DUNKIRK — Citing “construction needs” at what was described just years ago as a state-of-the-art facility, ImmunityBio confirmed there will be fewer workers at its Dunkirk plant for up to a year and a half. However, at least two sources, one who said he was a worker, said the company laid off all but a handful of employees without prior notice after they were gathered Thursday. News of the employee drawdown came following an “in-depth review” of the state-funded facility at 3805 Lake Shore Drive, the lease of which was acquired by ImmunityBio in February of this year from Athenex. A spokeswoman for the California-based clinical-stage immunotherapy company said it was determined that the plant “has construction needs that may take approximately 12 to 18 months in order to enable the facility to be used as it has been intended.” She added, in a statement to the OBSERVER, “For this reason, we will need fewer employees during the construction period. That said, we remain committed to the Dunkirk area and the large-scale manufacturing facility.” An employee, who wished not to be identified, said they were gathered Thursday inside the plant’s cafeteria and informed the facility needed work that could last more than a year. The employee estimated that up to 40 were laid off in a variety of departments, including plant services, micro-biology and office workers. Today at 6 p.m. EST, the Logan Square-based science center is launching an immersive Roblox experience called CurioCity. The Franklin Institute partnered with MELON, a metaverse development company, for the project, which incorporates features of the organization’s exhibits into the game. CurioCity will be available for free on Roblox and is open to people of all ages (though we know that kids love Roblox). It features mini games and two immersive escape rooms, one on a moon base and one about the human body. The escape rooms can be completed by one player or by a team, and they each require players to complete puzzles, earn rewards and collect items, all while learning about scientific topics. MELON was starting an educational game branch, and because of their design style and the type of experiences they create, it made sense for the Franklin Institute to partner with them, she said. “They’ve done a lot of brand stuff, they’ve done a lot of event-driven things,” Bysshe said. “They have a really good knowledge base of educational games. They’ve worked with a couple other institutions prior to us. So it felt like a good partnership from a look and feel and experience perspective.” Bysshe said CurioCity is part of a larger digital initiative the Franklin Institute is working on, including podcasts and video series. The goal is to reach a wider audience than just the people who would come to the museum. “Metaverse platforms like Roblox are a logical next step for The Franklin Institute, providing a highly relevant medium to connect with future audiences at a young age and pique their curiosity about science and technology,” Bysshe said in a statement. “Through CurioCity on Roblox, we are reaching a community of young thinkers where they are already socializing, creating, and sharing experiences together with friends, and are introducing valuable insights and resources to these new audiences in a highly engaging and entertaining way.” She told Technical.ly that the escape rooms in CurioCity coincide with space and human body exhibits they are working on at the actual museum. Last Updated: Sep 29, 2022 3:14 PM ET Read Time: 4 min Photo By – USA TODAY Sports Responsible gambling initiatives have surged this month, with Major League Baseball joining the club after announcing a partnership with the American Gaming Association’s “Have a Game Plan” program. “As legalized wagering continues to grow across the country, MLB is committed to ensuring that fans who choose to wager also have the tools and resources necessary to bet responsibly,” said Kenny Gersh, MLB Executive Vice President, Business Development. Starting this postseason, MLB will air public service announcements on some of their broadcasts. They will also invite each baseball team to individually partner with them to promote responsible strategies. The league will also assist the National Council on Problem Gambling on initiatives by using their platform to shed light on the NCPG’s Gambling Helpline. “MLB understands that as legal sports betting grows, so does our collective commitment to responsibility,” said AGA Senior Vice President Casey Clark. “This partnership will have a meaningful impact, teaching fans across the country the fundamentals of responsible wagering.” For its part, the AGA will educate MLB on league-wide responsible gambling through “benchmarks and annual trainings.” Other responsible gaming initiatives Although Responsible Gaming Education Month is ending this week, the past few weeks have seen an uptick in discussions and strategies for responsible gambling. Some of the largest sportsbooks released a 12-point pledge this month, creating an “industry standard” to tackle problem gambling. Included in the pledge is an adoption of a nationwide phone number, funding research, and promoting responsible strategies. The AGA also hosted a webinar where industry members mentioned collaborating in their research and speaking with regulators to further responsible gambling objectives. Other professional sports leagues, besides MLB, have also chipped in. The PGA Tour, which originally balked at working with online sportsbooks, released a PSA promoting the AGA’s “Have a Game Plan” ahead of this month and partnered with the AGA back in January 2021.  The NFL also aired their own responsible gambling ad on Sunday Night Football, under their motto “Stick to Your Gameplan.” MLB in the spotlight Although they are in the shadow of the NFL in the fall, September and October are when the MLB season really shines. This month featured two massive milestones, with Albert Pujols hitting 700 career home runs and Aaron Judge’s chase of Roger Maris and the American League single-season home run record — which saw sportsbooks offer a number of Pujols and Judge-related milestone promotions.  The World Series — if it goes seven games — will end on November 5. Just three days later, California, home to five MLB teams (Angels, Dodgers, Padres, Athletics, and Giants), will go to the polls to decide whether the Golden State will have online sports betting, retail sports betting, or no sports betting at all.  MLB had previously announced they are supporting Prop 27, the ballot measure allowing online sports betting. In a statement, MLB “believes that Prop 27 has the safeguards to create a safe and responsible online sports betting market in California.” However, a recent poll suggests there is a real chance this measure fails come November. As a whole, however, MLB is not necessarily all-in on sports betting. While voicing support for one side of California’s referendum on sports betting, they have not committed any financial funding — unlike DraftKings and FanDuel, which have poured in millions of dollars. Plus, MLBPA Executive Director Tony Clark said in July that the speed of the league’s betting sponsorship expansion after PASPA was repealed gave him pause. Suffolk County offices in Hauppauge. / Google Maps image By: David Winzelberg September 29, 2022 The recent cyberattack that crippled much of Suffolk County’s digital infrastructure is wreaking havoc throughout the Long Island real estate industry.  The attack shut down the county’s online systems earlier this month, and has paralyzed the county clerk’s office, which is responsible for recording documents and assisting with records searches for properties.  The result has delayed or cancelled real estate closings, especially on larger commercial deals, as title companies can’t search county databases to accurately ensure that the properties have no liens, judgments or other encumbrances in order to pass title.  “The delay in restoring access to the county’s real estate records, which had been accessible online prior to the hack, is causing many title companies to withhold final clearance which would allow closings to occur,” said attorney David Rosenberg of Garden City-based Rosenberg Fortuna & Laitman. “These records are essential to determine if any new liens, encumbrances or property transfers have been filed between the original title report and the closing. On newer deals, it delays the initial title report so the title company qualifies the report in a way that counsel for buyers, borrowers and lenders cannot confidently close any significant transactions.”  Attorney Howard Stein, head of the Real Estate Practice Group at East Meadow-based Certilman Balin Adler & Hyman, agrees that the inability to clear title will put new deals into limbo.  “New title reports cannot be prepared and therefore recently signed transactions are completely stalled so the impact will grow exponentially,” Stein said. “The effects of the economics could be devastating if they cannot find a workaround.”  The shutdown of county systems has forced some title insurers to add an exception to their Schedule B list of things they can’t insure, which now includes “any defect, lien, encumbrance, adverse claim, or other matter created by or arising out of the inaccessibility of the Office of Suffolk County, including, but not limited to an inability to search the public records, or any delay in recordation of documents in the public records.”  Joseph Barretta, managing partner of Garden City-based Capri Capital Management, said the inability to insure clear title is putting a multi-million-dollar deal in Bay Shore his company is trying to close in jeopardy.  “The longer this goes on the higher the likelihood is that real estate transactions will either be cancelled or end up in litigation,” Barretta told LIBN. “This also affects new development, as developers can’t close on construction loans. Tens of millions of dollars, if not hundreds of millions, of lost wages, profits, and commissions are being lost. It is impacting the livelihoods of anyone related to the real estate business.”  Some real estate deals, especially smaller residential sales, have been able to close, as buyers have been accepting affidavits from sellers that assert there are no liens or other encumbrances on their properties.  “If they were in process before the hack and all of the title searches were done, they have been closing,” said Linda Haltman of Plainview-based Hallmark Abstract Services. “With the exception of vacant land, new construction and foreclosures, underwriters are allowing sellers to sign affidavits if the searches have already been done.”  However, Haltman says that in light of rapidly rising mortgage rates, delays in closing could get expensive.  “Without an extension of a rate lock-in period, delays in being able to close could be costly,” she said. “On a mortgage for a $500,000 house, it could cost an additional $5,000 upfront to pay down the rate.”  But on higher-priced homes and larger commercial property sales, affidavits just won’t cut it, as insurance underwriters won’t want to take the word of a seller when the risk is substantial.  Suffolk County websites and web-based applications were taken down on Sept. 8, after officials found malware in county systems. Ransomware postings on the website DataBreaches.net showed images of county documents and the hackers claimed to have extracted court records, sheriff’s office records, contracts with the state, and personal data of citizens from the domain of the county clerk.  “It is imperative that the county resolve this issue and resume operations, as there will be an impending snowball effect of damages due to the shutdown,” Barretta said.    County officials have yet to respond to requests for comment on what the county is doing to repair or re-establish its data infrastructure and when its systems will be back online and operating normally.  × Enjoy This Free Article We Have 2 More For You All You Need To Do Is Register To Receive Your 2 Additional Free Articles

During this time, Favre also reportedly tried to raise money for a new volleyball center at the university, where his daughter was a member of the team. Favre’s charity, Favre 4 Hope, was created to support charities that provide support to underserved and disabled children and breast cancer patients, according to its mission statement. However, the charity made three large donations to the USM Athletic Foundation totaling more than $130,000. Those sums were significantly more than donations made to other organizations.  Favre 4 Hope donated $60,000 to USM in 2018, $46,817 in 2019 and $26,175 in 2020. The largest donation it made to any other organization during that time period was an $11,000 sum to the Special Olympics of Mississippi in 2019. The highest donations made in 2018 and 2020 were $10,000 sums to multiple organizations. Records obtained by ESPN also show that the booster club of Favre’s daughter’s high school received funds from Favre 4 Hope in years prior to her enrollment at Southern Miss. Favre 4 Hope’s role is part of a much larger welfare scandal involving the misappropriation of roughly $77 million, making it the largest public corruption case in Mississippi history. Favre sent text messages to the director of a non-profit organization expressing concern regarding his name potentially getting out in public, according to Mississippi Today.  Charities like Favre 4 Hope have an ethical obligation to spend funds the way donors intended, Charity Watch executive director Laurie Styron told ESPN.  John Davis, former Executive Director of the Mississippi Department of Human Services, pled guilty in September to one count of conspiracy and one count of theft concerning programs receiving federal funds. Davis worked with four unnamed co-conspirators, two of which are executive directors of organizations, according to CBS News.  “MDHS provided federal funds to two nonprofit organizations and then directed the two nonprofit organizations to fraudulently award contracts to various entities and individuals for social services that were never provided,” the United States Department of Justice said in a release on Sept. 22.  Favre played quarterback at Southern Miss from 1987-90. He was drafted 33rd overall by the Atlanta Falcons in the 1991 NFL Draft and traded to the Green Bay Packers the following offseason. Favre starred for the Packers from 1992-2007, earning three straight MVP awards (1995-97) and winning Super Bowl XXXI. He joined the New York Jets in 2008 and finished his career with the Minnesota Vikings in 2009 and 2010. He was inducted into the Pro Football Hall of Fame in 2016.

The European Parliament’s co-rapporteurs Dragoş Tudorache and Brando Benifei circulated two new batches of compromise amendments, seen by EURACTIV, on Wednesday (28 September), ahead of the technical discussion with the other political groups on Friday. These latest batches introduce significant changes to the regulation’s scope, subject matter and obligations for high-risk AI systems concerning risk management, data governance and technical documentation. Scope A new article has been added to extend the regulation’s scope to AI system operators in specific metaverse environments that meet several cumulative conditions. These criteria are that the metaverse requires an authenticated avatar, is built for interaction on a large scale, allows social interactions similar to the real world, engages in real-world financial transactions and entails health or fundamental rights risks. The scope has been expanded from AI providers to any economic operators placing an AI system on the market or putting it into service. The text specifies that the regulation does not prevent national laws or collective agreements from introducing stricter obligations intended to protect workers’ rights when employers use AI systems. At the same time, AI systems intended solely for scientific research and development are excluded from the scope. The question of whether any AI system is likely to interact with or impact children should be considered high-risk, as asked by some MEPs, has been postponed to a later date. In addition, the amendment from centre-right lawmakers that would restrict the scope for AI providers or users in a third country has also been kept for future discussions as it is linked to the definition, the note at the document’s margin says. Subject matter The rules laid out in the regulation are not to be intended only for the placement of the market of AI, but also for its development. The objectives of harmonising the rules for high-risk systems and supporting innovation with a particular focus on innovation have also been added. The amendment from centre-left MEPs, led by Benifei, to introduce principles applicable to all AI systems has been ‘parked’, according to a comment at the margin of the text. Similarly, the discussion on the governance model, if an EU agency or an enhanced version of the European Artificial Intelligence Board, was also put on hold. Requirements for high-risk AI The compromise amendments state that the high-risk AI systems should comply with the AI Act’s requirements throughout their lifetime and consider the state-of-the-art and relevant technical standards. The question of considering the foreseeable uses and misuses of the system in the compliance process has been parked as it will be addressed together with the topic of general purpose AI, large models that can be adapted for a variety of tasks. For what concerns the risk management system, the lawmakers clarified that it could be integrated with existing procedures set up about sectorial legislation, as is the case in the financial sector, for instance. Risk management The risk management system would have to be updated every time there is a significant change to the high-risk AI “to ensure its continuing effectiveness.” The list of elements that risk management would have to consider has been extended to health, legal and fundamental rights, impact on specific groups, the environment and the amplification of disinformation. If, after the risk assessment, the AI providers consider there are still relevant residual risks, they should provide a reasoned judgement to the user on why these risks can be considered acceptable. Data governance The compromise amendments mandate that, for high-risk AI, techniques such as unsupervised learning and reinforcement learning that do not use validation and testing data sets have to be developed based on training datasets that meet a specific set of criteria. The intention is to prevent the development of biases, and it is reinforced by the requirements to consider potential feedback loops. Moreover, the text indicates that validation, testing and training datasets must all be separate, and the legality of the data sources must be verified. Technical documentation Wording has been introduced to give more latitude to SMEs to comply with the obligation to keep technical documentation about high-risk systems in place upon approval from the national authorities. The list of technical information has been significantly extended to include information such as the user interface, how the AI system works, expected inputs and outputs, cybersecurity measures, and the carbon footprint. Regulations likely will mean less anonymity, less financial freedom, more reporting requirements and lots more red tape. But, one government official is trying to pitch these investors on a different possibility. Could regulation cause a price doubling for Bitcoin (BTC-USD)? Crypto news today sees the chairman of the Commodity Futures Trading Commission (CFTC) making a bold claim. Since President Joe Biden greased the wheels of crypto regulation back in March with his executive order, there’s been new bills, arrests and hot takes coming out of Washington just about every day. One of the biggest threads in this process is in whether lawmakers will give power to the U.S. Securities and Exchange Commission or the CFTC when all is said and done. One of the most popular bills among crypto fans is that of Sen. Cynthia Lummis. Her bipartisan bill would give most responsibility to the CFTC when it comes to crypto, rather than the SEC. This is because the bill argues that most cryptos are “much more similar to commodities than securities.” This is seen as a best-case scenario for crypto fanatics. After all, the SEC has not always been kind to the crypto industry. It has engaged in hefty legal battles with multiple different projects it accuses of conducting unregistered securities offerings. The most recent of these comes today, as the agency takes on Hydrogen Technology for a token sale it conducted four years ago. On the other hand, the CFTC has been gentler with the market. And as one official says, regulations led by the CFTC could mean big gains for top projects. Crypto News: CFTC Chair Argues Regulations Will Bring Gains The government agency is making the bold claim that, given the task of regulating cryptocurrency, the market could see major growth under its control. Rostin Behnam, chairman of the CFTC, gave a talk at the NYU School of Law Wednesday evening. The talk touched on various needs for cryptocurrency regulations going forward, but there was one remark investors are latching onto today. “Growth might occur if we have a well-regulated space,” he told attendees. “Bitcoin might double in price if there’s a CFTC-regulated market.” The claim is bold, since many investors see any regulations at all as a downside for crypto. But, it’s not implausible. Already, the CFTC is looking to implement an Office of the Retail Advocate, built specifically to protect retail traders. Commissioner Caroline Pham proposed the office in the midst of her crypto “learning tour” she has been documenting on Twitter. Indeed, the CFTC has made clear that it is taking a very careful and learned approach to regulations. Rounding out his remarks at NYU, Behnam reiterated an idea shared across most government bodies. That is that institutions will only pour into the market once there is regulatory clarity in the space. Given proper jurisdiction, Behnam argues that the CFTC can open the floodgates in terms of how much it can do to regulate companies that it currently can’t properly surveil. Putin’s illegitimate referenda are war with other means Russian President Vladimir Putin’s Potemkin referendums in eastern Ukraine, bringing four regions closer to illegitimate absorption by Russia, amount to a kind of reverse-Clausewitz effort to substitute a political process for a battlefield offensive that has gone decidedly poorly for him. Time will tell whether it works for Putin, but what he heard from the White House briefing room on Wednesday — promises of even more military aid for Ukraine, support for Kyiv to fight on regardless of the staged results, new sanctions on Russia — can’t have cheered him. Let me explain. No, there is too much. Let me sum up. Remember Carl von Clausewitz? The Prussian general whose much-quoted and sometimes-read philosophy of war is regularly reduced to the idea that war is the pursuit of politics “with other means”? (Namely: Force.) Can’t get what you want through the political process, negotiations, peaceful means? Well, have you considered using military force? (I’m oversimplifying Clausewitz and fully expect a number of .edu or .mil address-holders to complain. But I’m writing for a general audience.) Using politics to wage war Anyway, Putin’s war in Ukraine has been going badly for Russia. Ukrainians, armed and equipped by the United States and its allies, have been pushing back Moscow’s troops, whose logistical and battlefield performances have wrecked their image as an irresistible fighting force. So Putin has embraced a three-pronged escalation: Announce he’s mobilizing up to 300,000 Russians to fight (it’s not going well); warn, again, that he reserves the right to use nuclear weapons; and stage referendums to set the table for Russia to absorb large parts of eastern and southern Ukraine. (It’s not clear as I type this whether the Kremlin is behind the explosions that wrecked the Nord Stream pipelines that carry gas into Europe. In a statement on Thursday, NATO said the damage appeared to be “the result of deliberate, reckless, and irresponsible acts of sabotage” and warned of “a united and determined response” if that proves to have been the case. It did not directly blame Russia.) That last one is the reverse Clausewitz: Putin is using politics to wage war with other means. The Kremlin’s plan appears to be to annex Luhansk, Donetsk, Kherson and Zaporizhzhia, declare them part of Mother Russia as early as this week, then warn Ukraine (and its friends) Moscow will defend what it now considers its territory will all necessary means, including nukes. My colleague Robyn Dixon reported Putin on Friday will sign what the Kremlin calls “accession treaties” to seize the four regions “even though Russia does not fully control them militarily or politically.” Russian state TV is reportedly running a countdown clock. It’s a variation on an approach Putin has successfully used twice in the past. In 2014, his forces overran Ukraine’s Crimea region, then annexed it. In 2008, his troops overran part of Georgia, then helped pro-Moscow enclaves of Abkhazia and South Ossetia declare independence. But in both of those cases, Russia was acting from a position of strength on the battlefield, effectively dictating terms to far weaker powers with much less international support. This time, Putin’s gambit comes as Ukrainian forces, with U.S. and allied backing, are inflicting considerable damage on the invaders. White House ain’t buying Putin gambit At the White House, press secretary Karine Jean-Pierre served notice that the United States would not be intimidated into halting arms shipments and other aid or into pressuring Ukraine to stop or slow its advance. “Ukraine has every right to continue to fight for their full sovereignty,” she told reporters at her daily briefing. “We will continue to stand with Ukraine as they defend their territory and sovereignty as we have been doing for the past several months.” “We will work with our allies and partners to impose additional economic costs on Russia and individuals and entities inside and outside of Russia that provide support to this action,” Jean-Pierre said. And the Pentagon announced a new $1.1 billion package of weapons and materiel for Kyiv, including 18 additional High Mobility Artillery Rocket Systems (HIMARS), which have enhanced the range and accuracy of Ukraine’s long-distance strikes on Russian targets. (Ukraine already has 16 HIMARS. The newest batch won’t roll off the assembly line for “a few years,” a U.S. defense official told reporters in a briefing conducted on the condition of anonymity.) A Pentagon fact sheet said the latest military assistance also included 150 Humvees, 150 tactical vehicles, explosive ordnance disposal equipment, body armor and an array of tactical secure communications systems, surveillance systems and optics. Kacey Jennings, 28, was arrested Monday in connection with capital murder and abuse of a corpse after being released from a local medical facility, according to a post on the Fayetteville Police Department’s Facebook page. Jennings is set to be arraigned Oct. 19 in Washington County Circuit Court. The case involves the disappearance of 28-year-old Allison Maria Castro, who has been reported missing by her family. The Benton County Dive Team and Fayetteville police were searching an area of Beaver Lake near the Arkansas 12 bridge and boat launch for evidence Wednesday, according to police. Jennings petitioned for an order of protection against Castro the morning of June 8, according to Washington County Circuit Court records. The petition said Jennings believed he continued to be in immediate danger of domestic abuse and had been in contact with Fayetteville police about Castro. “I’m terrified of someone violent in my home,” Jennings wrote in the petition. Jennings said Castro had broken up with him in May, but they continued to live together and he continued to support her financially. He said he asked Castro’s boyfriend to take her in. “I was awoken to bright lights in my head as Allison was punching my face and protected my eyes from being scratched out,” Jennings wrote in an affidavit accompanying the June 8 petition. Jennings said in the affidavit the incident occurred earlier that morning. Jennings said Castor left his bedroom and he locked the door and called police. “I contacted the Fayetteville Police Department to assist me in leaving the house,” Jennings wrote in the affidavit. “While I was on the phone with dispatch, Allison was banging on my door telling me to open it and told me that she was going to beat me some more and kill me.” Circuit Judge Doug Martin granted an order of protection later that afternoon. The order said it was effective until July 1 and applied to Jennings’ home and place of employment. The order restrained Castro from having any contact with Jennings and from committing any criminal act against Jennings, including acts of violence, domestic abuse, harassment, harassing communications, stalking or terroristic threatening. Castro was also ordered to appear in court on July 1. On the morning of June 10, Jennings filed a petition to dismiss the order of protection. He said Castro said she was leaving the state and he was no longer in fear of her. “The incident triggered my PTSD of being beaten for the first 13 years of my life, leading me to make a rash decision,” Jennings wrote. “I do not think the respondent (Castro) is a danger to my life or a threat.” Martin granted the dismissal the same day. Police went Sept. 19 to a residence and found Jennings, who was experiencing an apparent drug overdose, according to the Facebook post. Several documents were discovered at the scene indicating Jennings possibly killed Castro and disposed of her body, the post said. Castro’s family members told police Jennings and Castro had been in a relationship and lived together, according to the post. She was entered as a missing person after a family member told police they were unable to contact her and were concerned for her safety, according to the post. The investigation is ongoing and police are working with other law enforcement agencies to locate Castro, according to the post. Ex Parte Protection Order A temporary order issued by a court which restrains any person from harassing, annoying, stalking, contacting or coming within a certain proximity to another person issued by a court with jurisdiction over the person restrained and subject matter jurisdiction. An ex parte order is one that is made without the other party being present. Ex parte is used to refer to motions for orders that can be granted without waiting for a response from the other side. There are also contingencies if they are unable to return to port as scheduled. Right now, all those playbooks have been dusted off and are in use. On Monday, Sept. 26, as Hurricane Ian was closing in on Florida, Disney Wish left Port Canaveral for a four-night Bahamas cruise with planned stops at Nassau and Castaway Cay, Disney Cruise Line’s private island, before a planned return to Port Canaveral on Friday, Sept. 30. But with Hurricane Ian a dangerous Category 4 storm making landfall in Central Florida, Port Canaveral closed and has ceased all operations until further notice. Sign up for our daily newsletter Without the option to return to Florida as originally scheduled, Disney Wish — along with other cruise ships — is (temporarily) “stuck” at sea. While staying at sea and away from the storm is the safest decision, travelers still have a lot of questions, concerns and general curiosity about the change of course. The Points Guy spoke with passengers currently on board Disney Wish to learn what it’s like being out at sea for a few extra days during a hurricane. You’ll get frequent updates from the captain When Disney Wish set sail on Sept. 26, the captain made an announcement that the ship might return to Port Canaveral later in the day than originally planned based on the projected forecast at that time. Matt Roseboom, editor and publisher at Attractions Magazine, is on board the sailing and captured video footage of the initial announcement. The captain notified guests with flights leaving before 3 p.m. on Sept. 30 to contact their airline to depart later in the day, if possible. He also advised that they were watching Hurricane Ian carefully and would continue to keep passengers updated on the weather throughout the voyage. Lizzie Meeks, a Disney travel advisor in Nashville, is also on the sailing and explained to TPG that the captain told guests “the port authority will need to assess any damage before giving the ship the green light to move into port and the cruise terminal.” Your itinerary might be adjusted A cruise ship’s schedule of port visits and sea days can be adjusted midcruise for a number of reasons. The weather is certainly one of those reasons — even absent a full-fledged hurricane. But when a hurricane is churning, it is very possible that the ship’s itinerary will change. For Disney Wish, a port change announcement came on the morning of Sept. 28 when the ship was scheduled to dock at Castaway Cay for the day. Rather than head toward Disney’s private island, and toward the storm, the ship turned toward the eastern edge of the Atlantic Ocean where seas would be calmer. Meeks shared that the winds near Castaway Cay were too strong, with little hope for improvement, so the captain made the decision to sail away from the area. LIZZY MEEKS A day at port became a day at sea, but Disney conjured a bit of its famous “Disney magic” and added more activities throughout the day, according to Roseboom. “They made an announcement and told us to close out of the Disney Cruise app and reopen it to see the new schedule of activities,” he said. Mickey and his friends still wore their island outfits to greet guests, even if everyone had to stay on board. “They’ve really made an effort to make it a special day,” Meeks said. “There have been a ton of new character meet and greets throughout the day, including Marvel, ‘Star Wars’ and Halloween characters that are typically reserved for special event cruises. New group games and trivia themes have been added, as well as additional times for drink tastings like Champagne, bourbon, gin and more,” she added. Related: What happens when a hurricane hits Disney World Your cruise might be extended If a hurricane strikes while you are at sea, it’s also possible that you may end up with an extended sailing and extra days on the ship. That’s currently the situation for Carnival Paradise, Carnival Elation, Royal Caribbean’s Mariner of the Seas, Norwegian Cruise Line’s Norwegian Getaway, MSC Cruise’s MSC Divina and Disney Wish. With several Florida ports closed due to the storm, the ships cannot return to disembark passengers on schedule. LIZZY MEEKS In such cases, cruise lines have two options: head to a different port up or down the coast to disembark passengers or remain at sea until the ship’s home port reopens. Docking at a different port creates a whole new set of issues for passengers who need to return to cars, homes or airports near the originally scheduled port — so that option is rarely used. Related: At least 5 cruise ships stuck at sea as Hurricane Ian closes Florida ports In the case of Disney Wish, the first announcement came on the evening of Sept. 27 as the storm moved closer to shore. Based on updated forecasts, the captain announced the ship would not return to port until Saturday or Sunday, after the storm had passed and they could better assess the situation at Port Canaveral. That meant passengers would remain on board one or two days longer than expected. Before he could even complete the announcement, cheers erupted through the ship, as seen in the below video. In a subsequent announcement on the afternoon of Sept. 28, the captain updated guests that Disney Wish would return to Port Canaveral on Sunday instead of Friday and that the ship should be able to dock at Castaway Cay on Saturday, Oct. 1. Even before the extension of this sailing was formally announced, Disney Cruise Line canceled the upcoming Disney Wish sailing that was set to depart Port Canaveral on Friday, Sept. 30, as a safety precaution. Extra days are generally a good thing As that announcement was made, audible cheers confirmed that most guests were thrilled that their vacation was just extended indefinitely. “The general sentiment is that people are content and happy about the extra day(s),” Roseboom said. Cruise ships can easily avoid storms by sailing away from them and chasing better weather. For Disney Wish, at least, the weather has been fairly calm. “The current weather is sunshine with some humidity. We had choppier waves this morning [when the ship was closer to the storm], but from where we are now, you wouldn’t even know there was a hurricane in the distance,” Meeks said. LIZZY MEEKS Plus, the crew is prepared to innovate to accommodate the extra days. The entertainment staff will schedule more sea-day activities, just as they did when Castaway Cay got canceled. Guests don’t need to worry about running out of food, as cruise ships carry more than just one sailing’s worth of food on board. In a pinch, the cruise ship can find a way of picking up provisions in the islands. With two extra days at sea, the ship might run out of specific perishables, like berries, but passengers will still have plenty of choices at every meal. Because Disney Wish employs a rotational dining schedule, in which passengers are assigned nights at each of the ship’s main restaurants, guests must now wait to be told which restaurants they should dine in on the additional nights of the sailing. “Since Disney Cruise Line uses rotational dining, they simply assigned us two more nights of a restaurant. It’s really operating like normal in many ways,” Meeks said. You’ll have to rearrange travel plans Roseboom, who resides in Central Florida, is enjoying the extra day or two of vacation, but is equally worried about his house and friends and family back home in the wake of Hurricane Ian. “For cruisers who live outside of Florida, they seem to be mostly happy, but they do have to figure out how to change their flights,” he shared. For Meeks, reality set in as the cheers subsided. “Some people, including myself, found the news concerning because of travel logistics — changing transfers and flights, booking a hotel room just in case our flights are canceled and communicating with family back home are all stressful and you could feel the tension late last night,” she said. Not only is Port Canaveral closed until Hurricane Ian passes and the wind calms, but Orlando International Airport (MCO) has also shuttered during the storm. Even once the airport reopens after the storm has passed, it will take some time for planes and crews to get back into position, and longer still to accommodate all of the passengers who have been temporarily stranded in the Central Florida area. This is one of the reasons why when cruising during hurricane season, it’s very important to seriously consider travel insurance, or at least book your trip using a credit card that conveys some built-in trip protections to help minimize the financial impact. Bottom line “There are certainly worse places to be ‘stuck,'” Meeks told us. “A lot of people have the perspective that we are safe and have much to be thankful for,” she added. Crew and passenger safety is the reason cruise lines make the decision to stay at sea past the end of their scheduled itinerary. Her HbA1c, a blood sugar measurement critical for diabetics, was at 10; below 8 is the threshold for diabetes under control. Ascension Wisconsin started the program — called Under 8 — in 2020, focusing on patients who live in the low-income neighborhoods near its Ascension SE Wisconsin-St. Joseph campus on the city’s northside. The 12-week program provides five prepared healthy meals — designed for people with diabetes — each week from UpStart Kitchen, a restaurant incubator in Milwaukee’s Sherman Park neighborhood. The program also provides grocery bags of food healthy for diabetics, and holds weekly meetings that offer counselling on nutrition, lifestyle and medication adherence. Over the duration of the program, Greer’s HbA1c fell from 10 to 6.3. The program is an example of how to improve health by going outside the four walls of a clinic and meeting people where they live, said Nancy Leahy, a nurse practitioner with Ascension Wisconsin. “We do it in a community setting, where people are a little more comfortable than meeting in a hospital or a clinic,” she said. It also is one of hundreds of initiatives — most of them small for now — started by health systems nationwide that move beyond doctor visits in clinical settings and instead address underlying social and economic conditions that affect health, particularly among poor people. Those conditions — what are known as the social determinants, or drivers, of health — can be more important than access to the best doctors and medicines in influencing a person’s overall health. They include food, housing, education, employment, neighborhoods, and the support of family and friends. Putting more resources toward addressing them not only could improve lives, it could save money. Adequate and stable housing often is considered the foundation of good health. But access to healthy and appropriate food can be as important, particularly in managing chronic conditions, such as diabetes and heart failure. And those conditions are more common among people who have low incomes. Some initiatives by health systems and, increasingly, health insurers focus on finding new ways to help people with those conditions to eat healthier. Some center on lessening food insecurity — the uncertain access to adequate, quality food. Some do both. There are hurdles to overcome. Healthy food can be more expensive, and the amount of money someone on a tight budget spends on housing can limit what’s left for food. Seth Berkowitz, a physician and professor of general medicine and clinical epidemiology at the University of North Carolina at Chapel Hill Fundamentally this gets down to insufficient resources that people need to maintain health, and food insecurity is just one manifestation of that. Quote icon Lower-income neighborhoods may be so-called food deserts, where corner convenience stores with limited offerings have taken the place of full-fledged supermarkets. For someone without a car, a trip to a supermarket can become a trek that involves several buses, possibly young children in tow, and then hauling back bags of groceries. “Fundamentally this gets down to insufficient resources that people need to maintain health, and food insecurity is just one manifestation of that,” said Seth Berkowitz, a physician and professor of general medicine and clinical epidemiology at the University of North Carolina at Chapel Hill. Education and health literacy — understanding what makes up a healthy diet and how to achieve it — also have a role. People who are skeptical of the prevalence of food insecurity note that many poor people are overweight or obese. What’s lost is that some, without the knowledge or the ability to get good food, may be getting by on calorie-rich processed foods and snacks. The impact of food insecurity on health is not new. For adults, it is associated with diabetes, heart disease, high blood pressure, obesity, chronic kidney disease, osteoporosis, depression and other medical conditions, according to the Food Research & Action Center.  Food insecurity added an estimated $51.8 billion a year to the health care costs for adults, according to a 2019 study done by Berkowitz and his co-authors. That included an estimated $687 million in additional health care costs in Wisconsin. The study found that health care costs for adults who were food insecure was $1,073 to $2,595 a year higher than costs for adults who had adequate food.  The study did not find a significant increase in costs for children. But food insecurity is associated with an array of poor health outcomes for children, from more frequent colds and stomach aches to behavioral health conditions, according to the Food Research & Action Center. Angela Peterson / Milwaukee Journal Sentinel “After multiple risk factors are considered, children who live in households that are food insecure, even at the lowest levels, are likely to be sick more often, recover from illness more slowly, and be hospitalized more frequently,” the American Academy of Pediatrics said in a policy statement titled Promoting Food Security for All Children. “Lack of adequate, healthy food can impair a child’s ability to concentrate and perform well in school and is linked to higher levels of behavioral and emotional problems from preschool through adolescence.” For adults, much of the increased cost for adults came from more hospital stays and emergency department visits. Here’s one example: A study done in California found a 27% increase in hospital admissions for people with diabetes who have low incomes in the last week of the month compared with the first week. There was no change for people with higher incomes. The likely reason is that people with low incomes had exhausted their food benefits and had less access to the foods essential to managing the disease at the end of the month. The increase overall actually was higher. The study looked at just hospital admissions and did not include increased visits to clinics or emergency departments. Nationally, initiatives by health systems have included providing financial support, such as low-interest loans for supermarkets to open in a low-income neighborhood. Some are experimenting with providing medically tailored meals to people with chronic diseases. The initiatives supplement and build on the work done for decades by organizations throughout the country, such as the Hunger Task Force in Milwaukee, to lessen food insecurity and encourage healthy diets. Chorus Community Health Plans, formerly Children’s Community Health Plan, for example, has a pilot program — Fresh Food Rx — that enables physicians and other clinicians at its Midtown Clinic to give vouchers for Pete’s Fruit Market to people who have been screened for food insecurity. Now, the music industry is playing catch-up to the world of Web3 and the rapid pace with which it is changing and growing. Whether it be Lil Nas X performing in Roblox, AI musicians, or NFTs, Web3 is opening the door to many exciting and new opportunities. However, they also come with a subset of issues that the music and tech industries need to address as soon as possible. Music rights are my life’s work and passion, and I have had the honor of working with artists like DJ Khaled, Megan Thee Stallion, Drake, and more, as well as film/TV and podcast projects for Rick Rubin, The Coen Brothers, Richard Linklater, Netflix, and Disney+, among others. Recently, I worked with Post Malone to handle music clearances for his metaverse performance on the Meta platform, and something struck me. Back in the early 1990s, when hip-hop artists were struggling to legitimize sampling, music industry executives tried to fit a square peg in a round hole by applying existing licensing criteria and terminology to a new field that they considered a “fad.” Of course, sampling only grew more popular, and eventually, a new licensing framework was created to accommodate it. Currently, we are having the same problem with Web3, and after that Post Malone metaverse project, I immersed myself in the Web3 world to apply the lessons I learned from the early days of sampling to this new field. More specifically, it has been my personal goal to address licensing terminology, which in my experience, has been a very complicated and confusing process for everyone involved. It all begins with mechanical licenses, which cover the publishing side of a composition. Mechanical royalty rates are set by the government and are not subject to negotiations — if an artist wants to cover a song and release it on their album, they only need to provide notice and pay the government-mandated royalty. Where things get tricky is when a song is paired with a visual, like in an advertising campaign, TV show, or movie. At that point, a synchronization license is needed, which requires negotiations with not only the publishing company but also the label that owns the master recording of a work. Either party can request as much money as they want, and they can shut down the usage completely by saying no. However, over the past few years, mechanical and synchronization licenses have quickly become antiquated. For example, sometimes music usages in audiobooks and podcasts are paid via mechanical licenses, the argument being that there is no visual linked to the audio. But shouldn’t a song’s rights-holders get the opportunity to decide which kinds of audio content they want their songs to be associated with, and for how much? Now, Web3, the metaverse, and NFTs are challenging these licensing definitions even further. With traditional synchronization licenses, rights-holders can see exactly what they are agreeing to connect their music with. But in the metaverse, the vast majority of content is user-generated, and that should come into consideration. Also, NFTs can take many forms, from an exclusive track, which could fall under a mechanical license, or video/audio set to music, which would require a synchronization license. NFTs can also be resold, and rights-holders should be able to receive a portion of each sale. So, how do we solve this problem? I would argue the best way is to introduce the new licensing terms Art-Driven Mechanical (for the mechanical reproduction in another art form) and Art-Driven Synchronization (for the syncing of music to another art form). By creating these new terms for Web3, we can grant permission to music copyright holders to generate at least two values or quotes as a means of collecting proper compensation for new Web3 music uses, whether or not music is the primary art form — and this art form will include the written word and other media. For example, an NFT would be subject to three fees: an art-driven mechanical royalty rate to generate income from included songs over time, an art-driven synchronization flat fee to cover any video/audio syncs, and an ongoing resale fee that provides a portion of future revenue to rights-holders on a pro-rated basis. Music usages in the metaverse would then be subject to two fees: an art-driven synchronization flat fee to use the song in the platform and a separate user-generated content (UGC) fee, in addition to the performance fees for the recording and compensation through PROs and CMOs. Mester touched on market conditions amid very unsettled conditions across the globe. But she added there were “good reasons” for what the UK central bank did, saying “market functioning is incredibly important, because you won’t be able to hit any monetary policy goals if the markets aren’t functioning.” Mester, who holds a voting role on the rate setting Federal Open Market Committee, said she still sees inflation as the paramount problem facing the economy, which means the central bank needs to press forward with rate rises, lifting a federal funds target rate range now at between 3.00%-3.25% to over 4%. The Fed has faced concerns that its aggressive rate hikes aimed at lowering inflation from 40-year highs will send the economy into recession. Financial markets have also been under broad pressure and suffered steep losses, and many observers worry Fed actions, coupled with rate rises from other major central banks, could trigger market dysfunction. Mester said she does not see a case for slowing down on rate rises right now. She noted that at last week’s FOMC meeting officials penciled in a path for the federal funds target rate that will get it to 4.6% next year and said she expects the central bank will likely have to go further than that. “I probably am a little bit above that median path because I see more persistence in the inflation process,” Mester said. Getting above a 4% fed funds rate is important to helping to lower inflation, she said. Mester also said job market demand continues to outpace supply. She also said the strong dollar is a helpful force to lower U.S. inflation. The central banker also cautioned against taking too much signal from data showing a decline in the nation’s money supply. Some see the drop as a sign that future inflation levels will fall. “Money supply hasn’t been that reliable an indicator for a long time,” Mester said.
