She said she will decide within a week whether the firm should be booted from representing plaintiffs in the case. Monday’s hearing came more than a month after a website called Crypto Leaks released recordings of firm co-founder Kyle Roche discussing a tight relationship with Ava Labs, a blockchain developer. Roche has denied allegations that his firm has used litigation to target Ava Labs competitors. The recordings also showed Roche making disparaging remarks about class members in general and jurors. After the leak, defendants and Roche Freedman’s co-lead counsel—the law firms Selendy Gay Elsberg and Schneider Wallace—filed motions for the firm’s removal from the case. A different plaintiffs firm also urged Failla to reconsider its 2020 appointment of lead counsel in the matter. During the hearing, Roche Freedman name partner Devin Freedman acknowledged that Roche’s comments were “stupid,” but he argued there’s no evidence to support a charge that the firm brought a lawsuit to help Ava Labs. He claimed that the leaks were orchestrated by a defendant, which he did not name, in a separate action and that the firm should remain counsel because it has the most expertise on the underlying issues. Freedman said he and Roche began working on the lawsuit before Ava Labs was even in existence. To protect against the appearance of impropriety, Roche has been kicked off the firm’s class action practice and “walled off” from all existing class action cases, Freedman said. Lawyers for Bitfinex and Tether argued that the steps weren’t enough, claiming the videos raised serious concerns about whether the firm has abused the discovery process. Selendy Gay Elsberg and Schneider Wallace also requested the firm be removed from the matter, claiming it would eliminate a “distraction” created by the recordings. The firms, however, said they would have no issue working with Roche Freedman if the boutique remained on the case. Expats of the prominent litigation firm Boies Schiller started Roche Freedman in 2019 and it now has 25 lawyers in New York, Miami and Boston. The firm, among the most active in the crypto class action space, has filed more than a dozen lawsuits against crypto exchanges and token issuers on behalf of investors and has earned lead counsel status in many of them. The lawsuit against Bitfinex and Tether alleges they were part of a scheme to manipulate the cryptocurrency market and defraud investors. Some of the claims survived a motion to dismiss in 2021. Named plaintiffs in the Bitfinex/Tether action submitted declarations in September saying they wanted to continue to be represented by Roche Freedman.

That is a 38 percent increase in spending over the previous year of 2020, she said. “We all know 2020 was a very difficult year for our industry.” “We all know things are costing more,” Medlin said, but the numbers in this year’s report were very rewarding “and we’re going in the right direction very positively. We still have some issues for full recovery.” More than $26 million was spent on lodging while more than $39 million was spent on food and beverage. (Medlin will present a similar report to Roanoke Rapids City Council Tuesday evening at 5:30. Council meets at the Lloyd Andrews City Meeting Hall on Jackson Street) Looking further into the report, more than $10 million was spent on recreation while over $8 million was spent on retail. She said $18 million was spent on transportation. Travel and tourism in the county employs more than 700 people and more than 1,000 indirectly. “These jobs are getting to be better paying jobs as time goes on,” Medlin told the board. The total payroll in the tourism industry last year was $26.2 million. The state tax dollars generated by tourism spending was $5.4 million in the form of state sales and excise taxes as well as taxes on personal and corporate income. She said the spending generated $4 million in local taxes through sales and property tax revenues. “That helps us all locally,” and saves each taxpayer $194.81. “Hopefully next year we’ll get over $200.” Marketing is what helps feed travel and tourism in the county, Medlin told the board. “Our number one job is to spend the dollars that are left in our hotels” through an occupancy tax. “That is our total funding source other than grant funding. No local tax dollars are used in our efforts. We are very proud of that.” Those marketing efforts include PR pieces in magazines such as Our State. The bureau’s print publications reach 10,540,800 combined readers including state hunting and fishing guides and the regulation guide for hunting fishing.  Social media also plays a role in the HCVB’s marketing efforts, Medlin said. Instagram, Facebook and Twitter are the primary ways the bureau spreads the message with a total impression rate of 1,246,575; an engagement rate of 75,117; and video views of 54,228.  Billboard campaigns reached over 127 million impressions last year. The tourism board believes the agency should be building partnerships and projects, which it is doing through the Weldon riverfront project as well as continued support of the Underground Railroad project. “We’re here to help our community grow through the impact of tourism,” Medlin said. “We’ve been able to work with Weldon on their wayfinding program.” The bureau works with county economic development. “We appreciate that partnership and we’re excited about the future.” The HCVB is working with other partners on the 250th anniversary of the signing of the Halifax Resolves along with the nation’s anniversary.  The bureau is funding a new blacksmith shop as well as an outside kitchen for the Bradford Denton House in preparation for the 250th anniversary celebrations. They are creating new wayfinding for the town of Halifax as well as rebranding effort for the entire county. “The plans are unbelievable. A lot of people keep coming forward with great ideas. The Historic Site is really engaged and really excited.”

Both grades of crude have lost more than a quarter of their value since their peaks in June, lowering the price of gasoline and taking some pressure off stubbornly high inflation. Analysts said the Saudis appeared determined to bring oil prices up to about $90 a barrel. The spike in oil prices triggered a rally in the stock market, as shares of energy companies surged. Marathon Oil rose 10.6 percent, making it the best performer in the S&P 500, while Devon Energy rallied 8.7 percent and ConocoPhillips and Hess rose more than 7 percent. The broader S&P 500 gained 2.6 percent. The OPEC Plus cuts of perhaps up to one million barrels a day, or roughly 1 percent of the global supply, would reverse a series of increases that had put downward pressure on prices alongside slowing economic growth that has led to lower forecasts for oil demand. A report released Monday by the International Energy Agency also predicted that global demand for natural gas would be weaker than previously expected. The drop would continue to be most pronounced in Europe, where high prices since Russia’s invasion of Ukraine have led to drops in consumption and raised fears about energy security. Since the group slashed oil production in early 2020 when demand collapsed because of the coronavirus pandemic, the producers have announced a series of steady monthly increases, though they have generally not met those goals. Analysts say that the Saudis appear determined to bring oil prices up to about $90 a barrel. Oil prices, about $85 a barrel on Friday for Brent crude, the international benchmark, have fallen by roughly a quarter since their June high. Oil prices in Europe and the United States rose 4 percent on Monday. “We certainly see a significant chance that the producer group will opt for a substantial cut to try to signal that there is indeed an effective circuit breaker in the market,” Helima Croft, head of commodity strategy at RBC Capital Markets, an investment bank, said last week. Ms. Croft estimated that the group was considering announcing a cut of 500,000 to one million barrels a day, roughly 1 percent of the global supply. The person familiar with the thinking of Saudi Arabia also said a cut of that size seemed likely. In his view, he said, the oil market is oversupplied and demand is weakening because of a flagging world economy. The Saudis signaled a hawkish posture last month with a largely symbolic cut of 100,000 barrels a day. Now, analysts say, they may think it is time to make a stronger statement. A sizable cut by Saudi Arabia would appear to be an act of defiance of the Biden administration, which has pushed the Saudis and other OPEC members to supply enough oil to keep a lid on prices. President Biden visited the Kingdom in July despite his disapproval of the 2018 murder of the Saudi dissident Jamal Khashoggi by Saudi operatives. OPEC Plus appears to be trying to intervene in a market that is difficult to read. Much of the recent fall in prices may be the result of worries about factors like rising interest rates by central banks around the world rather than oil market fundamentals. In addition, how the world economy will perform in the coming months is far from clear. Still, a cut in oil supplies by OPEC Plus that raises oil prices could increase the likelihood of a global downturn. While prices may be under pressure, oil inventories — the volumes in tank farms — are at low levels, meaning that the market could turn around quickly. A major unknown is the future output of Russia, the co-chair of OPEC Plus. Russian oil production has held up better than many analysts expected under sanctions imposed by the West over the war in Ukraine. But Russian production may fall more when the European Union tightens sanctions on Russia later this year. Just what OPEC Plus means by a cut may also be far from clear. The group has already been missing its targets by a proverbial mile. In August, for instance, Russia came up short a million barrels of its daily quota of 11 million barrels, according to the International Energy Agency, a Paris-based group. To be taken seriously by the markets, a cut will probably need to detail a substantial reduction by Saudi Arabia, the largest producer in the group. Also uncertain is Russia’s status in the organization. The Saudis appear to want to keep Russia, one of the world’s largest oil and natural gas producers, as a key member of the group, even though sanctions will likely make it difficult for Moscow to meet anything close to current production targets. Moscow’s oil and gas industry also appears headed for almost certain medium-term decline because Western companies will no longer supply it with technology. The Saudis appear to be betting that despite these negatives, Russia will remain a key player in energy markets. The Saudis are also trying to make sure that OPEC Plus continues. The oil agreement on production management that binds OPEC Plus together expires at the end of the year. The Saudis want the market management arrangements to continue, but detailed discussion will probably be required on extending the deal. The need to hold such talks soon may be a key reason the group decided to convene in Vienna on Wednesday, its first in-person meeting since the start of the pandemic. Nord Stream AG, the company that manages the pipeline, told the agency that “a stable pressure now appears to have been achieved on the two Nord Stream 1 pipelines,” meaning that gas is no longer flowing out of them, the agency said in a statement on Twitter. Several news outlets reported that the company said that pressure from water entering the ruptured pipelines had stopped the gas from leaking, but the claim could not be independently verified. The two major lines — which were built to deliver natural gas from Russia to Germany — ruptured in three separate places last week after explosions under the Baltic Sea. Although the official cause has not been identified, political leaders in Europe and the United States have suggested that the incident was an act of sabotage, as much of the speculation about responsibility has focused on Russia, whose state-controlled energy company, Gazprom, is the main owner of the pipelines. A spokesman for President Vladimir V. Putin of Russia, Dmitri S. Peskov, dismissed the notion of Russian sabotage as “stupid” and suggested that the United States was behind the attacks. Neither pipeline was actively transporting gas at the time, but they still contained methane, the main component of natural gas. The leaking gas produced a half-mile wide stream of bubbles near Denmark and Sweden, raising questions about the incident’s environmental impact. Though methane partly dissolves in water and is not toxic, it is a greenhouse gas. The pipelines have featured in the conflict over Russia’s invasion of Ukraine for months. The German government shelved the Nord Stream 2 project in February, just as Russia began to invade Ukraine. And Nord Stream 1 appears to be part of a larger Russian strategy of leveraging energy against Europe as punishment for opposing the war. But as Amazon figures out how to best offer “ambient intelligence” — products where computers and interfaces driven by screens fade into the background in favor of proactive information and natural, voice-driven interactions — filling every possible niche with its Alexa voice assistant might seem like a valid solution. This year, Amazon framed its products around reducing distractions and limiting screen time, but its most interesting announcement might be how it’s now subtly positioning itself against the current industry obsession with mixed reality and the metaverse. What is “ambient intelligence?” The fifth-generation Echo Dot is a smart speaker that doubles as a Wi-Fi extender.Amazon Ambient computing, or “ambient intelligence” as Amazon specifically refers to the thinking behind its products, is about making the computer “disappear.” That can happen in different ways, but Amazon has identified three main descriptors for its own “ambiently intelligent” devices. They’re intuitive, proactive, and personalized. The thinking goes: Technology should be intuitive to use or figure out how to use. It should be proactive about what information it shares with you and take action on its own so you can limit your time using it. And technology should be personalized, knowing what it needs to know about you to be useful, and fitting into your life in a way that makes sense to you. Talking to Alexa through an Echo speaker is frequently as simple as asking a question. Features like “Alexa Hunches” let you proactively know the state of your various smart home devices, and can even take action on them — turning them off or changing their settings — without you having to ask. At Amazon’s event, Dave Limp, the company’s senior vice president of devices and services shared that 90 percent of Alexa routines (programmable collections of actions for smart home devices) are initiated without a customer saying anything. That impressive statistic requires some setup on the part of the user, but it suggests that Amazon’s vision for a future with even less direct interactions with technology is feasible — if not already here for some people. That’s very different from the vision of a company like Meta, which imagines a less obtrusive computing future enabled by augmented reality, but is committing to a virtual reality present that involves wearing $1,000 displays on your face to go to work, hang out with friends, and have fun. The Meta Quest Pro headset could end up being totally impressive, but I can’t say spending all day inside one sounds more appealing than a world where my interactions with screens are limited by default. As Limp pointedly commented in his closing remarks at the Amazon event, “the real world matters to customers.” Amazon’s products are an attempt to keep people planted here in the real world, solving things “behind the scenes” rather than dragging them into another screen. Digital well-being features aside, most other companies are looking in a very different direction. All eyes on the next internet The Echo Show 15 can recognize who’s in front of it and show them relevant information.Amazon Meta is not alone in toying with VR, AR, and a future mobile internet that could connect them all. Google has made it clear that it’s going to try and make AR glasses again, plenty of also-ran corporations have their own ideas about the metaverse, and Apple has all but announced intentions to make AR and VR products for years with signs pointing to a possible January release of its own mixed reality headset. These plans only help to make Amazon’s case stronger. But what’s not on the surface of Amazon’s pitch, but implicit in all of its new products, is what’s required to make “ambient intelligence” work: a lot of cameras, a lot of microphones, and a pervasive internet connection throughout your home. Adding Eero mesh network extending capabilities to Echo Dot smart speakers is a clever way to make building out your smart home easier, and makes putting an Echo in every room that much more enticing. Easier networking was a mini theme of the event; Amazon also announced new Eero PoE 6 routers which can be powered over Ethernet and placed anywhere you can run cable. Back on the always-on microphone side of things, both the Fire TV Cube and Fire TV Omni QLED Series TVs make having Alexa to control your media center that much better. “[Amazon’s] vision of technology requires you to have a fundamentally different relationship with the tech in your life…” Amazon has privacy in mind for all of its new products, from simple things like shutters for cameras on its Echo Show smart displays to end-to-end encryption for the systems actually processing all the video and audio the company captures (Amazon also does on-device processing). But it doesn’t change the fact that the company’s vision of technology requires you to have a fundamentally different relationship with the tech in your life, one where you’re constantly observed rather than interacting with your computer or phone when you please. Not to say any of these metaverse ideas will require less surveillance, but at least for now, you can take the headset off. Increasingly, two visions around the future of how we’ll interact with technology and each other are coming into view: one involves bringing ourselves even closer to the screens we already have and the other consists of stuffing so much proactive technology into the world around us that we never really have to interact with computers directly. It’s hard to say whether one will be better than the other or whether either will even come to fruition, but it seems like Amazon now knows there could be value in styling itself as an alternative to the metaverse hype.

Week 8 in Utah County prep football was again filled with sparkling individual performances along with a stellar come-from-behind victory in a contest between two northern Utah County Region 4 rivals. Football expert Brian E. Preece takes a look back at the superlatives from last week’s action: Game of the Week: Look no further than Skyridge’s 31-30 win over rival Lone Peak in a game that lived up to the hype. Trailing 16-3 at halftime and 30-10 at the start of the final stanza, Skyridge scored the last 21 points to stun the Knights and their home faithful. Smith Snowden ignited the comeback with a 96-yard kickoff return for a touchdown and then Tate Walker crossed the goal line two more times. It was then up to Ian Keeslar to kick the winning PAT and he split the uprights. Special Team Superlatives: Besides the kickoff return there were other big-time special team plays. Lone Peak’s Ian Sanchez kicked field goals of 31, 54 and 56 yards, the last one being on the final play of the half that gave Lone Peak a 16-3 halftime lead. His namesake Ian Keeslar of Skyridge also nailed a 33-yard field goal and was 4-for-4 on his extra points. Timpanogos’ Luke Livingston had a 55-yard punt return for a touchdown as the Timberwolves crushed Hillcrest 51-14. Reid Harris added a 38-yard field goal to add to the Timberwolf scoring barrage. Spreading the Fun: Seven different Springville players scored touchdowns as the Red Devils routed Maple Mountain 74-20. Brooks Thorpe scored twice. Other Red Devils touchdowns were made by Tevita Valeti, Jaden Toki, Walker Deede, Luke Nadauld, William Emory, while Kasanova Valeti scored three touchdowns. Ryder Burton tossed two touchdown passes including a 91-yarder to Nadauld. Toki had a 30-yard pick six. Maple Mountain’s Jaxson Denton had two scores in the losing cause. The Rest of the Story: Springville’s Tevita Valeti is a touchdown scoring machine and has 15 touchdowns over eight games. But his performance against Wasatch two games ago was extra special and record setting. Valeti had a state record 58 rushing attempts for 349 yards with four touchdowns. Defensive Prowess: Lehi posted its sixth shutout of the season against Alta winning 20-0. It was the Pioneer’s third straight shutout. The last team to score against Lehi was Corner Canyon but the Pioneers held the Chargers scoreless in the fourth quarter meaning that Lehi has gone 13 straight quarters without yielding a point. In fact, in the last three games, Lehi’s defense has scored three touchdowns as Hema Katoa, Kadiyon Sweat, and Nathan Anderegg have had interception returns for touchdowns. Timpview’s defense had two scores as Siala Esera had a 71-yard pick six while teammate Isaiah Vaea had a 20-yard interception return to paydirt. Vaea also added a 68 yard TD run as Timpview blitzed Orem, 62-42. American Fork shut down the explosive Pleasant Grove offense as Champion Edwards tossed two touchdowns to lead the Cavemen to a 17-0 victory. Big Time and Break-out Performances: Payson’s Trevyn Wall scored three different ways as Payson routed Tooele 42-7. Wall had a 93-yard kick return for a touchdown, added a 75 yard run to paydirt and even threw a 19-yarder to teammate Cooper Swasey. Spanish Fork’s Britt Nielsen had two picks including one he returned 20 yards to paydirt as the Dons crushed Wasatch 56-20. Though in a losing cause, Orem’s Feleti Iongi thrilled the home faithful with a 90-yard kickoff return for a touchdown while also scoring on a 23-yard pass from Lance Reynolds III, who had three touchdowns passes while running for another. Provo’s Tagai Lesa did it on both sides of the ball scoring on two runs of four yards and then had an interception and return of 35 yards to set up another touchdown as the Bulldogs eased to a 35-19 victory over Salem Hills. Homecoming Fun: Provo broke out its new Bulldog head cauldron for its Homecoming contest against Salem Hills. Designed by metals teacher Kaleb Money, the cauldron was lit during halftime, and perhaps in a new tradition, Bulldog players gathered by it before taking the field for the second half. The cauldron was met with huge approval by Bulldog players, coaches and fans. “That was so cool,” said Provo offensive lineman Paxton McGinn of the lighting of the Bulldog head cauldron. “I’m so happy that our school has the facilities to make something like that and the shop classes we have here.” It’s not that unusual that football players be part of Homecoming royalty. In fact, Provo star running back Jamison Harward was the Homecoming King. But Provo had another player as royalty as Kayla Pagnani was so honored. Pagnani is one of the rare female gridiron players in the state, and on the last play of the game against Salem Hills, she downed the ball. Two weeks ago, Spanish Fork’s Joshua Buck was part of Spanish Fork’s royalty and part of the Homecoming festivities is an actual dance contest between those that are nominated. Spanish Fork’s Channel 17 showed some of the competition where Buck ended up being the winning contestant. And in the game against Wasatch this week, Buck crossed the goal line three times. Upcoming Big Game of the Week I: A Thursday late afternoon/early evening tilt (5 p.m.) has Timpview visiting Lehi for what should determine the Region 8 title. The two teams split last year as Timpview won the regular season contest but then the Pioneers turned the tables taking out the Thunderbirds in the quarterfinals enroute to winning the 5A state title. Upcoming Big Game of the Week II: Undefeated Stansbury travels to Payson for a Thursday night contest. If the Lions can pull the upset they could create a 3-way tie between them, Stansbury and Cedar Valley for the Region 7 title as each team would have one loss. A Stansbury win locks up the title and Payson would end up in third place in league play. Undefeated Teams Dwindling: Previously unbeaten Farmington fell to Davis last week so there are no 6A undefeated teams. 5A has two unblemished teams in Lehi and Stansbury. No team is undefeated in 4A but Juab and Morgan are undefeated in 3A, as are San Juan and South Summit in 2A. Enterprise is the lone team without a loss in 1A. RPI News: There were some big changes in the 5A RPI as now Timpview (6-1) takes the top spot with Brighton (7-1) moving into the No. 2 spot after its big win over East. Springville (7-1) slips to No. 3 while undefeated Lehi also retreats one position to No. 4. Spanish Fork (4-3) checks in at No. 7 while Provo (5-3) sits at No. 10. And right behind the Bulldogs are Orem (4-3), Cedar Valley (5-3) and Payson (6-2) in positions 11-13 respectively. Timpanogos (6-2) is at No. 18, Wasatch (3-5) No. 20, while currently Salem Hills (No. 26), Mountain View (No. 28) and Maple Mountain (No. 29) would not make the 24-team 5A playoff field. In 6A, Corner Canyon (6-2) still sits at the top spot while American Fork (6-2) moves up to No. 2 after defeating Pleasant Grove (5-3), who sits at No. 12. Skyridge (7-1) is No. 3 in the RPI, while Bingham (6-2) and Farmington (7-1) round out the top five. Lone Peak (4-3) is ranked No. 9 while Westlake is now No. 21. In 2A, winless American Leadership Academy is ranked No. 11 out of 12 programs. Crimson Cliffs (7-1) is the top-ranked team in 4A, undefeated Juab sits on top of 3A after Morgan defeats previously top-ranked Grantsville. The top-ranked team in 2A is undefeated South Summit while in 1A 11-player football undefeated Enterprise now claims the No. 1 position while in 1A 8-player football Monticello (4-3) is now the new top team. There is already a significant literature on the immediate impact of the outbreak, as well as on speculation on the future evolution of the industry.”

The market rallied to begin the fourth quarter, despite growing worries about the financial health of European banking giant Credit Suisse and weak economic data. The Dow rose nearly 900 points, or 3.1% in late afternoon trading. It was on track for its biggest gain since November 2020. The Nasdaq and S&P 500 were up 2.7% and 3%, respectively. Stocks ended September (and the third quarter) with a resounding thud on Friday. In a sign of how volatile the market is, all but one of the 30 Dow stocks were higher midday Monday — after they all finished lower Friday. (Johnson & Johnson (JNJ) was Monday’s lone laggard.) Investors are increasingly worried about inflation and how the Federal Reserve’s aggressive rate hikes to control surging prices could eventually tip the economy into a recession. Stocks are still down sharply this year. And the CNN Business Fear & Greed Index, which measures seven indicators of investor sentiment, remains at Extreme Fear levels. But Monday’s market rebound might be a perverse “bad news is good news” rally. Fears about rising stress at Credit Suisse (CS) may lead the Fed to slow down its pace of rate hikes. Bond market investors seem to be betting that as well. The yield on the benchmark 10-year US Treasury bond, which briefly topped 4% last week, has slid in recent days and fell again Monday to about 3.66%. Inflation, of course, is still a concern. But if the Fed and other central banks now also have to fear how a distressed European bank could lead to further financial contagion, then this might not be the best time to keep jacking up rates by historic amounts. Just a week ago, traders were pricing in more than 70% odds that the Fed would raise interest rates by three-quarters of a percentage point for the fourth consecutive time at its November 2 meeting. Now the chances of a rate hike that large are down to about 50%, as the probability of a more modest half-point increase grows. The latest manufacturing data in the US might also give the Fed reason to reconsider how much it should be raising interest rates. The Institute for Supply Management, a non-profit economic association, reported that its influential manufacturing index fell from August and was below Wall Street’s forecasts. That could be a sign that the Fed’s rate hikes are already having the desired effect of slowing the economy and reducing inflation. “The economy is slowing – a reality that is increasingly apparent in the manufacturing sector. The good news is that there are welcome signs that prices are stabilizing,” said Jim Baird, chief investment officer with Plante Moran Financial Advisors, in a report Monday. A spike in oil prices, while unwelcome news to consumers, lifted energy stocks Monday as well. Chevron (CVX) was the top Dow stock, and the energy sector was the best performer in the S&P 500. Oil stocks got a boost following reports that suggested that the OPEC+ bloc of petroleum producers are considering a cut in production to try and reverse the recent big slide in crude prices. Investors may also have taken solace in the fact that the British pound, which has recently tumbled to record lows versus the US dollar, rebounded after the new UK government abandoned a controversial plan to cut taxes for the wealthiest Brits. A stronger pound may allay fears about surging bond yields and rising credit costs in the UK. In corporate news, Tesla (TSLA) was one of the few stocks that didn’t take part in Monday’s rally. Shares of Elon Musk’s electric car giant fell more than 7%, making the company the worst performer in the S&P 500, after it reported disappointing third quarter delivery and production numbers over the weekend. Meanwhile, Tesla rival GM (GM) rallied after reporting stronger-than-expected third quarter sales.

The first two-and-a-half weeks of its New Jersey launch have already shown how popular it can be.  “As of … 17 days of being live, we’ve matched over 6,500 contracts,” Sporttrade founder and CEO, Alex Kane, said. “We’ve had over 1,500 trades and 27% of them have been risk off. That’s where customers are selling out in-play.”  On Sporttrade, bettors buy their wagers between $0 and $100. If bettors win, they receive $100. If bettors lose, they win nothing. Because of this pricing, a bet’s price is its probability of winning.  Sporttrade has also recruited large trading companies to accept bets, ensuring that most bettors can buy and sell bets as confidence in a bet’s outcome changes. That’s how it can give customers so many chances to sell their bets in-game for a profit instead of having to ride a losing bet to the bitter end. (Although, that doesn’t stop every customer from embracing that sports betting strategy.)   Profit from Sports Betting and Tight Pricing Sporttrade’s business model isn’t the only reason its bettors can profit on the app. Its tight prices are the other reason. Tight pricing means the buy and sell prices are close together. So, the markets only have to move a little for bettors to profit from sports betting.  Kane offered the example of a line with -115 odds on both sides of the line. At a traditional sportsbook, that has about a 7% vig. That’d be like if buy and sell prices were $7 apart on Sporttrade’s platform, a 53.50/47.50 split. On Sporttrade, a line with -115 odds at a traditional book “would be more like 49/51 or even closer — 49.50/50.50.”  “If you were to buy at $50.50 at Sporttrade vs. $53.50 at DraftKings, then you need a much smaller movement in price to be able to make a profit,” Kane said. Price Gaps, Uncertainty, and Profit    Even when the gap between buy and sell prices widens, the gap is smaller relative to other prediction markets. The gap between buy and sell prices is a measure of uncertainty. If the prices are close, then all the buyers and sellers agree on the odds. But if the gap widens, then bettors are more unsure about the odds and how the next play or decision will affect the game.  “I think the general rule of thumb is somewhere in the $2-3 range,” Kane said. “Our big difference is … we have the institutional market-making component.”    With companies in the background making sure bettors can buy and sell, Sporttrade can keep the price gaps caused by market uncertainty low. Other prediction markets have larger price gaps in their uncertain markets.  For example, PredictIt’s election markets can have overrounds as high as 10 cents. (Its prices range from $0 to $1.) Instead of an $11 price movement, Sporttrade users usually only have to wait for the price to move $2-3. (Sporttrade users also have a shorter time to wait — sports games go by faster than elections.)  Trading Sports vs. Betting Sports  Sporttrade’s trading market doesn’t guarantee profitable sports wagers. Instead, it gives bettors a chance to profit in the long run. Bettors can sell their wagers mid-game to profit from bets that may ultimately end up losing. This is all possible because Sporttrade ensured its platform had tight pricing and smaller gaps between prices than other trading and prediction platforms. Many of Sporttrade’s earliest users are taking advantage of the strategies in-play trading opens up.  “On Sunday, roughly 60% of our volume was in-play only,” Kane said. “It’s a very high number to get to so short in a company’s life cycle.”  Sporttrade is only live in New Jersey. However, it has plans to slowly expand to new legal sports betting markets, creating the possibility for the slow spread of sports trading across the United States. Over the next five years, sports trading could become a popular competitive alternative to sports betting.

These virtual worlds already exist, in some form, but many of the biggest names in tech are working to develop the hardware and software necessary for people to spend significant time — and money — in the metaverse. Mark Zuckerberg and Meta are heavily invested in the concept of the metaverse. Companies from Microsoft to Disney have laid out metaverse plans. But some experts suggest that any metaverse hype partially exists specifically because people don’t understand what it’s going to be. In June, former Google CEO Eric Schmidt summed up the general confusion over the concept, noting that “there’s not an agreement on what the metaverse is.” Similarly, Snap CEO Evan Spiegel has called the idea of the metaverse “ambiguous and hypothetical.” Instead, he’s pushed his company’s plans around augmented reality (AR), where virtual elements and images are superimposed onto the real world. Cook is also a big proponent of AR, and Apple is reportedly developing an AR/VR headset that could hit the market in 2023, according to Bloomberg. The future of AR “will go much, much further” than today’s applications, Cook told Bright on Friday. “I think AR is a profound technology that will affect everything,” Cook said. “Imagine suddenly being able to teach with AR and demonstrate things that way. Or medically, and so on. Like I said, we are really going to look back and think about how we once lived without AR.” Cook’s comments on the metaverse came amid a European tour that saw the Apple CEO visit the U.K. and Germany before speaking at the University of Naples Federico II’s commencement ceremony last week. From October 3-7, 2022, at the American Center in Ho Chi Minh City, Vietnam, Google’s Startup Academy will host entrepreneurs in technology for a four-day bootcamp-style curriculum that supports early-stage technology startups in addressing local challenges, such as building a business, accessing capital, and more. American Spaces are open-access learning and gathering places around the world that promote interaction with local communities and the United States. Additionally, on October 7, 2022, with support of Google.org, Google’s philanthropic arm, the ASEAN Foundation and its local partners will launch an initiative focused on youth engagement and media literacy at @America in Jakarta, Indonesia, one of the 12 American Spaces in Indonesia. The initiative will educate locally underserved communities, especially young leaders, on media literacy, how to combat online misinformation, and navigate the internet. Supreme Court Takes Up A Divisive Issue: Should Tech Companies Have Immunity Over Problematic User Content? – NBC News https://dentoncountynewsonline.com/supreme-court-takes-up-a-divisive-issue-should-tech-companies-have-immunity-over-problematic-user-content-nbc-news/ The Supreme Court on Monday stepped into the politically divisive issue of whether tech companies should have immunity over problematic content posted by users, agreeing to hear a case alleging that YouTube helped aid and abet the killing of an American woman in the 2015 Islamic State terrorist attacks in Paris. The family of Nohemi Gonzalez, one of 130 people killed in a series of linked attacks carried out by the militant Muslim group, argued that YouTube’s active role in recommending videos overcomes the liability shield for internet companies that Congress imposed in 1996 as part of the Communications Decency Act. It has come under heavy scrutiny from the right and left in recent years, with conservatives claiming that companies are inappropriately censoring content and liberals saying that social media companies are spreading dangerous right-wing rhetoric. The provision leaves it to companies to decide whether certain content should be removed and does not require them to be politically neutral. The stakes of the case could be enormous because recommendations are now the norm for online services, not just at YouTube. Apps such as Instagram, TikTok, Facebook and Twitter long ago began to rely on recommendation engines or algorithms to decide what people see most of the time, rather than using chronological feeds. NetChoice, a trade group for tech corporations, said the industry needs as much flexibility as possible to decide what to take down or leave up. “Without moderation, the internet will become a content cesspool, filled with vile content of all sorts, and making it easier for things like terrorist recruitment,” said NetChoice counsel Chris Marchese. In a separate move, the court on Monday said it would hear a related appeal brought by Twitter on whether the company can be liable under a federal law called the Anti-Terrorism Act, which allows people to sue people or entities who “aid and abet” terrorist acts. The same appeals court that handled the Gonzalez case revived claims brought by relatives of Nawras Alassaf, a Jordanian citizen killed in an Islamist attack in Istanbul in 2017, who accused Twitter, Google and Facebook of aiding and abetting the spread of militant Islamic ideology, which the companies deny. In that case, the question of Section 230 immunity has not yet been addressed. Twitter’s lawyers said in court papers that the company provides “generic, widely available services to billions of users who allegedly included some supporters of ISIS,” and that it has regularly enforced policies preventing terrorists from using its services. The ruling in the Twitter matter will also affect the claims against Facebook and Google in the same case. Gonzalez was a 23-year-old college student studying in France when she was killed while dining at a restaurant during the wave of attacks, which also targeted the Bataclan concert hall. Her family is seeking to sue Google-owned YouTube for allegedly allowing ISIS to spread its message. The lawsuit targets YouTube’s use of algorithms to suggest videos for users based on content they have previously viewed. YouTube’s active role goes beyond the kind of conduct that Congress intended to protect with Section 230, the family’s lawyers allege. They say in court papers that the company “knowingly permitted ISIS to post on YouTube hundreds of radicalizing videos inciting violence” that helped the group recruit supporters, some of whom then conducted terrorist attacks. YouTube’s video recommendations were key to helping spread ISIS’s message, the lawyers say. The plaintiffs do not allege that YouTube had any direct role in the killing. Gonzalez’s relatives, who filed their 2016 lawsuit in federal court in northern California, hope to pursue claims that YouTube violated the Anti-Terrorism Act. A federal judge dismissed the lawsuit but it was revived by the San Francisco-based 9th U.S. Circuit Court of Appeals in a June 2021 decision that also resolved similar cases brought by the families of other terrorist attacks against tech companies. Google’s lawyers urged the court not to hear the Gonzalez case, saying in part that the lawsuit would likely fail whether or not Section 230 applies. The Supreme Court has previously declined to take up cases on Section 230, although conservative Justice Clarence Thomas has criticized it, citing the market power and influence of tech giants. Another related issue is likely heading to the Supreme Court concerning a law enacted by Republicans in Texas that seeks to prevent social media companies from barring users who make inflammatory political comments. Wade Cannon has died after a battle with occupational colon cancer. He was 33. Cannon served the town of Flower Mound for over six years. “It truly is a somber day in Flower Mound as we mourn the loss of our brother with Flower Mound Fire Department Wade Cannon,” the Flower Mound Police Department said in a statement. “Wade served our town faithfully and was an inspiration to us all as he bravely fought cancer over the past several years. Wade was a shining example of service and leaves a legacy for us all to follow going forward.” Additional details regarding a Line of Duty memorial service will be released later. In lieu of flowers, the family asks that people make donations in Wade’s name to the Brent Lewis Bridges Foundation and Michael’s Memories, two organizations that were near and dear to them during Cannon’s cancer battle. When founder Megan Graham explained the concept — “the first made-for-beauty collection of reusable, refillable, washable travel-size toiletry containers” — it took a few moments of pause to realize that this product absolutely should exist and it’s bonkers no one else came up with it. In fact, I was livid I didn’t think of it myself. Inspired by the word ‘toiletries’, travel beauty brand RIES was a member of the 2021 Sephora Accelerate program, launched in February 2022. It soon became the first reusable travel bottle partner (airless bottles, that is) to make it into Sephora in August. Oh, and it would be remiss not to mention that Graham is a Black woman. “When I was creating the product, it was white men who were the gatekeepers,” Graham explained to me. “I was literally being told, ‘Go slap your name on [bottles] from Alibaba,’ or ‘It already exists.’ I was having to continually say, ‘No, it does not.'” Even as a beauty writer, I struggle when it comes to decanting my ‘big’ beauty products, like shampoo and conditioner, into small containers for travel purposes. I also have a deep hatred for those semitransparent, flimsy and overpriced travel bottles. Not only are they hideous, but they are near impossible to clean and leak everywhere. It’s very far from a perfect user experience, and the only other option is to hope and pray that brands make my favorite hair products in a travel size. Even that comes with the added element of excess waste, though, not to mention a serious price tag. Anyway, I have too much hair for travel-sized products, so RIES is giving me (and others) a level of access we only dreamed of. Those tiny, flimsy bottles are the standard at drugstores, said Graham, who added that we’ve accepted them as the only go-to. But that’s a layered problem. “To call RIES just a bottle just diminishes so much of what we’re trying to go up against,” said Graham. You see, traveling with textured hair comes with an unrecognized element of need. Our hair does not (and never will be) able to be condensed into a few products. RIES Beauty advocates for many unrecognized people in the travel space — and we’re screaming for it. I know how hard it is for brands to get funding, especially Black female founders. Graham had to convince people it was necessary, particularly white businessmen. “They truly didn’t understand,” said Graham. I thought, okay, you expect me to go to an Airbnb or a hotel and be able to use [the products which are] available there? That’s not what works for my hair type — or my skin.” Graham was also told to head to Target, Walgreens or CVS. She asked, “And buy whatever is available on the three inches of shelf that [they] give [my] hair type? It’s almost impossible to respond in that scenario, so I had to break it down.” The entire goal of RIES is to return control to the traveler. “Often, [traveling] is the only time we get to be ourselves and experiment with our hair since we can’t really do that thanks to work and other commitments,” said Graham. She added that we place a great deal of importance on our hair since it has a significant impact on our vacation mood. “When it comes to traveling and hair, we have to take a lot into account, since we are unable to travel the same way other races may. As a Black woman, having a leave-out during a trip will be nice, but you also might consider not swimming as it will mess up your hair and be time consuming to fix on vacation. We are constantly faced with these challenges.” Everything requires multiple levels of steps, and RIES Beauty exists to try to at least make our lives easier. The brand is all about thoughtful consumption and knowing you deserve everything you need, so it’s much more than a simple bottle. Traveling itself is already anxiety-inducing enough. On top of this, traveling with textured and curly hair requires a whole arsenal of products — something many lament. “If I plan to swim while on vacation or if I’m traveling for a long period of time,” said Black travel influencer, Wande Akin, “I need more products than usual. If I don’t have my hair in a simple protective style like braids, I have to pack heat tools, more hair products, spray bottles, brushes, combs and so on. This could take up the majority of my suitcase.” Personally, my hairstyles require at least six weeks of advance planning, so I feel Akin on this. When I’m traveling, the last thing I want to be fretting about is how good or bad my hair looks. Truly. “I’ve been in four different states in the last four days,” Graham told me. “I feel grimy, I’ve been hiking. But I have my own conditioner with me and my hair feels good. Hair is such a part of my identity and it’s a part of people’s first [impressions] of me. Being able to take care of it and truly have things that I know will make me feel good makes me want to travel more.” The public response to RIES’ travel-friendly containers has been overwhelmingly positive, particularly from the curly hair community. Many people have thanked Graham for creating the smart airless bottles, while others mention that the brand gives them freedom. RIES isn’t just for hair and body products, either. It’s a chic way to travel with your prescriptions, too. It’s not like the RIES travel containers have cured everything about traveling with curly and textured hair. But the brand has ignited a conversation people didn’t even realize was necessary. “One of the most frustrating parts of traveling with textured hair is drying it,” said curly hair coach Barbara Kurmlavage, the CEO and founder of Curlvitality. “Almost all hotels have blow-dryers in the rooms, but why don’t those blow-dryers also have diffuser attachments?” Kurmlavage’s dream for the future is that it becomes mandatory for hotels who carry hair dryers to provide diffuser attachments — “for all rooms to make the amenity inclusive to all.” Curly-haired travel influencer Hiba Stouhi agrees: “My struggle when traveling with textured hair is that I need a lot of products to wash and style my curls. Some of the bottles are big, others are okay, but I can’t fit all of them in my bag, especially if I’m taking a carry-on only.” Stouhi wishes hotels would provide more texture-friendly products in the room, like a diffuser as well as sulfate- and silicone-free products. “That way I wouldn’t have to worry about taking all my products with me. Travel-size products are available, but they are not available to everyone.” Sadly, mass retailers often overlook specific markets when it comes to travel-size products. But catering to only one type of person is not only dangerous, it’s boring. “Traveling while Black is very different from traveling while white,” Graham emphasises, “and for so many more reasons than anyone could understand, anticipate or scratch the surface with.” She concludes, “RIES is a way for people to start thinking about what that means, because beauty is truly the gateway into that conversation.” Like I said: this is so much more than just a bottle. The COVID-19 pandemic and recent rise in grocery prices have increased food insecurity across the nation, impacting nearly 1.5 million New Yorkers, including one in four children. To help combat this issue on a local level, Grubhub is leveraging its vast restaurant  network to support underserved communities in Council District 23 and eastern Queens. “This is a first-of-its-kind program for Grubhub and launching in New York City — touching all five boroughs and partnering with every single City Council member — is the perfect way to leverage our resources and address food insecurity for those in need,” said Brett Swanson, Grubhub’s senior manager for Community Affairs and Social Impact. “To have the greatest impact, we’re going hyper-local, working with the City Council members to understand specific needs in the community and then partner to address them.”

The “overwhelming majority” of those ADs at a Lead1 Association meeting in Washington D.C. had a “strong preference” the NCAA continue running major-college football if the association “can be more streamlined and less bureaucratic.” Or else … what? The answer has opened the door to perhaps not a breakaway of major college football and basketball but at least a forming picture of what a new structure would look like. A growing number of those ADs believe they have a unique and powerful hammer as leverage if the NCAA doesn’t clean up its act. “If not,” a Lead1 executive said. “We would explore other options.” Among those implied options, CBS Sports has learned, is leveraging schools’ participation in the NCAA Tournament. While a separate basketball tournament operated outside of the NCAA isn’t likely anytime soon, the ADs’ realization they could create such an event provides a picture as to how the NCAA’s two biggest sports will be run in the future. A football breakaway has long been discussed — it is more likely than one in basketball — as the NCAA’s power diminishes as membership has demanded a reorganization of the 117-year-old organization. Approximately 80 FBS ADs traveled to Lead1’s mid-September meeting in person. Another 20 participated virtually, putting 100 out of 131 total in attendance. They saw two compelling presentations made by former West Virginia AD and NCAA executive Oliver Luck and North Carolina associate professor of sports administration Erianne Weight. One presentation was a model with college football continuing to operate inside the NCAA. The other showed the FBS going “completely independent” of the NCAA, according to a source. “It was about as unanimous as it could get,” Lead1 CEO Tom McMillen said of his membership’s reaction to football governance. “It was, ‘Fix it or we will seriously consider move options.'” Basketball is involved in the discussion because the revenue from the NCAA Tournament is used by the association to essentially run major-college football. The NCAA does not sponsor an FBS championship. Meanwhile, the tournament is the mother’s milk of the association itself bringing approximately $800 million per year. Approximately 80% of that goes back to the members. McMillen compared more oversight of major-college sports by his members to a “discharge petition.” In parliamentary procedure, such an act means bringing a bill to the floor for a vote without a report from a committee. In this case, that “committee” represents the bureaucracy of the NCAA.  “If the ADs stand together, they can almost accomplish anything,” McMillen said. Lead1 is essentially an advisory group when it comes to NCAA matters, but change has to start somewhere. Ohio State AD Gene Smith raised eyebrows last summer when he suggested to ESPN that the College Football Playoff take over FBS. He was not alone. In December 2020, the reform-minded Knight Commission essentially suggested the same thing. Lead1 and its members hope to gain more power over major-college sports as the NCAA remakes itself through a rewritten constitution that will give more power to the schools. To that end, Lead1 was encouraged to see its views were taking hold recently when the NCAA adopted seven of its 11 recommendations. Among those was the abolition of the much-criticized Independent Accountability Resolution Process. The future of basketball was not discussed formally last month. Various college officials came out of that Lead1 meeting contending there is no grant of rights between the Division I schools and the NCAA that binds them to play in March Madness. The grant of rights is most commonly known as a document schools sign that assigns their television rights to their conference. Lead1 executives and other ADs confirmed to CBS Sports that there is no such binding document. “It’s not ironclad,” said McMillen. “That’s my quote. It’s just not ironclad [that they participate].” When asked what binds those schools to the tournament, NCAA general counsel Scott Bearby referred CBS Sports to Bylaw 31.2.1.1 It states: Eligible members in a sport … will participate [if selected] in the NCAA championship or in no postseason in that sport. “I don’t know the consequence, for instance, if a team that qualified for a conference automatic bid, their choice [was] to not participate,” Bearby told CBS Sports. “I don’t know what that would mean.” While there is no overt movement for Division I to stage its own basketball tournament, the National Association of Basketball Coaches is on record as saying it would like to establish a governing board of the game but within the NCAA structure. (NABC president Craig Robinson provided no comment when contacted.) Most importantly, for the first time during that Lead1 meeting, a price tag was put on what it would take to run the FBS: $65 million annually. That figure was revealed during a slide presentation by Kathleen McNeely, the NCAA’s former CFO and currently a Lead1 consultant. (McNeely did not comment but gave a Lead1 official permission to describe her presentation in detail with CBS Sports.) An outside entity taking over the FBS would be less about affordability and more about liability. That $65 million represents 10% of the current annual CFP payout ($600 million) and even less (about 4%) of the projected annual payout in an expanded 12-team CFP field. However, the NCAA has long been target practice for attorneys seeking retribution for clients with catastrophic injuries. The association also spends millions annually defending itself in lawsuits aimed at the NCAA and conferences. As mentioned, building a tournament outside of the NCAA structure would be a massive lift. And there is little indication that college presidents, who have the ultimate say, are dissatisfied enough to make such a dramatic move. However, acknowledging the fact that they could reflects some of the dissatisfaction. “I wouldn’t worry about the basketball tournament falling apart, yet,” said a source at the meeting. “I think there is widespread acceptance of the tournament as the place to be if you’re a college basketball team.”  Football remains key because its presence within the system was a significant reason the NCAA generated a record $1.16 billion in revenue last season. Division I is made up of 351 members, many of whom derive a large part of their budget from NCAA revenue distribution, a large portion of which comes from the tournament. But as part of the massive NCAA reorganization that’s in progress, Power Five schools hope to have more input into how the NCAA is run. That’s where the streamlining of governance comes in. Short of a breakaway, football and basketball could be parceled out into different pieces split between the NCAA and the schools. “If FBS football says, ‘We don’t want to have NCAA enforcement. We want to have our own enforcement and all we’re going to enforce recruiting,’ that could be a model,” said one person in the room. One source suggested getting rid of the NCAA Football Oversight Committee, which is responsible for kicking legislation upstairs to the NCAA Council. The composition of the committee is part of the problem for Power Five administrators. Only five of the 18 members are from Power Five schools. The new FBS governing board for the entire sport could be half that size. For example, NCAA eligibility and amateurism are largely dead discussion points. Name, image and likeness rules have wiped out whatever was left of the collegiate (amateurism) model. Initial eligibility is largely being left up to schools. There is a movement within Lead1 that would mimic what the Knight Commissioner has proposed: establish a board that would at least oversee the sport and answer to what was termed a commissioner or CEO of major-college football. CBS Sports took a deep dive into a potential football breakaway in June. The $65 million needed to make such a move is believed to be the first time a number has been attached to the FBS. That’s where the conflict emerges. Over the years, bowl games, the BCS and the College Football Playoff have been stewards of major-college football. The NCAA basically set play and practice rules and provided catastrophic insurance while overseeing the sport with its enforcement department. As the NCAA became less relevant and powerful in recent years, many questioned why the association should oversee the FBS at all. For any entity to take over the FBS, it would inherit the legal liability estimated by McNeely to be at least $10 million annually. That is not counting any massive legal settlement that might impact the NCAA’s legal exposure in any given year, she warned. The advantage of that arrangement is the NCAA remaining a “legal shield” against all incoming litigation. “They are the first line of defense,” McMillen said. “Whoever would take this over not only would have to pay the current legal bills of $10 million a year, but [McNeely said] you’d have to have a substantial reserve — $20-plus million per year in case you had settlements.” There is also health and welfare, insurance, officiating and rules oversight involved in that $65 million. All of it makes it unlikely a third party would take over the entirety of the FBS. The Knight Commission continues to argue that FBS schools receive NCAA revenue and have a weighted voting advantage in governance despite being a sport that, again, the association basically didn’t sponsor.
