Free Download Kanako N. Kusanagi, "Lesson Study as Pedagogic Transfer: A Sociological Analysis " English | ISBN: 9811959307 | 2023 | 200 pages | EPUB | 1018 KB This book examines education transfer, specifically focusing on pedagogic transfer, and analyzes what happens when lesson study is introduced into foreign contextual settings. Lesson study, a professional development approach that originated in Japan 150 years ago, has been widely considered one of the best practices for collaborative professional development. There is an underlying assumption behind education transfer that when "best practice" is transferred to another country, it will generate a similar effect and improve schooling quality. Since pedagogic practice is socially constructed, the best practice in one setting may not be meaningful in another contextual setting.

Free Download Wai Kong Ng, "Legitimacy, the Chinese Communist Party and Confucius" English | ISBN: 9819970881 | 2023 | 299 pages | EPUB | 462 KB This book explores the use of Confucianism by the Chinese Communist Party in its assertion of political legitimacy. Confucian thought offers an enduring framework for political legitimacy in East Asian societies, including China. All states strive to acquire legitimacy, and despite once denouncing Confucianism as the remnants of feudal poison, the Party is turning towards Confucianism as part of its legitimation efforts. This suggests that the Party is suffering from an ideological void in terms of legitimacy and legitimation due to the diminishing relevance of Marxism in Chinese societal practices.

Free Download Jasper Verstappen, "Legal Agreements on Smart Contract Platforms in European Systems of Private Law " English | ISBN: 3031354060 | 2023 | 428 pages | EPUB | 5 MB Blockchains and smart contracts are emerging technologies that pose unique challenges for legal systems. This book outlines the extent to which these new and innovative technologies could have potentially disruptive effects on contract law in Europe. It does so through a comparative, three-part analysis of the recognisability and effects of smart contracts in European legal systems. First of all, in light of the technologies' transboundary nature, the book employs a comparative approach, considering French law, German law, English law, and Dutch law to analyse the impact on the different systems of contract law. While doing so, it also addresses the formation, interpretation, and vitiation of contracts. Secondly, it analyses the impact of these technologies on European laws regarding unfair terms in consumer contracts and argues that the existing rules should be applied to smart legal agreements in business-to-consumer relations. Lastly, it analyses the current European rules of private international law on the basis of which jurisdiction and applicable law are developed. In this respect, the book concludes that the vast majority of these European rules are "smart contract-proof".

Lectures On Deformation Quantisation
Lectures On Deformation Quantisation
Free Download Lectures On Deformation Quantisation: From Moyal Product To Kontsevich's Formality Theorem English | 2025 | ISBN: 9811297800 | 450 Pages | PDF (True) | 6 MB Principles of classical Hamiltonian mechanics say that the evolution of a dynamical system is determined by the Poisson bracket of observable functions with the given Hamiltonian function of the system. In Quantum Mechanics, these principles are modified so that the algebra of observable functions should be replaced by a noncommutative algebra of operators and the Poisson bracket by their commutator so that the canonical commutation relations hold. Thus, working with quantum systems, we must determine the 'quantisation' of our observables, i.e. to choose a noncommutative algebra whose elements would play the role of the observables. With some modifications, this question is the main content of the Deformation Quantisation problem formulated in 1978 by Flato and others. This book is based on the course that the author taught in the Fall semester of 2019 at Peking University. The main purpose of that course and of this book is to acquaint the reader with the vast scope of ideas related to the Deformation Quantisation of Poisson manifolds. The book begins with Quantum Mechanics and Moyal product formula and covers the three main constructions that solve the Deformation Quantisation problem: Lecomte and de Wilde deformation of symplectic manifolds, Fedosov's Quantisation theory and Kontsevich's formality theorem. In the appendices, the Tamarkin's proof of formality theorem is outlined. The book is written in a reader-friendly manner and is as self-contained as possible. It includes several sets of problems and exercises that will help the reader to master the material.

Lawyer Evaluation in Chinese Courtroom A Social-Semiotic Perspective
Free Download Liping Zhang, "Lawyer Evaluation in Chinese Courtroom: A Social-Semiotic Perspective" English | ISBN: 9819712106 | 2025 | 216 pages | EPUB | 1055 KB This book focuses on the speech style of lawyer talk in contemporary Chinese courtrooms. The topic is intriguing to readers who may wonder how lawyers compete with their opposing counterparts in an adversarial trial system in China. The legal tradition in Confucianism, which advocates harmony in interpersonal relationships, has historically guided the practice of law in China. The book analyses how lawyers manage to compete in this system. Applying the social semiotic view of language in the Hallidayian sense, specifically systemic functional linguistics and its appraisal theory, this study interprets the subjectivity of legal language by lawyers. The speech style in legal argument presentation is described as 'rational'. The exploration of the rational speech style of lawyers is a theoretical and discursive topic. It draws upon Habermasian philosophy of intersubjectivity in legal argumentation and considers the cultural and legal contexts of China as contextual constraints. The keyconstruct of lawyer evaluation is fully captured in this discussion. As a linguistic phenomenon and unit of analysis, discourse can be examined both within local clauses and in larger stretches of talk beyond clauses. Additionally, it serves as an effective means for constructing a rational speech style for lawyers. Most importantly, discourse is a discursive act that negotiates legal arguments in the dynamic speech exchanges of a court trial, which is embedded in a wider social and cultural context.

Justice and Recovery for Victimised Children Institutional Tensions in Nordic and European Barnahus Models
Free Download Susanna Johansson, "Justice and Recovery for Victimised Children: Institutional Tensions in Nordic and European Barnahus Models " English | ISBN: 3031532325 | 2024 | 303 pages | EPUB | 510 KB This open access book contributes to ongoing discussions about how societies should respond to children who have experienced violence and abuse by delving into the Barnahus model: a multidisciplinary and co-located model whose aim is to provide both justice and recovery to victimised children. The promising model was first implemented in the Nordic region and is currently being diffused across Europe, although scientific knowledge about the model remains scarce: the Barnahus model's potential for delivering holistic services, the various tensions and dilemmas involved in the model, and how dual mandate of Barnahus can be managed all require further research. Continuing from the volume Collaborating Against Child Abuse (2017) which examined the process of Barnahus' diffusion in the Nordic countries, the current book digs deeper into the intrinsic institutional tensions of the model, as well as those that might arise during collaboration, in order to advance our understanding of what can be achieved through the model and thus improve the situation of child victims of violence and abuse. An institutional perspective is used in the book which is structured in four parts. The first three parts explore different types of institutional tensions -legal, organisational, and professional-ethical, while the fourth focuses on how these tensions may be balanced. The book's authors chart this new phase in the diffusion and translation of the Barnahus model. Their analyses will provide valuable guidance to countries that are currently considering or are already implementing the model.

Just Transitions and the Future of Law and Regulation
Free Download Alexandra R. Harrington, "Just Transitions and the Future of Law and Regulation " English | ISBN: 3031061810 | 2022 | 245 pages | EPUB | 470 KB This book provides a comprehensive assessment of how national and international efforts to achieve carbon neutrality have been embraced as necessary to meet the requirements of the Paris Agreement as well as the needs of the planet. The authors explore the increasing tensions between aspirations and entrenched practices as methods to implement carbon neutrality are devised, particularly at the national and sub-national levels. This is perhaps best typified by efforts to shift from "dirty" energy production, such as coal, to greener alternatives, which are often supported in laws and rules but opposed by society. To bridge this void, the concept of just transitions has increasingly come to the forefront of international and national focus yet is often poorly understood. This book examines the ways in which just transitions have been proposed as a legal and regulatory bridge to address issues that result in societal resistance to implementation. It uses past and existing practice studiesof just transitions before providing an analysis of how just transitions can be used to not only to assist in the shift to carbon neutrality but also in new shifts such as those caused by the Covid-19 pandemic impacts on economy, environment and society, and to address future global challenges.

Juridical Perspectives between Islam and the West A Tale of Two Worlds
Free Download Federico Lorenzo Ramaioli, "Juridical Perspectives between Islam and the West: A Tale of Two Worlds " English | ISBN: 3031378431 | 2024 | 301 pages | EPUB | 598 KB This comparative philosophy of law book aims at formulating a new analytical approach to the Islamic legal tradition based on 'juridical categories', a concept that facilitates comprehension and understanding of juridical phenomena. Building upon legal comparativism and legal pluralism, this project intends to avoid bias caused by universalizing Western categories when analyzing foreign juridical notions, which inevitably results in the miscomprehension of non-Western ideas and institutions. Unlike existing literature, this project will not focus on substantive comparisons between normative contents, but on the 'juridical perspectives' that helped to shape the Islamic and Western legal orders. The book focuses on the most relevant juridical questions regarding the Islamic and Western legal perspectives, such as the different visions regarding juridical spatiality, the role of human reason and the relationship between law, man and the divinity. While contributing to legal philosophy, this work intends also to develop and define a new interdisciplinary approach, aiming to provide a starting point for novel analyses in research fields such as legal comparativism, legal pluralism, and constitutional law. Finally, by formulating a new interdisciplinary approach, it will provide a foundational discussion of a continuously evolving subject that will never be exhaustively explored. As such, it aims at broadening scholarly reflections on the relationship between the West and Islam, eventually placing these concepts within a suitably comprehensive and contextualized framework.
