor Alliance. “Not only is the Federal Reserve going to raise rates by 75 bps next month, but there is now a possibility that they will raise rates by another 75 bps in December (although our base case is that they will raise rates by 50 bps)” Zaccarelli wrote in a note Thursday. “Effectively they started the year at a 0 – 0.25% Federal Funds rate and are now on track to finish the year at 4.25 – 4.5%.” The potential for even more rate hikes is not good for stocks going forward. “It is very difficult for this market to build a sustainable rally on the back of very high inflation and the expectation that the Federal Reserve is going to be more hawkish than ever,” he said. “We’ve been pretty consistent in saying that a recession was likely, that bear market rallies are likely to be unsustainable, and that it makes sense to own defensive investments, both in terms of shorter duration, higher quality with bonds and with more recession resilient sectors like healthcare and inflation-hedge industries in the energy and materials sectors,” he added. —Carmen Reinicke Stock futures plunge after hotter-than-expected inflation report Stock futures plummeted Thursday morning, erasing earlier gains, after the September consumer price index report came in higher than economists expected. The CPI report showed prices rose 0.4% on a monthly basis, more than the 0.3% estimate from Dow Jones. Futures for the Dow Jones Industrial Average fell 530 points, or 1.80%. S&P 500 and Nasdaq 100 futures slumped 2.18% and 2.97%, respectively. At the same time, the yield on the 10-year U.S. Treasury spiked above 4% as bonds sold off. Yields are inverse to price. —Carmen Reinicke Inflation rises more than expected despite rate hikes The U.S. consumer price index rose 0.4% in September, topping a Dow Jones estimate for a 0.3% gain. Excluding volatile food and energy prices, core CPI accelerated 0.6% against the Dow Jones estimate for a 0.4% increase. Core inflation was up 6.6% from a year ago. Vladimir Saldo said on Telegram Thursday that Ukraine was targeting the region with missile strikes every day and asked the Russian authorities for help in transporting families to Russia. Saldo said that Ukraine’s strikes were a retaliation for Kherson voting in a referendum to join the Russian Federation. “We suggested that all residents of the Kherson region, if there is such a desire, to protect themselves from the consequences of missile strikes … go to other regions. First of all, these are Crimea, the Rostov region, the Krasnodar Territory, the Stavropol Territory — our neighbors. Take out your children and yourself,” Saldo said on Telegram. “Turning to the leadership of the country, I would like to ask you for help in organizing such work. We, residents of the Kherson region, of course, know that Russia does not abandon its own people, and Russia always lends a shoulder where it is difficult.” Sham referendums were held in Kherson and three other Russian-occupied regions last month with a majority of people in those regions seen as voting to join Russia, although the votes were widely seen as fake and illegal. Saldo said Ukraine’s forces were “retaliating” as a result of the vote: “We knew that such decision would not be acknowledged by the Ukrainian authorities and we expected them to start retaliating against us. Dmitry Peskov told Russian state news agency RIA Novosti that the leaders’ meeting lasted about an hour and a half but that “the topic of Russian-Ukrainian settlement was not discussed.” It was widely expected that Turkey could use the meeting to formally offer to host peace talks between Russia and the West in a bid to end the war in Ukraine. National energy company Ukrenergo warned that it had more work to do to properly fix supplies, however. “The employees of Ukrenergo are dead tired but very satisfied because they restored power supply after the largest attack on the power system of an independent country in world history,” Ukrenergo said in a post on Telegram. There have been concerns that Western stockpiles of weapons and ammunition could run low and be hard to replenish in good time given Ukraine’s increasing need for military equipment, and the potential for the war to be long-lasting. Earlier this week, Jeremy Fleming, the head of GCHQ, one of the U.K.’s intelligence agency, said that Russia’s supplies and weaponry were running low. “We know — and Russian commanders on the ground know — that their supplies and munitions are running out,” Fleming said Tuesday. “Russia’s forces are exhausted. Ukraine’s President Volodymyr Zelenskyy commented on the attack Thursday, posting on Telegram that a child pulled from the rubble of the building earlier today had been trapped for six hours before being rescued. “The search for seven more people is ongoing. All services are there and working,” the president said. “Each of the Russian strikes, all manifestations of Russian terror against our people, our cities will not remain unpunished for the occupiers. A fair punishment awaits you. Know this,” he added. (Jose Luis Villegas / AP) Google said on October 12, 2022, it has allowed Truth Social, former US president Donald Trump’s social media outlet, in its Play Store for Android devices. Axios, which broke the news, noted that “nearly half of US smartphone users rely on Google’s Android operating system, and [while there are other ways to do so,] the Google Play Store is the primary way Android users can access – and download – apps to their phones.” Back in August 2022 Google had notified Truth Social about “several violations of standard policies in their app submission” which led to a rejection of their inclusion in the Google Play store. Truth Social, having updated its policies since then, was finally eligible for distribution via the Google Play store. The app –– which Trump launched after being barred from Twitter over the 2021 Capitol riot –– had been kept out of Google’s store over its lack of moderation tools, including for violent threats. Google said Truth Social has since been updated to comply with its policies barring objectionable posts, and has built-in effective systems for reporting and removing unwanted content as well as blocking abusers. “Apps may be distributed on Google Play provided they comply with our developer guidelines, including the requirement to effectively moderate user-generated content and remove objectionable posts such as those that incite violence,” a Google spokesperson said in response to an AFP inquiry. Developers can make Android apps available elsewhere on the internet, but the Play Store is the main source of content for users. Tech Crunch points out that this notion referred to as “sideloading” is tolerated by Google, and that Truth Social “recently offered the app as a direct download — the same strategy that fellow “free speech” app Parler previously employed to circumvent a similar situation.” A Truth Social app for Android devices is available on the social network’s website and other venues that may not have Google’s content moderation rules, according to the Alphabet-owned tech titan. “It’s been a pleasure to work with Google, and we’re glad they helped us to finally bring Truth Social to all Americans, regardless of what device they use,” Trump Media and Technology Group (TMTG) chief executive Devin Nunes said in a released statement. He added that the addition of Truth Social to Google Play was a “significant milestone” in the app’s mission “to restore free speech online”. TMTG on October 4, 2022, announced that a Truth Social app was freshly available for people in the United States who use Samsung smartphones, which are powered by customized Android software and have their own app shop. Samsung’s share of the US smartphone market is about 30 percent, according to industry analysis firm Counterpoint. A version of Truth Social tailored for Apple mobile devices is available at the App Store, which also enforces rules about content moderation. A version of Twitter, Trump style Google said in August that it had notified Truth Social that its app violated Play policies and required “effective systems for moderating user-generated content” in order to be offered on the platform. The online giant said at the time that Trump’s app broke rules barring content that incites physical threats and violence but was working on addressing those issues. Truth Social was conceived as Trump’s answer to Twitter –– from which he was ejected in January 2021, days after a mob of his supporters refusing to accept his election defeat to Joe Biden stormed the US Capitol. Billionaire Elon Musk, who has made a $44-billion deal to buy Twitter, has said he would likely allow the former US leader back on the platform. After trying to walk away, Musk now says the troubled deal is back on and could close by the end of this month. Meanwhile, a merger between TMTG and a blank check company named Digital World Acquisition Corp –– intended to bring in fresh funding for the Trump platform –– has yet to take place. Digital World shares were up more than seven percent to just over $17 in after-market trades in the wake of the Play Store news. Safe haven for conspiracy theorists Excluded from major social networks, Trump has regained only a fraction of his followers on Truth Social. Trump has 4.18 million followers at Truth Social, compared to the 88.8 million he had on Twitter and the 35.4 million he had on Facebook before being booted for encouraging real-world violence such as the deadly attack on the US Capitol. Truth Social has become an online haven for QAnon fans to share conspiracy theories such as prominent members of the Democratic Party being involved with Satanists or paedophiles. (Doug Mills/The New York Times) The appeal carried the unmistakable whiff of desperation. That it was delivered on live television only heightened the dramatic tension. A Utah Republican, Sen. Mike Lee, was publicly begging a fellow Utah Republican, Sen. Mitt Romney, for a simple act of solidarity: an endorsement in his campaign for reelection. One that, in Lee’s telling, could amount to no less than an act of salvation, as he battles for political survival against an unexpectedly fierce challenger, independent candidate Evan McMullin. “Please, get on board,” Lee said, looking into the camera and addressing Romney by name on Tuesday night. “Help me win reelection. Help us do that. You can get your entire family to donate to me.” Sign up for The Morning newsletter from the New York Times But Lee and Romney are not merely fellow Utah Republicans. And this was not just any television show. Lee and Romney were — and evidently remain — antagonists in the lingering drama of Jan. 6, 2021. Lee played a key role in support of President Donald Trump’s attempt to subvert the 2020 election and cling to power. Romney was a stalwart opponent of it. And Lee was making his appeal to Romney on Tuesday night on Tucker Carlson’s Fox News program — a venue in which Romney has been routinely roasted, for years, before audiences of millions of conservative viewers. The irony of the moment seemed lost on both Lee and the show’s host, though that may have been a bit of a shared ruse. Either way, audacity was in abundant supply. Lee’s plea for Romney’s assistance, after all, came after Lee’s votes in opposition to three bipartisan bills that Romney helped to pass, on infrastructure, gun safety and semiconductor manufacturing. Lee denounced the infrastructure bill, for one, as “an orgiastic convulsion of federal spending.” The SOS to his fellow senator also appeared to ignore Lee’s own actions of intraparty sabotage, dating back a dozen years: Lee refused to endorse Romney’s 2018 Senate campaign. He declined in 2012 to endorse the senior senator from Utah, Orrin Hatch, even as his own chief of staff openly predicted Hatch’s defeat. And Lee first won his own seat in 2010 by orchestrating the defeat of a popular Republican senator, Robert Bennett, during the state’s Republican convention. What Lee was not ignoring, however, was a new poll published in Utah’s Deseret News this week showing Lee leading McMullin 41% to 37%, with 12% undecided. Self-described moderates made up a plurality of those undecided voters, as the center of Utah’s political spectrum seems to be agonizing over which candidate to coalesce behind. “We are winning this race, and Mike Lee is panicked,” McMullin said in an interview Wednesday. In fact, McMullin’s task of uniting independents, Democrats and anti-Trump Republicans remains daunting in Utah, a state that gave Trump 58% of the vote in 2020. When McMullin ran for president in 2016 as an independent, he netted 21.5% in his home state. (One of those voters was Lee.) Jason Perry, director of the Hinckley Institute of Politics at the University of Utah, which conducted the poll, stressed that Lee “is still in the driver’s seat,” but, he said, with so many centrist voters still undecided, “this is one still to watch.” The FiveThirtyEight polling average still has Lee up by 7.6%. “Let’s be clear, Mike Lee is leading this race,” said Matt Lusty, an adviser to the Lee campaign. “Every reliable poll shows Sen. Lee with a significant lead, and our internal polling gives us even greater confidence in the strong support he has across the state.” Lee declined to comment. But no contest in the country is as closely tied to the failed efforts to deny President Joe Biden’s victory as the Utah Senate race. And no other race is as squarely centered on the fate of representative democracy. Lee appears particularly spooked by the $3.3 million in campaign contributions — a small portion of that through ActBlue, an online Democratic fundraising tool — that have flowed to McMullin, who has vowed to caucus with neither party if he wins. Lee was exaggerating a little when he told Carlson, “Evan McMullin is raising millions of dollars off of ActBlue, the Democratic donor database, based on this idea that he’s going defeat me and help perpetuate the Democratic majority.” But his fears were clear. Romney, who declined to be interviewed for this article, has explained his decision not to endorse Lee or McMullin by saying “both are good friends.” But the personal divide between him and Lee over the events surrounding the 2020 election remains deep, and is playing a role now, according to Stuart Stevens, a senior official in Romney’s 2012 presidential run who is also an outspoken critic of Trump and his supporters. Romney became the first senator from a president’s party ever to vote to convict him after Trump’s 2020 impeachment trial, when he sided with Democrats to try to throw Trump out of office for abuse of power, for conditioning military aid to Ukraine on President Volodymyr Zelenskyy’s launching an investigation into Biden. Romney again voted to convict Trump in 2021 for inciting the attack on the Capitol. Lee, in contrast, was an active participant in the effort to keep Trump in office. He cheered Trump on for weeks in late 2020, and privately offered in a text to the White House chief of staff, Mark Meadows, “a group of ready and loyal advocates who will go to bat for him.” Lee also endorsed a plan to have legislatures in “a very small handful of states” carried by Biden put forward pro-Trump electors, as part of a scheme to allow Vice President Mike Pence to reject Biden’s victory. Ultimately, Lee backed away from those plans and voted to certify Biden’s election, unlike eight of his Senate colleagues, a point that the Lee campaign stresses. But turning against a plan as it was failing does not exonerate him, McMullin argues. “Sen. Lee, who called himself a constitutional conservative and who swore an oath to the Constitution, betrayed the Constitution in an effort to overturn the will of the people by recruiting fake electors to topple American democracy,” McMullin said in the interview. “It was one of the most egregious betrayals of the American republic in its history.” It is, in some sense, that inconstancy that has gotten Lee in trouble: his willingness to challenge the powers in his own party, then tack back when his base demands it. “Reaping what he sowed is a good way to put it,” quipped Christopher F. Karpowitz, co-director of the Center for the Study of Elections and Democracy at Brigham Young University. Lee led the floor fight to stop Trump’s nomination at the 2016 Republican National Convention, called for Trump to exit the race after the “Access Hollywood” tape surfaced, and voted for McMullin in protest. Then he became one of Trump’s staunchest supporters. “Politics is an ongoing character test, and the people of Utah are going to have to ask themselves if he’s passed,” said Stevens, the former Romney aide. How real a threat McMullin poses to Lee’s reelection remains to be seen. Both sides produce internal polls that serve their purposes, Lee’s showing him with a double-digit lead, McMullin’s showing him barely overtaking the incumbent. It’s entirely possible that Lee’s dire-sounding appearance on Fox News proves a reprise of the pleas that Sen. Lindsey Graham, R-S.C., made toward the end of his 2020 reelection run as he watched his Democratic opponent, Jaime Harrison, rake in a record $57 million for his challenge: All panic aside, Graham ultimately won by more than 10 percentage points. Still, Rep. Adam Kinzinger of Illinois, one of two Republicans serving on the House Jan. 6 Committee, will campaign with McMullin next week in Salt Lake City, trying to rally disaffected Republicans, a crucial bloc after Utah Democrats decided not to field their own candidate. The state’s most important Democrats, Mayor Jenny Wilson of Salt Lake County and former Rep. Ben McAdams are backing McMullin. Though McMullin says the preservation of democracy is the organizing theme of his campaign, he has branched out to tar Lee as “the most ineffective member of the Senate,” contrasting his ideological stands with Romney’s productivity. And, as Lee’s campaign tries to project an air of confidence, his appearance on Carlson’s show projected anything but. Pressing Romney to do the right thing as a Republican, he repeatedly warned Fox viewers that Romney’s mere neutrality could give McMullin — “a closeted Democrat,” as he put it — a victory, and ensure continued Democratic control of the Senate. On Wednesday, Lusty, the Lee campaign adviser, said his boss still hoped that Romney would come around. “Sen. Lee sees it as important for all members of the party to stand together,” he said. But if Lee had truly hoped to change Romney’s mind, there were few avenues likely to be less persuasive than Carlson’s show. As Lee spoke, Romney’s picture was shown with a beret and handlebar mustache crudely superimposed, over the caption “Pierre Delecto Strikes Again” — the nom de plume Romney once got caught using on Twitter. “Mitt Romney has stood up to withering criticism from Trump and others,” said Karpowitz, the BYU professor. “I’m not sure Tucker Carlson is going to move him.” © 2022 The New York Times Company Read More Here

The Bristol police officers were shot while responding to a domestic violence emergency call at a home late Wednesday night, according to Connecticut Gov. Ned Lamont. According to police sources, the gunman made a fake 911 call for a disturbance at his home then carried out an apparent ambush attack on the officers with an AR-15-style rifle. Law enforcement on the scene in Bristol, Conn., in the early hours of Oct. 13, 2022, after two officers were shot and killed during a domestic violence call. WTNH The suspect was shot dead at the scene, police said. The suspect’s brother was also shot and has been hospitalized in unknown condition, according to police. Two police officers were fatally shot and another was seriously injured in an ambush-style shooting in Bristol, Conn., on Thursday, Oct. 13, 2022. WTNH “This is a senseless tragedy, and my prayers are with their families, loved ones, and fellow officers. I also ask the residents of Connecticut to keep in their prayers a third officer who was shot and is currently in the hospital with serious injuries,” the governor said in a statement. “This is a devastating reminder of the dangers that police officers face every day to protect our families and neighbors from all kinds of situations. These officers are heroes.” Lamont ordered flags in Connecticut to be lowered to half-staff. As of Sept. 27, there have been 49 officers killed in the United States this year — which is lower than the record last year (73), but higher than the complete year totals for 2020 and 2019, according to data from the FBI. For more than a week, the Ukrainian mother had heard nothing from her six adopted children stranded in Mariupol, and she was going out of her mind with worry. The kids had spent their vacation at a resort in the port city, as usual. But this time war with Russia had broken out, and her little ones — always terrified of the dark — were abandoned in a besieged city with no light and no hope. All they had now was her oldest son, Timofey, who was still himself just 17. The questions looped endlessly in her head: Should she try to rescue the children herself — and risk being killed, making them orphans yet again? Or should she campaign to get them out from afar — and risk them being killed or falling into the hands of the Russians? She had no idea her dilemma would lead her straight into a battle against Russia, with the highest stakes of her life. ___ Russia’s open effort to adopt Ukrainian children and bring them up as Russian is already well underway, in one of the most explosive issues of the war, an Associated Press investigation shows. Thousands of children have been found in the basements of war-torn cities like Mariupol and at orphanages in the Russian-backed separatist territories of Donbas. They include those whose parents were killed by Russian shelling as well as others in institutions or with foster families, known as “children of the state.” Russia claims that these children don’t have parents or guardians to look after them, or that they can’t be reached. But the AP found that officials have deported Ukrainian children to Russia or Russian-held territories without consent, lied to them that they weren’t wanted by their parents, used them for propaganda, and given them Russian families and citizenship. The investigation is the most extensive to date on the grab of Ukrainian orphans, and the first to follow the process all the way to those already growing up in Russia. The AP drew from dozens of interviews with parents, children and officials in both Ukraine and Russia; emails and letters; Russian documents and Russian state media. Whether or not they have parents, raising the children of war in another country or culture can be a marker of genocide, an attempt to erase the very identity of an enemy nation. Prosecutors say it also can be tied directly to Russian President Vladimir Putin, who has explicitly supported the adoptions. “It’s not something that happens spur of the moment on the battlefield,” said Stephen Rapp, a former U.S. Ambassador-at-Large for War Crimes Issues who is advising Ukraine on prosecutions. “And so your ability to attribute responsibility to the highest level is much greater here.” Even where parents are dead, Rapp said, their children must be sheltered, fostered or adopted in Ukraine rather than deported to Russia. Russian law prohibits the adoption of foreign children. But in May, Putin signed a decree making it easier for Russia to adopt and give citizenship to Ukrainian children without parental care — and harder for Ukraine and surviving relatives to win them back. Russia also has prepared a register of suitable Russian families for Ukrainian children, and pays them for each child who gets citizenship — up to $1,000 for those with disabilities. It holds summer camps for Ukrainian orphans, offers “patriotic education” classes and even runs a hotline to pair Russian families with children from Donbas. “It is absolutely a terrible story,” said Petro Andryushchenko, an adviser to the Mariupol mayor, who claims hundreds of children were taken from that city alone. “We don’t know if our children have an official parent or (stepparents) or something else because they are forcibly disappeared by Russian troops.” Russia portrays its adoption of Ukrainian children as an act of generosity that gives new homes and medical resources to helpless minors. Russian state media shows local officials hugging and kissing them and handing them Russian passports. It’s very hard to pin down the exact number of Ukrainian children deported to Russia — Ukrainian officials claim nearly 8,000. Russia hasn’t given an overall number, but officials regularly announce the arrival of Ukrainian orphans in Russian military planes. In March, Russian children’s rights ombudswoman Maria Lvova-Belova said 1,000 children from Ukraine were in Russia. Over the summer, she said 120 Russian families had applied for guardianship, and more than 130 Ukrainian children had received Russian citizenship. Many more have come since, including a batch of 234 in early October. Lvova-Belova has said these children need Russia’s help to overcome trauma that has left them sleeping badly, crying at night and drawing basements and bomb shelters. She acknowledged that at first, a group of 30 children brought to Russia from the basements of Mariupol defiantly sang the Ukrainian national anthem and shouted, “Glory to Ukraine!” But now, she said, their criticism has been “transformed into a love for Russia,” and she herself has taken one in, a teenager. “Today he received a passport of a citizen of the Russian Federation and does not let go of it!” she posted on Telegram on Sept. 21, along with a photo. “(He) was waiting for this day in our family more than anyone else.” Lvova-Belova has been sanctioned by the United States, Europe, the U.K., Canada and Australia. Her office referred the AP to her reply in a state-owned news agency that Russia was “helping children to preserve their right to live under a peaceful sky and be happy.” In August, a post from a senior official at the Moscow Department of Labor and Social Protection thanking the Russian foster families declared: “Our Children…Now they are ours.” ___ As Lopatkina agonized over what to do, her teenage son’s childhood came to an abrupt end in Mariupol. Suddenly, Timofey had become the father to all his siblings. Three had chronic illnesses or disabilities, and the youngest was just 7. As intense shelling broke the glass around them, they cowered in a basement. When the younger ones were scared, Timofey carried them in his arms. After one airstrike, they moved their beds closer together next to the thickest wall. But no wall could keep out the war. Every day, Timofey awoke at 6 a.m. in the bitter cold and chopped wood for a bonfire to cook food. All he wanted to do was to finish his work and sleep — only to have to wake up and do it again. Calluses built up on his hands. His skin grew thicker in other ways. When airplanes rumbled overhead, he no longer ran for shelter. “When you walk and see brains of people on the road, right on the pavement, nothing matters,” he recalled. He promised his mother he would look after the younger children. But then the power went out, and he lost touch with her completely. A friend who had joined the fighting offered to take him out of Mariupol. He refused. He knew he would never forgive himself if he left his siblings behind. Finally, a local doctor from Mariupol arranged an evacuation to elsewhere in Ukraine. But pro-Russia forces at a checkpoint refused to recognize the children’s documents, photocopies of official papers identifying them and their parents. Timofey’s pleas went nowhere. Instead, the children ended up in a hospital in the Donetsk People’s Republic, or DPR, a separatist Russian-controlled area in Ukraine. Timofey was only months away from turning 18 — the age when he would be drafted into the DPR army against his homeland. “For the DPR, I would never go to fight in my life,” he said. “I understood that I had to get out of there one way or another.” At least, Timofey thought, he could tell his mother he had kept the children safe. He was close to his mother, and they were alike, he and she — both tough survivors who would stick it out to the end no matter what. Or so he thought, until he reached her. “It’s great that they are alive,” she replied. “But we are already abroad.” Timofey was utterly devastated. His parents had fled Ukraine without him. He felt they had thrown him away like garbage, along with five children he hadn’t asked for and couldn’t know how to protect. “Thanks for leaving me,” he wrote back, furious. ___ The children of Mariupol aren’t the first Russia has been accused of stealing from Ukraine. In 2014, after Russia annexed the Crimean Peninsula, more than 80 children from Luhansk were stopped at checkpoints and abducted. Ukraine sued, and the European Court of Human Rights found the children were taken into Russia “without medical support or the necessary paperwork.” The children were returned to Ukraine before a final decision. Kateryna Rashevska, a human rights defender, said she knows of about 30 Ukrainian children from Crimea adopted by Russians under a program known as Train of Hope. Now, she said, some of those children might well be Russian soldiers. Since 2015, the Young Army Cadets national movement has trained youth in Crimea and Russia for potential recruitment into the military. This time around, at least 96 children have been returned to Ukraine since March after negotiations. But Ukrainian officials have tracked down the identities of thousands more in Russia, and the names of many others simply aren’t published. “We cannot ask the Russian Federation to return the children because we don’t know who they should return,” said Rashevska, with the Ukrainian organization Regional Central for Human Rights. Redden-Dorian. Edna was a 1972 graduate of Benton High School and attended the nursing program at Benton Service Center now known as Arkansas Health Center in Benton. She later continued her education and attended the Baptist Hospital Nursing program to become a Registered Nurse.  She served as an R.N. for over 20 years. Edna was a member of First Presbyterian Church in Benton, Arkansas. She was preceded in death by her parents, husband, Marcus Lee White and nephew, Marcus Allen Griffin. Edna is survived by her sister, Judy (Rick) Dorian Elrod and very special friend, Steve Caple. Visitation will be held on Thursday, October 13th from 6:00 p.m. until 8:00 p.m. at Ashby Funeral Home. Jimmy enlisted into the U. S. Navy during the Vietnam War where he proudly served aboard the U. S. S.  Guardfish. While stationed in Philadelphia, Pa., he met, and later married, Celestine McRae, who proceeded him in death on July 16, 2014 and from this union 5 children were born: Jimmy(Charlotte), Kenneth(Mimi),  Angela(Lamont), Daman(Monica) and Trecia. Jimmy graduated from Philander Smith College with a degree in psychology.  For many years, he served in the mental health field until he retired in 2010 from Goodwill Industries of Arkansas.   He was a proud member of Mt. Zion Baptist Church and would later serve as a Deacon until his death. Jimmy later married Linda (Haire) Ingram who proceeded him in death on May 27, 2012. He enjoyed photography, traveling, spending time with his family, cooking, discussing current events, working on cars, getting his hands dirty by tinkering on his lawn and, just like those before him, he loved to fish or sometimes as he called it… “drowning worms “ Jimmy Sr. was a dedicated father, grandfather and great grandfather. He had three (3) brothers: Joel White, Jr. (Sonny), J. C. White and Aaron White; seven (7) sisters: Zola  Standard, Frankie Calvin, Charlene Dawn, Earlene Dawn,  Betty Bush, Djuanna Chambers and Sharon Rule. Randell “Randy” Tipton Brasher, 67, of Benton, Arkansas awakened in the arms of his Savior and Lord October 9, 2022.  He was born on July 8, 1955 in Yoder, Kansas to L.T. Randy loved his Lord with all his heart.  Once he found his way to the Lord, there was no wavering in his commitment to his Redeemer.  He was a member of New Hope Church located in Manvel, Texas.  He participated in a Bible study with a group from New Hope Church via livestream every Wednesday evening, and looked forward to their time together.  One of Randy’s all time favorite activities was to drop by the Starbucks in Bryant, located inside Target, where he visited with the Starbucks ladies and a special friendship developed.  Randy loved his cup of coffee.  With his Bible and coffee in hand, he would drive to Bishop Park, to spend time in prayer and Bible study.  Even on his most difficult days struggling with health issues, Randy would find strength to get out of the house because he knew it would always make for a better day.   Randy at a young age developed a love for music, it later provided him an enduring time of worship and peace, discovering gospel groups and several radio preachers. Before Randy’s limiting health issues, he loved being outdoors going fishing, hunting, or going on a scenic drive on his motorcycle with his friends.  It was often that you could find Randy of his iPad diligently working a puzzle game, in his favorite recliner-reserved just for him.  Randy also loved his food!  Preferably, “Mom’s” cooking.  He would ask her regularly, “What’s for supper?” laying his options and hoping to entice Mom for one of his favorites.  He knew his mother’s heart- she loves to cook for others. Five Things To Watch For At Thursday’s Jan. 6 Hearing  https://digitalarkansasnews.com/five-things-to-watch-for-at-thursdays-jan-6-hearing/ (The Hill) — The House panel investigating last year’s attack on the U.S. Capitol will hold its ninth hearing Thursday, the latest in a series of open forums aimed to demonstrate that former President Donald Trump sought to remain in power illicitly following his 2020 election defeat.  In a break from the past, this week’s hearing is not expected to present any live witnesses. Instead, it will feature fresh evidence and testimony the committee has received in the long gap since its last public meeting, including new records from the Secret Service revealing that Trump was warned of the potential for violence at the Capitol before it erupted.   Here are five things to watch as the hearing unfolds.   What did Trump know — and when?  Through the course of the long investigation, Trump has repeatedly claimed he was unaware of the extent of the violence unfolding at the Capitol until hours after it had begun, when he finally released a video from the White House asking the rioters to go home.  That argument has been disputed by numerous members of his administration, who told investigators that Trump was watching the rampage unfold on television and refused to intervene. Cassidy Hutchinson, a former West Wing aide, had testified previously that Trump knew some of his supporters were armed on Jan. 6, but he urged them to march on the Capitol anyway.   The committee will attempt to build on that narrative on Thursday, when it says it will delve into Trump’s thinking on Jan. 6.   As part of that effort, the committee is expected to air new records from the Secret Service revealing that Trump was aware of the heightened potential for violence but continued to rile his supporters with false claims of a “stolen” election.   The Secret Service, which had had a front-row seat to both the then-president’s actions and the general security threat that day, has been a crucial part of the investigation. But the agency was embroiled in controversy after revelations that many of the text messages sent between front-line agents in the days surrounding Jan. 6 had been deleted.   Since the last hearing, the Secret Service has provided the committee with a massive trove of documents related to the attack — records that are expected to be featured on Thursday.  “We’ve had a huge amount of documents from the Secret Service that we’re going through,” Rep. Zoe Lofgren (D-Calif.), a member of the committee, told CNN on Friday. “And we’ve found some new things that we’ll be able to present.”  A question of momentum  Thursday’s forum marks the first time the nine-member Jan. 6 committee will air its findings in public since July — a nearly three-month pause that’s raised questions about whether it has lost momentum.   Since Congress left Washington for the long August recess, the public’s attention has shifted to a number of other issues, raising pressure on the panel to pick up the narrative thread it left behind in July.   Before the hiatus, investigators had laid out a case that Trump had been told by top officials in his own administration that the election was fairly lost, but had ignored their counsel to amplify false claims of rampant fraud while encouraging thousands of his supporters to march on the Capitol. He then sat silently for hours while a violent mob tried to block Congress from formalizing Joe Biden’s victory.  Lofgren is promising that the panel on Thursday will deliver the goods.   “We hope that this will … help fill in some of the gaps for the public,” she said.  The closing argument challenge  Much of the challenge facing the committee relates to the sheer volume of information it has collected over the course of its marathon probe.   Since its inception 16 months ago, the panel has received millions of documents and heard testimony from more than 1,000 witnesses, creating enormous hurdles as investigators race to crunch the massive trove of data and condense it into an accessible narrative.  The task has been complicated by the fact that the committee has continued to receive new information even as it’s trying to wind down the investigation and produce a final report.   Just last month, investigators secured the long-sought testimony of Virginia Thomas, a conservative “Stop the Steal” activist and the wife of Supreme Court Justice Clarence Thomas. More recently, the Secret Service showered the panel with more than a million new records — a document dump far beyond what the committee had requested.   Lofgren said that a task of that magnitude won’t be completed until the final report emerges, likely in December.   “I think all the loose ends will finally be tied up in the report,” she said.   Can the committee close the gaps?  The hearing serves as an opportunity to further explore threads teased this summer, including explosive allegations relayed by Hutchinson, the former White House aide.  Hutchinson’s account — that Trump lunged at his security detail after being told he could not join his supporters at the Capitol — was recounted to her in the presence of Trump’s lead security officer that day.  The two men involved in the story — Tony Ornato, a former Secret Service agent who took an unprecedented civilian role in the White House, and Bobby Engel — have denied the account through anonymous sources but failed to deliver promised testimony to rebut her.   Since Hutchinson’s testimony, the Secret Service under a subpoena sent the panel more than a million electronic communications.   The hearing also gives the panel a chance to go deeper on a July hearing that was designed to explore the role extremist groups played in the attack.  Many suspected the hearing would be an opportunity for the panel to reveal any damning evidence tying Trump to the extremist groups that stormed the Capitol. But the July hearing left that unexplored, instead using much of its time to review clips of a newly scored interview with former White House counsel Pat Cipollone.  Rep. Jamie Raskin (D-Md.), who walked through the evidence in that hearing, has said he is hopeful Thursday will address what he called loose ends.  “Different members have been focused on different loose ends that might need to be wrapped up and out. So, again, speaking just for myself, I would hope that the hearing would allow us to make some overall synthetic judgments about what took place and why and the culpability of different key actors,” Raskin told reporters in September.  The committee will turn to its report  The committee hasn’t confirmed whether Thursday’s hearing will be its last, but its deadline to complete its work is not a moving target — the panel must issue its final report before it sunsets at the end of the current Congress.  The dwindling time frame creates a daunting task for the panel not only to lay out its recommendations for legislative remedies that could prevent a future insurrection but also to push for their passage.  So far, two of the panel’s members have introduced a bill to reform the Electoral College Act. The bill, already passed by the House, affirms that the vice president’s role in certifying the election results is purely ministerial and ups the number of lawmakers required to object to a state’s results, among other changes. The Senate has passed a separate bill, meaning the differences would need ironing out if the reforms are to become law.   But there are numerous other areas the panel could explore, including changes to the criminal code, perhaps increasing some penalties, or changes to the 25th Amendment, which allows Cabinet members to remove a president.   Committee Chairman Bennie Thompson (D-Miss.) has said the panel will not be formally introducing legislation and will only produce recommendations.  But many Democrats have said they must forge ahead and try to pass Jan. 6-related legislation this year, particularly since House Republicans, who are expected to take control of the House next year, have defended Trump by downplaying the Capitol attack.  “We have two months. What? Is there anything more important than making sure we defend our democracy?” said Rep. David Cicilline (D-R.I.). “We have no option, in my view, other than to act swiftly as soon as those recommendations are reported. We have to get this done before we adjourn.” Read More Here

The panel will reconvene at 1 p.m. on Thursday for what could be its final hearing before it releases a final report on its findings and recommendations to avoid any similar attacks in the future. The hearing will focus on Trump’s “state of mind” leading up to and surrounding Jan. 6, 2021, committee aides told reporters. “What you’re going to see is a synthesis of some evidence we’ve already presented with that new, never-before-seen information to, let’s say, illustrate Donald Trump’s centrality from the time prior to the election,” an aide said. There will be no live witnesses, the aides said, but new witness testimony will be aired, as well as new documentary evidence and video footage showing efforts to respond to the violence. New documents from the Secret Service will also be included in the hearing, aides said. The agency’s been under intense scrutiny over missing text messages from around the time of the insurrection, and after bombshell testimony about an alleged incident inside the presidential SUV on Jan. 6 involving Trump and members of his security detail. “We have received a huge amount of information from the Secret Service. The Select Committee has reviewed much of that. And I imagine going forward there may be additional witnesses the Select Committee wants to hear from related to that, but I don’t have any. I don’t have any more details on that just now,” an aide said. The aides would not say, despite multiple questions on the topic, what efforts had been taken to secure the testimony of Tony Ornato and Bobby Engel — two officials named by former White House aide Cassidy Hutchinson in her testimony about the alleged episode in the presidential SUV after Trump’s rally at the Ellipse. Hutchinson told the committee in live testimony that she heard the account from Ornato, a senior Secret Service official who was at the time White House deputy chief of staff for operations. Hutchinson said Ornato told her Trump was “irate” after being told he couldn’t join his supporters at the Capitol, going so far as to try to grab the steering wheel of the SUV and lunging towards Engel, who was driving. Hutchinson told the committee Engel was in the room as Ornato told the story, and that Ornato motioned toward his clavicles as he was talking about the lunge toward Engel. After Hutchinson’s testimony, the Secret Service said it was cooperating with the House committee and was prepared for agents to provide sworn testimony in response. Ornato has since retired from the agency. It’s been nearly three months since the panel met, and since then members have held closed-door interviews with former Secretary of State Mike Pompeo, former Treasury Secretary Steve Mnuchin and former Transportation Secretary Elaine Chao. Last month, the committee interviewed Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas, over her efforts to push state officials to reject the outcome of the 2020 election. Thomas was also in contact with White House staffers, including Trump’s last chief of staff, Mark Meadows, about efforts to overturn the results. Chair Bennie Thompson, D-Miss., said Thomas told lawmakers she still believes the 2020 election was stolen and answered some questions but didn’t elaborate further on the content of the discussion. It’s not clear if the committee will reveal more from her deposition on Thursday. Her interview was not video-recorded, only transcribed, so the committee could only use quotes from Thomas. As the committee wraps up its investigation, Rep. Adam Schiff, D-Calif., told ABC News what he wants the public to take away from their work. “That Jan. 6 was not a date in isolation,” Schiff said. “It was the violent culmination of multiple lines of effort to overturn the election.” Schiff highlighted the efforts that were also the focus of several hearings this summer, including Trump’s pressure campaigns against state officials, against Vice President Mike Pence and against the Justice Department. “It was only when all those other things failed, that Donald Trump resorted to inciting a mob to attack the Capitol. And so people, I think, need to see Jan. 6 in that broader context, but also realize that the danger to our democracy didn’t end that day because the big lie that led to the violence of that day continues to be propagated by Donald Trump and his enablers,” Schiff said. From the open ocean to tropical rainforests, the abundance of birds, fish, amphibians and reptiles is in freefall, declining on average by more than two-thirds between 1970 and 2018, according to the WWF and Zoological Society of London’s (ZSL) biennial Living Planet Report. Two years ago, the figure stood at 68%, four years ago, it was at 60%. Many scientists believe we are living through the sixth mass extinction – the largest loss of life on Earth since the time of the dinosaurs – and that it is being driven by humans. The report’s 89 authors are urging world leaders to reach an ambitious agreement at the Cop15 biodiversity summit in Canada this December and to slash carbon emissions to limit global heating to below 1.5C this decade to halt the rampant destruction of nature. The Living Planet Index combines global analysis of 32,000 populations of 5,230 animal species to measure changes in the abundance of wildlife across continents and taxa, producing a graph akin to a stock index of life on Earth. Latin America and the Caribbean region – including the Amazon – has seen the steepest decline in average wildlife population size, with a 94% drop in 48 years. Tanya Steele, chief executive at WWF-UK, said: “This report tells us that the worst declines are in the Latin America region, home to the world’s largest rainforest, the Amazon. Deforestation rates there are accelerating, stripping this unique ecosystem not just of trees but of the wildlife that depends on them and of the Amazon’s ability to act as one of our greatest allies in the fight against climate change.” A set of graphs showing the decline in biodiversity since 1970 across the 5 world regions Africa had the second largest fall at 66%, followed by Asia and the Pacific with 55% and North America at 20%. Europe and Central Asia experienced an 18% fall. The total loss is akin to the human population of Europe, the Americas, Africa, Oceania and China disappearing, according to the report. “Despite the science, the catastrophic projections, the impassioned speeches and promises, the burning forests, submerged countries, record temperatures and displaced millions, world leaders continue to sit back and watch our world burn in front of our eyes,” said Steele. “The climate and nature crises, their fates entwined, are not some faraway threat our grandchildren will solve with still-to-be-discovered technology.” She added: “We need our new prime minister to show the UK is serious about helping people, nature and the economy to thrive, by ensuring every promise for our world is kept. The report points out that not all countries have the same starting points with nature decline and that the UK has only 50% of its biodiversity richness compared with historical levels, according to the biodiversity intactness index, making it one of the most nature-depleted countries in the world. Land use change is still the most important driver of biodiversity loss across the planet, according to the report. Mike Barrett, executive director of science and conservation at WWF-UK, said: “At a global level, primarily the declines we are seeing are driven by the loss and fragmentation of habitat driven by the global agricultural system and its expansion into intact habitat converting it to produce food.” The researchers underscore the increased difficulty animals are having moving through terrestrial landscapes as they are blocked by infrastructure and farmland. Only 37% of rivers longer than 1,000km (600 miles) remain free-flowing along their entire length, while just 10% of the world’s protected areas on land are connected. Future declines are not inevitable, say the authors, who pinpoint the Himalayas, south-east Asia, the east coast of Australia, the Albertine Rift and Eastern Arc mountains in eastern Africa, and the Amazon basin among priority areas. The IUCN is also developing a standard to measure the conservation potential of an animal, known as its green status, which will allow researchers to plot a path to recovery for some of the one million species threatened with extinction on Earth. When Brooks Ward, his go-to target this season for the Rockets (6-0, 5-0 6A-West), is making toe-tap catches for touchdowns, his confidence in their partnership grows that much more. “Sometimes he surprises me. … But I kind of expect him [to make that kind of play], and if he doesn’t make the catch, then just come back at him. Keep throwing at him,” Sanders said. The duo has led overall-No. 8 Catholic to its first 6-0 start in their lifetimes, something they could feel coming all along. “We try to not make it surprising to us, because we wanted this to happen and we prepared for it to happen,” Sanders said. “But I think the fan base and all the alumni, they really like it and it’s really surprising to them.” “We put in a lot of work in the offseason,” Ward said. “I thought this team could be special. And we’ve shown it so far this season.” Sanders has combined with Ward on 24 passes for 573 yards and 7 TDs, putting Ward 19th in the state in receiving yards. Sanders, a senior, has known of Ward, a junior, since the pair were playing for separate parochial schools in the Little Rock area. Ward consistently played up a year due to his talent level — something Sanders recognized right away. “He was always a baller,” he said. Sanders served on last season’s team as a primary backup for the since-graduated Preston Scott. The vast majority of his time on the field came as a free safety for Catholic’s defense — something Coach John Fogleman says has been instrumental in his development. “I think the thing that’s helped him [most is] he played free safety last year,” Fogelman said. “He understands the game. He’s played football. He hadn’t just trained to be a quarterback. He understands not just the position of quarterback, but he understands the game of football. And so his experience coming into this year has helped a lot. We knew he’d have great leadership. We knew he’d be competitive. But he’s been very efficient.” Sanders is 27th in passing yards with 1,017 to go along with 10 passing touchdowns. The Sanders-Ward connection is built on a foundation of trust. The 6-2 Ward is taller than most defensive backs he matches up against, and the duo has used it to their advantage on multiple occasions. “I’m placing it to where only he can catch it, nowhere near the other team,” Sanders said, “So if I overthrow him, fine. It’s better than [an] interception. But sometimes he’ll just make an incredible play.” “If he’s in trouble, he can just throw it up, and he believes in me to go get it,” Ward said. Catholic doesn’t put up the number of passing attempts other Class 6A schools do. With Sanders averaging 18.5 per game, the Rockets lean on a balanced run game — led by Sanders himself. “We weren’t a very good running team last year. And he has added to our ability to run the ball,” Fogleman said. Sanders has rushed for 311 yards and 10 touchdowns on 64 carries. Junior running back Dominic Keeton has rushed for 436 yards and 2 touchdowns on 110 carries. “I think we run the ball about 60% of the time, which is a good thing. I like that,” Sanders said. Along with a new quarterback, has come one other significant change with Catholic moving from Class 7A to the new 6A-East. It’s been a fresh start for a program that has had one winning season in its last 10. “We were excited about the change and everything, but we also understand there’s a lot of depth on our side,” Fogleman said. “When you’re in a 10-team conference that makes it pretty tough, and then there’s a bunch of newness that you don’t know your opponents, that you’re unfamiliar with.” While the number in the win column is different this October compared to most recently, Fogleman said not much has changed around the program. One difference he has noticed, however, has Catholic in unfamiliar territory. “We’ve always had good, hard-working kids,” He said. “[The difference now is] you’re not having to convince people so much, that they can. I think they actually believe [and] obviously, that’s a big deal. Now, the shoes on the other foot. You gotta convince them that instead of being the hunter, you’re the hunted. FBI agents have explained to jurors hundreds of encrypted text messages. Older white men have testified about their attraction to the far-right Oath Keepers during the summer of 2020 as racial justice protests swept the nation and violence erupted on the streets of several cities. And on Wednesday, Terry Cummings, who traveled from Florida for the Jan. 6, 2021, rally, introduced the orange ammunition case and the AR-15 rifle he brought, as jurors craned their necks to get a closer look. Every trial operates on its own rhythms, with a mix of personalities that seem both peculiar and familiar. Here’s a glimpse at what it’s like inside the room. Stewart Rhodes can’t stop talking On any given day inside the wood-paneled courtroom, down the block from the Capitol, a screen might be displaying the words of Oath Keepers founder Stewart Rhodes. Rhodes is a prolific texter who once belonged to more than 100 chat groups. What’s unusual is that Rhodes, the most prominent defendant in the case, with a distinctive black eye patch, is continuing to speak outside the courtroom, too. This week, while the trial was on break for a federal holiday, and while in federal custody, Rhodes gave a telephone interview to InfoWars, a website known for peddling conspiracy theories, likening himself to a martyr. “But just like Nelson Mandela was willing to go to jail for life, he did 20 years, you have to be willing to do that,” Rhodes said, comparing himself to the anti-apartheid leader who spent nearly three decades in prison. “You have to be willing to take the hit if you’re a person who’s a freedom fighter and is standing up for rights. Because if you don’t, then what you become is a slave.” Lee Bright, an attorney for Rhodes, told NPR of his client Wednesday, “We kindly asked him to stop” doing interviews while the case continues. Rhodes, a graduate of the Yale Law School who was later disbarred, has promised to take the witness stand later in this trial. Anything he says outside of court could wind up coming back to punch him on cross-examination. The InfoWars remarks add to a feet-long stack of texts and transcripts the prosecutors already have amassed. A spokesman for the Justice Department declined comment on Rhodes’ communication style. The defense operates on its own clock In opening statements, lawyers for Rhodes and the four other defendants signaled they would strive to present jurors with a complete record. For every text the Justice Department introduces, they’ll push for several more in a string. For every video snippet the prosecutors play, the defense will press for jurors to hear the full recording. Their argument is that the DOJ is mischaracterizing the goals of the Oath Keepers to inflame and anger the jury, which deserves a complete picture of events. But that strategy risks testing the patience of Judge Amit Mehta and members of the nine-man, seven-woman jury. It’s already led to repeated and sometimes lengthy arguments at the bench or over the phones, while the jury and audience hear the loud courtroom hushing device. Judge Mehta told lawyers in an unrelated case this week that he expects the Oath Keepers trial to extend into the first or second week in November, on the far end of an estimate he gave the jury pool. Prosecutors had planned to call about 40 witnesses over 3 1/2 weeks. They’re not quite through week two, and on witness No. 10. Hints about Trump and his inner circle This seditious conspiracy case against Oath Keepers is one of the two most serious the Justice Department has brought following the siege on the Capitol. Inside the same courthouse, prosecutors continue their work in secret, before grand juries that appear to be investigating the money and organization behind the Jan. 6 rally, as well as a scheme to replace slates of legitimate electors in swing states with fake electors. What else federal prosecutors may have gathered, and about whom, sometimes surfaces briefly in the Rhodes trial before it sinks back into the water. Last week, John Zimmerman, who affiliated with the Oath Keepers chapter in North Carolina, told the jury that Rhodes claimed he was in touch with someone at the Secret Service in 2020, as they prepared to provide backup support for a Trump campaign rally in Fayetteville, N.C. Zimmerman, who said he only heard Rhodes’ end of the phone call, testified that Rhodes asked the Secret Service agent about what sorts of weapons might be allowed near the site. Prosecutors didn’t dwell on the issue, but it piqued interest given questions about Donald Trump’s dealings with the Secret Service on the day of the Capitol attack and missing text messages from agents during that time. This week came another glimpse at what Rhodes may have been doing outside the Oath Keepers network. On Dec. 30, 2020, only days before the Capitol siege, Rhodes texted members of the “DC Op: Jan 6 21” chat group: “I have been so busy on back channel working groups trying to advise the President.” The prosecutor didn’t ask more questions about which working groups or who the members might be. But DOJ has told the jury that one of the chat groups Rhodes frequented was called “F.O.S.” — for friends of Trump ally Roger Stone. Bombast vs. sedition In the weeks after news organizations called the 2020 election for Joe Biden, Rhodes and other Oath Keepers invoked angry and increasingly apocalyptic rhetoric. That December, Rhodes delivered a speech at a rally urging Trump to use the Insurrection Act to enlist private militia groups like the Oath Keepers. “If he does not do it now, while he is commander in chief, we are going to have to do it ourselves later, in a much more desperate, much more bloody war,” he said. Days after the Capitol riot, Rhodes allegedly said, “My only regret is that they should have brought rifles.” Lawyers for Rhodes call that language bombast and bravado and they say the government is stretching when it alleges a formal conspiracy to overthrow the 2020 election. The defense teams have used cross examination to highlight the lack of explicit text messages or recorded conversations among the defendants that outline a plot to burst through the doors of the Capitol and stop the electoral count. “Was there ever any mention of an insurrection?” asked defense lawyer Brad Geyer. “Was there ever any mention of attacking the Capitol?” Read More Here

According to Google, the app will soon be made accessible in the Play Store by Trump Media & Technology Group (TMTG), which runs Truth Social. In a statement, TMTG’s Chief Executive Officer Devin Nunes stated, ‘It’s been a pleasure working with Google, and we’re delighted they helped us to finally deliver Truth Social to all Americans, regardless of what device they use’. Previously unavailable in the Play Store owing to insufficient content filtering, according to a Google representative in August, Truth Social was released in the United States on the Apple App Store in February. Infractions of Google’s Play Store guidelines, which forbid materials like physical threats and incitement to violence, have raised issues with Truth Social. Most smartphone users lack a simple option to download Truth Social outside the Google and Apple shops. The primary resource for Android app downloads in the US is Google’s Play Store. Android users may download programmes straight from websites or through competing app stores, albeit the latter sometimes necessitates additional procedures and security approvals. Even after Google barred Truth Social from the Play Store, it was still accessible through those channels. About 40% of American consumers use Android smartphones. Following the Jan. 6, 2021 U.S. Capitol riots, when Trump was accused of posting comments encouraging violence, Twitter Inc (TWTR.N), Facebook (META.O), and Alphabet Inc (GOOGL.OYouTube )’s banned him. More than a year later, Truth Social reinstated Trump’s social media presence. Immigration rights advocates held a press call including Democratic Sens. Dick Durbin of Illinois and Robert Menendez of New Jersey to stress the need for legislative action, following a recent 5th Circuit Court of Appeals ruling that upheld a lower court decision in the Southern District of Texas. That decision determined the Obama-era Deferred Action for Childhood Arrivals program to be unlawful—though current recipients are not yet affected—and blocked the government from accepting new applications. “The writing is on the wall,” Greisa Martinez, who leads United We Dream Action, the largest youth immigration advocacy group, said. Martinez, who is a DACA recipient herself, told Durbin and Menendez that Congress needs to move quickly, because “we are closer than we have ever been to the possible end of DACA.” Created a decade ago DACA was created a decade ago to provide temporary relief for children who were brought into the country unlawfully, allowing them to obtain drivers licenses and work permits and protecting them from deportation. Durbin, who chairs the U.S. Senate Judiciary Committee, said Congress realistically will not be able to pass any DACA legislation before the midterm elections. Republicans will not want to vote for immigration reform during their reelection campaigns, he said. “The Republican election strategy is to attack immigration,” he said. “We will do everything in our power to get the 10 Republican votes to make this a reality, either at the end of this year into this session, or with a better majority in the next session.” Durbin stressed that Americans need to get out to the polls in November to “step up and vote for those who are willing to enter into an honest dialogue about immigration.” Democrats are projected to lose the House, but could possibly pick up a couple seats in the Senate. Although Democrats control the White House and Congress, an evenly divided Senate has meant that any immigration reform has languished. Durbin said Senate Democrats do not have the 10 votes needed to meet the 60-vote threshold to overcome a filibuster, and have tried to pass legislation protecting Dreamers at least five times. “We fell short,” he said. “And that’s where we stand today.” Durbin added that four or five Republicans would be willing to vote on DACA-related immigration reform, but did not name those senators. Hope for narrow legislation Menendez, who also chairs the Senate Foreign Relations Committee, said he remained confident that Democrats could pass a narrow piece of immigration legislation by the end of the year that would provide a pathway to citizenship for the more than 600,000 undocumented people in the program. “If we could just center on the question of Dreamers and DACA in and of itself, I think a … legitimate issue can be resolved,” he said. Menendez noted that in the past, when it comes to trying to pass immigration policy, Republicans have tried to attach “onerous” conditions such as tighter restrictions on asylum. “I’m not personally willing to give away the fundamental rights that America has had on the question of asylum in a way that basically guts asylum,” he said. Menendez added that Democrats would also like to see the Biden administration prioritize immigration. He said that he would like to see the White House allow those undocumented people who could not apply to DACA, due to a pause ordered by the Texas court, to instead apply under Temporary Protected Status and Deferred Enforced Departure. TPS is granted to those who are already residing in the U.S., but whose home country is deemed unsafe for return, and allows those recipients to stay in the U.S. temporarily. DED is not a specific immigration status, but allows those covered to be exempt from deportation for a certain period of time. Texas U.S. District Judge Andrew Hanen prevented the government from accepting new DACA applications, but has allowed the program to remain for current participants. He ruled in July 2021 that because DACA was not subject to public comment or notice, it violated the Administrative Procedure Act. A three-judge panel from the 5th Circuit Court of Appeals, headquartered in New Orleans agreed with Hanen, a President Donald Trump appointee, but asked the Texas judge to look at the new version of a rule on the program issued by the Biden administration in August, which is set to take effect Oct. 31. Rendon/The Daily Beast/Getty Florida Gov. Ron DeSantis recently created a national uproar when he flew 50 Venezuelan undocumented immigrants and asylum seekers to Martha’s Vineyard. DeSantis’ plan sought to expose the supposed hypocrisy of Democrats who say they welcome immigrants, but subsequently panic when the immigrants arrive in their communities. His flight follows similar actions by Republican Govs. Greg Abbott of Texas and Doug Ducey of Arizona, who have sent busloads of migrants to liberal cities, hoping to provoke fierce reactions. Regardless of the effect of the flight to Martha’s Vineyard, it exposed an underlying chaos that has paralyzed the immigration debate. And it is a chaos that can be fixed using the same tools we’ve utilized in the past. This Isn’t the First Time White Racists Have Sent Migrants North on Buses (Though Using Planes Is New) Border chaos has become a central focus of the immigration debate in the United States, in no small part thanks to Donald Trump’s entrance on to the political scene in 2015. At his rallies, Trump led his supporters in chants of “Build the Wall,” arguing a physical barricade was a solution to chaos and criminality along the border. Although Trump ran on building the wall to reduce the chaos, his main immigration achievement was reducing legal immigration, even before the COVID-19 pandemic hit and his administration shut the system down. Ironically, reducing legal immigration just laid the groundwork for more future illegal immigration. While illegal immigrants have a much lower crime rate than native-born Americans, and border communities are generally safer than other parts of the United States, border chaos is not, itself, exaggerated. In fact, it’s terrifying. Obviously, people cross the border illegally because they can’t enter legally. The vast majority of migrants want to work in the U.S. where wages far exceed those in their home countries, and the number of job openings is currently near a record high. But Congress has not issued a sufficient number of visas (for enough types of migrant workers) that would allow them to enter legally and work, even on a temporary basis. U.S. firms and consumers demand immigrant labor, but the legal immigration system doesn’t allow them to hire legally. The predictable results are large numbers of illegal border crossers—and the subsequent chaos. Border chaos doesn’t just increase American concerns about undocumented immigrants, it also spills over into opposition to legal immigration. Most people respond to chaos by supporting harsher enforcement and cracking down on legal pathways. But this is a counterproductive reaction that boosts chaos. The way to get the border under control is with more visas, as fewer visas will only continue to make things worse. The U.S. has dealt with this problem before, and solved it by issuing more visas. In the 1950s, there were about 2 million unauthorized and undocumented Mexican workers in the U.S., and the government responded with some more vigorous enforcement, but mainly increased the number of so-called Bracero guest worker visas available to Mexican workers. This satisfied the labor demand on the employer side. Historian Ernesto Galarza wrote in his book, Merchants of Labor: The Mexican Bracero Story, “[t]he most skeptical of farm employers could see that the private black market was no longer vital, now that a public one could be created at will.” Who Is Perla? NYT Identifies Woman Behind Martha’s Vineyard Migrant Flights Within a few years, the population of illegal immigrants dropped by 90 percent, and border crossings fell by an even higher percentage. At the time, a U.S. Border Patrol official warned that if the Bracero visa program was ever “repealed or a restriction placed on the number of braceros allowed to enter the United States, we can look forward to a large increase in the number of illegal alien entrants into the United States.” That is exactly what happened after Bracero was canceled in 1964. The U.S. government tried the strategy later with some success. From 2000–2018, a 1 percent increase in the number of H-2 temporary low-skilled work visas for Mexicans was associated with a 1.04 percent decline, on average, in the number of Mexicans apprehended. The U.S. government should increase the number of visas again and streamline the process for Mexicans, Central Americans, Venezuelans, Cubans, and others attempting to cross the border in large numbers. What Liberals Don’t Want to Admit About Influxes of Migrants Border enforcement played an important role in both the 1950s and during the 2000-2018 period, but mainly by channeling would-be undocumented immigrants onto legal visas. The government can’t regulate an illegal market of unauthorized border crossers, it can only regulate a legal market. More visas are the vital component to making the market legal, regulated, and orderly. Fortunately, there are many proposals to do this—some even coming from Republicans in Congress. Sen. Ron Johnson and Rep. John Curtis have introduced bills that would increase visas for temporary migrant workers and let them be managed by the states. The Farm Workforce Modernization Act would also liberalize migration for farm workers. These are important first steps, but the Biden administration can also do more to deregulate and streamline existing H-2 visas. DeSantis’ flight of migrants to Martha’s Vineyard exposed, again, that chaos dominates the debate over immigration in the United States. Yes, chaos is terrifying and needs to be replaced by order. But immigration restrictions make it impossible to impose that order through expanding and creating legal migration pathways. This immigration catch-22 creates a negative feedback loop that must be broken for there to be a policy solution.
