Les lois du 10 juillet 1987 et du 11 février 2005 portant sur l’intégration des personnes en situation de handicap imposent un quota de 6 % des effectifs ainsi qu’une contribution pécuniaire à verser en cas de non respect de ce quota. Les études anglo-saxonnes, en particulier celles d’Ewick et Silbey (1998), décrivent trois approches du droit : la conformité, le jeu et la résistance. Envisageant plus spécifiquement l’intégration des personnes en situation de handicap, Point et al. (2010) distinguent deux attitudes, l’une « réactive » qui vise à répondre uniquement à l’obligation légale, l’autre « proactive » qui consiste à mettre en œuvre une véritable politique handicap. S’appuyant sur des entretiens semi-directifs menés auprès de 22 DRH et 8 chargés de mission handicap, notre étude affine la typologie des attitudes des responsables des ressources humaines dans leur rapport à la contrainte légale et montre qu’une connaissance globale et approfondie de la loi peut aider à adopter une attitude proactive.
