In a 6-3 decision on Wednesday, the U.S. Supreme Court upheld Tennessee’s ban on puberty blockers and hormone therapy for transgender youth, paving the way for other bans on trans healthcare to remain in effect in 24 other states. According to the ACLU, over 100,000 transgender people under the age of 18 now live in a state with a ban on their healthcare. “This is a fight that extends back 100 years, and we will keep fighting for 100 more years,” says Chase Strangio, the first openly trangender attorney to make oral arguments before the Supreme Court and the co-director of the American Civil Liberties Union’s LGBTQ & HIV Project.

"On Sex and Gender focuses on three sequential and consequential questions: What is sex--as opposed to gender? How does sex matter in our everyday lives? And how should it be reflected in law and policy? All three are front-and-center in American politics: They are included in both of the major parties' political platforms. They are the subject of ongoing litigation in the federal courts and of highly contentious legislation on Capitol Hill. And they are a pivotal issue in the culture war between left and right playing out on battlegrounds from campuses and school boards to op-ed pages and corporate handbooks. Doriane Coleman challenges both sides to chart a new way forward. She argues that denying biological sex would have profound and detrimental effects on women's equal opportunity and on the health and welfare of society generally. Structural sexism needed to be dismantled--a true achievement of feminism and an ongoing fight--but sex blindness is not the next step forward. Chase Strangio Makes History: First Trans Lawyer to Argue at Supreme Court
Next week, our guest Chase Strangio will make history as the first openly transgender lawyer to argue before the Supreme Court. Strangio will argue on behalf of the American Civil Liberties Union’s LGBTQ & HIV Project that Tennessee’s state ban on gender-affirming hormone therapies for transgender children is a form of sex discrimination. “Our hope is that the cultural anxiety about trans people … is not going to sway the justices from applying straightforward constitutional principles,” says Strangio about the case. We also discuss recent cultural backlash against trans rights as part of an “approach to gender that is regressive and dangerous.” The Democratic Party has been unwilling to provide a robust defense to conservative attacks on trans identity, says Strangio, ceding ground to the further loss of the community’s civil rights and protections. Yet even as trans people are “demonized” and blamed for structural problems in the U.S., he adds, “We have always resisted. We have always taken care of each other. No matter what happens, that is what we’ll do.”

The last decade has seen significant changes in global attitudes, policies and practices that impact the lives of trans people, but the world of sport has been slow to follow these initiatives.
